DURCHFÜHRUNGSBESCHLUSS (EU) 2017/564 DER KOMMISSION

vom 23. März 2017

zur Änderung des Anhangs des Durchführungsbeschlusses 2014/709/EU mit tierseuchenrechtlichen Maßnahmen zur Bekämpfung der Afrikanischen Schweinepest in bestimmten Mitgliedstaaten

DIE EUROPÄISCHE KOMMISSION —

gestützt auf den Vertrag über die Arbeitsweise der Europäischen Union,

gestützt auf die Richtlinie 89/662/EWG des Rates vom 11. Dezember 1989 zur Regelung der veterinärrechtlichen Kontrollen im innergemeinschaftlichen Handel im Hinblick auf den gemeinsamen Binnenmarkt (1), insbesondere auf Artikel 9 Absatz 4,

gestützt auf die Richtlinie 90/425/EWG des Rates vom 26. Juni 1990 zur Regelung der veterinärrechtlichen und tierzüchterischen Kontrollen im innergemeinschaftlichen Handel mit lebenden Tieren und Erzeugnissen im Hinblick auf den Binnenmarkt (2), insbesondere auf Artikel 10 Absatz 4,

gestützt auf die Richtlinie 2002/99/EG des Rates vom 16. Dezember 2002 zur Festlegung von tierseuchenrechtlichen Vorschriften für das Herstellen, die Verarbeitung, den Vertrieb und die Einfuhr von Lebensmitteln tierischen Ursprungs (3), insbesondere auf Artikel 4 Absatz 3,

in Erwägung nachstehender Gründe:

Im Durchführungsbeschluss 2014/709/EU der Kommission (4) sind tierseuchenrechtliche Maßnahmen zur Bekämpfung der Afrikanischen Schweinepest in bestimmten Mitgliedstaaten festgelegt. Im Anhang des genannten Durchführungsbeschlusses sind in den Teilen I, II, III und IV bestimmte Gebiete dieser Mitgliedstaaten abgegrenzt und aufgeführt, die nach ihrem Risikoniveau in Bezug auf die Seuchenlage eingestuft wurden. Diese Liste umfasst u. a. bestimmte Gebiete in Litauen.

Seit November 2016 wurden in bestimmten in Teil III des Anhangs des Durchführungsbeschlusses 2014/709/EU aufgeführten Gebieten Litauens keine Fälle von Afrikanischer Schweinepest bei Hausschweinen gemeldet. Ferner wurden die Biosicherheitsmaßnahmen in den Haltebetrieben in diesen Gebieten gemäß dem nationalen Biosicherheitsprogramm zur Verhinderung der Ausbreitung der Afrikanischen Schweinepest ordnungsgemäß überwacht. Diese Tatsachen weisen auf eine Verbesserung der Seuchenlage hin. Diese Gebiete Litauens sollten daher nicht länger in Teil III, sondern in Teil II des Anhangs des Durchführungsbeschlusses 2014/709/EU aufgeführt werden.

Bei der Bewertung des Risikos, das von der Tierseuchenlage in Bezug auf die Afrikanische Schweinepest in Litauen ausgeht, sollte die Entwicklung der aktuellen Lage hinsichtlich dieser Seuche in den betroffenen Haus- und Wildschweinpopulationen in der Union berücksichtigt werden. Um die gezielten tierseuchenrechtlichen Maßnahmen gemäß dem Durchführungsbeschluss 2014/709/EU durchführen und die weitere Ausbreitung der Afrikanischen Schweinepest verhindern zu können sowie jede unnötige Störung des Handels innerhalb der Union und die Errichtung ungerechtfertigter Handelsschranken durch Drittländer zu vermeiden, sollte die Unionsliste der Gebiete, die tierseuchenrechtlichen Maßnahmen gemäß dem Anhang des genannten Durchführungsbeschlusses unterliegen, unter Berücksichtigung der geänderten Lage in Bezug auf die genannte Seuche in Litauen angepasst werden.

(4)	Der Anhang des Durchführungsbeschlusses 2014/709/EU sollte daher entsprechend geändert werden.

(5)	Die in diesem Beschluss vorgesehenen Maßnahmen entsprechen der Stellungnahme des Ständigen Ausschusses für Pflanzen, Tiere, Lebensmittel und Futtermittel —

HAT FOLGENDEN BESCHLUSS ERLASSEN:

Artikel 1

Der Anhang des Durchführungsbeschlusses 2014/709/EU wird durch den Wortlaut im Anhang des vorliegenden Beschlusses ersetzt.

Artikel 2

Dieser Beschluss ist an die Mitgliedstaaten gerichtet.
