amending Protocol 31 to the EEA Agreement, on cooperation in specific fields outside the four freedoms

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Articles 86 and 98 thereof,

Whereas:

(1) Protocol 31 to the Agreement was amended by Decision of the EEA Joint Committee No 100/2001 of 13 July 2001(1).

(2) It is appropriate to extend the cooperation of the Contracting Parties to the Agreement to include Decision No 1786/2002/EC of the European Parliament and of the Council of 23 September 2002 adopting a programme of Community action in the field of public health (2003-2008)(2).

(3) Decision No 1786/2002/EC repeals with effect from 31 December 2002 Decisions Nos 645/96/EC(3), 646/96/EC(4), 647/96/EC(5), 102/97/EC(6), 1400/97/EC(7), 372/1999/EC(8), 1295/1999/EC(9) and 1296/1999/EC(10) of the European Parliament and the Council which are incorporated into the Agreement and which are consequently to be repealed under the Agreement,

(4) Protocol 31 to the Agreement should therefore be amended in order to allow for this extended cooperation to take place from 1 January 2003,

HAS DECIDED AS FOLLOWS:

Article 1

Article 16 of Protocol 31 to the Agreement shall be amended as follows:

1. the first eight indents in paragraph 1 shall be deleted;

2. the following indent shall be added in paragraph 1:

"- 32002 D 1786: Decision No 1786/2002/EC of the European Parliament and of the Council of 23 September 2002 adopting a programme of Community action in the field of public health (2003 to 2008) (OJ L 271, 9.10.2002, p. 1)";

3. paragraph 2 shall be deleted;

4. paragraph 3 shall be renumbered 2, and paragraph 4 be renumbered 3.

Article 2

This Decision shall enter into force on 1 February 2003, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(11).

It shall apply from 1 January 2003.

Article 3

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
