vu le traité instituant la Communauté européenne, et notamment son article 157, paragraphe 3,

Having regard to the Treaty establishing the European Community, and in particular Article 157(3) thereof,

considérant ce qui suit:
|
Whereas:
|
|
(1) la résolution (97)4 adoptée par le comité des ministres du Conseil de l'Europe le 20 mars 1997 a confirmé la poursuite des activités de l'Observatoire européen de l'audiovisuel, établi à l'origine par la résolution (92)70 adoptée par le comité des ministres le 15 décembre 1992;

(1) Resolution (97)4 adopted by the Committee of Ministers of the Council of Europe on 20 March 1997 confirmed the continuation of the European Audiovisual Observatory initially established by Resolution (92)70 adopted by the Committee of Ministers on 15 December 1992;

(2) tous les États membres sont membres de l'Observatoire européen de l'audiovisuel; la représentation de la Communauté par la Commission, dans ses relations avec l'Observatoire européen de l'audiovisuel, n'affecte pas la participation directe des différents États membres de l'Union européenne à cet Observatoire ni leur représentation auprès de lui;

(2) All the Member States are members of the European Audiovisual Observatory; the representation of the Community in its relations with the European Audiovisual Observatory by the Commission does not affect the direct representation of individual Member States of the European Union themselves;

(3) le Conseil a adopté le 26 avril 1999 une décision visant à établir une infrastructure d'information statistique communautaire concernant l'industrie et les marchés des secteurs audiovisuels et connexes(4);

(3) The Council adopted on 26 April 1999 a Decision establishing a Community statistical information infrastructure relating to the industry and markets of the audiovisual and related sectors(4);
|
|
(4) il est en conséquence nécessaire d'assurer une complémentarité entre les travaux entrepris en vertu de ladite décision du Conseil et l'Observatoire européen de l'audiovisuel;
|
(4) It is therefore necessary to ensure complementarity between the work undertaken under the said Council Decision and the European Audiovisual Observatory;
|
|
(5) l'Observatoire européen de l'audiovisuel contribue à renforcer la compétitivité de l'industrie audiovisuelle communautaire en améliorant notamment la diffusion de l'information à destination de l'industrie, en particulier des petites et moyennes entreprises, et en contribuant à donner une vision plus claire du marché,

(5) The European Audiovisual Observatory contributes to strengthening the competitiveness of the Community's audiovisual industry notably by improving the transfer of information to the industry, in particular small and medium-sized enterprises, and promoting a clearer view of the market,

DÉCIDE:

HAS DECIDED AS FOLLOWS:

La Communauté devient membre de l'Observatoire européen de l'audiovisuel.

The Community shall be a member of the European Audiovisual Observatory.

La Commission représente la Communauté dans ses relations avec l'Observatoire.

The Commission shall represent the Community in its relations with the Observatory.

Les crédits nécessaires à la contribution financière de la Communauté au budget de fonctionnement de l'Observatoire sont autorisés par l'autorité budgétaire conformément à la perspective financière en vigueur.

The appropriations required for the Community's financial contribution to the Observatory's operating budget shall be authorised by the Budgetary Authority in accordance with the financial perspective in force.
|

Avant la fin de la troisième année suivant l'année de l'adoption de la présente décision ainsi qu'à l'expiration de la présente décision, la Commission présente au Parlement européen, au Conseil et au Comité économique et social un rapport sur sa mise en oeuvre.

Before the end of the third year following the year of adoption of this Decision, as well as upon expiry of this Decision, the Commission shall present to the European Parliament, the Council and the Economic and Social Committee a report on its implementation.

La présente décision est applicable jusqu'au dernier jour du dernier mois de la cinquième année suivant celle de son adoption.

This Decision shall apply until the last day of the last month of the fifth year following the year of its adoption.
