Corrigendum to Regulation (Euratom, ECSC, EEC) No 1473/72 of the Council of 30 June 1972 amending Regulation (EEC, Euratom, ECSC) No 259/68 laying down the Staff Regulations of Officials and the Conditions of employment of other servants of the European Communities

On page 709, Article 38 (replacement of Article 90 of the Staff Regulations):

(a)

paragraph 2, first subparagraph, first sentence:

for

:

‘2.   Any person to whom these Staff Regulations apply may submit to the appointing authority a complaint against an act embodying a complaint against him, …’,

read

:

‘2.   Any person to whom these Staff Regulations apply may submit to the appointing authority a complaint against an act affecting him adversely, …’;

(b)

paragraph 2, first subparagraph, second indent:

for

:

‘…; if, however, an act affecting a specified person also contains a complaint against another person, the period shall start to run in respect of that other person on the date on which he receives notification thereof but in no case later than the date of publication;’,

read

:

‘…; if, however, an act affecting a specified person is such as to affect adversely another person, the period shall start to run in respect of that other person on the date on which he receives notification thereof but in no case later than the date of publication;’.

On page 709, Article 39 (replacement of Article 91(1) of the Staff Regulations):

for:

‘1.   The Court of Justice of the European Communities shall have jurisdiction in any dispute between the Communities and any person to whom these Staff Regulations apply regarding the legality of an act embodying a complaint against such person within the meaning of Article 90(2). In disputes of a financial character the Court of Justice shall have unlimited jurisdiction.’,

read:

‘1.   The Court of Justice of the European Communities shall have jurisdiction in any dispute between the Communities and any person to whom these Staff Regulations apply regarding the legality of an act affecting such person adversely within the meaning of Article 90(2). In disputes of a financial character the Court of Justice shall have unlimited jurisdiction.’
