vu le protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne, annexé au traité sur l'Union européenne et au traité instituant la Communauté européenne, et notamment son article 7,

Having regard to the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and the Treaty establishing the European Community, and in particular Article 7 thereof,
|
|
considérant ce qui suit:
|
Whereas:
|
|
(1) en vertu du protocole susvisé, les accords et règles contenant l'acquis de Schengen sont incorporés dans le cadre de l'Union européenne;
|
(1) pursuant to the aforementioned Protocol, the agreements and rules containing the Schengen acquis are to be incorporated into the framework of the European Union;
|
|
(2) en vertu de l'article 7 dudit protocole, il appartient au Conseil, statuant à la majorité qualifiée, d'adopter les modalités d'intégration du secrétariat de Schengen au secrétariat général du Conseil;
|
(2) pursuant to Article 7 of that Protocol, it is up to the Council, acting by a qualified majority, to adopt the detailed arrangements for the integration of the Schengen Secretariat into the General Secretariat of the Council;
|
|
(3) cette intégration a pour but d'assurer que, lors de l'intégration de l'acquis de Schengen dans le cadre de l'Union européenne, l'application et le développement des dispositions relatives à cet acquis continuent à se dérouler dans des conditions qui en assurent le bon fonctionnement;
|
(3) the aim of this integration is to ensure that, when the Schengen acquis is integrated into the framework of the European Union, application and development of the provisions relating to the acquis continue in conditions which ensure they function properly;
|
|
(4) les modalités de cette intégration doivent permettre, d'une part, de limiter les recrutements aux nécessités de service qui résulteront pour le secrétariat général du Conseil des nouvelles tâches qu'il devra assurer et, d'autre part, de vérifier les qualités de compétence, de rendement et d'intégrité des personnes recrutées;

(4) the detailed arrangements for this integration should make it possible, on the one hand, to limit recruitment to the administrative needs arising for the General Secretariat of the Council from the new tasks it will have to perform and, on the other hand, to check the competence, efficiency and integrity of those recruited;
|
|
(5) le budget général des Communautés européennes pour l'exercice 1999 a prévu les emplois permanents nécessaires, ventilés par catégorie et par grade, au sein du secrétariat général du Conseil;
|
(5) the general budget of the European Communities for the financial year 1999 has made provision for the necessary permanent posts, broken down into category and grade, within the General Secretariat of the Council;
|
|
(6) les effectifs ainsi déterminés sont nécessaires et suffisants pour permettre au secrétariat général du Conseil de répondre d'une façon efficace aux besoins qui découleront de l'intégration de l'acquis de Schengen dans le cadre de l'Union européenne;
|
(6) the staff complement thus determined is necessary and sufficient to enable the General Secretariat of the Council to cope efficiently with the needs arising from integration of the Schengen acquis into the framework of the European Union;
|
|
(7) il convient d'adopter, par dérogation au statut des fonctionnaires des Communautés européennes, ci-après dénommé "statut", les dispositions nécessaires pour permettre à l'autorité investie du pouvoir de nomination (AIPN) de nommer les personnes concernées en qualité de fonctionnaires stagiaires des Communautés européennes au secrétariat général du Conseil, ces nominations devant prendre effet à la date d'entrée en vigueur du traité d'Amsterdam;

(7) it is necessary, by way of derogation from the Staff Regulations of Officials of the European Communities, hereafter referred to as "the Staff Regulations", to adopt the arrangements necessary to enable the Appointing Authority (IAA) to appoint those concerned as probationer officials of the European Communities at the General Secretariat of the Council, with the appointments taking effect from the date of entry into force of the Treaty of Amsterdam;
|

(8) il convient de soumettre cette nomination au respect, par chaque personne concernée, de certaines conditions; il convient également de soumettre cette nomination à la fourniture des pièces justificatives prouvant que la personne en cause était employée à divers titres au secrétariat de Schengen à la date de la signature du traité d'Amsterdam (2 octobre 1997), à savoir la date à laquelle la décision de principe d'effectuer cette intégration a été arrêtée; qu'elle y était encore employée à la date d'entrée en vigueur du traité d'Amsterdam (1er mai 1999) et qu'elle y exerçait effectivement des fonctions, liées à l'application et au développement de l'acquis de Schengen, d'assistance à la présidence et aux délégations, de gestion des affaires financières et budgétaires, de traduction et/ou d'interprétation, de documentation ou de secrétariat, à l'exclusion des tâches de support technique ou administratif, fonctions pour lesquelles les nécessités de service n'imposent pas de recrutement supplémentaire au secrétariat général du Conseil;

(8) such appointments should be subject to compliance by each of those concerned with certain conditions; such appointments should also be subject to the provision of supporting documents proving that those concerned were employed in various capacities at the Schengen Secretariat on the date on which the Treaty of Amsterdam was signed (2 October 1997), i.e. the date on which it was decided in principle to carry out that integration; and proving that those concerned were still employed there on the date of entry into force of the Treaty of Amsterdam (1 May 1999) and were actually performing duties involved in applying and developing the Schengen acquis, assisting the Presidency and delegations, managing financial and budget matters, translating and/or interpreting, documentation or secretarial work, with the exception of technical or administrative duties for which the administrative needs do not require additional recruitment to the General Secretariat of the Council;

(9) il convient en outre, de s'assurer, avant leur nomination en qualité de fonctionnaire stagiaire, que les personnes concernées fournissent tout document ou pièce justificative, diplôme, titre ou certificat, établissant qu'elles disposent du niveau de qualification ou d'expérience requis pour exercer les fonctions correspondant à la catégorie ou au cadre dans lequel elles doivent être intégrées;

(9) it is also necessary to ensure, before those concerned are appointed as probationer officials, that they provide all supporting or other documents, diplomas, qualifications or certificates, which prove that they have the level of qualification or experience required to perform the duties involved in the category or service into which they are to be integrated;
|

(10) il convient également de prévoir que les personnes recrutées auront l'obligation, conformément aux dispositions de l'article 34 du statut, d'effectuer un stage destiné à vérifier leurs aptitudes à s'acquitter d'une façon satisfaisante de leurs fonctions et que les décisions à prendre par l'AIPN à l'issue de ce stage seront prises après avis d'un comité ad hoc désigné par celle-ci et dans lequel le comité du personnel du secrétariat général du Conseil pourra être représenté,

(10) it is also necessary to specify that those recruited will, in accordance with Article 34 of the Staff Regulations, be obliged to serve a probationary period designed to check their ability to perform their duties satisfactorily, and that any decisions taken by the AA following the probationary period will be taken after consulting an ad hoc Committee appointed by the AA on which the Staff Committee of the General Secretariat of the Council may be represented,

1. La présente décision a pour objet de fixer les modalités de l'intégration du secrétariat de Schengen au secrétariat général du Conseil.

1. The aim of this Decision is to determine the detailed arrangements for the integration of the Schengen Secretariat into the General Secretariat of the Council.
|
|
2. Aux fins de la présente décision, le secrétariat de Schengen est défini comme constitué par les personnes qui remplissent les conditions prévues à l'article 3, paragraphe 1, point e).
|
2. For the purposes of this Decision, the Schengen Secretariat is defined as consisting of persons fulfilling the conditions laid down by Article 3(1)(e).

Par dérogation au statut, et sous réserve de la vérification du respect des conditions fixées à l'article 3 de la présente décision, AIPN, au sens de l'article 2 du statut peut nommer au secrétariat général du Conseil les personnes visées à l'article 1er de la présente décision en qualité de fonctionnaires stagiaires des Communautés européennes au sens du statut et les affecter à l'un des emplois figurant à cet effet au tableau des effectifs du secrétariat général du Conseil pour l'exercice 1999, à la catégorie, dans le cadre, au grade et à l'échelon déterminés conformément au tableau d'équivalence qui figure en annexe.

By way of derogation from the Staff Regulations and subject to a check on compliance with the conditions specified in Article 3 of this Decision, the Appointing Authority (AA) within the meaning of Article 2 of the Staff Regulations may appoint to the General Secretariat of the Council the persons referred to in Article 1 of this Decision as probationer officials of the European Communities within the meaning of the Staff Regulations and allocate them to one of the posts included to that end in the staff complement of the General Secretariat of the Council for the 1999 financial year in the category, service, grade and step determined in accordance with the correlation table annexed hereto.

L'AIPN peut procéder aux nominations prévues à l'article 2 après avoir vérifié que les personnes en cause:

The AA may make the appointments provided for in Article 2 after checking that the persons concerned:
|
|
a) sont ressortissantes d'un des États membres;
|
(a) are nationals of one of the Member States;
|
|
b) se trouvent en position régulière au regard des lois de recrutement qui leur sont applicables en matière militaire;
|
(b) have fulfilled any obligations concerning statutory military service;
|
|
c) offrent les garanties de moralité requises pour l'exercice de leurs fonctions;
|
(c) produce the necessary character references for the performance of their duties;
|
|
d) remplissent les conditions d'aptitude physique requises pour l'exercice de ces fonctions;
|
(d) are physically fit to perform such duties;
|
|
e) fournissent les pièces justificatives prouvant:
|
(e) provide the supporting documents proving that:
|
|
i) qu'elles étaient employées au secrétariat de Schengen à la date du 2 octobre 1997 soit en tant que membre du Collège des secrétaires généraux du Benelux en situation de mise à disposition du secrétariat de Schengen, soit en tant qu'agent lié par un contrat de travail à l'Union économique Benelux, soit en tant qu'agent statutaire du secrétariat du Benelux en situation de mise à disposition du secrétariat de Schengen et y exerçaient une activité effective;
|
(i) they were employed at the Schengen Secretariat on 2 October 1997 either as a member of the Benelux College of Secretaries-General incorporated into the Schengen Secretariat, or as a member of staff having an employment contract with the Benelux Economic Union, or as a statutory member of staff of the Benelux Secretariat incorporated into the Schengen Secretariat and were actually performing duties there,

ii) qu'elles étaient encore employées au secrétariat de Schengen à la date du 1er mai 1999

(ii) they were still employed at the Schengen Secretariat on 1 May 1999, and
|
|
et
|
(iii) they were actually performing duties at the Schengen Secretariat on the dates referred to in (i) and (ii), involved in applying and developing the Schengen acquis, assisting the Presidency and delegations, managing financial and budget matters, translating and/or interpreting, documentation or secretarial work, with the exception of technical or administrative backup duties;

iii) qu'elles exerçaient effectivement au secrétariat de Schengen, aux dates visées aux points i) et ii) des fonctions liées à l'application et au développement de l'acquis de Schengen, d'assistance à la présidence et aux délégations, de gestion des affaires financières et budgétaires, de traduction et/ou d'interprétation, de documentation ou de secrétariat, à l'exclusion des tâches de support technique ou administratif;
|
(f) provide all supporting or other documents, diplomas, qualifications or certificates proving that they have the level of qualification or experience required to perform the duties in the category or service into which they are to be integrated.
|

f) fournissent tout document ou pièce justificative, diplôme, titre ou certificat, établissant qu'elles disposent du niveau de qualification ou d'expérience requis pour exercer les fonctions correspondant à la catégorie ou au cadre dans lequel elles doivent être intégrées.

1. The persons appointed on the basis of Article 3 of this Decision will be obliged, in accordance with the provisions of Article 34 of the Staff Regulations and of this Article, to serve a probationary period designed to check their ability to perform the duties satisfactorily pertaining to their posts and also their efficiency and conduct in the service.
|

Les personnes nommées sur la base de l'article 3 de la présente décision auront l'obligation, conformément aux dispositions de l'article 34 du statut ainsi que des dispositions du présent article, d'effectuer un stage destiné à vérifier leurs aptitudes à s'acquitter d'une façon satisfaisante des attributions que comportent leurs fonctions, ainsi que leur rendement et leur conduite dans le service.

2. Any probationer officials who do not demonstrate sufficient professional skills to be appointed permanently shall be dismissed.
|

2. Les fonctionnaires stagiaires qui n'auront pas fait preuve des qualités professionnelles suffisantes pour être titularisés seront licenciés.
|
3. Any decisions to be taken by the AA following the probationary period shall be taken after consulting an ad hoc Committee appointed by the AA to which the Staff Committee of the General Secretariat of the Council may delegate a representative. The opinion of this ad hoc committee shall be without prejudice to the role of the Reports Committee provided for by Article 34 of the Staff Regulations.

3. Les décisions à prendre par l'AIPN à l'issue du stage le seront après avis d'un comité ad hoc désigné par l'AIPN et dans lequel le comité du personnel du secrétariat général du Conseil pourra déléguer un représentant. L'avis de ce comité ad hoc est sans préjudice du rôle du comité des rapports prévu à l'article 34 du statut.
