A. KINGDOM OF BELGIUM

III. Minimum benefits referred to in Article 50 of the Regulation

IV. Benefits referred to in Articles 77 and 78 of the Regulation

1. Benefits referred to in Article 77 of the Regulation: (a) increases or supplements for children to:

pensions in the case of invalidity preventing the exercise of the profession (Berufsunfähigkeit),

pensions in the case of invalidity preventing the exercise of any lucrative activity (Erwerbsunfähigkeit),

and old age pensions: - law concerning social insurance (Reichsversicherungsordnung) of 19 July 1911, with amendments and supplements, in the applicable version;

D. FRENCH REPUBLIC

A. UNDER ARTICLE 4 (1) AND (2) OF THE REGULATION

I. General scheme for employed persons or persons treated as such in non-agricultural occupations

Legislation applicable in metropolitan France concerning: (a) general organization of social security, volume I of the social security code (code de la sécurité sociale);

social security disputes (volume II of the social security code);

(b) general provisions governing the social insurance scheme : insurance covering sickness, maternity, invalidity, old age, death (volume III of the social security code);

(c) allowance for elderly employed persons and allowance for women with children (mères de famille) (volume VII of the social security code);

(d) accidents at work and occupational diseases: I. laws of 9 April 1898, 3 April 1942, 2 September 1954 and all the laws granting allowances or increases to the victims of accidents at work which occurred or occupational diseases which were certified on or before 31 December 1946;

II. legislation on the prevention of and compensation for accidents at work and occupational diseases: - volume IV of the social security code (applicable to accidents on or after 1 January 1947);

- decree No 46-2959 of 31 December 1946, as amended, on the application of the provisions of volume IV of the social security code, including the tables of occupational diseases;

(e) family benefits except the allowances mentioned in Annex I (volume V of the social security code);

(b) legislation on agricultural social insurance : insurance covering sickness, maternity, invalidity, old age, death (rural code - volume VII - title II - chapter II);

(c) special provisions relating to the departments of Haut-Rhin, Bas-Rhin and Moselle (rural code - volume VII - title V);

(d) allowance to elderly employed persons and allowance to women with children (mères de famille);

(e) legislation on compensation for accidents at work, risks and occupational diseases in agriculture, and the legislation increasing pensions (rural code - volume VII - title III - chapters I and II);

(f) legislation on family benefits except the allowances mentioned in Annex I (rural code - volume VII - title II - chapter III);

(g) legislation on voluntary sickness/maternity insurance (ordonnance No 67-709 of 21 August 1967).

III. Special schemes

(a) Special schemes laid down in Article L 3 of the social security code and in Article 61 of decree No 46-1378 of 8 June 1946: 1. State services, departments, offices and public establishments;

2. the departments, and communes;

3. public establishments of a non-industrial and non-commercial nature in departments and communes;

(officials and employees on the permanent staff of the bodies mentioned in 1, 2 and 3 above are only included in the declaration to the extent that they come under social security schemes);

4. mines and establishments treated as such;

5. the Société nationale des chemins de fer français (French railways);

6. secondary railways and tramways, and the Régie autonome des transports Parisiens (RATP, the Paris transport authority);

7. the gas and electrical industries;

8. the Compagnie générale des eaux (water board);

9. the Bank of France;

10. the Comédie française;

11. the Opéra and the Opéra comique;

12. the clerks and other employees of notaries.

(b) Social security scheme for French mariners employed in commerce, in fishing and on pleasure craft, managed by the National Institute for Disabled Mariners (Établissement national des invalides de la marine).

The legislation is that relating to the branches of social security covering: - sickness and maternity benefits,

- invalidity benefits, including those intended for the improvement or maintenance of the capacity to work,

- old-age benefits,

- benefits for accidents at work,

- survivors' benefits (invalidity, old age and accidents at work),

- death grants,

- family benefits under the general social security scheme.

IV. Unemployment benefits

(a) Public aid scheme resulting from the provisions of ordonnance No 67-580 of 13 July 1967 and of the decree of 25 September 1967, as amended.

(b) Unemployment insurance scheme set up by the national collective agreement of 31 December 1958 approved pursuant to ordonnance No 59-129 of 7 January 1959 and extended by ordonnance No 67-580 of 13 July 1967.

(c) As regards employed persons and persons treated as such in agricultural occupations: (i) the public aid allowance;

(ii) additional unemployment insurance, applying only to employed persons in professional agricultural bodies (ordonnance No 67-580 of 13 July 1967).

V. Legislation applicable in the overseas departments

(Social security code (code de la sécurité sociale volume XI))

The provisions of volume XI of the social security code apply in the departments of Guadeloupe, French Guiana, Martinique and Reunion to all persons covered by the general social security legislation, including persons in agricultural occupations. - Organization and resources (title I)

- Disputes (title II)

- Social insurance (title III)

- Accidents at work (title IV)

- Family benefits (title V)

- Miscellaneous schemes (title VI)

- Allowance for elderly employed persons (title VII).

B. UNDER ARTICLE 50 OF THE REGULATION (MINIMUM BENEFITS FOR INVALIDITY, OLD AGE AND SURVIVORS)

1. General scheme

- Old-age pensions (pensions de vieillesse) under the general scheme raised at the age of 65 (or at the time of lump sum payment) to the amount of the minimum benefit, without any conditions as to means.

This minimum also applies: - in the event of incapacity to work certified between the ages of 60 and 65,

- to the holders of a deportee's or internee's card;

- Old-age pensions (rentes de vieillesse) under the general scheme raised at the age of 65 (or at the time of lump sum payment) to the amount of the minimum benefit, depending on means;

- Reversionary pensions (pensions de réversion) raised to the minimum at the time of lump sum payment, without any conditions as to means.

2. Agricultural scheme

Certain old age and invalidity benefits may not be below a minimum sum fixed by decree: - old-age pensions (pensions de vieillesse);

- old-age pensions (rentes de vieillesse);

- reversionary pensions (pensions de réversion).

3. Special social security scheme for mariners

The minimum benefits referred to in Article 50 of the Regulation, provided by the special social security scheme for mariners, are those laid down for the general social security scheme.

C. UNDER ARTICLES 77 AND 78 OF THE REGULATION (BENEFITS FOR DEPENDENT CHILDREN OF PENSIONERS AND FOR ORPHANS)

I. Article 77 - pensioners

1. General scheme:

pensioners receive the family allowances referred to in Article 4 (1) and (2).

2. Agricultural scheme:

persons receiving pensions for old age, invalidity or an accident at work or occupational disease receive the family allowances referred to in Article 4 (1) and (2).

3. Miners' scheme: (a) family allowances;

(b) allowances for the dependent children of pensioners (Article 171 of the decree of 27 November 1946).

4. Mariners' scheme:

family allowances referred to in Article 4 (1) and (2).

II. Article 78 - orphans

1. General scheme: (a) family allowances;

(b) orphan's allowance (social security code (code de la sécurité sociale) volume V - title II - chapter V. 2).

2. Agricultural scheme: (a) family allowances;

(b) orphan's allowance.

3. Miners' scheme:

grant of an orphan's pension (Article 164 of the decree of 27 November 1946).

4. Mariners' scheme:

temporary orphan's pension of 10 % out of the mariners' pension fund (Caisse de retraite des marins).

5. Special provisions for the overseas departments:

(social security code - volume V - title II - chapter V. 2 - Article L 543 - 9).

E. IRELAND

1. Legislation and schemes referred to in Article 4 (1) and (2) of the Regulation

(a) Sickness and maternity benefits:

the provisions of the Social Welfare Acts 1952 to 1972 and of the regulations made thereunder, relating to disability benefit, maternity benefit and treatment benefit;

the provisions of the Health Acts 1947 to 1970 and of the regulations made thereunder.

(b) Invalidity benefits:

the provisions of the Social Welfare Acts 1952 to 1972 and of the regulations made thereunder, relating to invalidity pension.

(c) Old-age benefits:

the provisions of the Social Welfare Acts 1952 to 1972 and of the regulations made thereunder, relating to old-age (contributory) pension and retirement pension.

(d) Survivors' benefits:

the provisions of the Social Welfare Acts 1952 to 1972 and of the regulations made thereunder, relating to widows' (contributory) pension and orphans' (contributory) allowance.

(e) Benefits in respect of accidents at work and occupational diseases:

the provisions of the Social Welfare Acts 1952 to 1972 and of the regulations made thereunder, relating to occupational injuries benefit;

the provisions of the Health Acts 1947 to 1970 and of the regulations made thereunder.

(f) Death grants:

the provisions of the Social Welfare Acts 1952 to 1972 and of the regulations made thereunder, relating to death grant.

(g) Unemployment benefits:

the provisions of the Social Welfare Acts 1952 to 1972 and of the regulations made thereunder, relating to unemployment benefit.

(h) Family benefits:

the provisions of the Social Welfare (Children's Allowances) Acts 1944 to 1970 and of the regulations made thereunder.

The Regulation shall apply to the above legislation from and including 1 April 1973.

2. Minimum benefits referred to in Article 50 of the Regulation

None.

3. Benefits referred to in Article 77 of the Regulation

Children's allowances under the Social Welfare (Children's Allowances) Acts 1944 to 1970 payable to persons in receipt of retirement pension, old-age (contributory) pension, invalidity pension, disablement pension, or pension by way of death benefit under the Social Welfare Acts 1952 to 1972, and increases of retirement pension, of old-age (contributory) pension and of invalidity pension in respect of qualified children under the Social Welfare Acts 1952 to 1972.

4. Benefits referred to in Article 78 of the Regulation

Children's allowances under the Social Welfare (Children's Allowances) Acts 1944 to 1970 payable in respect of orphans or in respect of children for whom increases of widows' (contributory) pension are payable under the Social Welfare Acts 1952 to 1972, and orphans' (contributory) allowance and increases of widows' (contributory) pension payable in respect of qualified children under the latter Acts.

F. ITALIAN REPUBLIC

I. Legislation and schemes referred to in Article 4 (1) and (2) of the Regulation

1. Sickness and maternity benefits (Article 4 (1) (a)): (i) laws, regulations and administrative provisions governing the general compulsory scheme for employed persons (sickness, maternity, death);

(ii) laws, regulations and administrative provisions concerning special schemes for certain categories of employed persons (sickness, maternity, death), including the scheme instituted for the staff of public bodies, administered by the National Welfare and Assistance Office for the Staff of Public Bodies (Ente nazionale di previdenza e assistenza per i dipendenti degli enti di diritto pubblico (ENPDEDP));

(iii) laws, regulations and administrative provisions concerning the tuberculosis insurance for employed persons;

(iv) laws, regulations and administrative provisions concerning the sickness insurance for the special categories of self-employed persons who qualify for the benefits of the general insurance of invalidity, old age and survivors for employed persons (agricultural workers, tenant farmers, craftsmen, small traders and small-scale fishermen).

2. Invalidity, old-age and survivors' benefits (Article 4 (1) (b), (c) and (d)): (i) laws, regulations and administrative provisions concerning the general insurance of invalidity, old age and survivors for employed persons;

(ii) laws, regulations and administrative provisions concerning the special schemes for certain categories of employed persons;

G. GRAND DUCHY OF LUXEMBOURG
