LA COMMISSIONE DELLE COMUNITÀ EUROPEE,

Having regard to the Treaty establishing the European Community,

visto il regolamento (CE) n. 1258/1999 del Consiglio, del 17 maggio 1999, relativo al finanziamento della politica agricola comune [1], in particolare l'articolo 7, paragrafo 4,

Having regard to Council Regulation (EC) No 1258/1999 of 17 May 1999 on the financing of the common agricultural policy [1], and in particular Article 7(4) thereof,

Having regard to Council Regulation (EC) No 1290/2005 of 21 June 2005 on the financing of the common agricultural policy [2], and in particular Article 31 thereof,

previa consultazione del comitato dei Fondi agricoli,

Having consulted the Committee on the Agricultural Funds,

considerando quanto segue:

Whereas:

(1) A norma dell'articolo 7, paragrafo 4, del regolamento (CE) n. 1258/1999 e dell'articolo 31 del regolamento (CE) n. 1290/2005, la Commissione deve effettuare le necessarie verifiche, comunicare agli Stati membri i risultati di dette verifiche, prendere atto delle osservazioni degli Stati membri, avviare consultazioni bilaterali per cercare di raggiungere un accordo con gli Stati membri interessati e notificare formalmente a questi ultimi le proprie conclusioni.

(1) Under Article 7(4) of Regulation (EC) No 1258/1999, and Article 31 of Regulation (EC) No 1290/2005, the Commission is to carry out the necessary verifications, communicate to the Member States the results of these verifications, take note of the comments of the Member States, initiate a bilateral discussion so that an agreement may be reached with the Member States in question, and formally communicate its conclusions to them.

(2) Gli Stati membri hanno avuto la possibilità di chiedere l'avvio di una procedura di conciliazione. In certi casi si sono avvalsi di tale possibilità e la relazione redatta a conclusione di tale procedura è stata esaminata dalla Commissione.

(2) The Member States have had an opportunity to request the launch of a conciliation procedure. That opportunity has been used in some cases and the report issued on the outcome has been examined by the Commission.

(3) Ai sensi del regolamento (CE) n. 1258/1999 e del regolamento (CE) n. 1290/2005, possono essere finanziate unicamente le spese agricole eseguite in conformità alle norme comunitarie.

(3) Under Regulation (EC) No 1258/1999 and Regulation (EC) No 1290/2005, only agricultural expenditure which has been incurred in a way that has not infringed Community rules may be financed.

(4) In base alle verifiche effettuate, all'esito delle discussioni bilaterali e alle procedure di conciliazione, una parte delle spese dichiarate dagli Stati membri non soddisfa tale requisito e non può pertanto essere finanziata dal FEAOG, sezione "garanzia", e dal Fondo europeo agricolo di garanzia (di seguito "FEAGA").

(4) In the light of the verifications carried out, the outcome of the bilateral discussions and the conciliation procedures, part of the expenditure declared by the Member States does not fulfil this requirement and cannot, therefore, be financed under the EAGGF Guarantee Section and the European Agricultural Guarantee Fund, hereinafter referred to as EAGF.

(5) Occorre indicare gli importi non riconosciuti imputabili al FEAOG, sezione "garanzia", e al FEAGA. Tali importi non riguardano spese eseguite anteriormente ai ventiquattro mesi che precedono la comunicazione scritta, da parte della Commissione agli Stati membri interessati, dei risultati delle verifiche.

(5) The amounts that are not recognised as being chargeable to the EAGGF Guarantee Section and the EAGF should be indicated. Those amounts do not relate to expenditure incurred more than twenty-four months before the Commission's written notification of the results of the verifications to the Member States.

(6) Per i casi di cui alla presente decisione, la Commissione ha comunicato agli Stati membri in una relazione di sintesi la valutazione degli importi da escludere per mancata conformità alle norme comunitarie.

(6) As regards the cases covered by this Decision, the assessment of the amounts to be excluded on grounds of non-compliance with Community rules was notified by the Commission to the Member States in a summary report on the subject.

(7) La presente decisione lascia impregiudicate le conseguenze finanziarie che la Commissione potrebbe trarre dalle sentenze della Corte di giustizia in cause pendenti alla data del 15 dicembre 2007 e riguardanti materie in essa trattate,

(7) This Decision is without prejudice to any financial conclusions that the Commission may draw from the judgments of the Court of Justice in cases pending on 15 December 2007 and relating to its content,

HA ADOTTATO LA PRESENTE DECISIONE:

Le spese riportate nell'allegato della presente decisione, sostenute dagli organismi pagatori riconosciuti dagli Stati membri e dichiarate a titolo del FEAOG, sezione "garanzia", o del FEAGA, sono escluse dal finanziamento comunitario per mancata conformità alle norme comunitarie.

The expenditure itemised in the Annex hereto that has been incurred by the Member States' accredited paying agencies and declared under the EAGGF Guarantee Section or under the EAGF shall be excluded from Community financing because it does not comply with Community rules.
