No 117/2001

of 28 September 2001

amending Annex VI (Social security) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex VI to the Agreement was amended by Decision of the EEA Joint Committee No 72/2001 of 19 June 2001(1).

(2) Commission Regulation (EC) No 89/2001 of 17 January 2001 amending Council Regulation (EEC) No 574/72 laying down the procedure for implementing Regulation (EEC) No 1408/71 on the application of social security schemes to employed persons, to self-employed persons and to members of their families moving within the Community(2) is to be incorporated into the Agreement.

(3) Due to legislative changes in Iceland it is necessary to adjust the adaptation text in point 2 of Annex VI to the Agreement to reflect these changes,

HAS DECIDED AS FOLLOWS:

Article 1

Point 2 (Council Regulation (EEC) No 574/72) of Annex VI to the Agreement shall be amended as follows:

1. The following indent shall be added before the adaptation text: "- 32001 R 0089: Commission Regulation (EC) No 89/2001 of 17 January 2001 (OJ L 14, 18.1.2001, p. 16)".

2. The text of section "P. ICELAND" in item (b) of the adaptation text shall be replaced by the following: "1. Sickness and Maternity:

(a) Sickness:

Tryggingastofnun ríkisins (The State Social Security Institute), Reykjavík

(b) Maternity:

Tryggingastofnun ríkisins (The State Social Security Institute), Reykjavík.

2. Invalidity, old-age and death (pensions):

(a) Pensions under the Act on Social Security:

Tryggingastofnun ríkisins (The State Social Security Institute), Reykjavík.

(b) Pensions granted under the Act on Mandatory Insurance of Pension Rights and on Activities of Pension Funds:

The pension fund where the person paid contributions.

Liaison body for the pension funds is Tryggingastofnun ríkisins (The State Social Security Institute), Reykjavík.

3. Accidents at work and occupational injuries:

(a) Benefits in kind and pensions under the Act on Social Security Tryggingastofnun ríkisins (The State Social Security Institute), Reykajvík

(b) Pensions under the Act on Mandatory Insurance of Pension Right and on Activities of Pension Funds:

The pension fund where the person paid contributions.

Liaison body for the pension funds is Tryggingastofnun ríkisins (The State Social Security Institute), Reykjavík.

4. Unemployment:

Vinnumálastofnun (Directorate of Labour), Reykjavík.

5. Family benefits:

(a) Family benefits with the exception of children's benefits:

Tryggingastofnun ríkisins (The State Social Security Institute), Reykjavík

(b) Children's and supplementary children's benefits:

Ríkisskattstjóri (The Directorate of Internal Revenue), Reykjavík".

3. The text of part 2 (Unemployment benefits) of section "P. ICELAND" in item (c) of the adaptation text shall be replaced by the following: "Unemployment:

Vinnumálastofnun (Directorate of Labour), Reykjavík".

4. The text of part 2 (Unemployment benefits) of section "P. ICELAND" in item (f) of the adaptation text shall be replaced by the following: "Unemployment:

Vinnumálastofnun (Directorate of Labour), Reykjavík".

5. The text of the first paragraph of part 1 of section "P. ICELAND" in item (m) of the adaptation text shall be replaced by the following: "For the purpose of applying Articles 13(2)(d), 14(1)(a), 14(2)(b), 14a(1)(a), 14a(2), 14a(4), 14b(1), 14b(2), 14b(4), 14c(a) and 14e of the Regulation and Articles 11, 11a, 12a(2)(a), 12a(5)(c), 12a(7)(a) and 12b of the implementing Regulation:"

6. The text of the second paragraph of part 4 of section "P. ICELAND" in item (m) of the adaptation text shall be replaced by the following: "Vinnumálastofnun (Directorate of Labour), Reykjavík".

Article 2

The texts of Commission Regulation (EC) No 89/2001 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 29 September 2001, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(3).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
