Prior notification of a concentration

(Case COMP/M.5464 — Veolia Eau/Société des Eaux de Marseille/Société des Eaux d'Arles/Société Stéphanoise des Eaux)

1.

On 24 June 2009, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Veolia Eau (France) controlled by Veolia Environnement (France) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertakings Société des Eaux de Marseille (France), Société des Eaux d'Arles (France) and Société Stéphanoise des Eaux (France) by way of exchanges of shares.

The business activities of the undertakings concerned are:

—

for Veolia Eau: water collection, treatment and supply,

—

for Société des Eaux de Marseille: water collection, treatment and supply, waster collection, treatment and disposal activities; material recovery, and public lighting,

—

for Société des Eaux d'Arles: water collection, treatment and supply,

—

for Société Stéphanoise des Eaux: water collection, treatment and supply.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication.
