Having regard to the Treaty establishing the European Community,

vu le traité relatif à l'adhésion de la Bulgarie et de la Roumanie à l'Union européenne, signé à Luxembourg le 25 avril 2005, et notamment son article 4, paragraphe 3,

Having regard to the Treaty of Accession of Bulgaria and Romania signed in Luxembourg on 25 April 2005, and in particular Article 4(3) thereof,

vu l'acte d'adhésion de la Bulgarie et de la Roumanie, et notamment son article 56,

Having regard to the Act of Accession of Bulgaria and Romania, and in particular Article 56 thereof,

Having regard to the proposal from the Commission,

considérant ce qui suit:

Whereas:

(1) Le règlement (CE) no 1698/2005 du Conseil [1] définit les règles générales régissant le soutien communautaire en faveur de la politique de développement rural pour la période de programmation 2007-2013 et établit des priorités ainsi que des mesures en la matière.

(1) Council Regulation (EC) No 1698/2005 [1] introduced general rules governing Community support for rural development policy for the programming period 2007 to 2013 and established priorities and measures for rural development.

(2) Il convient d'adapter ces règles générales et ces mesures afin de permettre leur mise en œuvre en Bulgarie et en Roumanie dès la date d'adhésion de ces pays à l'Union européenne.

(2) Those general rules and measures should be adapted to allow their implementation in Bulgaria and Romania as from the date of accession of those countries to the European Union.

(3) Le règlement (CE) no 1698/2005 prévoit un axe Leader obligatoire dans tout programme de développement rural, axe devant représenter un pourcentage minimal de la contribution du Feader au programme. Compte tenu du manque d'expérience de la Bulgarie et de la Roumanie dans la mise en œuvre de l'approche Leader et afin de pouvoir mettre en place la capacité locale nécessaire à l'application de Leader, il convient que la contribution financière moyenne de 2,5 % prévue pour l'axe Leader s'applique à ces deux pays pour la période 2010-2013.

(3) Regulation (EC) No 1698/2005 establishes a compulsory Leader axis within the rural development programme, which must account for a minimum percentage of EAFRD contribution to the programme. Given the lack of experience of Bulgaria and Romania in implementing the Leader approach and in order to build sufficient local capacity to apply Leader, the average financial contribution of 2,5 % for the Leader axis should be applied for the period 2010 to 2013 for those countries.

(4) Afin que la Bulgarie et la Roumanie puissent bénéficier jusqu'en 2013 des mesures transitoires en matière de soutien aux exploitations de semi-subsistance et à la création de groupements de producteurs, il y a lieu d'inclure la Bulgarie et la Roumanie dans la liste des pays bénéficiaires desdites mesures.

(4) With a view to allowing Bulgaria and Romania to benefit until 2013 from the transitional measures concerning the support to semi-subsistence agricultural holdings and the setting-up of producer groups, Bulgaria and Romania should be added to the list of countries benefiting from these measures.

(5) Il convient donc de modifier le règlement (CE) no 1698/2005 en conséquence,

A ARRÊTÉ LE PRÉSENT RÈGLEMENT:

HAS ADOPTED THIS REGULATION:

Article premier

Article 1

Le règlement (CE) no 1698/2005 est modifié comme suit:

Regulation (EC) No 1698/2005 shall be amended as follows:

1) À l'article 17, paragraphe 2, l'alinéa suivant est ajouté:

1. the following subparagraph shall be added to Article 17(2):

"Pour la Bulgarie et la Roumanie, la moyenne minimale de 2,5 % de la contribution totale du Feader en faveur de l'axe 4 est respectée au cours de la période 2010-2013. Toute contribution du Feader au titre de cet axe au cours de la période 2007-2009 est prise en considération dans le calcul de ce pourcentage."

"For Bulgaria and Romania, an average of at least 2,5 % of the EAFRD total contribution for axis 4 shall be respected during the period 2010 to 2013. Any contribution from the EAFRD for that axis during the period 2007 to 2009 shall be taken into account for the calculation of that percentage."

2) À l'article 20, point d), les termes introductifs sont remplacés par le texte suivant:

"des mesures transitoires pour la Bulgarie, la République tchèque, l'Estonie, Chypre, la Lettonie, la Lituanie, la Hongrie, Malte, la Pologne, la Roumanie, la Slovénie et la Slovaquie concernant:"

2. the introductory words in Article 20(d) shall be replaced by the following:

"transitional measures for Bulgaria, the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Romania, Slovenia and Slovakia concerning:"

Article 2

Le présent règlement entre en vigueur le 1er janvier 2007, sous réserve de l'entrée en vigueur du traité d'adhésion de la Bulgarie et de la Roumanie.

Article 2

Le présent règlement est obligatoire dans tous ses éléments et directement applicable dans tout État membre.

This Regulation shall enter into force on 1 January 2007 subject to the entry into force of the Treaty of Accession of Bulgaria and Romania.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
