1.

Pursuant to Article 3(2)(a) of Directive 94/22/WE of the European Parliament and of the Council of 30 May 1994 on the conditions for granting and using authorisations for the prospection, exploration and production of hydrocarbons and Article 11(2) of the Geological and Mining Law Act of 4 February 1994 (1), the Minister for the Environment hereby invites all interested parties to submit applications for authorisations for hydrocarbon prospecting and exploration, hereinafter referred to as ‘mining usufruct rights’.

The subject of the tender is the establishment of mining usufruct rights for the prospection and exploration of oil and natural gas deposits in the areas (blocks) not covered by concessions, listed in the table published in the Official Journal of the European Union  (2) and on the website of the Department of Geology and Geological Concessions of the Ministry of the Environment (www.mos.gov.pl/dgikg/english). The above areas comprise the following blocks:

The geographical coordinates of the areas that are the subject of the tender may be found on the website of the Department of Geology and Geological Concessions of the Ministry of the Environment and in the ‘Detailed conditions of the tender for the acquisition of mining usufruct rights for the exploration and prospection of oil and natural gas deposits in selected concession areas’.

Proposals for the establishment of mining usufruct rights may cover an area no smaller than that stipulated in the ‘Detailed conditions of the tender for the acquisition of mining usufruct rights for the exploration and prospection of oil and natural gas deposits in selected concession areas’, but no greater than 1 200 km2.

Mining usufruct rights shall be granted to the successful bidder for the duration of the concession for the exploration and prospection of oil and natural gas deposits.

Proposals for the establishment of mining usufruct rights must be delivered to the central office of the Ministry of the Environment no later than 12 noon CET, on the last day of the 91-day period commencing on the day following the date of publication of the communication in the Official Journal of the European Union.

The tender committee shall evaluate the proposals received on the basis of the following criteria:

The proposals shall be opened in public at the central office of the Ministry of the Environment at 12 noon CET, on the fourteenth working day after the expiry of the deadline for the submission of proposals. The tender shall be finalised within a period of six months after the completion of the tender submission stage. Bidders shall receive written notification of the outcome of the tender.

To obtain a copy of the ‘Detailed conditions of the tender for the acquisition of mining usufruct rights for the exploration and prospection of oil and natural gas deposits in selected concession areas’ a written application should be submitted to the Department of Geology and Geological Concessions of the Ministry of the Environment. The conditions of the tender contain, among other things:

The rules for tenders for the acquisition of mining usufruct rights were established on the basis of the Regulation of the Council of Ministers of 21 June 2005concerning the tender procedure for the acquisition of mining usufruct rights  (3), which transposes the provisions of Directive 94/22/EC of the European Parliament and of the Council of 30 May 1994on the conditions for granting and using authorisations for the prospection, exploration and production of hydrocarbons.

Proposals shall be submitted in Polish.

The successful bidder shall sign a contract for mining usufruct with the State Treasury, represented by the Minister for the Environment, and shall subsequently apply to the Minister for the Environment to obtain a concession for the prospection and exploration of oil and natural gas deposits.

12.

The enterprise in question must hold both mining usufruct rights and a concession in order to be able to carry out activity involving the prospection and exploration of hydrocarbon deposits in Poland.
