AGREEMENT

de Cooperação entre a Comunidade Europeia da Energia Atómica e o Governo do Japão no domínio da fusão termonuclear controlada

for cooperation between the European Atomic Energy Community and the Government of Japan in the field of controlled thermonuclear fusion

A COMUNIDADE EUROPEIA DA ENERGIA ATÓMICA (a seguir denominada « Euratom ») e

THE EUROPEAN ATOMIC ENERGY COMMUNITY (hereinafter referred to as 'Euratom'), and

O GOVERNO DO JAPÃO,

THE GOVERNMENT OF JAPAN,

colectivamente denominados « as Partes »,

collectively referred to as 'the Parties',

NOTANDO a cooperação existente no domínio da fusão termonuclear controlada entre as Partes e desejando manter e reforçar a cooperação nesse domínio,

NOTING the existing cooperation in the field of controlled thermonuclear fusion between the Parties, and wishing to maintain and strengthen cooperation in this field,

DESEJANDO facilitar o sucesso da energia de fusão como fonte de energia potencialmente aceitável do ponto de vista do ambiente, economicamente competitiva e virtualmente sem limites,

DESIRING to facilitate the achievement of fusion energy as a potentially environmentally acceptable, economically competitive, and virtually limitless source of energy,

RECONHECENDO a existência de pontos comuns e a complementaridade dos programas das Partes de investigação e desenvolvimento da energia de fusão,

RECOGNIZING the commonality and complementarity of the Parties' programmes in fusion energy research and development,

TENDO EM CONTA as realizações e as oportunidades de colaboração sob a égide da Agência Internacional da Energia da Organização de Cooperação e Desenvolvimento Económicos,

TAKING INTO ACCOUNT the accomplishments of, and opportunities for, collaboration under the International Energy Agency of the Organization for Economic Cooperation and Development,

ACORDAM:

HAVE AGREED AS FOLLOWS:

Artigo 1º

Article I

O objectivo do presente Acordo é manter e intensificar a cooperação entre as Partes nas áreas cobertas pelos respectivos programas de fusão, com base na igualdade e benefício mútuo, para desenvolver o entendimento científico e a competência tecnológica subjacentes a um sistema de energia de fusão.

The objective of this Agreement is to maintain and intensify cooperation between the Parties in the areas covered by their respective fusion programmes, on the basis of equality and mutual benefit, in order to develop the scientific understanding and technological capability underlying a fusion power system.

Artigo 2º

Article II

A cooperação ao abrigo do presente Acordo pode ser empreendida nas seguintes áreas:

Cooperation under this Agreement may be undertaken in the following areas:

a) Máquinas Tokamak;

(a) tokamaks;

b) Linhas alternativas às máquinas Tokamak;

(b) alternative lines to tokamaks;

c) Tecnologia da fusão;

(c) fusion technology;

d) Física dos plasmas;

(d) plasma physics; and

e) Outras áreas que possam ser mutuamente acordadas, conforme especificadas nos Anexos I, II e III, que são parte integrante do presente Acordo.

Artigo 3º

as specified in Annexes I, II and III which form an integral part of this Agreement.

A cooperação nas áreas referidas no artigo 2º pode incluir as seguintes actividades:

(d) exchange and provision of samples, materials, instruments, and components;

f) Outras actividades que possam ser mutuamente acordadas,

(e) execution of joint studies, projects or experiments; and

conforme especificadas nos Anexos I, II e III.

Artigo 4º

as specified in Annexes, I, II and III.

1. A cooperação será conduzida de acordo com os Anexos I, II e III, pela Euratom ou qualquer entidade ou organização a ela associada dentro do âmbito do programa de fusão da Euratom ou da « Joint European Torus » (JET) « Joint Undertaking », designada pela Euratom para o efeito, e pelo lado japonês pelo Monbusho, pelo Ministério do Comércio Internacional e da Indústria e pela Agência da Ciência e Tecnologia ou qualquer entidade ou organização por eles designada para o efeito.

Article IV

2. a) Os anexos continuarão em vigor enquanto este Acordo se mantiver em vigor, a não ser que lhes seja posto fim mais cedo de acordo com a alínea b) a seguir;

The cooperation shall be conducted in accordance with Annexes I, II and III, by Euratom or any entity or organization associated with it within the framework of the Euratom Fusion Programme or the Joint European Torus (JET) Joint Undertaking, designated by Euratom for this purpose, and on the Japanese side by the Monbusho, the Ministry of International Trade and Industry and the Science and Technology Agency or any entity or organization designated by them for this purpose.

b) Pode ser posto fim a cada anexo, a qualquer momento, por iniciativa de qualquer uma das Partes, mediante notificação por escrito da Parte que pretende pôr fim ao Acordo, com a antecedência de seis meses. Tal fim não deve acarretar qualquer prejuízo para os direitos que possam ter sido adquiridos ao abrigo de cada anexo até à data do seu termo;

2. (a) The Annexes shall continue in force as long as this Agreement remains in force, unless terminated earlier in accordance with subparagraph (b) below.

c) Todas as actividades que não estiverem concluídas no termo de cada anexo podem ser continuadas até à sua conclusão nos termos do anexo em causa;

(b) Each Annex may be terminated at any time at the discretion of either party, upon six months' advance notification in writing by the party seeking to terminate the Annex. Such termination shall be without prejudice to the rights that may have accrued under each Annex up to the date of its termination.

d) No caso de, durante o período em que vigora o presente Acordo, a natureza do programa de fusão de qualquer das Partes mudar substancialmente, seja por expansão, redução ou transformação substanciais, seja por combinação dos seus elementos principais com o programa de fusão de uma terceira parte, cada parte terá o direito de requerer revisões ao âmbito e aos termos dos anexos em causa. Artigo 5º

(c) All activities not completed at the expiry of each Annex may be continued until their completion under the terms of the Annex concerned.

1. As Partes estabelecerão um comité coordenador para facilitar a coordenação e a execução de actividades de cooperação ao abrigo do presente Acordo. Cada Parte designará um número igual de membros para o Comité Coordenador e nomeará um dos seus membros designados como chefe de delegação.

(d) In the event that, during the period of the Agreement, the nature of either party's fusion programme should change substantially, whether this be by substantial expansion, reduction or transformation, or by an amalgamation of major elements with the fusion programme of a third party, either party shall have the right to request revisions in the scope and terms of the Annexes concerned. Article V

2. O Comité Coordenador reunir-se-á anualmente, alternadamente na Europa e no Japão, ou em outras ocasiões e locais acordados. O chefe da delegação da Parte visitada será o presidente da reunião.

1. The Parties shall establish a Coordinating Committee to facilitate the coordination and implementation of cooperative activities under this Agreement. Each Party shall appoint an equal number of members to the Coordinating Committee and nominate one of its appointed members as the head of its delegation.

2. The Coordinating Committee shall meet annually, alternately in Europe and in Japan, or at other agreed times and places. The head of the delegation of the host Party shall chair the meeting.

O tratamento da informação, da propriedade industrial e dos direitos de autor em ligação com as actividades de cooperação ao abrigo do presente Acordo está previsto nos Anexos I, II e III. Essas disposições são idênticas em todos os anexos.

Article VI

Artigo 7º

Treatment of information, industrial property and copyright in connection with the cooperative activities under this Agreement is provided in Annexes I, II and III. These provisions are identical in all the Annexes.

Nenhuma cláusula do presente Acordo será interpretada em termos que possam prejudicar providências existentes ou futuras de cooperação entre as Partes.

Article VII

Artigo 8º

Nothing in this Agreement shall be construed to prejudice existing or future arrangements for cooperation between the Parties.

Article VIII

2. A cooperação ao abrigo do presente Acordo deve ser compatível com as disposições legislativas e regulamentares aplicáveis nos países respectivos e à Euratom.

1. Performance of the Parties under this Agreement shall be subject to the availability of appropriated funds.

3. Cada Parte envidará os seus maiores esforços, no âmbito da legislação aplicável, no sentido de facilitar o cumprimento de formalidades envolvidas com o movimento de pessoas, a importação de materiais e equipamentos e a transferência de divisas que possam ser necessários para conduzir à cooperação.

2. Cooperation under this Agreement shall be in accordance with the laws and regulations applicable in the respective countries and to Euratom.

4. As compensações por danos, incorridos durante a execução do presente Acordo, devem estar em conformidade com a legislação aplicável nos países respectivos e à Euratom.

3. Each Party shall use its best endeavours, within the framework of the applicable laws, to facilitate the accomplishment of formalities involved in the movement of persons, the import of materials and equipment and the transfer of currency, which shall be required to conduct the cooperation.

Artigo 9º

4. Compensation for damages incurred during the implementation of this Agreement shall be in accordance with the laws applicable in the respective countries and to Euratom.

Todas as questões relacionadas com o presente Acordo serão resolvidas por consultas mútuas das Partes.

Article IX

Artigo 10º

All questions related to this Agreement will be settled by mutual consultations of the Parties.

1. O presente Acordo entra em vigor na data da sua assinatura. Vigorará durante três anos e continuará em vigor a seguir a esse período, a não ser que lhe seja posto fim por qualquer uma das Partes no final do período inicial de três anos ou em qualquer altura a seguir, através da notificação por escrito da outra Parte, com a antecedência mínima de seis meses, com a intenção de pôr fim ao presente Acordo.

Article X

2. O fim do presente Acordo não afectará a realização de qualquer projecto ou programa empreendido ao abrigo do presente Acordo e não totalmente concluído na altura do fim do presente Acordo.

1. This Agreement shall enter into force on the date of signature thereof. It shall remain in force for three years and shall continue in force thereafter unless terminated by either Party at the end of the initial three-year period or at any time thereafter by giving to the other Party at least six months' written advance notice of its intention to terminate this Agreement.

3. O fim do presente Acordo ou dos seus anexos não afectará os direitos e obrigações ao abrigo do artigo 6º ou qualquer acordo feito em conformidade com o artigo 6º

2. The termination of this Agreement shall not affect the carrying-out of any project or programme undertaken under this Agreement and not fully executed at the time of termination of this Agreement.

Artigo 11º

3. The termination of this Agreement or its Annexes shall not affect rights and obligations under Article VI or any agreement made in accordance with Article VI.

1. O presente Acordo aplica-se, no que diz respeito à Euratom, aos territórios nos quais o Tratado que institui a Comunidade Europeia da Energia Atómica se aplica e nas condições estabelecidas no referido Tratado.

Article XI

2. Sempre que, no presente Acordo, forem utilizados os termos « país », « entidade », « organização » ou « nacional » com referência à Euratom, esses termos devem ser entendidos como sendo relativos aos Estados-membros da Euratom, bem como ao Reino da Suécia e à Confederação Suíça, ambos associados ao programa de fusão da Euratom e representados no JET « Joint Undertaking ».

1. This Agreement shall apply, in so far as Euratom is concerned, to the territories in which the Treaty establishing the European Atomic Energy Community is applied and under the conditions laid down in that Treaty.

Feito em Bruxelas, em 20 de Fevereiro de 1989, em duplicado, nas línguas inglesa e japonesa, fazendo ambas as versões igualmente fé.

2. Whenever in this Agreement the words 'country', 'entity', 'organization' or 'national' are used with reference to Euratom, they shall be understood to mean or to refer to the Member States of Euratom as well as to the Kingdom of Sweden and the Swiss Confederation which are both associated with the Euratom Fusion Programme and represented in the JET Joint Undertaking.
