J'ai l'honneur de me référer aux négociations menées entre nos délégations respectives en vue de l'élaboration des dispositions relatives à l'importation dans la Communauté économique européenne de viande de mouton, d'agneau et de chèvre ainsi que des ovins et caprins vivants autres que reproducteurs de race pure en provenance de la République socialiste tchécoslovaque, conjointement à la mise en oeuvre par la Communauté de la réglementation portant organisation commune des marchés dans le secteur des viandes ovine et caprine.

I have the honour to refer to the negotiations undertaken between our respective delegations for the purpose of drawing up provisions concerning imports into the European Economic Community from Czechoslovakia of mutton, lamb and goatmeat, and of live sheep and goats other than pure-bred breeding animals, in connection with implementation by the Community of the common organization of the market in sheepmeat and goatmeat.

Au cours de ces négociations, les délégations des deux parties, qui sont des participants à l'accord général sur les tarifs douaniers et le commerce (GATT), sont convenues de ce qui suit:

- les viandes fraîches ou réfrigérées de mouton, d'agneau et de chèvre [sous-position 02.01 A IV a) du tarif douanier commun],

- fresh or chilled mutton, lamb and goatmeat (subheading 02.01 A IV a) of the Common Customs Tariff),
|
|
- les viandes congelées de mouton, d'agneau et de chèvre [sous-position 02.01 A IV b) du tarif douanier commun].
|
- frozen mutton, lamb and goatmeat (subheading 02.01 A IV b) of the Common Customs Tariff).
|
|
|
|
|
2. Dans le cadre du présent arrangement, les autorités compétentes tchécoslovaques s'engagent à assurer que les exportations vers la Communauté des produits visés au point 1 ne dépassent pas la quantité annuelle de 800 tonnes de viandes fraîches ou réfrigérées, exprimées en poids carcasse avec os [1].

2. Within the terms of this Arrangement, the competent Czechoslovak authorities undertake to ensure that exports to the Community of the products referred to in point 1 do not exceed an annual quantity of 800 tonnes of fresh or chilled meat, expressed as carcase weight bone-in [1].

[1] Carcase weight (bone-in equivalent weight). This shall be taken to mean the weight of bone-in meat presented as such as well as boned meat converted by a coefficient into bone-in weight. 3. Provided that Czechoslovak exports do not exceed the quantity given in point 2 the Community will not apply any quantitative restriction or measure having equivalent effect.

Should the Community invoke the protective clause, the provisions of this Arrangement would not be affected.

4. Si les importations en provenance de Tchécoslovaquie dépassent la quantité convenue, la Communauté se réserve le droit de suspendre les importations ultérieures en provenance de ce pays jusqu'à la fin de l'année en cours. Toutefois, en tout état de cause, les quantités qui dépassent la quantité convenue pour l'année en cours seront imputées sur la quantité convenue pour l'année suivante.

4. If imports from Czechoslovakia exceed the agreed quantity, the Community reserves the right to suspend further imports from that country until the end of

|
5. The Community undertakes, in respect of imports of products covered by this Arrangement, to restrict the charges levied to a maximum ad valorem level of 10 % for meat and for live animals.
|
|
5. La Communauté s'engage, lors de l'importation de produits couverts par le présent arrangement, à limiter la perception des prélèvements à un montant maximal de 10 % ad valorem pour les viandes et pour les animaux vivants.

|
|
The Community will not charge, apart from the levies set out above, customs duties or charges having equivalent effect to levies or to customs duties.
|
|
La Communauté s'abstiendra de percevoir, en dehors des prélèvements convenus ci-dessus, des droits de douane ou d'autres taxes d'effet équivalant à des prélèvements ou à des droits de douane.

6. When a new Member State accedes to the Community and if the pattern of trade between Czechoslovakia and such Member State justifies it, the Community shall agree to consultations between the two parties with a view to possible adaptation of the quantity given in point 2.
|
|

Lors de l'adhésion d'un nouvel État membre à la Communauté, et si les échanges commerciaux de la Tchécoslovaquie avec cet État membre le justifient, la Communauté accepte que les deux parties procèdent entre elles à des consultations en vue d'adapter éventuellement la quantité figurant au point 2.

The quantity given in point 2 shall not be reduced.

|
The charges applicable to imports for the said new Member States shall be fixed in accordance with the rules in the treaty of accession, the maximim level of the levy specified in point 5 of this Arrangement being taken into account.

Les charges applicables aux importations pour ces nouveaux États membres seront fixées conformément aux règles du traité d'adhésion, le niveau de limitation du prélèvement spécifié au point 5 du présent arrangement étant pris en considération.

7. The competent Czechoslovak authorities shall ensure compliance with the terms of this Arrangement, in particular by means of the issue, by a Czechoslovak body designated for the purpose, of export licences covering the products listed in point 1, within the limits of the quantities agreed.

Les autorités compétentes tchécoslovaques veillent à ce que le présent arrangement soit observé, notamment grâce à la délivrance, par un organisme tchécoslovaque désigné à la délivrance, par un organisme tchécoslovaque désigné à cet effet, de certificats d'exportation applicables aux produits visés au point 1, dans les limites des quantités convenues.

For its part the Community undertakes to adopt all the necessary measures to ensure that the automatic issue of an import licence for the abovementioned products originating in Czechoslovakia shall be subject to production of an export licence issued by the competent Czechoslovak authority.
|

Pour sa part, la Communauté s'engage, en ce qui concerne les produits susmentionnés originaires de Tchécoslovaquie, à arrêter toutes dispositions nécessaires pour subordonner la délivrance automatique d'un certificat d'importation à la présentation d'un certificat d'exportation délivré par l'organisme compétent tchécoslovaque.

Detailed rules for the implementation of this system will be drawn up in such a way that there is no requirement for a security for issue of import licences in respect of the products in question. These rules shall also provide that the competent Czechoslovak authorities and the competent Community authorities shall undertake periodical exchanges of information on the quantities in respect of which export and import licences have been issued, broken down, as appropriate, according to destination.

Les modalités d'application de ce régime seront établies de manière à rendre inutile la constitution d'une caution pour la délivrance des certificats d'importation concernant les produits en question. Elles prévoiront également que les autorités compétentes tchécoslovaques et les autorités compétentes de la Communauté se communiqueront périodiquement les informations portant sur les quantités pour lesquelles des certificats d'exportation et d'importation auront été délivrés, ventilées le cas échéant selon la destination.

|
It is hereby agreed that export licences will be valid for a period of three months from their date of issue. The corresponding import licences shall be valid until the date on which validity of the export licences expires.
|
|
Il est convenu que les certificats d'exportation auront une validité de trois mois à partir de la date de leur délivrance. Les certificats d'importation correspondants seront valables jusqu'à la date d'expiration de la validité des certificats d'exportation.

|
Quantities delivered under an export licence shall be deducted from the quantity agreed for the year during which the export licence was issued.
|

Les quantités livrées au titre d'un certificat d'exportation seront imputées sur la quantité convenue pour l'année pendant laquelle le certificat d'exportation a été délivré.

8. The two parties agree that steps should be taken to ensure that the smooth operation of this Arrangement is not disturbed by deliveries of sheepmeat and goatmeat products falling under tariff headings not covered by this Arrangement.
|

8. Les deux parties conviennent qu'il y a lieu d'éviter que la bonne application du présent arrangement ne soit affectée par des livraisons de produits à base de viande ovine et caprine sous des positions douanières non visées par cet arrangement.

9. In order to ensure the smooth operation of this Arrangement, the two parties agree to remain in close contact and to be ready to undertake consultations on any question which might arise in the course of application of this Arrangement. The said consultations must be commenced within a maximum period of 14 days following request by one of the parties.
|
|

Afin d'assurer le bon fonctionnement du présent arrangement, les deux parties conviennent de rester en contact étroit et de procéder à des consultations qui pourront porter sur toutes les questions susceptibles de se poser dans l'application de cet arrangement. Ces consultations s'ouvriront dans un délai maximal de quatorze jours à la demande de l'une des parties.

10. The provisions of this Arrangement shall be accepted without prejudice to the rights and obligations of the parties under GATT.
|

10. Les dispositions du présent arrangement sont acceptées sans préjudice des droits et obligations qu'ont les parties dans le cadre du GATT.

11. The annual quantity fixed in point 2 shall cover the period 1 January to 31 December.
|
|
11. La quantité annuelle fixée au point 2 se rapporte à la période s'étendant du 1er janvier au 31 décembre.

|
|
The quantity applicable from 1 January 1984 to 31 March 1984 shall be fixed, by means of the consultations referred to in point 9, in proportion to the overall annual quantity.

La quantité applicable à partir du 1er janvier 1984 jusqu'au 31 mars 1984 sera fixée, dans le cadre des consultations visées au point 9, au prorata de la quantité annuelle globale.
|
12. This Arrangement shall apply, on the one hand, to the territories in which the Treaty establishing the European Economic Community is applied, under the conditions laid down in that Treaty, and, on the other hand, to the territory of the Czechoslovak Socialist Republic.
|
|
12. Le présent arrangement s'applique aux territoires où le traité instituant la Communauté économique européenne est d'application, dans les conditions prévues par ledit traité, d'un côté, et au territoire de la République socialiste tchécoslovaque, de l'autre côté.
|
13. This Arrangement shall enter into force on 1 January 1982. It shall apply until 31 March 1984 and, subsequently, for periods of two years, subject to the right of either of the parties to terminate it by giving notice in writing six months before the date of expiry of any one of the said periods. In the case of termination, the Arrangement shall come to an end at the date of expiry of the period in question. In any event, the provisions of this Arrangement shall be reviewed by the two parties during the six months preceding 1 April 1984, so that any adaptations which might be necessary can be made to it.

13. Le présent arrangement entre en vigueur le 1er janvier 1982. Il sera applicable jusqu'au 31 mars 1984 et ensuite pendant des périodes de deux ans, sous réserve du droit de chacune des deux parties de le dénoncer par notification écrite remise six mois avant la date d'expiration de l'une quelconque de ces périodes. En cas de dénonciation, il prendra fin à la date d'expiration de la période considérée. En tout état de cause, les dispositions du présent arrangement feront l'objet d'un examen par les deux parties pendant les six mois précédant le 1er avril 1984, pour que les adaptations éventuellement nécessaires y soient apportées.

12. Le présent arrangement s'applique aux territoires où le traité instituant la Communauté économique européenne est d'application, dans les conditions prévues par ledit traité, d'un côté, et au territoire de la République socialiste tchécoslovaque, de l'autre côté.

13. This Arrangement shall enter into force on 1 January 1982. It shall apply until 31 March 1984 and, subsequently, for periods of two years, subject to the right of either of the parties to terminate it by giving notice in writing six months before the date of expiry of any one of the said periods. In the case of termination, the Arrangement shall come to an end at the date of expiry of the period in question. In any event, the provisions of this Arrangement shall be reviewed by the two parties during the six months preceding 1 April 1984, so that any adaptations which might be necessary can be made to it.

13. Le présent arrangement entre en vigueur le 1er janvier 1982. Il sera applicable jusqu'au 31 mars 1984 et ensuite pendant des périodes de deux ans, sous réserve du droit de chacune des deux parties de le dénoncer par notification écrite remise six mois avant la date d'expiration de l'une quelconque de ces périodes. En cas de dénonciation, il prendra fin à la date d'expiration de la période considérée. En tout état de cause, les dispositions du présent arrangement feront l'objet d'un examen par les deux parties pendant les six mois précédant le 1er avril 1984, pour que les adaptations éventuellement nécessaires y soient apportées.
