Untreated and Heat-treated milk

The European Union lays down health criteria for heat-treated milk (pasteurised, UHT or sterilised milk) for intra-Community trade.

ACTS

Council Directive 89/384/EEC of 20 June 1989 establishing the detailed procedures for carrying out checks to ensure that the freezing-point of untreated milk laid down in Annex A to Directive 85/397/EEC is complied with.

Council Decision 92/608/EEC of 14 December 1992 laying down methods for the analysis and testing of heat-treated milk for direct human consumption.

SUMMARY

Directive 89/384/EEC

The Directive describes the procedures for checking the freezing-point of untreated milk delivered to a treatment establishment or a collection or standardisation centre. Untreated milk from each holding must be checked regularly by random sampling.

If the results of the check refute the suspicion of water having been added, untreated milk may be used for producing heat-treated milk. If not, additional checks must be carried out and, if the suspicion is confirmed, the milk must be excluded from the market.

Decision 92/608/EEC

The purpose of this Decision was to establish control measures to ensure that the standards laid down in Directive 85/397/EEC are met, by establishing health rules for heat-treated milk. It describes the application of reference methods for analysis and testing, the fixing of reliability criteria, and the collection of samples.

The analysis and testing methods for heat-treated milk for direct human consumption consist in determining a product's total solids content, fat content, total non-fat solids content, total nitrogen content, protein content and specific mass.

Background

Directive 85/397/EEC was replaced by Directive 92/46/EEC laying down the health rules for the production and placing on the market of raw milk, heat-treated milk and milk-based products.

The 1992 Directive describes the criteria for raw milk to be heat-treated and lays down microbiological standards for raw milk and treated milk, together with the requirements relating to heat treatment. It also contains provisions on the approval of milk treatment establishments and collection and standardisation centres, necessary checks and inspections, and measures to be taken in the case of diseases, together with rules relating to milk transport.

Directive 92/46/EEC will be repealed when the hygiene package enters into force in January 2006.
