Council Regulation (EC) No 1353/2004 of 26 July 2004 amending Regulation (EC) No 131/2004 concerning certain restrictive measures in respect of Sudan

Gelet op het Verdrag tot oprichting van de Europese Gemeenschap, en met name op de artikelen 60 en 301,

Having regard to the Treaty establishing the European Community, and in particular Articles 60 and 301 thereof,

Gelet op Gemeenschappelijk Standpunt 2004/510/GBVB van de Raad van 10 juni 2004 tot wijziging van Gemeenschappelijk Standpunt 2004/31/GBVB met betrekking tot de instelling van een embargo op wapens, munitie en militaire uitrusting ten aanzien van Sudan(1) ,

Having regard to Council Common Position 2004/510/CFSP of 10 June 2004 amending Common Position 2004/31/CFSP concerning the imposition of an embargo on arms, munitions and military equipment on Sudan(1),

Gezien het voorstel van de Commissie,

Having regard to the proposal from the Commission,

Overwegende hetgeen volgt:

Whereas:

(1) Gemeenschappelijk Standpunt 2004/31/GBVB van de Raad(2) voorziet in een embargo op wapens, munitie en militaire uitrusting voor Sudan, met inbegrip van een verbod op het leveren van technische en financiële steun die verband houdt met militaire activiteiten in Sudan. Het verbod op het leveren van technische en financiële steun die verband houdt met militaire activiteiten is op communautair niveau ten uitvoer gelegd bij Verordening (EG) nr. 131/2004 van 26 januari 2004 betreffende bepaalde restrictieve maatregelen ten aanzien van Sudan(3).

(1) Council Common Position 2004/31/CFSP(2) provides for an embargo on arms, munitions and military equipment for Sudan, including a ban on the provision of technical and financial assistance related to military activities in Sudan. The ban on the provision of technical and financial assistance related to military activities is implemented at Community level by Regulation (EC) No 131/2004 concerning certain restrictive measures in respect of Sudan(3).

(2) Gezien de recente ontwikkelingen in Sudan en de regio, met inbegrip van de ondertekening op 8 april 2004 van een humanitaire staakt-het-vuren-overeenkomst betreffende het conflict in Darfur, en gezien de geplande instelling van een door de Afrikaanse Unie geleide staakt-het-vuren-commissie in Sudan, werd Gemeenschappelijk Standpunt 2004/31/GBVB op 10 juni 2004 gewijzigd bij Gemeenschappelijk Standpunt 2004/510/GBVB, waarbij wordt voorzien in een aanvullende vrijstelling van het embargo voor crisisbeheerrsingsoperaties van de Afrikaanse Unie.

(2) In view of recent developments in Sudan and the region, including the signature on 8 April 2004 of a Humanitarian Ceasefire Agreement on the Conflict in Darfur, and in view of the planned deployment of an African Union-led Ceasefire Commission in Sudan, Common Position 2004/31/CFSP was amended by Common Position 2004/510/CFSP on 10 June 2004 by providing for an additional exemption to the embargo for crisis management operations of the African Union.

(3) Deze vrijstelling geldt ook voor het embargo op bepaalde financiële en technische bijstand. Verordening (EG) nr. 131/2004 moet bijgevolg dienovereenkomstig worden gewijzigd.

(3) That exemption also applies to the embargo on certain financial and technical assistance. Regulation (EC) No 131/2004 should therefore be amended accordingly.

(4) Teneinde ervoor te zorgen dat de vrijstelling zo spoedig mogelijk effectief wordt, dient deze Verordening onmiddellijk in werking te treden en van toepassing te zijn met ingang van de datum waarop Gemeenschappelijk Standpunt 2004/510/GBVB werd vastgesteld,

(4) In order to ensure that the exemption becomes effective as soon as possible, this Regulation should enter into force immediately and apply from the date on which Common Position 2004/510/CFSP was adopted,

HEEFT DE VOLGENDE VERORDENING VASTGESTELD:

HAS ADOPTED THIS REGULATION:

Artikel 1

Article 1

Artikel 4 van Verordening (EG) nr. 131/2004 wordt vervangen door:

Article 4 of Regulation (EC) No 131/2004 is replaced by the following:

«Artikel 4

«Article 4

1. Bij wijze van afwijking van de artikelen 2 en 3 kunnen de in de bijlage genoemde bevoegde autoriteiten van de lidstaten het verstrekken van financiering en financiële bijstand en technische bijstand in verband met het onderstaande toestaan:

1. By way of derogation from Articles 2 and 3, the competent authorities of Member States as listed in the Annex, may authorise the provision of financing and financial assistance and technical assistance related to:

a) niet-letale militaire uitrusting die uitsluitend bestemd is voor humanitair gebruik of voor beschermingsdoeleinden, of voor programma's van de Verenigde Naties, de Afrikaanse Unie, de Europese Unie of de Gemeenschap voor institutionele versterking;

(a) non-lethal military equipment intended solely for humanitarian or protective use, or for institution-building programmes of the United Nations, the African Union, the European Union and the Community;

b) materieel bedoeld voor crisisbeheerrsingsoperaties van de Europese Unie of de Verenigde Naties;

(b) materiel intended for European Union and United Nations crisis management operations;

c) ontmijningsuitrusting en materieel voor gebruik bij ontmijning;

(c) mine clearance equipment and materiel for use in mine clearance;

d) crisisbeheerrsingsoperaties van de Afrikaanse Unie, met inbegrip van materieel voor dergelijke operaties.

(d) African Union crisis management operations, including materiel intended for such operations.

2. Er worden geen vergunningen afgegeven voor activiteiten die reeds hebben plaatsgevonden.» .

2. No authorisations shall be granted for activities that have already taken place.»

Deze verordening treedt in werking op de dag van haar bekendmaking in het Publicatieblad van de Europese Unie .

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union .

Zij is van toepassing vanaf 10 juni 2004 .

It shall apply from 10 June 2004 .

Deze verordening is verbindend in al haar onderdelen en is rechtstreeks toepasselijk in elke lidstaat.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
