hereinafter referred to as the "Parties",

considérant ce qui suit:

Whereas:

(1) L'Union européenne (l'Union) peut décider d'entreprendre une action dans le domaine de la gestion de crises.

(1) The European Union may decide to take action in the field of crisis management.

(2) L'Union décidera si des États tiers seront invités à participer à une opération de gestion de crise menée par l'Union. La République de Bulgarie peut accepter l'invitation de l'Union et présenter une offre de contribution. En pareil cas, l'Union se prononcera sur l'acceptation de la contribution proposée par la République de Bulgarie.

(2) The European Union will decide whether third states will be invited to participate in an EU crisis management operation. The Republic of Bulgaria may accept the invitation by the European Union and offer its contribution. In such case, the European Union will decide on the acceptance of the proposed contribution of the Republic of Bulgaria.

(3) Si l'Union décide d'entreprendre une opération militaire de gestion de crise en ayant recours aux moyens et capacités de l'OTAN, la République de Bulgarie peut exprimer son intention de principe de participer à l'opération.

(3) If the European Union decides to undertake a military crisis management operation with recourse to NATO assets and capabilities, the Republic of Bulgaria may express its intention in principle of taking part in the operation.

(4) Lors de sa réunion à Bruxelles, les 24 et 25 octobre 2002, le Conseil européen est convenu des modalités de mise en œuvre des dispositions sur la participation des membres européens de l'OTAN non membres de l'Union à la gestion des crises menée par l'Union, qui ont été adoptées par le Conseil européen réuni à Nice du 7 au 9 décembre 2000.

(4) The European Council at Brussels on 24 and 25 October 2002 has agreed modalities for implementation of the provisions agreed by the Nice European Council on 7 to 9 December 2000 on the involvement of the non-EU European NATO members in EU-led crisis management.

(5) Les conditions relatives à la participation de la République de Bulgarie aux opérations de gestion de crises menées par l'Union ne devraient pas être définies cas par cas pour chaque opération concernée, mais fixées dans un accord établissant le cadre d'une telle participation future éventuelle.

(5) Conditions regarding the participation of the Republic of Bulgaria in EU crisis management operations should be laid down in an Agreement establishing a framework for such possible future participation, rather than defining these conditions on a case-by-case basis for each operation concerned.

(6) Cet accord devrait s'entendre sans préjudice de l'autonomie décisionnelle de l'Union et ne pas préjuger du fait que la République de Bulgarie prendra cas par cas la décision de participer à une opération de gestion de crise menée par l'Union.

(6) Such an Agreement should be without prejudice to the decision-making autonomy of the European Union, and should not prejudge the case-by-case nature of the decisions of the Republic of Bulgaria to participate in an EU crisis management operation.

(7) Cet accord ne devrait porter que sur les opérations futures de gestion de crises qui seront menées par l'Union et devrait s'entendre sans préjudice d'éventuels accords existants régissant la participation de la République de Bulgarie à une opération de gestion de crise de l'Union qui a déjà été déployée,

(7) Such an Agreement should only address future EU crisis management operations and should be without prejudice to possible existing agreements regulating the participation of the Republic of Bulgaria in an already deployed EU crisis management operation,

SECTION I

DISPOSITIONS GÉNÉRALES

1. À la suite de la décision prise par l'Union d'inviter la République de Bulgarie à participer à une opération de gestion de crise menée par l'Union, et une fois que ce pays aura décidé d'y participer, la République de Bulgarie fournit des informations sur la contribution qu'elle propose d'apporter à l'Union.

1. Following the decision of the European Union to invite the Republic of Bulgaria to participate in an EU crisis management operation, and once the Republic of Bulgaria has decided to participate, the Republic of Bulgaria shall provide information on its proposed contribution to the European Union.

2. Au cas où l'Union a décidé d'entreprendre une opération militaire de gestion de crise en ayant recours aux moyens et capacités de l'OTAN, la République de Bulgarie informe l'Union de son intention éventuelle de participer à l'opération et fournit des informations sur la contribution qu'elle envisage d'apporter à l'Union européenne.

2. Where the European Union has decided to undertake a military crisis management operation with recourse to NATO assets and capabilities, the Republic of Bulgaria will inform the European Union of any intention to participate in the operation, and subsequently provide information on any proposed contribution.

3. L'évaluation, par l'Union, de la contribution proposée par la République de Bulgarie est menée en consultation avec ce pays.

3. The assessment by the European Union of the Republic of Bulgaria's contribution shall be conducted in consultation with the Republic of Bulgaria.

4. L'Union fournira le plus tôt possible à la République de Bulgarie une première indication de la contribution probable aux coûts communs de l'opération afin d'aider la République de Bulgarie à formuler son offre.

4. The European Union will provide the Republic of Bulgaria with an early indication of the likely contribution to the common costs of the operation as soon as possible with a view to assisting the Republic of Bulgaria in the formulation of its offer.

5. L'Union informe par courrier la République de Bulgarie des résultats de l'évaluation, en vue de s'assurer de sa participation conformément aux dispositions du présent accord.

5. The European Union shall communicate the outcome of the assessment to the Republic of Bulgaria by letter with a view to securing the participation of the Republic of Bulgaria in accordance with the provisions of this Agreement.

Article 2

Cadre

Framework

1. La République de Bulgarie souscrit à l'action commune en vertu de laquelle le Conseil de l'Union européenne décide que l'Union mènera l'opération de gestion de crise, ainsi qu'à toute action commune ou décision en vertu de laquelle le Conseil de l'Union européenne décide de prolonger l'opération de gestion de crise menée par l'Union conformément aux dispositions du présent accord et aux modalités de mise en œuvre s'avérant nécessaires.

1. The Republic of Bulgaria shall associate itself with the Joint Action by which the Council of the European Union decides that the EU will conduct the crisis management operation, and with any Joint Action or Decision by which the Council of the European Union decides to extend the EU crisis management operation, in accordance with the provisions of this Agreement and any required implementing arrangements.

2. La contribution de la République de Bulgarie à une opération de gestion de crise menée par l'Union s'entend sans préjudice de l'autonomie décisionnelle de l'Union.

2. The contribution of the Republic of Bulgaria to an EU crisis management operation is without prejudice to the decision-making autonomy of the European Union.

Article 3

Statut du personnel et des forces

Status of personnel and forces

1. Le statut du personnel que la République de Bulgarie détaché dans le cadre d'une opération civile de gestion de crise menée par l'Union et/ou des forces que la République de Bulgarie met à la disposition d'une opération militaire de gestion de crise menée par l'Union est régi par l'accord sur le statut des forces/de la mission, s'il est disponible, conclu entre l'Union et l'État (ou les États) dans le(s)quel(s) l'opération est menée.

1. The status of personnel seconded to an EU civilian crisis management operation and/or of the forces contributed to an EU military crisis management operation by the Republic of Bulgaria shall be governed by the agreement on the status of forces/mission, if available, concluded between the European Union and the State(s) in which the operation is conducted.

2. Le statut du personnel détaché auprès du quartier général ou des éléments de commandement situés en dehors de l'État (ou des États) dans le(s)quel(s) se déroule l'opération de gestion de crise menée par l'Union est régi par des accords entre, d'une part, le quartier général et les éléments de commandement concernés et, d'autre part, la République de Bulgarie.

2. The status of personnel contributed to headquarters or command elements located outside the State(s) in which the EU crisis management operation takes place shall be governed by arrangements between the headquarters and command elements concerned and the Republic of Bulgaria.

3. Sans préjudice de l'accord sur le statut des forces/de la mission visé au paragraphe 1, le personnel de la République de Bulgarie participant à l'opération de gestion de crise menée par l'Union relève de la juridiction de ce pays.

3. Without prejudice to the agreement on the status of forces/mission referred to in paragraph 1, the Republic of Bulgaria shall exercise jurisdiction over its personnel participating in the EU crisis management operation.

4. Il appartient à la République de Bulgarie de répondre à toute plainte liée à la participation d'un de ses agents à une opération de gestion de crise menée par l'Union, qu'elle émane de l'un de ses agents ou qu'elle le concerne. Il appartient à la République de Bulgarie d'intenter toute action, notamment juridique ou disciplinaire, contre l'un de ses agents.

4. The Republic of Bulgaria shall be responsible for answering any claims linked to participation in an EU crisis management operation from or concerning any of its personnel. The Republic of Bulgaria shall be responsible for bringing any action, in particular legal or disciplinary, against any of its personnel.

5. La République de Bulgarie s'engage à faire une déclaration en ce qui concerne la renonciation aux demandes d'indemnités à l'encontre de tout État participant à une opération de gestion de crise menée par l'Union à laquelle la République de Bulgarie participe, et à le faire lors de la signature du présent accord. Un modèle de déclaration figure à l'annexe du présent accord.

5. The Republic of Bulgaria undertakes to make a declaration as regards the waiver of claims against any State participating in an EU crisis management operation in which the Republic of Bulgaria participates, and to do so when signing this Agreement. A model for such a declaration is annexed to this Agreement.

6. L'Union s'engage à veiller à ce que les États membres fassent une déclaration en ce qui concerne la renonciation aux demandes d'indemnités, pour toute participation future de la République de Bulgarie à une opération de gestion de crise menée par l'Union, et à le faire lors de la signature du présent accord. Un modèle de déclaration figure à l'annexe du présent accord.

6. The European Union undertakes to ensure that Member States make a declaration as regards the waiver of claims, for any future participation of the Republic of Bulgaria in an EU crisis management operation, and to do so when signing this Agreement. A model for such a declaration is annexed to this Agreement.

Article 4

Informations classifiées

1. La République de Bulgarie prend les mesures nécessaires pour faire en sorte que les informations classifiées de l'Union soient protégées conformément au règlement de sécurité du Conseil de l'Union européenne, ainsi qu'aux autres instructions formulées par les autorités compétentes, y compris le commandant de l'opération de l'Union s'il s'agit d'une opération militaire de gestion de crise menée par l'Union, ou le chef de mission de l'Union s'il s'agit d'une opération civile de gestion de crise menée par l'Union.

1. The Republic of Bulgaria shall take appropriate measures to ensure that EU classified information is protected in accordance with the European Union Council's security regulations, and in accordance with further guidance issued by competent authorities, including the EU Operation Commander concerning an EU military crisis management operation or by the EU Head of Mission concerning an EU civilian crisis management operation.

2. Au cas où l'Union et la République de Bulgarie ont conclu un accord sur les procédures de sécurité pour l'échange d'informations classifiées, les dispositions de cet accord s'appliquent dans le cadre d'une opération de gestion de crise menée par l'Union.

2. Where the EU and the Republic of Bulgaria have concluded an agreement on security procedures for the exchange of classified information, the provisions of such an agreement shall apply in the context of an EU crisis management operation.

SECTION II

DISPOSITIONS RELATIVES À LA PARTICIPATION À DES OPÉRATIONS CIVILES DE GESTION DE CRISES

PROVISIONS ON PARTICIPATION IN CIVILIAN CRISIS MANAGEMENT OPERATIONS

Article 5

Personnel détaché dans le cadre d'une opération civile de gestion de crise menée par l'Union

Personnel seconded to an EU civilian crisis management operation

1. La République de Bulgarie veille à ce que son personnel détaché dans le cadre de l'opération civile de gestion de crise menée par l'Union exécute sa mission conformément:

1. The Republic of Bulgaria shall ensure that its personnel seconded to an EU civilian crisis management operation undertake their mission in conformity with:

- à l'action commune et à ses modifications ultérieures visées à l'article 2, paragraphe 1, du présent accord,

- the Joint Action and subsequent amendments as referred to in Article 2(1) of this Agreement;

- au plan d'opération,

- the Operation Plan;

- aux mesures de mise en œuvre.

- implementing measures.

2. La République de Bulgarie informe en temps voulu le chef de mission de l'opération civile de gestion de crise menée par l'Union ainsi que le secrétariat général du Conseil de l'Union européenne de toute modification apportée à sa contribution à ladite opération.

2. The Republic of Bulgaria shall inform in due time the EU civilian crisis management operation Head of Mission and the General-Secretariat of the Council of the European Union of any change to its contribution to the EU civilian crisis management operation.

3. Le personnel détaché dans le cadre de l'opération civile de gestion de crise menée par l'Union se soumet à un examen médical, est vacciné et reçoit d'une autorité compétente bulgare un certificat médical attestant son aptitude au service. Le personnel détaché dans le cadre de l'opération civile de gestion de crise menée par l'Union fournit un exemplaire de ce certificat.

3. Personnel seconded to the EU civilian crisis management operation shall undergo a medical examination, vaccination and be certified medically fit for duty by a competent authority from the Republic of Bulgaria. Personnel seconded to the EU civilian crisis management operation shall produce a copy of this certification.

Article 6

1. Le personnel détaché par la République de Bulgarie doit s'acquitter de ses fonctions et régler sa conduite en ayant uniquement en vue les intérêts de l'opération civile de gestion de crise menée par l'Union.

1. Personnel seconded by the Republic of Bulgaria shall carry out their duties and conduct themselves solely with the interests of the EU civilian crisis management operation in mind.

2. Tous les membres du personnel restent entièrement sous le commandement de leurs autorités nationales.

2. All personnel shall remain under the full command of their national authorities.

3. Les autorités nationales transfèrent le contrôle opérationnel au chef de mission de l'opération civile de gestion de crise menée par l'Union, qui exerce le commandement via une structure hiérarchique de commandement et de contrôle.

3. National authorities shall transfer operational control to the EU civilian crisis management operation Head of Mission, who shall exercise that command through a hierarchical structure of command and control.

4. Le chef de mission dirige l'opération civile de gestion de crise menée par l'Union et en assure la gestion quotidienne.

4. The Head of Mission shall lead the EU civilian crisis management operation and assume its day-to-day management.

5. La République de Bulgarie a les mêmes droits et obligations en termes de gestion quotidienne de l'opération que les États membres de l'Union qui y participent, conformément aux instruments juridiques visés à l'article 2, paragraphe 1, du présent accord.

5. The Republic of Bulgaria shall have the same rights and obligations in terms of day-to-day management of the operation as EU Member States taking part in the operation, in accordance with the legal instruments referred to in Article 2(1) of this Agreement.

6. Le chef de mission de l'opération civile de gestion de crise menée par l'Union est responsable des questions de discipline touchant le personnel. Les mesures disciplinaires éventuelles sont du ressort de l'autorité nationale concernée.

6. The EU civilian crisis management operation Head of Mission shall be responsible for disciplinary control over EU civilian crisis management operation personnel. Where required, disciplinary action shall be taken by the national authority concerned.

7. La République de Bulgarie désigne un point de contact des contingents nationaux (PCN) pour représenter son contingent national au sein de l'opération. Le PCN rend compte au chef de mission de l'opération civile de gestion de crise menée par l'Union sur des questions nationales et est responsable au quotidien de la discipline au sein du contingent.

7. A National Contingent Point of Contact (NPC) shall be appointed by the Republic of Bulgaria to represent its national contingent in the operation. The NPC shall report to the EU civilian crisis management operation Head of Mission on national matters and shall be responsible for day-to-day contingent discipline.

8. L'Union prend la décision de mettre fin à l'opération après consultation de la République de Bulgarie, pour autant que ce pays apporte toujours une contribution à l'opération civile de gestion de crise menée par l'Union à la date à laquelle celle-ci prend fin.

8. The decision to end the operation shall be taken by the European Union, following consultation with the Republic of Bulgaria, provided that the Republic of Bulgaria is still contributing to the EU civilian crisis management operation at the date of termination of the operation.

Article 7

Aspects financiers

Financial aspects

1. La République de Bulgarie assume tous les coûts liés à sa participation à l'opération, à l'exception de ceux qui font l'objet d'un financement commun, tel qu'il ressort du budget opérationnel de l'opération. Cette disposition est sans préjudice de l'article 8.

1. The Republic of Bulgaria shall assume all the costs associated with its participation in the operation apart from the costs, which are subject to common funding, as set out in the operational budget of the operation. This shall be without prejudice to Article 8.

2. En cas de décès, de blessure, de perte ou de dommage causés à des personnes physiques ou morales de l'État (ou des États) dans le(s)quel(s) l'opération est menée, la République de Bulgarie verse des indemnités, lorsque sa responsabilité a été établie, selon les conditions prévues dans l'accord sur le statut de la mission, s'il est disponible, visé à l'article 3, paragraphe 1, du présent accord.

2. In case of death, injury, loss or damage to natural or legal persons from the State(s) in which the operation is conducted, the Republic of Bulgaria shall, when its liability has been established, pay compensation under the conditions foreseen in the agreement on the status of mission, if available, as referred to in Article 3(1) of this Agreement.

Article 8

Contribution au budget opérationnel

1. La République de Bulgarie contribue au financement du budget opérationnel de l'opération civile de gestion de crise menée par l'Union.

1. The Republic of Bulgaria shall contribute to the financing of the operational budget of the EU civilian crisis management operation.

2. La contribution financière de la République de Bulgarie au budget opérationnel est égale au plus faible des deux montants suivants:

2. The financial contribution of the Republic of Bulgaria to the operational budget shall be the lower amount of the following two alternatives:

a) le montant de référence multiplié par le ratio entre son revenu national brut (RNB) et le total des revenus nationaux bruts (RNB) de tous les États contribuant au budget opérationnel de l'opération, ou

(a) that share of the reference amount which is in proportion to the ratio of its gross national income (GNI) to the total of the GNIs of all States contributing to the operational budget of the operation; or

b) le montant de référence pour le budget opérationnel multiplié par le ratio entre ses effectifs participant à l'opération et le total des effectifs engagés par tous les États participant à l'opération.

(b) that share of the reference amount for the operational budget which is in proportion to the ratio of the number of its personnel participating in the operation to the total number of personnel of all States participating in the operation.

3. Nonobstant les paragraphes 1 et 2, la République de Bulgarie ne contribue pas au financement des indemnités journalières versées au personnel des États membres de l'Union.

3. Notwithstanding paragraphs 1 and 2, the Republic of Bulgaria shall not make any contribution towards the financing of per diem allowances paid to personnel of the European Union Member States.

4. Nonobstant le paragraphe 1, l'Union dispense en principe les États tiers de contribuer financièrement à une opération civile donnée de gestion de crise menée par l'Union lorsque:

4. Notwithstanding paragraph 1, the European Union shall, in principle, exempt third States from financial contributions to a particular EU civilian crisis management operation when:

a) l'Union décide que l'État tiers participant à l'opération fournit une contribution substantielle qui est essentielle à l'opération, ou

(a) the European Union decides that the third State participating in the operation provides a significant contribution which is essential for this operation; or

b) l'État tiers participant à l'opération a un RNB par habitant ne dépassant aucun de ceux des États membres de l'Union.

(b) the third State participating in the operation has a GNI per capita which does not exceed that of any Member State of the European Union.

5. Un accord sur les modalités pratiques du paiement est signé entre le chef de mission de l'opération civile de gestion de crise menée par l'Union et les services administratifs compétents bulgares concernant les contributions de la République de Bulgarie au budget opérationnel de l'opération civile de gestion de crise menée par l'Union. Cet accord comporte notamment des dispositions concernant:

An arrangement on the practical modalities of the payment shall be signed between the EU civilian crisis management operation Head of Mission and the relevant administrative services of the Republic of Bulgaria on the contributions of the Republic of Bulgaria to the operational budget of the EU civilian crisis management operation. This arrangement shall, inter alia, include the following provisions:

(a) the amount concerned;

(b) the arrangements for payment of the financial contribution;

c) la procédure de vérification.

SECTION III

DISPOSITIONS RELATIVES À LA PARTICIPATION À DES OPÉRATIONS MILITAIRES DE GESTION DE CRISES

PROVISIONS ON PARTICIPATION IN MILITARY CRISIS MANAGEMENT OPERATIONS

Article 9

Participation à l'opération militaire de gestion de crise menée par l'Union

Participation in the EU military crisis management operation

1. La République de Bulgarie veille à ce que les membres de ses forces et de son personnel participant à l'opération militaire de gestion de crise menée par l'Union exécutent leur mission conformément:

1. The Republic of Bulgaria shall ensure that its forces and personnel participating in the EU military crisis management operation undertake their mission in conformity with:

- à l'action commune et à ses modifications ultérieures visées à l'article 2, paragraphe 1, du présent accord,

- the Joint Action and subsequent amendments as referred to in Article 2(1) of this Agreement;

- au plan d'opération,

- the Operation Plan;

- aux mesures de mise en œuvre.

2. Le personnel détaché par la République de Bulgarie doit s'acquitter de ses fonctions et régler sa conduite en ayant uniquement en vue l'intérêt de l'opération militaire de gestion de crise menée par l'Union.

2. Personnel seconded by the Republic of Bulgaria shall carry out their duties and conduct themselves solely with the interest of the EU military crisis management operation in mind.

3. La République de Bulgarie informe en temps voulu le commandant de l'opération de l'Union de toute modification apportée à sa contribution à ladite opération.

3. The Republic of Bulgaria shall inform the EU Operation Commander in due time of any change to its participation in the operation.

Article 10

Chaîne de commandement

Chain of command

1. Tous les membres des forces et du personnel participant à l'opération militaire de gestion de crise menée par l'Union restent entièrement sous le commandement de leurs autorités nationales.

1. All forces and personnel participating in the EU military crisis management operation shall remain under the full command of their national authorities.

2. Les autorités nationales transfèrent le commandement et/ou le contrôle opérationnel et tactique de leurs forces et de leur personnel au commandant de l'opération de l'Union. Celui-ci est habilité à déléguer son autorité.

2. National authorities shall transfer the Operational and Tactical command and/or control of their forces and personnel to the EU Operation Commander. The EU Operation Commander is entitled to delegate his authority.

3. La République de Bulgarie a les mêmes droits et obligations en termes de gestion quotidienne de l'opération que les États membres de l'Union qui y participent.

3. The Republic of Bulgaria shall have the same rights and obligations in terms of the day-to-day management of the operation as participating European Union Member States.

4. Le commandant de l'opération de l'Union peut à tout moment demander le retrait de la contribution apportée par la République de Bulgarie après consultation de ce pays.

4. The EU Operation Commander may, following consultations with the Republic of Bulgaria, at any time request the withdrawal of the Republic of Bulgaria's contribution.

5. La République de Bulgarie désigne un haut représentant militaire (HRM) pour représenter son contingent national au sein de l'opération militaire de gestion de crise menée par l'Union. Le HRM consulte le commandant de la force de l'Union sur toute question liée à l'opération et est responsable au quotidien de la discipline au sein du contingent.

5. A Senior Military Representative (SMR) shall be appointed by the Republic of Bulgaria to represent its national contingent in the EU military crisis management operation. The SMR shall consult with the EU Force Commander on all matters affecting the operation and shall be responsible for day-to-day contingent discipline.

Article 11

Aspects financiers

Financial aspects

1. Sans préjudice de l'article 12, la République de Bulgarie assume tous les coûts liés à sa participation à l'opération, à moins que les coûts ne fassent l'objet d'un financement commun prévu par les instruments juridiques visés à l'article 2, paragraphe 1, du présent accord, ainsi que par la décision 2004/197/PESC du Conseil du 23 février 2004 créant un mécanisme de gestion du financement des coûts communs des opérations de l'Union européenne ayant des implications militaires ou dans le domaine de la défense [1].

1. Without prejudice to Article 12, the Republic of Bulgaria shall assume all the costs associated with its participation in the operation unless the costs are subject to common funding as provided for in the legal instruments referred to in Article 2(1) of this Agreement, as well as in Council Decision 2004/197/CFSP of 23 February 2004 establishing a mechanism to administer the financing of the common costs of EU operations having military or defence implications [1].

2. En cas de décès, de blessure, de perte ou de dommage causés à des personnes physiques ou morales de l'État (ou des États) dans le(s)quel(s) l'opération est menée, la République de Bulgarie verse des indemnités, lorsque sa responsabilité a été établie, selon les conditions prévues dans l'accord sur le statut des forces, s'il est disponible, visé à l'article 3, paragraphe 1, du présent accord.

2. In case of death, injury, loss or damage to natural or legal persons from the State(s) in which the operation is conducted, the Republic of Bulgaria shall, when its liability has been established, pay compensation under the conditions foreseen in the agreement on the status of forces, if available, as referred to in Article 3(1) of this Agreement.

Article 12

Contribution aux coûts communs

1. La République de Bulgarie contribue au financement des coûts communs de l'opération militaire de gestion de crise menée par l'Union.

1. The Republic of Bulgaria shall contribute to the financing of the common costs of the EU military crisis management operation.

2. The financial contribution of the Republic of Bulgaria to the common costs shall be the lower amount of the following two alternatives:

a) le montant de référence pour les coûts communs multiplié par le ratio entre son RNB et le total des RNB de tous les États contribuant aux coûts communs de l'opération, ou

(a) that share of the reference amount for the common costs which is in proportion to the ratio of its GNI to the total of the GNIs of all States contributing to the common costs of the operation; or

b) le montant de référence pour les coûts communs multiplié par le ratio entre ses effectifs participant à l'opération et le total des effectifs engagés par tous les États participant à l'opération.

(b) that share of the reference amount for the common costs which is in proportion to the ratio of the number of its personnel participating in the operation to the total number of personnel of all States participating in the operation.

Lors du calcul du montant visé au paragraphe 2, point b), au cas où la République de Bulgarie ne détache du personnel qu'auprès du centre de commandement de l'opération ou de la force, le ratio utilisé est obtenu en rapportant les effectifs de cet État aux effectifs totaux des centres de commandement respectifs. Si tel n'est pas le cas, le ratio utilisé est obtenu en rapportant tous les effectifs détachés par la République de Bulgarie aux effectifs totaux affectés à l'opération.

In calculating 2(b), where the Republic of Bulgaria contributes personnel only to the Operation or Force Headquarters, the ratio used shall be that of its personnel to that of the total number of the respective headquarters personnel. Otherwise, the ratio shall be that of all personnel contributed by the Republic of Bulgaria to that of the total personnel of the operation.

3. Nonobstant le paragraphe 1, l'Union dispense en principe les États tiers de contribuer financièrement aux coûts communs d'une opération militaire donnée de gestion de crise menée par l'Union lorsque:

3. Notwithstanding paragraph 1, the European Union shall, in principle, exempt third States from financial contributions to the common costs of a particular EU military crisis management operation when:

a) l'Union décide que l'État tiers participant à l'opération fournit une contribution substantielle à des moyens et/ou capacités qui sont essentiels à l'opération, ou

(a) the European Union decides that the third State participating in the operation provides a significant contribution to assets and/or capabilities which are essential for this operation; or

b) l'État tiers participant à l'opération a un RNB par habitant ne dépassant aucun de ceux des États membres de l'Union.

(b) the third State participating in the operation has a GNI per capita which does not exceed that of any Member State of the European Union.

4. Un accord est conclu entre, d'une part, l'administrateur prévu par la décision 2004/197/PESC et, d'autre part, les autorités administratives compétentes bulgares. Cet accord comporte notamment des dispositions concernant:

An arrangement shall be concluded between the Administrator provided for in Council Decision 2004/197/CFSP of 23 February 2004 establishing a mechanism to administer the financing of the common costs of EU operations having military or defence implications, and the competent administrative authorities of the Republic of Bulgaria. This arrangement shall include inter alia provisions on:

Article 13

Modalités de mise en œuvre de l'accord

Arrangements to implement the Agreement

Sans préjudice des dispositions de l'article 8, paragraphe 5, et de l'article 12, paragraphe 4, le secrétaire général du Conseil de l'Union européenne, haut représentant pour la politique étrangère et de sécurité commune, et les autorités pertinentes bulgares arrêtent les modalités techniques et administratives nécessaires aux fins de l'application du présent accord.

Without prejudice to the provisions of Articles 8(5) and 12(4), any necessary technical and administrative arrangements in pursuance of the implementation of this Agreement shall be concluded between the Secretary-General of the Council of the European Union, High Representative for the Common Foreign and Security Policy, and the appropriate authorities of the Republic of Bulgaria.

Article 14

Manquement aux obligations

Si l'une des parties ne respecte pas les obligations qui lui incombent en vertu des articles qui précèdent, l'autre partie a le droit de résilier le présent accord moyennant un préavis d'un mois.

Should one of the Parties fail to comply with its obligations laid down in the previous Articles, the other Party shall have the right to terminate this Agreement by serving a notice of one month.

Article 15

Règlement des différends

Dispute settlement

Les différends portant sur l'interprétation ou l'application du présent accord sont réglés entre les parties par la voie diplomatique.

Disputes concerning the interpretation or application of this Agreement shall be settled by diplomatic means between the Parties.

Article 16

Entrée en vigueur

Entry into force

1. Le présent accord entre en vigueur le premier jour du premier mois suivant la date à laquelle les parties se sont notifié mutuellement l'accomplissement des procédures internes nécessaires à cet effet.

1. This Agreement shall enter into force on the first day of the first month after the Parties have notified each other of the completion of the internal procedures necessary for this purpose.

2. Le présent accord s'applique à titre provisoire à compter de la date de sa signature.

2. This Agreement shall be provisionally applied from the date of signature.

3. Le présent accord peut être modifié sur la base d'un accord écrit conclu entre les parties.

3. This Agreement may be amended on the basis of mutual written agreement between the Parties.

4. Le présent accord peut être dénoncé par une partie au moyen d'une notification écrite de dénonciation adressée à l'autre partie. La dénonciation prend effet six mois après réception de la notification par l'autre partie.

4. This Agreement may be denounced by one Party by written notice of denunciation given to the other Party. Such denunciation shall take effect six months after receipt of notification by the other Party.
