THE COUNCIL OF THE EUROPEAN UNION,

Gelet op het Verdrag betreffende de Europese Unie, en met name op artikel 31 en artikel 34, lid 2, onder c),

Having regard to the Treaty on European Union, and in particular Articles 31 and 34(2)(c) thereof,

Gezien het voorstel van de Commissie(1),

Having regard to the initiative from the Commission(1),

Gezien het advies van het Europees Parlement(2),

Having regard to the opinion of the European Parliament(2),

Gezien het advies van de Rekenkamer(3),

Having regard to the opinion of the Court of Auditors(3),

Overwegende hetgeen volgt:

Whereas:

(1) Eurojust is een krachtens het Verdrag betreffende de Europese Unie opgericht orgaan, dat feitelijk subsidies ten laste van de algemene begroting van de Europese Unie ontvangt. Bijgevolg moeten de uit de algemene begroting gefinancierde uitgaven van Eurojust overeenkomstig artikel 41, lid 4, van het Verdrag betreffende de Europese Unie worden beheerd volgens de procedures en voorschriften die van toepassing zijn op de algemene begroting van de Europese Unie.

(1) Eurojust is a body established under the Treaty on European Union which actually receives a subsidy charged to the general budget of the European Union. Consequently, Eurojust expenditure financed by the general budget is managed in accordance with the Community rules and procedures applicable to the general budget of the European Union in conformity with Article 41(4) of the Treaty on European Union.

(2) Sommige bepalingen van Besluit 2002/187/JBZ van de Raad van 28 februari 2002 betreffende de oprichting van Eurojust teneinde de strijd tegen ernstige vormen van criminaliteit te versterken(4), moeten derhalve in overeenstemming worden gebracht met Verordening (EG, Euratom) nr. 1605/2002 van de Raad van 25 juni 2002 houdende het Financieel Reglement van toepassing op de algemene begroting van de Europese Gemeenschappen(5) ("het algemeen Financieel Reglement").

(2) Under these conditions, certain provisions of Council Decision 2002/187/JHA of 28 February 2002 setting up Eurojust with a view to reinforcing the fight against serious crime(4) should be brought into line with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (hereinafter referred to as "the general Financial Regulation")(5).

(3) Besluit 2002/187/JBZ dient derhalve te worden gewijzigd,

BESLUIT:

HAS DECIDED AS FOLLOWS:

Artikel 1

1. Het college stelt jaarlijks, op basis van een ontwerp van de administratief directeur, een raming van de ontvangsten en uitgaven van Eurojust voor het volgende begrotingsjaar vast. Deze raming, die tevens een ontwerp-overzicht van de personeelsbezetting bevat, wordt uiterlijk op 31 maart door het college bij de Commissie ingediend.

1. Each year the College, on the basis of a draft drawn up by the Administrative Director, shall produce an estimate of revenue and expenditure for Eurojust for the following financial year. This estimate, which shall include a draft establishment plan, shall be forwarded by the College to the Commission by 31 March at the latest.

2. Op basis van die raming presenteert de Commissie, in het voorontwerp van de algemene begroting van de Europese Unie, een voorstel voor de jaarlijkse subsidie en de vaste of tijdelijke ambten, en dient dit overeenkomstig artikel 272 van het Verdrag tot oprichting van de Europese Gemeenschap bij de begrotingsautoriteit in.

2. On the basis of the estimate, the Commission shall propose in the preliminary draft general budget of the European Union the amount of the annual subsidy as well as the posts of a permanent or temporary nature and submit this proposal to the budgetary authority in accordance with Article 272 of the Treaty.

3. De begrotingsautoriteit keurt de kredieten voor de subsidie aan Eurojust goed en beslist over de vaste of tijdelijke ambten in het kader van het statuut van de ambtenaren van de Europese Gemeenschappen en de regeling met betrekking tot andere personeelsleden.

3. The budgetary authority shall authorise the appropriations for the subsidy to Eurojust and determine the posts of a permanent or temporary nature within the framework of the Staff Regulations of officials and other Servants of the European Communities.

4. Voor de aanvang van ieder begrotingsjaar stelt het college van Eurojust aan de hand van de door de begrotingsautoriteit overeenkomstig lid 3 van dit artikel goedgekeurde jaarlijkse subsidie en ambten de begroting vast, met inbegrip van het overzicht van de personeelsbezetting als omschreven in artikel 34, lid 1, derde zin, en past het deze begroting aan aan de verschillende aan Eurojust toegewezen bijdragen alsmede aan de uit andere bronnen afkomstige middelen.

4. Before the beginning of the financial year, the College of Eurojust shall adopt the budget, including the establishment plan referred to in Article 34(1), third sentence, on the basis of the annual subsidy and posts authorised by the budgetary authority in accordance with paragraph 3 of this Article, adjusting it to the various contributions granted to Eurojust and the funds from other sources.

1. De administratief directeur voert als ordonnateur de begroting van Eurojust uit. Hij licht het college in over de uitvoering van de begroting

1. The Administrative Director shall, as authorising officer, implement the Eurojust budget. He shall report to the College on the implementation of the budget.

2. Uiterlijk op 1 maart van het jaar dat volgt op het afgesloten begrotingsjaar, dient de rekenplichtige van Eurojust de voorlopige rekeningen met het verslag over het budgettair en financieel beheer van het begrotingsjaar in bij de rekenplichtige van de Commissie. De rekenplichtige van de Commissie consolideert de voorlopige rekeningen van de instellingen en de gedecentraliseerde organen overeenkomstig artikel 128 van het algemeen Financieel Reglement.

2. By 1 March at the latest following each financial year, the accounting officer of Eurojust shall communicate the provisional accounts to the Commission's accounting officer together with a report on the budgetary and financial management for that financial year. The Commission's accounting officer shall consolidate the provisional accounts of the institutions and decentralised bodies in accordance with Article 128 of the general Financial Regulation.

3. Uiterlijk op 31 maart van het jaar dat volgt op het afgesloten begrotingsjaar, dient de rekenplichtige van de Commissie de voorlopige rekeningen van Eurojust met het verslag over het budgettair en financieel beheer van het begrotingsjaar in bij de Rekenkamer. Het verslag over het budgettair en financieel beheer van het begrotingsjaar wordt ook toegezonden aan het Europees Parlement en de Raad.

3. By 31 March at the latest following each financial year, the Commission's accounting officer shall forward Eurojust's provisional accounts to the Court of Auditors, together with a report on the budgetary and financial management for that financial year. The report on the budgetary and financial management for the financial year shall also be forwarded to the European Parliament and the Council.

4. Na ontvangst van de opmerkingen van de Rekenkamer over de voorlopige rekeningen van Eurojust overeenkomstig artikel 129 van het algemeen Financieel Reglement maakt de administratief directeur onder zijn eigen verantwoordelijkheid de definitieve rekeningen van Eurojust op en legt deze voor advies voor aan het college van Eurojust.

4. On receipt of the Court of Auditors' observations on Eurojust's provisional accounts, pursuant to Article 129 of the general Financial Regulation, the Administrative Director shall draw up Eurojust's final accounts under his own responsibility and submit them to the College of Eurojust for an opinion.

5. Het college van Eurojust brengt een advies uit over de definitieve rekeningen van Eurojust.

5. The College of Eurojust shall deliver an opinion on Eurojust's final accounts.

6. Uiterlijk op 1 juli van het jaar dat volgt op het afgesloten begrotingsjaar, dient de administratief directeur de definitieve rekeningen met het advies van het college van Eurojust in bij het Europees Parlement, de Raad, de Commissie en de Rekenkamer.

6. The Administrative Director shall, by 1 July at the latest following each financial year, forward the final accounts to the European Parliament, the Council, the Commission and the Court of Auditors, together with the College of Eurojust's opinion.

7. De definitieve rekeningen worden gepubliceerd.

8. De administratief directeur dient uiterlijk op 30 september een antwoord op de opmerkingen van de Rekenkamer in bij deze instelling. Hij dient dit antwoord ook in bij het college van Eurojust.

8. The Administrative Director shall send the Court of Auditors a reply to its observations by 30 September at the latest. He shall also send this reply to the College of Eurojust.

9. De administratief directeur, die optreedt onder het gezag van het college en diens voorzitter, verstrekt het Europees Parlement op verzoek, overeenkomstig het bepaalde in artikel 146, lid 3, van het algemeen Financieel Reglement, alle inlichtingen die nodig zijn voor het goede verloop van de kwijtingsprocedure voor het betrokken begrotingsjaar.

9. The Administrative Director, acting under the authority of the College of Eurojust and its President, shall submit to the European Parliament at the latter's request any information required for the smooth application of the discharge procedure for the financial year in question, as laid down in Article 146(3) of the general Financial Regulation.

10. Vóór 30 april van het jaar n + 2 verleent het Europees Parlement op aanbeveling van de Raad, die met gekwalificeerde meerderheid van stemmen besluit, de administratief directeur van Eurojust kwijting voor de uitvoering van de begroting van het begrotingsjaar n.

10. The European Parliament, on a recommendation from the Council acting by a qualified majority, shall, before 30 April of year N + 2, give a discharge to the Administrative Director in respect of the implementation of the budget for year N.

1. De financiële regeling van toepassing op de begroting van Eurojust wordt, na raadpleging van de Commissie, door het college met eenparigheid van stemmen vastgesteld. Deze financiële regeling mag slechts van Verordening (EG, Euratom) nr. 2343/2002 van de Commissie van 19 november 2002 houdende de financiële kaderregeling van de organen, bedoeld in artikel 185 van Verordening (EG, Euratom) nr. 1605/2002 van de Raad houdende het Financieel Reglement van toepassing op de algemene begroting van de Europese Gemeenschappen(6) afwijken indien de specifieke vereisten van de taakverrichting van Eurojust dit noodzakelijk maken, en met voorafgaande instemming van de Commissie.".

1. The financial rules applicable to Eurojust's budget shall be adopted unanimously by the College after the Commission has been consulted. They may not depart from Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities(6) unless specifically required for Eurojust's operation and with the Commission's prior consent."

2. artikel 38, lid 1, wordt vervangen door:

"1. De ordonnateur is belast met het invoeren van interne controlesystemen en -procedures die zijn toegesneden op de uitvoering van zijn taken.".

Dit besluit wordt van kracht op de eerste dag van de maand volgende op die van zijn bekendmaking in het Publicatieblad van de Europese Unie.

This Decision shall enter into force on the first day of the month following that of its publication in the Official Journal of the European Union.
