Opinion of the Advisory Committee on restrictive agreements and dominant position given at its meeting of 4 March 2013 regarding a draft decision relating to Case COMP/39.530 — Microsoft (Tying)

1.

The Advisory Committee agrees with Commission's assessment in the draft decision that Microsoft Corporation (‘Microsoft’) has failed to comply with Commission Decision of 16 December 2009 relating to a proceeding under Article 102 of the Treaty on the Functioning of the European Union and Article 54 of the EEA Agreement (Case COMP/39.530 — Microsoft (Tying), notified under document C(2009) 10033).

The Advisory Committee agrees with the fine the Commission intends to impose on Microsoft.

The Advisory Committee asks the Commission to take into account any other points raised during the discussion.

4.

The Advisory Committee recommends the publication of its opinion in the Official Journal of the European Union.
