Notification by the Hungarian Government under Directive 94/22/EC of the European Parliament and of the Council on the conditions for granting and using authorisations for the prospection, exploration and production of hydrocarbons (1)

I.   The Hungarian Office for Mining and Geology (Magyar Bányászati és Földtani Hivatal – MBFH) is launching an invitation to tender under Section 26/A(6)-(7) of Act No XLVIII of 1993 on mining and Section 12/B(2) of Government Decree 203/1998 (XII. 19.) implementing it for the cancelled mining rights set out in point II below

Upon obtaining the mining rights (i.e. on entry into force of the decision designating the new rights holder), the successful tenderer will be authorised to conduct its operations in compliance with the provisions of the legislation governing this sector.

Under the applicable law, the party awarded the mining rights must seek approval of a technical operational plan from the Mining Department before commencing operations. No actual operations may be carried out without an approved technical operational plan.

Only those persons who have purchased a copy of the detailed tender documents (‘the documents’) from the MBFH may take part in the invitation to tender. The documents will be dispatched upon receipt of proof of payment. The documents may be purchased at a price of HUF 25 000, to be paid into MBFH account No 10032000-01417179-00000000 (IBAN: HU56 1003 2000 0141 7179 0000 0000; SWIFT: MANEHUHB) held by the Hungarian State Treasury. Payment can be made by cash transfer order (cheque) or by bank transfer. The communication column of the proof of payment slip should bear the message ‘invitation to tender for mining rights’.

The documents can be obtained (in person only) on weekdays between 09.00 and 12.00 a.m. from the MBFH at the following address: room 203, second floor secretariat, Columbus u. 17–23., 1145 Budapest, HUNGARY. Information on how to obtain the documents can be requested under telephone +36 13012921.

The MBFH bears no responsibility for any obligations or claims arising in connection with the mining rights other than as laid down in point II below and in the documents.

This invitation to tender is being published in the Official Journal of the European Union and on the Mining Supervisory Authority’s website and official journal (in the official notices annexed to the Magyar Közlöny (Hungarian Official Gazette)). The deadline for the submission of tenders will be calculated from the date of publication in the Official Journal of the European Union. The documents can be obtained as of that date.

Applications for the mining rights of hydrocarbon mineral resources must be submitted by post to the presidential secretariat of the MBFH (Columbus u. 17–23., 1145 Budapest, HUNGARY) in triplicate, within 90 days of publication of this invitation to tender in the Official Journal of the European Union.

The MBFH will not consider any applications sent after the deadline for submission of tenders.

All applications will be evaluated by the MBFH at the same time within 22 working days after the deadline for the submission of tenders has expired.

The Mining Supervisory Authority will issue a decision designating the successful tenderer and the new holder of the rights to the mining site. Information regarding the successful tenderer will be published on the MBFH website (http://www.mbfh.hu).

Main evaluation criteria:

the amount offered to the Hungarian State to obtain the rights to the mining site,

the financial suitability of the tenderer as demonstrated by the supporting documents.

After evaluating the tenders, the Mining Supervisory Authority will notify the tenderers of the date and place of the announcement of the results. The successful tenderer will have eight days after the results have been announced to pay the amount offered for the mining rights into the abovementioned account. The communication column of the proof of payment slip must display the ‘name of mining site — price for mining rights’. The dispatch of the payment slip will serve as proof of payment. If the successful tenderer fails to pay the price for the mining rights within eight days of the results being announced, its tender must be considered unsuccessful, and the other tenders submitted for the mining rights must be evaluated within five days.

II.   Mining rights offered under this invitation to tender

Mining rights to the ‘IMREHEGY I. – szénhidrogén’ mining site

(a)

geographical location of the mining site: Bács-Kiskun county, Kiskőrös sub-region, outside the municipality of Imrehegy, total of 60 ha;

(b)

information on the mineral resources of the mining site according to the National Mineral Resources Register:

(ba)

name: mineral oil;

(bb)

quantity: geological stock: 106 175 m3, stock to be produced: 10 617 m3;

(bc)

quality: 0,923 t/m3;

(c)

minimum price to be paid for the mining rights: HUF 1 000 000;

(d)

the obligation as regards landscaping will not be borne by the new rights holder.
