Having regard to the Treaty establishing the European Community,

vu le règlement (CE) n° 2488/2000 du Conseil du 10 novembre 2000 maintenant un gel des capitaux concernant M. Milosevic et les personnes de son entourage et abrogeant les règlements (CE) n° 1294/1999 et (CE) n° 607/2000 ainsi que l'article 2 du règlement (CE) n° 926/98(1), et notamment son article 4, paragraphe 2,

Having regard to Council Regulation (EC) No 2488/2000 of 10 November 2000 maintaining a freeze of funds in relation to Mr Milosevic and those persons associated with him and repealing Regulations (EC) No 1294/1999 and (EC) No 607/2000 and Article 2 of Regulation (EC) No 926/98(1), and in particular Article 4(2)(a) thereof,

considérant ce qui suit:

Whereas:

(1) En vertu de l'article 1er du règlement (CE) n° 2488/2000, tous les capitaux et autres ressources financières détenus en dehors du territoire de la République fédérale de Yougoslavie et appartenant à M. Milosevic et aux personnes physiques de son entourage énumérées à l'annexe I du règlement doivent être gelés et ne peuvent être mis à la disposition de ces personnes. La Commission est autorisée à modifier cette annexe, compte tenu des décisions appliquant la position commune 2000/696/PESC(2).

(1) In accordance with Article 1 of Regulation (EC) No 2488/2000 all funds and other financial resources held outside the Federal Republic of Yugoslavia belonging to Mr Milosevic and to natural persons associated with him, are to be frozen and such funds and financial resources are not to be made available to or for the benefit of these persons, as listed in Annex I to the Regulation. The Commission is empowered to amend that Annex, taking into account decisions implementing Common Position 2000/696/CFSP(2).

(2) Par la position commune 2001/155/PESC(3), le Conseil a modifié les dispositions de sa position commune 2000/696/PESC en ce qui concerne l'interdiction d'accès à l'Union européenne. Il convient dès lors de modifier le règlement (CE) n° 2488/2000.

(2) By means of Common Position 2001/155/CFSP(3), the Council amended the provisions of its Common Position 2000/696/CFSP as regards the ban on admission to the European Union. It is, therefore, appropriate to amend Regulation (EC) No 2488/2000.

(3) Les mesures prévues dans le présent règlement sont conformes à l'avis émis par le comité de gestion visé à l'article 5 du règlement (CE) n° 2488/2000,

(3) The measures provided for in this Regulation are in accordance with the opinion of the Management Committee referred to in Article 5 of Regulation (EC) No 2488/2000,

A ARRÊTÉ LE PRÉSENT RÈGLEMENT:

HAS ADOPTED THIS REGULATION:

Article premier

Article 1

L'annexe I du règlement (CE) n° 2488/2000 est remplacée par le texte figurant à l'annexe du présent règlement.

Annex I to Regulation (EC) No 2488/2000 is replaced by the text in the Annex to this Regulation.

Article 2

Article 2

Le présent règlement entre en vigueur le jour suivant celui de sa publication au Journal officiel des Communautés européennes.

This Regulation shall enter into force on the day following its publication in the Official Journal of the European Communities.

Le présent règlement est obligatoire dans tous ses éléments et directement applicable dans tout État membre.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
