Tendo em conta o Protocolo anexado ao Tratado da União Europeia e ao Tratado que institui a Comunidade Europeia, que integra o acervo de Schengen no âmbito da União Europeia, e, nomeadamente, o n.o 2 do seu artigo 2.o,

Having regard to the Protocol annexed to the Treaty on European Union and to the Treaty establishing the European Community, integrating the Schengen acquis into the framework of the European Union, and in particular Article 2(2) thereof,

Tendo em conta o Acordo celebrado pelo Conselho da União Europeia, a República da Islândia e o Reino da Noruega relativo à associação destes Estados à execução, à aplicação e ao desenvolvimento do acervo de Schengen(1) (a seguir designado "Acordo de 18 de Maio de 1999"), assinado em 18 de Maio de 1999 e que entrou em vigor em 26 de Junho de 2000, e, nomeadamente, o n.o 4 do seu artigo 15.o,

Having regard to the Agreement concluded by the Council of the European Union, the Republic of Iceland and the Kingdom of Norway concerning the latters' association with the implementation, application, and development of the Schengen acquis(1) (hereinafter referred to as the "Agreement of 18 May 1999"), which was signed on 18 May 1999 and entered into force on 26 June 2000, and in particular Article 15(4) thereof,

Considerando o seguinte:

Whereas:

(1) A Acta Final da Convenção de Aplicação do Acordo de Schengen, assinada em 19 de Junho de 1990, e a Acta Final relativa aos Acordos de Adesão à referida Convenção do Reino da Dinamarca, da República da Finlândia e do Reino da Suécia, assinados em 19 de Dezembro de 1996 incluem no ponto 1 uma declaração comum relativa à colocação em vigor dos instrumentos em questão.

(1) Point 1 of the Final Act to the Convention Implementing the Schengen Agreement signed on 19 June 1990 and of the respective Final Acts to the Agreements on the accession, to that Convention, of the Kingdom of Denmark, the Republic of Finland and the Kingdom of Sweden, which were signed on 19 December 1996, contains a Joint Declaration on the entry into force of the instruments in question.

(2) A data em que o acervo de Schengen passará a ser aplicado na Dinamarca, na Finlândia e na Suécia, bem como na Islândia e na Noruega, (adiante designados "Estados nórdicos") deve ser fixada.

(2) The date on which the Schengen acquis will apply to Denmark, Finland and Sweden, and to Iceland and Norway (hereinafter referred to as "the Nordic States") should be fixed.

(3) A data a fixar deverá ser aplicável ao conjunto dos Estados nórdicos, para ser compatível com a União Nórdica dos Passaportes.

(3) In order to be compatible with the Nordic passport union, that date will have to apply to all the Nordic States.

(4) A preparação da presente decisão abrangeu as etapas que a seguir se descrevem. Numa primeira fase foi apresentado um questionário completo aos Estados nórdicos, cujas respostas foram registadas. Em seguida, foram efectuadas visitas de verificação e de avaliação em todos os Estados nórdicos, em conformidade com os procedimentos aplicáveis no Conselho domínio da cooperação policial e da protecção de dados. O Conselho concluiu em 29 de Maio de 2000 que estavam satisfeitas as condições nestes domínios. Tais visitas revelaram, no que se refere à aplicação do acervo de Schengen em matéria de vistos e cooperação consular e salvo determinados aspectos que os Estados nórdicos zelarão por ter em conta, que fora dada resposta satisfatória às exigências no plano legislativo e em matéria de efectivos e respectiva formação, bem como de infra-estruturas e material disponível.

(4) Preparation of this Decision comprised the following stages. Firstly, a full questionnaire was forwarded to the Nordic States, whose replies were recorded. Then, verification and evaluation visits were made to all the Nordic States in accordance with the procedures applicable within the Council, in the areas of police cooperation and data protection. On 29 May 2000 the Council concluded that the conditions in these areas had been fulfilled. As regards the application of the Schengen acquis relating to visas and consular cooperation, the visits demonstrated that, except for some points which the Nordic States will undertake to deal with, the requirements relating to legislation, manpower levels, training, infrastructure and material resources had been satisfied.

(5) Todavia, no que se refere ao Sistema de Informação Schengen (SIS), cujos trabalhos de alargamento no âmbito do projecto SIS 1+ devem ser concluídos e cuja capacidade de funcionamento em 18 países deve ser demonstrada pelas campanhas de testes, as visitas para avaliação do seu funcionamento deverão ser efectuadas antes da abolição dos controlos nas futuras fronteiras internas.

(5) However, as regards the Schengen Information System (SIS), extension of which under the SIS 1 + project should be completed with test exercises demonstrating its ability to operate in 18 countries, visits to evaluate its functioning should be carried out before controls at the future internal borders are lifted.

(6) Foram efectuadas visitas de avaliação no domínio do controlo e vigilância nas fronteiras externas. Dessas visitas resultou um balanço positivo dos programas realizados. Todavia, subsistem algumas lacunas. É, pois, necessário efectuar visitas de avaliação complementares.

(6) Evaluation visits in the context of controls and surveillance at the external borders have been carried out. They revealed that a positive record of progress achieved could be drawn up. Some gaps do, however, remain. It is therefore necessary to conduct further evaluation visits.

(7) Os Estados nórdicos notificaram o Conselho da lista das suas autoridades e instâncias competentes a que se referem o n.o 4 do artigo 101.o e o n.o 1 do artigo 108.o da Convenção de Aplicação do Acordo de Schengen, assinada em 19 de Junho de 1990. Os Estados nórdicos cumprem as obrigações do artigo 114.o da Convenção de Aplicação.

(7) The Nordic States have forwarded to the Council a list of their competent authorities referred to in Articles 101(4) and 108(1) of the Convention implementing the Schengen Agreement, signed on 19 June 1990. The Nordic States have satisfied the obligations of Article 114 of the said implementing Convention.

(8) Para verificar o bom funcionamento do SIS nos Estados nórdicos, as Secções Nacionais do Sistema de Informação Schengen (N.SIS) devem começar a funcionar de modo operacional a partir de 1 de Janeiro de 2001 (ou seja, a acessibilidade dos utilizadores finais aos dados reais na totalidade dos 15 países), antes da supressão dos controlos nas fronteiras internas.

(8) To check that the SIS is functioning correctly in the Nordic States, the national section of the Schengen Information System (N.SIS) of the Nordic States should become fully operational (i.e. final users should be able to access real data in all 15 countries) as from 1 January 2001, before the abolition of internal border controls.

(9) O Conselho deve zelar por que seja estabelecido atempadamente um sistema que defina os critérios e mecanismos de determinação do Estado responsável pela análise de um pedido de asilo apresentado num Estado-Membro, na Islândia ou na Noruega, tal como se refere no artigo 7.o do Acordo de 18 de Maio de 1999.

(9) The Council should ensure that an arrangement on criteria and mechanisms for establishing the State responsible for examining a request for asylum lodged in any of the Member States or in Iceland or Norway, as mentioned in Article 7 of the Agreement of 18 May 1999, is set up in due course.

(10) A não ser que o Conselho constate, no final das visitas de avaliação a efectuar após 1 de Janeiro de 2001, que o SIS não funciona de maneira correcta num ou mais Estados nórdicos ou que nem todos os portos e aeroportos satisfazem as condições requeridas, a aplicação do conjunto do acervo de Schengen a estes Estados terá início em 25 de Março de 2001.

(10) Unless the Council establishes, on conclusion of the evaluation visits to be carried out after 1 January 2001, that the SIS does not function correctly in one or more of the Nordic States, or that the ports and airports in those countries do not fulfil all the necessary requirements, the entire Schengen acquis will have to be applied with regard to these States as from 25 March 2001.

(11) The procedure referred to in Article 15(4) of the Agreement of 18 May 1999 has been observed,

DECIDE:

HAS DECIDED AS FOLLOWS:

Artigo 1.o

Article 1

A partir de 25 de Março de 2001 e sob reserva do n.o 2 do artigo 3.o:

As from 25 March 2001, and subject to Article 3(2):

a) Todas as disposições decorrentes do acervo de Schengen enumeradas nos anexos A, B, C e D da Decisão 1999/436/CE do Conselho, de 20 de Maio de 1999, que determina, nos termos das disposições pertinentes do Tratado que institui a Comunidade Europeia e do Tratado da União Europeia, a base jurídica de cada uma das disposições ou decisões que constituem o acervo de Schengen(2), bem como todos os actos aprovados pelo Conselho que estabeleçam um instrumento que tenha entrado em vigor e que constituam o desenvolvimento de uma ou mais destas disposições, passam a ser aplicados relativamente à Dinamarca, à Finlândia e à Suécia, nas suas relações entre si e com a Bélgica, a Alemanha, a Grécia, a Espanha, a França, a Itália, o Luxemburgo, os Países Baixos, a Áustria e Portugal;

(a) all the provisions of the Schengen acquis referred to in Annexes A, B, C and D to Council Decision 1999/436/EC of 20 May 1999 determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the Schengen acquis(2), and any act adopted by the Council establishing an instrument which has entered into force and constitutes a further development of one or more of these provisions, shall apply to Denmark, Finland and Sweden, in their relations between each other and with Belgium, Germany, Greece, Spain, France, Italy, Luxembourg, Netherlands, Austria and Portugal;

b) Todas as disposições enumeradas nos anexos A e B do Acordo, de 18 de Maio de 1999, celebrado pelo Conselho da União Europeia, a República da Islândia e o Reino da Noruega relativo à associação destes Estados à execução, à aplicação e ao desenvolvimento do acervo de Schengen, bem como todos os actos aprovados pelo Conselho que estabeleçam um instrumento que tenha entrado em vigor e constituam o desenvolvimento de uma ou mais destas disposições, passam a ser aplicados relativamente à Islândia e à Noruega, nas suas relações entre si e com a Bélgica, a Alemanha, a Grécia, a Dinamarca, a Espanha, a França, a Itália, o Luxemburgo, os Países Baixos, a Áustria, Portugal, a Finlândia e a Suécia.

(b) all the provisions referred to in Annexes A and B to the Agreement of 18 May 1999 concluded by the Council of the European Union, the Republic of Iceland and the Kingdom of Norway concerning the latters' association with the implementation, application, and development of the Schengen acquis, and any act adopted by the Council establishing an instrument which has entered into force and constitutes a further development of one or more of these provisions, shall apply to Iceland and Norway, in their relations between each other and with Belgium, Denmark, Germany, Greece, Spain, France, Italy, Luxembourg, Netherlands, Austria, Portugal, Finland and Sweden.

1. A aplicação das disposições do acervo de Schengen que incidem sobre o SIS tem início a partir de 1 de Janeiro de 2001, de acordo com os critérios definidos no artigo 1.o Para o efeito, o SIS deve ser carregado com dados reais pelos Estados nórdicos; sob reserva do n.o 3, estes Estados estarão assim em condições de explorar esses dados tal como os Estados-Membros relativamente aos quais o acervo de Schengen já é aplicado. A entrada em aplicação estabelecida no presente número não obsta à cooperação no quadro da União Nórdica dos Passaportes.

1. The provisions of the Schengen acquis relating to the SIS shall apply, according to the procedure referred to in Article 1, as from 1 January 2001. To this end, the SIS will be loaded with real data by the Nordic States which, like the Member States in respect of which the Schengen acquis has already been implemented, will be able to use such data, subject to the provisions of paragraph 3. This application shall not hinder cooperation within the Nordic passport union.

2. As disposições referidas no n.o 1 figuram no anexo.

a) Não são obrigados a recusar a entrada no seu território ou a afastar nacionais de Estados terceiros que sejam assinalados por outro Estado-Membro no SIS para efeitos de não admissão e que provenham directamente de um Estado-Membro em relação ao qual as disposições do acervo do Schengen sejam já aplicadas;

(a) shall not be obliged to refuse entry to their territory or to expel nationals of third States for whom an SIS alert has been issued by another Member State for the purposes of refusing entry and who come direct from a Member State in respect of which the Schengen acquis provisions already apply;

b) Podem admitir no seu território nacionais de Estados terceiros, assinalados por outro Estado-Membro no SIS para efeitos de não admissão, aos quais um Estado nórdico tenha decidido conceder um visto ou outro título de residência.

(b) may admit to their territory nationals of third States for whom an SIS alert has been issued by another Member State for the purposes of refusing entry, where a Nordic State has decided to grant a visa or another residence permit to such nationals;

c) Abster-se-ão de introduzir dados decorrentes do disposto no artigo 96.o da Convenção de Aplicação do Acordo de Schengen.

(c) shall refrain from entering the data covered by Article 96 of the Convention implementing the Schengen Agreement.

Artigo 3.o

Article 3

1. Durante os meses de Janeiro e Fevereiro de 2001, realizar-se-ão em todos os Estados nórdicos visitas de avaliação, em conformidade com os procedimentos aplicáveis no Conselho para esse efeito, a fim de verificar se o SIS aí funciona e é aplicado correctamente.

1. During January and February 2001, evaluation visits shall be carried out in all the Nordic States in accordance with the procedures applicable within the Council for this purpose, in order to check whether the SIS functions and is applied there correctly.

Durante o mesmo período, serão efectuadas visitas de avaliação complementares aos portos da Dinamarca e da Noruega e aos aeroportos de todos os Estados nórdicos para verificar se estes portos e aeroportos respondem às condições exigidas.

During this same period, additional evaluation visits shall be carried out at the Danish and Norwegian ports and at the airports of all the Nordic States to ascertain whether these ports and airports fulfil the necessary requirements.

Os relatórios dessas visitas serão apresentados ao Conselho antes de 1 de Março de 2001.

The reports on these visits shall be submitted to the Council by 1 March 2001.

2. Com base nos relatórios de tais visitas, o Conselho, deliberando por maioria qualificada dos seus membros representantes dos Governos dos Estados-Membros referidos no artigo 1.o do Protocolo que integra o Acervo de Schengen no âmbito da União Europeia, e com o voto de pelo menos dez desses membros, pode decidir adiar a data referida no artigo 1.o Nesse caso, o Conselho fixará uma nova data, deliberando por unanimidade dos seus membros representantes dos governos dos Estados-Membros referidos no artigo 1.o do referido Protocolo.

2. On the basis of these reports, the Council, acting by a qualified majority of its members representing the Governments of the Member States referred to in Article 1 of the Protocol integrating the Schengen acquis into the framework of the European Union, and with the vote of at least 10 of these members, may decide to defer the date mentioned in Article 1. In that case, a new date shall be set by the Council, acting by unanimity of its members representing the Governments of the Member States referred to in Article 1 of the said Protocol.

A presente decisão entra em vigor no dia da sua publicação.

This Decision shall enter into force on the date of its publication.

Statement by the Council, meeting on 30 November and 1 December 2000 in Brussels

O disposto no n.o 2 do artigo 3.o do projecto de decisão do Conselho relativa à entrada em aplicação do acervo de Schengen na Dinamarca, na Finlândia e na Suécia, bem como na Islândia e na Noruega, não implica qualquer derrogação à regra segundo a qual a entrada em aplicação do acervo de Schengen em novos Estados-Membros se realiza nas condições e datas fixadas pelo Conselho, deliberando por unanimidade dos seus membros.

The provisions of Article 3(2) of the draft Council Decision on the application of the Schengen acquis in Denmark, Finland and Sweden, and in Iceland and Norway, do not imply any derogation from the rule whereby the application of the Schengen acquis in new Member States takes place under the conditions and on the dates set by the Council acting by unanimity of its members.

Swedish declaration

A Suécia confirma a sua obrigação de aplicar o acervo de Schengen na íntegra. Para o efeito, o Governo Sueco encarregou uma comissão de inquérito de rever a actual legislação em matéria de responsabilização dos transportadores, com vista a dar cumprimento ao disposto no n.o 2 do artigo 26.o da Convenção de Schengen.

Sweden confirms its obligation to apply the entire Schengen acquis. The Swedish Government has therefore commissioned a Committee of Inquiry to review existing legislation concerning carrier liability in order to comply with the provision of Article 26.2 of the Schengen Convention.

O Governo Sueco compromete-se a apresentar ao Parlamento uma proposta, com base nas constatações da referida comissão, e define como objectivo a aprovação de nova legislação antes de Julho de 2002.

The Government undertakes to present a proposal to the Parliament based on the findings of the Committee and sets as an objective the adoption of new legislation before July 2002.

O Governo Sueco informará ainda regularmente o Conselho das suas acções a este respeito.

The Government will also regularly inform the Council about its undertakings in this regard.
