Declare that, by permitting the discharge of industrial waste water from the industrial unit ‘Estação de Serviço Sobritos’, situated in the Matosinhos area, without adequate authorisation, the Portuguese Republic has failed to fulfil its obligations under Article 11(1) and (2) of Council Directive 91/271/EEC of 21 May 1991 concerning urban waste-water treatment. (1)

Order the Portuguese Republic to pay the costs.

Pleas in law and main arguments

The Portuguese Republic has not to date informed the Commission that the licensing of the industrial unit ‘Estação de Serviço Sobritos’ has been completed.
