BESCHLUSS Nr. 2/2006 DES ASSOZIATIONSRATES EU-CHILE

vom 16. Oktober 2006

zur Änderung von Anhang I des Abkommens zur Gründung einer Assoziation zwischen der Europäischen Gemeinschaft und ihren Mitgliedstaaten einerseits und der Republik Chile andererseits zur Konsolidierung der Chile nach dem Allgemeinen Zollpräferenzschema der Gemeinschaft gewährten Zollpräferenzen

DER ASSOZIATIONSRAT —

gestützt auf das am 18. November 2002 in Brüssel unterzeichneten Abkommen zur Gründung einer Assoziation zwischen der Europäischen Gemeinschaft und ihren Mitgliedstaaten einerseits und der Republik Chile andererseits (nachstehend das „Assoziationsabkommen“ genannt), insbesondere auf Artikel 60 Absatz 5,

in Erwägung nachstehender Gründe:

Um Klarheit, die Möglichkeit langfristiger wirtschaftliche Voraussagen und Rechtssicherheit für die Wirtschaftsbeteiligten zu gewährleisten, haben die Vertragspartner vereinbart, die verbleibenden Zollpräferenzen, die der Republik Chile im Rahmen des Schemas allgemeiner Zollpräferenzen der Gemeinschaft gewährt werden und die in den in Anhang I des Assoziationsabkommens aufgeführten gemeinschaftlichen Zollzugeständnissen noch nicht berücksichtigt sind, in ihr bilaterales Freihandelsabkommen aufzunehmen.

Gemäß Artikel 60 Absatz 5 des Assoziationsabkommens kann der Assoziationsrat beschließen, Zölle früher als in den Artikeln 65, 68 und 71 vorgesehen zu senken oder die Zugangsbedingungen nach diesen Artikeln auf andere Weise zu verbessern.

Dieser Beschluss tritt für die betreffende Ware an die Stelle der Bedingungen der Artikel 65, 68 und 71.

Um den Übergang vom allgemeinen Zollpräferenzschema zu den präferenziellen bilateralen Handelsregelungen gemäß dem Assoziationsabkommen reibungslos zu gestalten, können für einen bestimmten Zeitraum auch APS-Ursprungsnachweise (Ursprungszeugnis nach Formblatt A oder Erklärung auf der Rechnung) vorgelegt werden —

BESCHLIESST:

Artikel 1

Anhang I des Assoziationsabkommens wird nach Maßgabe der Bestimmungen des Anhangs dieses Beschlusses geändert.

Artikel 2

Dieser Beschluss tritt für die Einfuhr der betreffenden Waren in die Gemeinschaft an die Stelle der Bedingungen der Artikel 65, 68 und 71 des Assoziationsabkommens.

Artikel 3

Ursprungsnachweise, die im Rahmen des allgemeinen Zollpräferenzsystems der Gemeinschaft in der Republik Chile ordnungsgemäß ausgestellt wurden, sind in der Europäischen Gemeinschaft als gültige Ursprungsnachweise für die präferenziellen bilateralen Handelsregelungen laut Assoziationsabkommen anzuerkennen, sofern:

i)

der Ursprungsnachweis innerhalb von vier Monaten nach dem Inkrafttreten dieses Beschlusses vorgelegt wird;

ii)

der Ursprungsnachweis und die Beförderungspapiere spätestens am Tag vor Inkrafttreten dieses Beschlusses ausgestellt worden sind;

iii)

der Ursprungsnachweis bei der Einfuhr in die Europäische Gemeinschaft zugunsten von Zollpräferenzen vorgelegt wird, die früher im Rahmen des allgemeinen Zollpräferenzschemas gewährt und mit diesem Beschluss konsolidiert wurden.

Artikel 4

Dieser Beschluss tritt am 1. Januar 2006 oder am Tag seiner Annahme in Kraft, sofern diese nach dem 1. Januar 2006 erfolgt.
