on the signing and conclusion of the Agreement between the European Union and Montenegro establishing a framework for the participation of Montenegro in European Union crisis management operations

EUROPEISKA UNIONENS RÅD HAR ANTAGIT DETTA BESLUT

THE COUNCIL OF THE EUROPEAN UNION,

med beaktande av fördraget om Europeiska unionen, särskilt artikel 37, och fördraget om Europeiska unionens funktionssätt, särskilt artikel 218.5 och 218.6,

Having regard to the Treaty on European Union, in particular Article 37 thereof, and the Treaty on the Functioning of the European Union, in particular Article 218(5) and (6) thereof,

med beaktande av förslaget från unionens höga representant för utrikes frågor och säkerhetspolitik (nedan kallad den höga representanten), och

Having regard to the proposal of the High Representative of the Union for Foreign Affairs and Security Policy ("HR"),

av följande skäl:

Whereas:

(1) Villkoren för tredjestaters deltagande i Europeiska unionens krishanteringsinsatser bör anges i ett avtal om fastställande av en ram för ett eventuellt sådant framtida deltagande i stället för att fastställas från fall till fall för varje aktuell insats.

(1) Conditions regarding the participation of third States in European Union crisis management operations should be laid down in an agreement establishing a framework for such possible future participation, rather than defining those conditions on a case-by-case basis for each operation concerned.

(2) Efter rådets beslut av den 26 april 2010 om bemyndigande att inleda förhandlingar har den höga representanten förhandlat om ett avtal mellan Europeiska unionen och Montenegro om fastställande av en ram för Montenegros deltagande i Europeiska unionens krishanteringsinsatser (nedan kallat avtalet).

(2) Following the adoption of a Decision by the Council on 26 April 2010 authorising the opening of negotiations, the HR negotiated an agreement between the European Union and Montenegro establishing a framework for the participation of Montenegro in European Union crisis management operations ("the Agreement").

(3) Avtalet bör godkännas.

(3) The Agreement should be approved,

HÄRIGENOM FÖRESKRIVS FÖLJANDE.

HAS ADOPTED THIS DECISION:

Artikel 1

Article 1

Avtalet mellan Europeiska unionen och Montenegro om fastställande av en ram för Montenegros deltagande i Europeiska unionens krishanteringsinsatser (avtalet) godkänns härmed på unionens vägnar.

The Agreement between the European Union and Montenegro establishing a framework for the participation of Montenegro in European Union crisis management operations ("the Agreement") is hereby approved on behalf of the Union.

Texten till avtalet åtföljer detta beslut.

The text of the Agreement is attached to this Decision.

Artikel 2

Article 2

Rådets ordförande bemyndigas härmed att utse den eller de personer som ska ha rätt att underteckna avtalet med bindande verkan för unionen.

The President of the Council is hereby authorised to designate the person(s) empowered to sign the Agreement in order to bind the Union.

Artikel 3

Article 3

Avtalet ska tillämpas provisoriskt från och med den dag då avtalet undertecknas, i avvaktan på att de förfaranden som är nödvändiga för avtalets ingående avslutas [1].

The Agreement shall be applied on a provisional basis as from the date of signature thereof, pending the completion of the procedures for its conclusion [1].

Artikel 4

Rådets ordförande ska på unionens vägnar göra den anmälan som avses i artikel 16.1 i avtalet.

The President of the Council shall, on behalf of the Union, give the notification provided for in Article 16(1) of the Agreement.

Artikel 5

Article 5

Detta beslut träder i kraft samma dag som det antas.

This Decision shall enter into force on the date of its adoption.

Utfärdat i Bryssel den 21 februari 2011.
