COMMISSION IMPLEMENTING REGULATION (EU) 2025/1379
of 15 July 2025
amending Regulation (EU) No 142/2011 as regards the digitalisation of record keeping, the models for the commercial document and for health certificates for movement of animal by-products from restricted zones and for transport of unprocessed manure

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1069/2009 of the European Parliament and of the Council of 21 October 2009 laying down health rules as regards animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No 1774/2002 (Animal by-products Regulation) (1), and in particular Article 21(5), point (a) and point (b), and Article 22(1), thereof,
Whereas:

Regulation (EC) No 1069/2009 requires that animal by-products and derived products be accompanied during transport within the Union by a commercial document or a health certificate where appropriate. In addition, operators are to keep records of consignments and related commercial documents and health certificates. |

The models for the commercial document and for the health certificate for movement of animal by-products from restricted zones, as well as the duration for keeping records are set out in Annex VIII to Commission Regulation (EU) No 142/2011 (2). |

Records and related documents are to be kept for a period of at least 2 years for presentation to the competent authority. Given that the Trade Control and Expert System (TRACES) (3) electronic system issues and records electronic versions of commercial documents and health certificates it is appropriate to exempt operators from the obligation to keep commercial documents where they have obtained them using TRACES. It is also appropriate to exempt operators from the obligation to keep animal health certificates for consignments of unprocessed manure where they have obtained them using TRACES. |

The model health certificate for movements of animal by-products from restricted zones should be updated with the latest model set out in Commission Implementing Regulation (EU) 2020/2235 (4). |

Regulation (EC) No 999/2001 of the European Parliament and of the Council (5) prohibits the movement into the Union of consignments of urine hunting lures derived from cervids originating in Norway, as well as the manufacture, placing on the market and use of urine hunting lures derived from cervids originating in the Member States listed in Chapter A, Section C, point 1.1, of Annex VIII to that Regulation. Those prohibitions should be reflected in the commercial document to ensure they are complied with. |

Regulation (EU) No 142/2011 should therefore be amended accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Regulation (EU) No 142/2011 is amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
