(1) Considerando que o artigo 160.o do Tratado prevê que o Fundo Europeu de Desenvolvimento Regional (FEDER) tem por objectivo contribuir para a correcção dos principais desequilíbrios regionais na Comunidade; que o FEDER contribuiu, assim, para reduzir a diferença entre os níveis de desenvolvimento das diversas regiões e o atraso das regiões ou ilhas menos favorecidas, incluindo as zonas rurais;

Acting in accordance with the procedure laid down in Article 251 of the Treaty(5),

(2) Considerando que o Regulamento (CE) n.o 1260/1999 do Conselho, de 21 de Junho de 1999, que estabelece disposições gerais sobre os Fundos estruturais(6) prevê, no n.o 2 do artigo 2.o, que o FEDER tem por fim essencial o apoio aos objectivos n.o 1 e n.o 2, enunciados no artigo 1.o, primeiro parágrafo, pontos 1 e 2 (a seguir designados "objectivos n.o 1 e n.o 2") desse regulamento; que os artigos 20.o e 21.o do mesmo regulamento prevêem que o FEDER contribua para o financiamento da cooperação transnacional, transfronteiriça e inter-regional, bem como para a regeneração económica e social de cidades e subúrbios em crise, a título das iniciativas comunitárias; que os artigos 22.o e 23.o do citado regulamento prevêem que o FEDER apoie acções inovadoras ao nível comunitário e medidas de assistência técnica;

(1) Whereas Article 160 of the Treaty provides that the European Regional Development Fund (ERDF) is intended to help redress the main regional imbalances in the Community; whereas the ERDF therefore contributes to reducing the gap between the levels of development of the various regions and the extent to which the least-favoured regions and islands, including rural areas, are lagging behind;

(3) Considerando que as disposições comuns aos Fundos Estruturais são definidas no Regulamento (CE) n.o 1260/1999; que é conveniente especificar a natureza das medidas que podem ser financiadas pelo FEDER a título dos objectivos n.o 1 e n.o 2, das iniciativas comunitárias e das acções inovadoras;

(2) Whereas Article 2(2) of Council Regulation (EC) No 1260/1999 of 21 June 1999 laying down general provisions on the Structural Funds(6) provides that the main task of the ERDF is to contribute to the attainment of Objectives 1 and 2, as referred to in Article 1, first subparagraph, points 1 and 2 (hereinafter referred to as "Objectives 1 and 2") of that Regulation; whereas Articles 20 and 21 of the same Regulation provide that the ERDF is to contribute to financing cross-border, transnational and interregional cooperation as well as to economic and social regeneration of cities and urban neighbourhoods in crisis under the Community Initiatives; whereas Articles 22 and 23 of the Regulation in question state that it is to support innovative measures at Community level and technical assistance measures;

(4) Considerando que é conveniente especificar a contribuição do FEDER, no âmbito dos seus objectivos de desenvolvimento regional, para um desenvolvimento harmonioso, equilibrado e sustentável das actividades económicas, um elevado grau de competitividade, um elevado nível de emprego, a igualdade entre homens e mulheres e um elevado nível de protecção e de melhoria da qualidade do ambiente;

(3) Whereas the provisions common to the Structural Funds are set out in Regulation (EC) No 1260/1999; whereas the type of measures which may be financed by the ERDF under Objectives 1 and 2, the Community Initiatives and innovative measures should be defined;

(5) Considerando que a intervenção do FEDER deve processar-se no âmbito de uma estratégia global e integrada de desenvolvimento sustentável e assegurar efeitos de sinergia com as intervenções dos demais Fundos Estruturais;

(4) Whereas the contribution of the ERDF, in the context of its task of promoting regional development, to the harmonious, balanced and sustainable development of economic activity, to a high degree of competitiveness, to a high level of employment, to equality between women and men and to a high level of protection and improvement of the environment should be defined;

(6) Considerando que, no âmbito dos seus objectivos, é conveniente que o FEDER apoie a envolvente produtiva e a competitividade das empresas, nomeadamente das pequenas e médias empresas; o desenvolvimento económico local e do emprego, nomeadamente nos domínios da cultura e do turismo, na medida em que contribuem para a criação de empregos duradouros; a investigação e o desenvolvimento tecnológico; o desenvolvimento das redes locais, regionais e transeuropeias - incluindo o acesso adequado a estas redes - nos sectores das infra-estruturas de transportes, das telecomunicações e da energia; a protecção e a melhoria da qualidade do ambiente, tendo em conta os princípios da precaução e da acção preventiva, da correcção, prioritariamente na fonte, dos danos causados ao ambiente bem como do princípio do poluidor/pagador, e favorecendo uma utilização limpa e eficaz da energia e o desenvolvimento das energias renováveis, bem como a igualdade entre homens e mulheres perante o emprego;

(5) Whereas the ERDF should provide assistance within the framework of a comprehensive and integrated strategy for sustainable development and ensure synergy with assistance from the other Structural Funds;

(7) Considerando que o FEDER deve desempenhar um papel especial em favor do desenvolvimento económico local, num contexto de melhoria das condições de vida e de ordenamento do território, designadamente mediante a promoção de pactos territoriais de emprego e de novas fontes de emprego;

(6) Whereas, as part of its tasks, the ERDF should support the productive environment and the competitiveness of enterprises, especially small and medium-sized enterprises; local economic development and employment, including in the fields of culture and tourism where these contribute to the creation of sustainable jobs; research and technological development; the development of local, regional and trans-European networks including the provision of suitable access to the said networks in the sectors of transport infrastructure, telecommunications and energy; the protection and improvement of the environment taking into account the principles of precaution and that preventive action should be taken, that environmental damage should as a priority be rectified at source and that the polluter should pay and by fostering the clean and efficient utilisation of energy and the development of renewable energy sources; and equality between women and men in the field of employment;

(8) Considerando que o FEDER, no âmbito dos seus objectivos, deveria apoiar os investimentos a favor da recuperação das zonas desafectadas, numa perspectiva de desenvolvimento económico local, rural ou urbano;

(7) Whereas the ERDF should play a particular role in favour of local economic development, in the context of improving the quality of life and developing the territory, especially by promoting territorial employment pacts and new sources of employment;

(9) Considerando que as medidas de interesse comunitário empreendidas por iniciativa da Comissão têm um papel importante a desempenhar no contexto da realização dos objectivos gerais da acção estrutural comunitária prevista no artigo 1.o do Regulamento (CE) n.o 1260/1999; que, nesta perspectiva, atento o seu valor acrescentado comunitário, é importante que o FEDER continue a promover a cooperação transfronteiriça, transnacional e inter-regional, incluindo a das regiões situadas nas fronteiras externas da União na acepção do Tratado, a das ilhas menos favorecidas, bem como a das regiões ultraperiféricas, dado as características e limitações específicas destas; que, no âmbito dessa cooperação, um desenvolvimento harmonioso, equilibrado e sustentável do conjunto do espaço comunitário, inclusive em ligação com o ordenamento do território, confere um valor acrescentado à acção a favor da coesão económica e social; que é conveniente que o contributo do FEDER para esse desenvolvimento seja prosseguido e reforçado; que, além disso, é desejável apoiar a regeneração económica e social de cidades e subúrbios em crise a fim de se promover o desenvolvimento urbano sustentável;

(8) Whereas the ERDF should as part of its task support investment in favour of the rehabilitation of abandoned areas with a view to local, rural or urban economic development;

(10) Considerando que é conveniente determinar a competência para a adopção de normas de execução e prever disposições transitórias;

(9) Whereas measures of Community interest undertaken at the initiative of the Commission have an important role to play in achieving the general objectives of Community structural action referred to in Article 1 of Regulation (EC) No 1260/1999; whereas, to that end, in view of the value it adds at Community level, it is important that the ERDF continue to promote cross-border, transnational and inter-regional cooperation, including in the regions located on the external frontiers of the Union within the meaning of the Treaty, the least-favoured islands and the outermost regions, in view of their special features and difficulties; whereas in the context of that cooperation, the harmonious, balanced and sustainable development of the whole of the Community territory, including in connection with spatial planning, adds value to action to promote economic and social cohesion; whereas the contribution of the ERDF to that development should be continued and increased; whereas moreover it is desirable to support the economic and social regeneration of cities and urban neighbourhoods in crisis with a view to promoting sustainable urban development;

(11) Considerando que é necessário revogar o Regulamento (CEE) n.o 4254/88 do Conselho, de 19 de Dezembro de 1988, que estabelece as regras de execução do Regulamento (CEE) n.o 2052/88 no que respeita ao Fundo Europeu de Desenvolvimento Regional(7),

(10) Whereas it is appropriate to lay down the powers for adoption of the implementing provisions and to set out transitional provisions;

ADOPTARAM O PRESENTE REGULAMENTO:

(11) Whereas Council Regulation (EEC) No 4254/88 of 19 December 1988 laying down provisions for implementing Regulation (EEC) No 2052/88 as regards the European Regional Development Fund(7) should be repealed,

HAVE ADOPTED THIS REGULATION:

Artigo 1.o

Objectivos

Article 1

Nos termos do artigo 160.o do Tratado e do Regulamento (CE) n.o 1260/1999, o Fundo Europeu de Desenvolvimento Regional (FEDER) participa no financiamento de intervenções, na acepção do artigo 9.o do mesmo regulamento, com o objectivo de promover a coesão económica e social, mediante a correcção dos principais desequilíbrios regionais e a participação no desenvolvimento e na reconversão das regiões.

Tasks

Para o efeito, o FEDER contribui igualmente para a promoção de um desenvolvimento sustentável e a criação de empregos duradouros.

Pursuant to Article 160 of the Treaty and Regulation (EC) No 1260/1999, the European Regional Development Fund (ERDF) shall contribute towards the financing of assistance as defined in Article 9 of that Regulation to promote economic and social cohesion by correcting the main regional imbalances and participating in the development and conversion of regions.

To that end, the ERDF shall also contribute to promoting sustainable development and the creation of sustainable jobs.

Artigo 2.o

Âmbito de aplicação

Article 2

1. No âmbito dos objectivos definidos no artigo 1.o, o FEDER participa no financiamento de:

Scope

a) Investimentos produtivos que permitam a criação ou a manutenção de empregos duradouros;

1. As part of its tasks as defined in Article 1, the ERDF shall contribute towards the financing of:

b) Investimentos em infra-estruturas que:

(a) productive investment to create and safeguard sustainable jobs;

i) nas regiões abrangidas pelo objectivo n.o 1, contribuam para o aumento do potencial económico, o desenvolvimento, o ajustamento estrutural e a criação ou manutenção de empregos duradouros nessas regiões, incluindo os investimentos que contribuam para o estabelecimento e o desenvolvimento das redes transeuropeias nos sectores dos transportes, das telecomunicações e da energia, tendo em conta a necessidade do estabelecimento de ligações das regiões afectadas por desvantagens de ordem estrutural decorrentes da sua natureza de regiões insulares, sem litoral ou periféricas com as regiões centrais da Comunidade,

(b) investment in infrastructure:

ii) nas regiões ou zonas abrangidas pelos objectivos n.o 1 e n.o 2 ou pela iniciativa comunitária mencionada no n.o 1, alíneas a) e b), do artigo 20.o do Regulamento (CE) n.o 1260/1999, visem a diversificação das zonas de implantação económica e dos espaços industriais em declínio, a renovação de áreas urbanas degradadas, bem como a revitalização e o desenclavamento das zonas rurais e das zonas dependentes da pesca, e ainda infra-estruturas cuja modernização ou remodelação constituam condição para a criação ou o desenvolvimento de actividades económicas criadoras de emprego, incluindo as ligações em infra-estruturas que sejam condicionantes do desenvolvimento dessas actividades;

(i) which, in regions covered by Objective 1, helps to increase the economic potential, development, structural adjustment and creation or maintenance of sustainable jobs in those regions, including investment in infrastructure contributing to the establishment and development of trans-European networks in the areas of transport, telecommunications and energy infrastructures taking into account the need to link to the central regions of the Community regions suffering from a structural handicap because of their insular, landlocked or peripheral status;

c) Acções de desenvolvimento do potencial endógeno, através de medidas de animação e de apoio às iniciativas de desenvolvimento local e de emprego e às actividades das pequenas e médias empresas, incluindo, nomeadamente:

(ii) which, in regions and areas covered by Objectives 1 and 2 or the Community initiatives referred to in Article 20(1)(a) and (b) of Regulation (EC) No 1260/1999, concerns the diversification of economic sites and industrial areas suffering from decline, the renewal of depressed urban areas and the revitalisation of and improved access to rural areas and areas dependent on fisheries; instruments in infrastructure where modernisation or regeneration is a prerequisite for the creation or development of job-creating economic activities, including infrastructure links on which the development of such activities depends;

i) auxílios à prestação de serviços às empresas, nomeadamente no campo da gestão, dos estudos e prospecção de mercados e dos serviços comuns a várias empresas,

(c) the development of endogenous potential by measures which encourage and support local development and employment initiatives and the activities of small and medium-sized enterprises, involving in particular:

ii) financiamento da transferência de tecnologia, incluindo, nomeadamente, a recolha, a difusão de informação, a organização comum entre empresas e estabelecimentos de investigação e o financiamento da aplicação da inovação nas empresas;

(i) assistance towards services for enterprises, in particular in the fields of management, market studies and research and services common to several enterprises,

iii) melhoria do acesso das empresas ao financiamento e ao crédito, mediante a criação e o desenvolvimento de instrumentos de financiamento adequados, nos termos do artigo 28.o do Regulamento (CE) n.o 1260/1999,

(ii) financing the transfer of technology, including in particular the collection and dissemination of information, common organisation between enterprises and research establishments and financing the implementation of innovation in enterprises,

iv) auxílios directos ao investimento, como definidos no n.o 3 do artigo 28.o do Regulamento (CE) n.o 1260/1999, em caso de inexistência de um regime de auxílio,

(iii) improvement of access by enterprises to finance and loans, by creating and developing appropriate financing instruments, as referred to in Article 28 of Regulation (EC) No 1260/1999,

v) realização de infra-estruturas de dimensões apropriadas ao desenvolvimento local e ao emprego,

(iv) direct aid to investment as defined in Article 28(3) of Regulation (EC) No 1260/1999 where no aid scheme exists,

vi) auxílios às estruturas de serviços de proximidade que tenham por objectivo a criação de novos postos de trabalho, com exclusão das medidas financiadas pelo Fundo Social Europeu (FSE);

(v) the provision of infrastructure on a scale appropriate to local and employment development,

d) Medidas de assistência técnica referidas no n.o 4, segundo parágrafo, do artigo 2.o do Regulamento (CE) n.o 1260/1999.

(vi) aid for structures providing neighbourhood services to create new jobs but excluding measures financed by the European Social Fund (ESF);

Nas regiões abrangidas pelo objectivo n.o 1, o FEDER pode participar no financiamento de investimentos nos sectores da educação e da saúde que contribuam para o seu ajustamento estrutural.

(d) technical assistance measures as referred to in the second subparagraph of Article 2(4) of Regulation (EC) No 1260/1999.

2. A participação financeira do FEDER nos termos do n.o 1 visa nomeadamente os seguintes domínios:

In the regions designated under Objective 1, the ERDF may contribute towards the financing of investment in education and health that is beneficial to the regions' structural adjustment.

a) A envolvente produtiva, nomeadamente para desenvolver a competitividade e o investimento sustentável das empresas, em especial das pequenas e médias empresas, bem como a capacidade de atracção das regiões, designadamente pela elevação do seu nível de equipamento em infra-estruturas;

2. In application of paragraph 1, the financial contribution of the ERDF shall support, inter alia, the following:

b) A investigação e o desenvolvimento tecnológico, com o objectivo de fomentar a aplicação das novas tecnologias e a inovação ou de reforçar as capacidades de investigação e de desenvolvimento tecnológico que contribuam para o desenvolvimento regional;

(a) the productive environment, in particular to increase competitiveness and sustainable investment by firms, especially the small and medium-sized enterprises, and to make regions more attractive, particularly by improving the standard of their infrastructure;

c) O desenvolvimento da sociedade de informação;

(b) research and technological development with a view to promoting the introduction of new technologies and innovation and the strengthening of research and technological development capacities contributing to regional development;

d) O desenvolvimento do turismo e do investimento na cultura, incluindo a protecção do património cultural e natural, desde que sejam criados empregos duradouros;

(c) the development of the information society;

e) A protecção e a melhoria da qualidade do ambiente, tendo nomeadamente em conta os princípios da precaução e da acção preventiva no apoio ao desenvolvimento económico, à utilização limpa e eficaz da energia e ao desenvolvimento das energias renováveis;

(d) the development of tourism and cultural investment, including the protection of cultural and natural heritage, provided that they are creating sustainable jobs;

f) A igualdade entre homens e mulheres perante o emprego, nomeadamente através da criação de empresas e de infra-estruturas ou serviços que permitam conciliar a vida familiar com a vida profissional;

(e) the protection and improvement of the environment, in particular taking account of the principles of precaution and preventative action in support of economic development, the clean and efficient utilisation of energy and the development of renewable energy sources;

g) A cooperação transnacional, transfronteiriça e inter-regional no domínio do desenvolvimento regional e local sustentável.

(f) equality between women and men in the field of employment, principally through the establishment of firms and through infrastructure or services enabling the reconciliation of family and working life;

(g) transnational, cross-border and inter-regional cooperation on sustainable regional and local development.

Artigo 3.o

Iniciativa comunitária

Article 3

1. Em execução do artigo 20.o do Regulamento (CE) n.o 1260/1999, o FEDER contribui, nos termos do artigo 21.o do mesmo regulamento, para a execução da iniciativa comunitária em matéria de cooperação transfronteiriça, transnacional e inter-regional destinada a fomentar um desenvolvimento harmonioso, equilibrado e sustentável do espaço comunitário no seu conjunto ("Interreg"), bem como para a execução da iniciativa comunitária em matéria de regeneração económica e social de cidades e subúrbios em crise na perspectiva da promoção do desenvolvimento urbano sustentável ("URBAN").

Community initiative

2. Nos termos do n.o 2 do artigo 21.o do Regulamento (CE) n.o 1260/1999, o âmbito de aplicação referido no n.o 1 do presente artigo é alargado pela decisão de participação dos Fundos a medidas que possam ser financiadas ao abrigo dos Regulamentos (CE) n.o 1784/1999(8), (CE) n.o 1257/1999(9) e (CE) n.o 1263/1999(10), a fim de poderem ser executadas todas as medidas previstas pelo programa de iniciativa comunitária em causa.

1. Pursuant to Article 20 of Regulation (EC) No 1260/1999, the ERDF shall, in accordance with Article 21 of that Regulation, contribute to the implementation of the Community initiative for cross-border, transnational and inter-regional cooperation intended to encourage the harmonious, balanced and sustainable development of the whole of the Community's territory ("Interreg") as well as to the implementation of the Community initiative for economic and social regeneration of cities and urban neighbourhoods in crisis with a view to promoting sustainable urban development ("URBAN").

2. In accordance with Article 21(2) of Regulation (EC) No 1260/1999, the scope laid down in paragraph 1 of this Article shall be extended by the decision on the Funds' contribution to the financing of measures eligible under Regulations (EC) No 1784/1999(8), (EC) No 1257/1999(9) and (EC) No 1263/1999(10) with a view to implementing all the measures set out in the Community initiative programme concerned.

Artigo 4.o

Acções inovadoras

Article 4

1. Nos termos do n.o 1 do artigo 22.o do Regulamento (CE) n.o 1260/1999, o FEDER pode participar no financiamento de:

Innovative measures

a) Estudos elaborados por iniciativa da Comissão, destinados a analisar e identificar problemas e soluções no âmbito do desenvolvimento regional, nomeadamente tendo em vista um desenvolvimento harmonioso, equilibrado e sustentável do espaço comunitário no seu conjunto, e inclusivamente o esquema de desenvolvimento do espaço comunitário;

1. In accordance with Article 22(1) of Regulation (EC) No 1260/1999, the ERDF may also contribute to financing:

b) Projectos-piloto que revelem ou proponham novas soluções em matéria de desenvolvimento regional e local, a fim de as transferir, uma vez demonstradas, para as intervenções;

(a) studies initiated by the Commission to identify and analyse regional development problems and solutions, particularly with a view to the harmonious, balanced and sustainable development of the whole of the Community's territory, including the European Spatial Development Perspective;

c) Intercâmbios de experiências inovadoras, destinados a valorizar e transferir a experiência adquirida no domínio do desenvolvimento regional ou local.

(b) pilot projects to identify or test new regional and local development solutions with a view to their inclusion in assistance after demonstration of their feasibility;

2. Nos termos do n.o 2 do artigo 22.o do Regulamento (CE) n.o 1260/1999, o âmbito de aplicação referido no n.o 1 é alargado pela decisão de participação dos Fundos a medidas que possam ser financiadas ao abrigo dos Regulamentos (CE) n.o 1784/1999, (CE) n.o 1257/1999 e (CE) n.o 1263/1999, a fim de poderem ser executadas todas as medidas previtas pelo projecto-piloto em causa.

(c) exchanges of experience relating to innovation with the aim of turning to account and transferring experience gained in the regional or local development field.

2. In accordance with Article 22(2) of Regulation (EC) No 1260/1999, the scope laid down in paragraph 1 of this Article shall be extended by the decision on the Funds' contribution to the financing of measures eligible under Regulations (EC) No 1784/1999, (EC) No 1257/1999 and (EC) No 1263/1999 with a view to implementing all the measures in the pilot project concerned.

Artigo 5.o

Regras de execução

Article 5

Todas as regras de execução do presente regulamento serão adoptadas pela Comissão nos termos do artigo 48.o do Regulamento (CE) n.o 1260/1999.

Implementing rules

Any detailed implementing rules for this Regulation shall be adopted by the Commission in accordance with the procedure laid down in Article 48 of Regulation (EC) No 1260/1999.

Artigo 6.o

Revogação

Article 6

O Regulamento (CEE) n.o 4254/88 é revogado com efeitos a partir de 1 de Janeiro de 2000.

Repeal

As remissões para o regulamento revogado consideram-se como remissões para o presente regulamento.

Regulation (EEC) No 4254/88 shall be repealed with effect from 1 January 2000.

References to the repealed Regulation shall be construed as references to this Regulation.

Artigo 7.o

Cláusula de reexame

Article 7

Sob proposta da Comissão, o Parlamento Europeu e o Conselho reexaminarão o presente regulamento o mais tardar em 31 de Dezembro de 2006.

Review clause

Deliberarão sobre essa proposta nos termos do artigo 162.o do Tratado.

On a proposal from the Commission, the European Parliament and the Council shall review this Regulation by 31 December 2006.

They shall act on this proposal in accordance with the procedure laid down in Article 162 of the Treaty.

Artigo 8.o

Disposições transitórias

Article 8

As disposições transitórias constantes do artigo 52.o do Regulamento (CE) n.o 1260/1999 aplicam-se, mutatis mutandis, ao presente regulamento.

Transitional provisions

The transitional provisions referred to in Article 52 of Regulation (EC) No 1260/1999 shall apply mutatis mutandis to this Regulation.

Artigo 9.o

Entrada em vigor

Article 9

O presente regulamento entra em vigor no terceiro dia seguinte ao da sua publicação no Jornal Oficial das Comunidades Europeias.

Entry into force

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Communities.

O presente regulamento é obrigatório em todos os seus elementos e directamente aplicável em todos os Estados-Membros.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
