IL CONSIGLIO DELL'UNIONE EUROPEA,

THE COUNCIL OF THE EUROPEAN UNION,

visto il protocollo sull'integrazione dell'acquis di Schengen nell'ambito dell'Unione europea, allegato al trattato sull'Unione europea e al trattato che istituisce la Comunità europea, in particolare l'articolo 7,

Having regard to the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and the Treaty establishing the European Community, and in particular Article 7 thereof,

considerando che:

Whereas:

(1) in virtù del suddetto protocollo, gli accordi e le norme contenenti l'acquis di Schengen sono incorporati nell'ambito dell'Unione europea;

(1) pursuant to the aforementioned Protocol, the agreements and rules containing the Schengen acquis are to be incorporated into the framework of the European Union;

(2) in virtù dell'articolo 7 di detto protocollo, compete al Consiglio, che delibera a maggioranza qualificata, adottare le modalità relative all'integrazione del segretariato di Schengen nel segretariato generale del Consiglio;

(2) pursuant to Article 7 of that Protocol, it is up to the Council, acting by a qualified majority, to adopt the detailed arrangements for the integration of the Schengen Secretariat into the General Secretariat of the Council;

(3) tale integrazione è intesa a garantire che, al momento dell'integrazione dell'acquis di Schengen nell'ambito dell'Unione europea, l'applicazione e lo sviluppo delle disposizioni relative a detto acquis continuino ad aver luogo in condizioni tali da assicurarne il buon funzionamento;

(3) the aim of this integration is to ensure that, when the Schengen acquis is integrated into the framework of the European Union, application and development of the provisions relating to the acquis continue in conditions which ensure they function properly;

(4) le modalità di tale integrazione devono consentire, da un lato, di limitare le assunzioni alle necessità di servizio che risulteranno per il segretariato generale del Consiglio dai nuovi compiti che esso dovrà svolgere e, dall'altro, di verificare la competenza, il rendimento e l'integrità delle persone assunte;

(4) the detailed arrangements for this integration should make it possible, on the one hand, to limit recruitment to the administrative needs arising for the General Secretariat of the Council from the new tasks it will have to perform and, on the other hand, to check the competence, efficiency and integrity of those recruited;

(5) il bilancio generale delle Comunità europee per l'esercizio 1999 ha previsto gli impieghi permanenti necessari, ripartiti per categoria e per grado, in seno al segretariato generale del Consiglio;

(5) the general budget of the European Communities for the financial year 1999 has made provision for the necessary permanent posts, broken down into category and grade, within the General Secretariat of the Council;

(6) l'organico così determinato è necessario e sufficiente a consentire al segretariato generale del Consiglio di rispondere efficacemente alle necessità che risulteranno dall'integrazione dell'acquis di Schengen nell'ambito dell'Unione europea;

(6) the staff complement thus determined is necessary and sufficient to enable the General Secretariat of the Council to cope efficiently with the needs arising from integration of the Schengen acquis into the framework of the European Union;

(7) occorre adottare, in deroga allo statuto dei funzionari delle Comunità europee, in seguito denominato "Statuto", le disposizioni necessarie per consentire all'autorità che ha il potere di nomina (AIPN) di nominare le persone interessate funzionari in prova delle Comunità europee presso il segretariato generale del Consiglio, con effetto alla data di entrata in vigore del trattato di Amsterdam;

(7) it is necessary, by way of derogation from the Staff Regulations of Officials of the European Communities, hereafter referred to as "the Staff Regulations", to adopt the arrangements necessary to enable the Appointing Authority (IAA) to appoint those concerned as probationer officials of the European Communities at the General Secretariat of the Council, with the appointments taking effect from the date of entry into force of the Treaty of Amsterdam;

(8) occorre subordinare tale nomina al rispetto, da parte di ciascuna delle persone interessate, di taluni requisiti; che occorre parimenti subordinare tale nomina alla presentazione dei documenti giustificativi attestanti che la persona in questione era impiegata a vario titolo presso il segretariato di Schengen alla data della firma del trattato di Amsterdam (2 ottobre 1997), vale a dire alla data di adozione della decisione di principio di procedere a tale integrazione; che vi era ancora impiegata alla data di entrata in vigore del trattato di Amsterdam (1o maggio 1999) e che vi esercitava effettivamente funzioni, connesse all'applicazione e allo sviluppo dell'acquis di Schengen, di assistenza alla presidenza e alle delegazioni, di gestione delle questioni finanziarie e di bilancio, di traduzione e/o d'interpretazione, di documentazione o di segreteria, ad esclusione dei compiti di supporto tecnico o amministrativo, funzioni per le quali le necessità di servizio non richiedono assunzioni supplementari presso il segretariato generale del Consiglio;

(8) such appointments should be subject to compliance by each of those concerned with certain conditions; such appointments should also be subject to the provision of supporting documents proving that those concerned were employed in various capacities at the Schengen Secretariat on the date on which the Treaty of Amsterdam was signed (2 October 1997), i.e. the date on which it was decided in principle to carry out that integration; and proving that those concerned were still employed there on the date of entry into force of the Treaty of Amsterdam (1 May 1999) and were actually performing duties involved in applying and developing the Schengen acquis, assisting the Presidency and delegations, managing financial and budget matters, translating and/or interpreting, documentation or secretarial work, with the exception of technical or administrative duties for which the administrative needs do not require additional recruitment to the General Secretariat of the Council;

(9) occorre inoltre assicurarsi, prima della nomina in qualità di funzionario in prova, che le persone interessate forniscano i documenti giustificativi, diplomi, titoli o certificati attestanti che esse dispongono del livello di qualifica o di esperienza richiesto per esercitare le funzioni corrispondenti alla categoria o al quadro in cui devono essere integrate;

(9) it is also necessary to ensure, before those concerned are appointed as probationer officials, that they provide all supporting or other documents, diplomas, qualifications or certificates, which prove that they have the level of qualification or experience required to perform the duties involved in the category or service into which they are to be integrated;

(10) occorre parimenti prevedere che le persone assunte debbano, ai sensi delle disposizioni dell'articolo 34 dello statuto, compiere un periodo di prova destinato a verificarne la capacità di espletare in modo soddisfacente le loro funzioni e che le decisioni che l'AIPN dovrà prendere al termine di tale tirocinio siano prese previo parere di un comitato ad hoc designato da quest'ultima, in cui il comitato del personale del segretariato generale del Consiglio potrà essere rappresentato,

(10) it is also necessary to specify that those recruited will, in accordance with Article 34 of the Staff Regulations, be obliged to serve a probationary period designed to check their ability to perform their duties satisfactorily, and that any decisions taken by the AA following the probationary period will be taken after consulting an ad hoc Committee appointed by the AA on which the Staff Committee of the General Secretariat of the Council may be represented,

HA ADOTTATO LA PRESENTE DECISIONE:

HAS ADOPTED THIS DECISION:

Articolo 1

Article 1

1. La presente decisione è intesa a stabilire le modalità d'integrazione del segretariato di Schengen nel segretariato generale del Consiglio.

1. The aim of this Decision is to determine the detailed arrangements for the integration of the Schengen Secretariat into the General Secretariat of the Council.

2. Ai fini della presente decisione, il segretariato di Schengen si intende costituito dalle persone che soddisfano le condizioni di cui all'articolo 3, paragrafo 1, lettera e).

2. For the purposes of this Decision, the Schengen Secretariat is defined as consisting of persons fulfilling the conditions laid down by Article 3(1)(e).

Articolo 2

Article 2

In deroga allo statuto dei funzionari delle Comunità europee, in seguito denominato "Statuto", e fatta salva la verifica del rispetto delle condizioni di cui all'articolo 3 della presente decisione, l'autorità che ha il potere di nomina (AIPN), ai sensi dell'articolo 2 dello statuto, può nominare presso il segretariato generale del Consiglio le persone di cui all'articolo 1 della presente decisione in qualità di funzionari in prova delle Comunità europee in virtù dello statuto e assegnarle ad uno degli impieghi figuranti a tal fine nella tabella dell'organico del segretariato generale del Consiglio per l'esercizio 1999, nella categoria, nel quadro, nel grado e nello scatto determinati conformemente alla tabella di equivalenza figurante nell'allegato.

By way of derogation from the Staff Regulations and subject to a check on compliance with the conditions specified in Article 3 of this Decision, the Appointing Authority (AA) within the meaning of Article 2 of the Staff Regulations may appoint to the General Secretariat of the Council the persons referred to in Article 1 of this Decision as probationer officials of the European Communities within the meaning of the Staff Regulations and allocate them to one of the posts included to that end in the staff complement of the General Secretariat of the Council for the 1999 financial year in the category, service, grade and step determined in accordance with the correlation table annexed hereto.

L'AIPN può procedere alle nomine previste all'articolo 2 dopo aver verificato che le persone in questione:

The AA may make the appointments provided for in Article 2 after checking that the persons concerned:

a) sono cittadini di uno degli Stati membri;

(a) are nationals of one of the Member States;

b) sono in regola con le leggi applicabili in materia di obblighi militari;

(b) have fulfilled any obligations concerning statutory military service;

c) offrono le garanzie di moralità richieste per le funzioni da svolgere;

(c) produce the necessary character references for the performance of their duties;

d) soddisfano le condizioni di idoneità fisica richieste per l'esercizio di tali funzioni;

(d) are physically fit to perform such duties;

e) forniscono i documenti giustificativi attestanti che:

(e) provide the supporting documents proving that:

i) esse erano impiegate presso il segretariato di Schengen alla data del 2 ottobre 1997, o in qualità di membro del Collegio dei Segretari generali del Benelux messo a disposizione del segretariato di Schengen, o in qualità di agente legato da un contratto di lavoro all'Unione economica Benelux, o in qualità di agente statutario del segretariato del Benelux messo a disposizione del segretariato di Schengen e vi esercitavano effettivamente un'attività;

(i) they were employed at the Schengen Secretariat on 2 October 1997 either as a member of the Benelux College of Secretaries-General incorporated into the Schengen Secretariat, or as a member of staff having an employment contract with the Benelux Economic Union, or as a statutory member of staff of the Benelux Secretariat incorporated into the Schengen Secretariat and were actually performing duties there,

ii) erano ancora impiegate presso il segretariato di Schengen alla data del 1o maggio 1999, e

(ii) they were still employed at the Schengen Secretariat on 1 May 1999, and

iii) esercitavano effettivamente presso il segretariato di Schengen, alle date di cui ai punti i) e ii), funzioni connesse all'applicazione e allo sviluppo dell'acquis di Schengen, di assistenza alla presidenza e alle delegazioni, di gestione delle questioni finanziarie e di bilancio, di traduzione e/o d'interpretazione, di documentazione o di segreteria, ad esclusione dei compiti di supporto tecnico o amministrativo;

(iii) they were actually performing duties at the Schengen Secretariat on the dates referred to in (i) and (ii), involved in applying and developing the Schengen acquis, assisting the Presidency and delegations, managing financial and budget matters, translating and/or interpreting, documentation or secretarial work, with the exception of technical or administrative backup duties;

f) forniscono i documenti giustificativi, diplomi, titoli o certificati attestanti che esse dispongono del livello di qualifica o di esperienza richiesto per esercitare le funzioni corrispondenti alla categoria o al quadro in cui devono essere integrate.

(f) provide all supporting or other documents, diplomas, qualifications or certificates proving that they have the level of qualification or experience required to perform the duties in the category or service into which they are to be integrated.

Articolo 4

Article 4

1. Le persone nominate in base all'articolo 3 della presente decisione devono, ai sensi delle disposizioni dell'articolo 34 dello statuto nonché del presente articolo, compiere un periodo di prova destinato a verificarne la capacità di espletare in modo soddisfacente i compiti corrispondenti alle rispettive funzioni nonché il rendimento e il comportamento in servizio.

1. The persons appointed on the basis of Article 3 of this Decision will be obliged, in accordance with the provisions of Article 34 of the Staff Regulations and of this Article, to serve a probationary period designed to check their ability to perform the duties satisfactorily pertaining to their posts and also their efficiency and conduct in the service.

2. I funzionari in prova che non abbiano dimostrato qualità professionali sufficienti per essere nominati in ruolo sono licenziati.

2. Any probationer officials who do not demonstrate sufficient professional skills to be appointed permanently shall be dismissed.

3. Le decisioni dell'AIPN allo scadere del periodo di prova sono prese previa consultazione di un comitato ad hoc designato dall'AIPN stessa, in cui il comitato del personale del segretariato generale del Consiglio può nominare un rappresentante. Il parere di tale comitato ad hoc lascia impregiudicato il ruolo del comitato dei rapporti di cui all'articolo 34 dello statuto.

3. Any decisions to be taken by the AA following the probationary period shall be taken after consulting an ad hoc Committee appointed by the AA to which the Staff Committee of the General Secretariat of the Council may delegate a representative. The opinion of this ad hoc committee shall be without prejudice to the role of the Reports Committee provided for by Article 34 of the Staff Regulations.

La presente decisione entra in vigore il giorno dell'adozione.

This Decision shall enter into force on the date of its adoption.

Essa è applicabile a partire dal 1o maggio 1999.
