Commission Regulation (EC) No 1778/2004 of 13 October 2004 prohibiting fishing for blue ling by vessels flying the flag of the United Kingdom

Tendo em conta o Tratado que institui a Comunidade Europeia,

Having regard to the Treaty establishing the European Community,

Tendo em conta o Regulamento (CEE) n.° 2847/93 do Conselho, de 12 de Outubro de 1993 , que institui um regime de controlo aplicável à política comum das pescas(1), nomeadamente o n.° 3 do artigo 21.°,

Having regard to Council Regulation (EEC) No 2847/93 of 12 October 1993 establishing a control system applicable to the common fisheries policy(1), and in particular Article 21(3) thereof,

Considerando o seguinte:

Whereas:

(1) O Regulamento (CE) n.° 2340/2002 do Conselho, de 16 de Dezembro de 2002 , que fixa, para 2003 e 2004, as possibilidades de pesca relativas às unidades populacionais de peixes de profundidade(2), estabelece quotas de maruca azul para 2004.

(2) Para assegurar o respeito das disposições relativas às limitações quantitativas das capturas de uma unidade populacional submetida a quota, é necessário que a Comissão fixe a data em que se considera que as capturas efectuadas por navios arvorando pavilhão de um Estado-Membro esgotaram a quota atribuída.

(2) In order to ensure compliance with the provisions relating to the quantity limits on catches of stocks subject to quotas, the Commission must fix the date by which catches made by vessels flying the flag of a Member State are deemed to have exhausted the quota allocated.

(3) De acordo com as informações comunicadas à Comissão, as capturas de maruca azul nas águas da subzona CIEM II, IV, V (águas comunitárias e águas que não estão sob a soberania ou jurisdição de países terceiros), efectuadas por navios arvorando pavilhão do Reino Unido ou registados no Reino Unido, atingiram a quota atribuída para 2004. O Reino Unido proibiu a pesca desta unidade populacional a partir de 12 de Julho de 2004 . É, por conseguinte, conveniente reter essa data,

(3) According to the information received by the Commission, catches of blue ling in the waters of ICES sub-areas II, IV and V (EC waters and waters not subject to the sovereignty or jurisdiction of third countries) by vessels flying the flag of the United Kingdom or registered in the United Kingdom have exhausted the quota allocated for 2004. The United Kingdom has prohibited fishing for this stock from 12 July 2004 . This date should be adopted in this Regulation also,

ADOPTOU O PRESENTE REGULAMENTO:

HAS ADOPTED THIS REGULATION:

Artigo 1.°

Article 1

Considera-se que as capturas de maruca azul nas águas da subzona CIEM II, IV, V (águas comunitárias e águas que não estão sob a soberania ou jurisdição de países terceiros), efectuadas por navios arvorando pavilhão do Reino Unido ou registados no Reino Unido, esgotaram a quota atribuída ao Reino Unido para 2004.

Catches of blue ling in the waters of ICES sub-areas II, IV and V (EC waters and waters not subject to the sovereignty or jurisdiction of third countries) by vessels flying the flag of the United Kingdom or registered in the United Kingdom are hereby deemed to have exhausted the quota allocated to the United Kingdom for 2004.

É proibida a pesca da maruca azul nas águas da subzona CIEM II, IV, V (águas comunitárias e águas que não estão sob a soberania ou jurisdição de países terceiros) por navios arvorando pavilhão do Reino Unido ou registados no Reino Unido, assim como a manutenção a bordo, o transbordo e o desembarque desta unidade populacional capturada pelos referidos navios após a data de aplicação do presente regulamento.

Fishing for blue ling in the waters of ICES sub-areas II, IV and V (EC waters and waters not subject to the sovereignty or jurisdiction of third countries) by vessels flying the flag of the United Kingdom or registered in the United Kingdom is hereby prohibited, as are the retention on board, transhipment and landing of this stock caught by the above vessels after the date of application of this Regulation.

Artigo 2.°

Article 2

O presente regulamento entra em vigor no dia seguinte ao da sua publicação no Jornal Oficial da União Europeia .

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union .

O presente regulamento é aplicável com efeitos desde 12 de Julho de 2004 .

It shall apply from 12 July 2004 .

O presente regulamento é obrigatório em todos os seus elementos e directamente aplicável em todos os Estados-Membros.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
