COMMISSION REGULATION (EC) No 1362/94 of 15 June 1994 amending Commission Regulation (EEC) No 3201/90 laying down detailed rules for the description and presentation of wines and grape musts

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 822/87 of 16 March 1987 on the common organization of the market in wine (1), as last amended by Regulation (EEC) No 1566/93 (2), and in particular Article 72 (5) thereof,

Whereas Council Regulation (EEC) No 2392/89 (3), as last amended by Regulation (EEC) No 3897/91 (4), lays down general rules for the description and presentation of wines and grape musts;

Whereas Commission Regulation (EEC) No 3201/90 (5), as last amended by Regulation (EEC) No 1847/93 (6), lays down detailed rules for the description and presentation of wines and gape musts;

Whereas additional traditional terms used to denote French, Italian, Spanish and Portuguese quality wines psr should be indicated;

Whereas, in view of a request by Argentina, provision should be made for wine originating in that country made exclusively from two varieties to bear the name of those varieties when marketed in the Community;

Whereas the Community has undertaken, by virtue of the bilateral agreements on wine concluded with Australia (7), Bulgaria (8), Hungary (9) and Romania (10), to protect with wine names; whereas Annexes I and II to Regulation (EEC) No 3201/90 must therefore be adjusted so that such names may be used for the designation and presentation of wines imported from these countries;

Whereas, as a result of the geopolitical changes which have taken place in the former Soviet Union, the former Yugoslavia and the former Czechoslovakia, Annexes I, II and IV to Regulation (EEC) No 3201/90 should be adjusted to take account of the new circumstances;

Whereas South Africa, Croatia, the former Yugoslav republic of Macedonia, Mexico, Slovenia, the Republic of Moldova, the Czech Republic, Romania, Switzerland, Ukraine and Uruguay have asked for Annexes I, II and IV to Regulation (EEC) No 3201/90 to be adjusted; whereas it seems warranted to comply with these requests;

Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Wine,

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EEC) No 3201/90 is hereby amended as follows:

1. The following abbreviation is added to the sixth indent of the third subparagraph of Article 3 (1):

'- D.O. Ca.'

2. The following is added to Article 3 (3):

- at (b), for French wines:

- 'cru artisan',

- at (c), for Italian wines:

- 'Gutturnio'.

3. In Article 13 (2) (a), 'Argentina' is added after 'Chile'.

4. In Article 14 (3) (c), for Italian wines:

- 'Lambiccato.'

5. In Article 14 (3) (d), the following terms are added for Spanish wines:

'- Fermentado en barrica,

- Vendimia inicial,

- Vino de tea.'

6. In Article 14 (7) (b), after the term 'meio seco' the following is added:

'- Adamado.'

7. Annexes I, II and IV are amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

ANNEX

I. Annex I to Regulation (EEC) No 3201/90 is amended as follows:

1. In Annex I, the following point 3 (a) (AUSTRALIA) is added after point 3 (ARGENTINA):

'3 (a) AUSTRALIA

- "botrytis" , or other equivalent terms,

- "noble late harvested",

- "special late harvested".'

2. In Annex I, point 5 (BULGARIA) is replaced by the following:

'5. BULGARIA

The terms denoting superior quality are those listed in point B (Wines originating in Bulgaria), at point 1 (Traditional expressions) of the Annex to the 1993 agreement between the Community and Bulgaria on the reciprocal protection and control of wine names.'

3. In Annex I, point 7 (HUNGARY) is replaced by the following:

'7. HUNGARY

The terms denoting superior quality are those listed in point B (Wines originating in Hungary), at point II (Traditional expressions) of the Annex to the 1993 agreement between the Community and Hungary on the reciprocal protection and control of wine names.'

4. In Annex I, point 10 (ROMANIA) is replaced by the following:

'10. ROMANIA

The terms denoting superior quality are those listed in point B (Wines originating in Romania), at point II (Traditional expressions of quality wines) of the Annex to the 1993 agreement between the Community and Romania on the reciprocal protection and control of wine names.'

5. Point 15 (YUGOSLAVIA) is deleted.

6. The following terms are added to point 12 (SWITZERLAND):

'- "appellation d'origine, Ursprungsbezeichnung, denominazione di origine",

- "appellation d'origine contrôlée, kontrollierte Ursprungsbezeichnung, denominatione di origine controlata",

(2) Point 4 (AUSTRALIA) is replaced by the following:

The geographical indications are those listed in point B (Wines originating in Australia) of Annex II to the 1994 agreement between the Community and Australia on trade in wine.'

(3) Point 6 (BULGARIA) is replaced by the following:

The geographical indications are those listed in point B (Wines originating in Bulgaria) of the Annex to the 1993 agreement betweeen the Community and Bulgaria on the reciprocal protection and control of wine names.'
