Considerando que compete a los Estados miembros garantizar en su territorio la seguridad y la salud de las personas;

Whereas Member States are responsible within their territory for the health and safety of people;
|
|
Considerando que el Libro blanco del mercado interior, aprobado por el Consejo Europeo en junio de 1985, prevé en sus apartados 65 y 68 la utilización del nuevo enfoque para la aproximación de las legislaciones;
|
Whereas paragraphs 65 and 68 of the White Paper on the completion of the internal market, approved by the European Council in June 1985, provide for a new approach to the approximation of laws;
|
|
Considerando que la Directiva 84/529/CEE del Consejo, de 17 de septiembre de 1984, relativa a la aproximación de las legislaciones de los Estados miembros sobre los ascensores movidos eléctrica, hidráulica u oleoeléctricamente (4), no autoriza la libre circulación de todos los tipos de ascensores; que las disposiciones obligatorias de las normativas nacionales para los tipos no incluidos en la Directiva 84/529/CEE constituyen, a causa de su disparidad, obstáculos al comercio intracomunitario; que, por lo tanto, procede armonizar las disposiciones nacionales relativas a los ascensores;

Whereas Council Directive 84/529/EEC of 17 September 1984 on the approximation of the laws of the Member States relating to electrically, hydraulically or oil-electrically operated lifts (4) does not ensure freedom of movement for all types of lift; whereas disparities between the binding provisions of the various national systems for types of lift not covered by Directive 84/529/EEC constitute barriers to trade within the Community; whereas the national rules on lifts should therefore be harmonized;

Considerando que la Directiva 84/528/CEE del Consejo, de 17 de septiembre de 1984, relativa a la aproximación de las legislaciones de los Estados miembros sobre las disposiciones comunes a los aparatos elevadores y de manejo mecánico (5), constituye la Directiva marco de dos Directivas específicas: la Directiva 84/529/CEE y la Directiva 86/663/CEE del Consejo, de 22 de diciembre de 1986, sobre aproximación de las legislaciones de los Estados miembros relativas a las carretillas automotoras de manutención (6), derogada por la Directiva 91/368/CEE del Consejo, de 20 de junio de 1991, por la que se modifica la Directiva 89/392/CEE, relativa a la aproximación de las legislaciones de los Estados miembros sobre máquinas (7);

Whereas Council Directive 84/528/EEC of 17 September 1984 on the approximation of the laws of the Member States relating to common provisions for lifting and mechanical handling appliances (5) serves as a framework Directive for two specific Directives, namely Directive 84/529/EEC and Council Directive 86/663/EEC of 22 December 1986 on the approximation of the laws of the Member States relating to self-propelled industrial trucks (6), repealed by Council Directive 91/368/EEC of 20 June 1991 amending Directive 89/392/EEC on the approximation of the laws of the Member States relating to machinery (7);
|

Considerando que la Comisión adoptó, el 8 de junio de 1995, la Recomendación 95/216/CE (8) a los Estados miembros, relativa a la mejora de la seguridad de los ascensores ya instalados;
|
Whereas on 8 June 1995 the Commission adopted recommendation No 95/216/EC (8) to the Member States concerning improvement of safety of existing lifts;
|
|
Considerando que los requisitos esenciales de la presente Directiva sólo garantizarán el nivel de seguridad esperado en la medida en que se garantice su cumplimiento mediante los procedimientos adecuados de evaluación de la conformidad, elegidos entre los establecidos en la Decisión 93/465/CEE del Consejo, de 22 de julio de 1993, relativa a los módulos correspondientes a las diversas fases de los procedimientos de evaluación de la conformidad y a las disposiciones referentes al sistema de colocación y utilización del marcado «CE» de conformidad, que van a utilizarse en las directivas de armonización técnica (9);
|
Whereas the essential requirements of this Directive will guarantee the intended level of safety only if appropriate conformity assessment procedures, chosen from among the provisions of Council Decision 93/465/EEC of 22 July 1993 concerning the modules for the various phases of the conformity assessment procedures and the rules for the affixing and use of the CE conformity marking, which are intended to be used in the technical harmonization directives (9), ensure compliance therewith;
|
|
Considerando que los ascensores, o algunos de sus componentes de seguridad, que cumplan los requisitos esenciales de seguridad y de salud de la presente Directiva deben ir provistos de forma visible del marcado «CE», a fin de poder ser puestos en el mercado;
|
Whereas the CE marking must be visibly affixed to lifts or to certain safety components of lifts which meet the essential health and safety requirements of this Directive to enable them to be placed on the market;
|
|
Considerando que la presente Directiva define solamente los requisitos esenciales de seguridad y de salud de carácter general; que, para facilitar a los fabricantes la prueba de la conformidad con dichos requisitos esenciales, es deseable disponer de normas armonizadas a escala europea respecto a la prevención de los riesgos propios del diseño y de la instalación de los ascensores, que permitan asimismo el control de la conformidad con los requisitos esenciales; que esas normas armonizadas a escala europea son elaboradas por organismos de Derecho privado y deben conservar su estatuto de textos no obligatorios; que, a tal efecto, el Comité Europeo de Normalización (CEN) y el Comité Europeo de Normalización Electrotécnica (CENELEC) son los organismos competentes para adoptar las normas armonizadas de acuerdo con las orientaciones generales para la cooperación entre la Comisión y dichos organismos, suscritas el 13 de noviembre de 1984; que, a efectos de la presente Directiva, una norma armonizada es una especificación técnica aprobada por uno u otro de dichos organismos, o por ambos, por mandato de la Comisión, con arreglo a lo dispuesto en la Directiva 83/189/CEE del Consejo, de 28 de marzo de 1983, por la que se establece un procedimiento de información en materia de normas y reglamentaciones técnicas (1), así como de acuerdo con las directrices generales anteriormente citadas;

Whereas this Directive defines only general essential health and safety requirements; whereas, in order to help manufacturers prove conformity with these essential requirements, it is desirable to have standards harmonized at European level concerning the prevention of risks arising from the design and installation of lifts, and also in order to enable conformity with the essential requirements to be verified; whereas such standards are drawn up at European level by private-law bodies and must retain their non-binding status; whereas, for this purpose, the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) are recognized as the competent bodies for adopting harmonized standards in accordance with the general guidelines for cooperation between the Commission and CEN and Cenelec signed on 13 November 1984; whereas a harmonized standard within the meaning of this Directive is a technical specification adopted by CEN and/or Cenelec on the basis of a mandate from the Commission in accordance with Council Directive 83/189/EEC of 28 March 1983 laying down a procedure for the provision of information in the field of technical standards and regulations (1) and pursuant to the abovementioned general guidelines;
|

Considerando que procede prever un régimen transitorio que permita a los instaladores poner en el mercado los ascensores fabricados antes de la fecha de aplicación de la presente Directiva;
|
Whereas provision should be made for transitional arrangements to enable installers to place on the market lifts manufactured before the date of implementation of this Directive;
|
|
Considerando que la presente Directiva ha sido redactada para cubrir todos los riesgos de los ascensores a los que se encuentran expuestos los usuarios y los ocupantes de la construcción; que, por consiguiente, esta Directiva se deberá considerar una directiva en el sentido del apartado 3 del artículo 2 de la Directiva 89/106/CEE del Consejo, de 21 de diciembre de 1988, relativa a la aproximación de las disposiciones legales, reglamentarias y administrativas de los Estados miembros sobre los productos de la construcción (2);

Whereas this Directive is designed to cover all risks caused by lifts and run by their users and by the occupants of the construction; whereas this Directive should therefore be regarded as a Directive within the meaning of Article 2 (3) of Council Directive 89/106/EEC of 21 December 1988 on the approximation of laws, regulations and administrative provisions of the Member States relating to construction products (2);
|

Whereas an agreement on a modus vivendi between the European Parliament, the Council and the Commission concerning the implementing measures for acts adopted in accordance with the procedure laid down in Article 189b of the EC Treaty was reached on 20 December 1994,

HAN ADOPTADO LA PRESENTE DIRECTIVA:

1. La presente Directiva se aplicará a los ascensores en funcionamiento permanente en edificios ya construidos o en construcción. Se aplicará también a los componentes de seguridad utilizados en dichos ascensores, cuya lista figura en el Anexo IV.
|
1. This Directive shall apply to lifts permanently serving buildings and constructions. It shall also apply to the safety components for use in such lifts listed in Annex IV.
|
|
2. A efectos de la presente Directiva, se entenderá por ascensor todo aparato utilizado en niveles definidos con ayuda de una cabina que se desplace a lo largo de guías rígidas, cuya inclinación sobre la horizontal sea superior a 15 grados, destinada al transporte:
|
2. For the purposes of this Directive, 'lift' shall mean an appliance serving specific levels, having a car moving along guides which are rigid and inclined at an angle of more than 15 degrees to the horizontal and intended for the transport of:
|
|
- de personas,
|
- persons,
|
|
- de personas y de objetos,
|
- persons and goods,
|
|
- de objetos únicamente si la cabina es accesible, es decir, si una persona puede entrar en ella sin dificultad y está equipada de elementos de mando situados dentro de la cabina o al alcance de una persona que se encuentre en el interior de la misma.
|
- goods alone if the car is accessible, that is to say, a person may enter it without difficulty, and fitted with controls situated inside the car or within reach of a person inside.
|
|
Los ascensores que se desplacen siguiendo un recorrido totalmente fijo en el espacio, aun si no está determinado por guías rígidas, también estarán incluidos en el ámbito de aplicación de la presente Directiva (por ejemplo, los ascensores de tijera).
|
Lifts moving along a fixed course even where they do not move along guides which are rigid shall fall within the scope of this Directive (for example, scissor lifts).
|
|
3. Quedan excluidos del ámbito de aplicación de la presente Directiva:

3. The Directive shall not apply to:
|
|
- las instalaciones de cables, incluidos los funiculares, para el transporte público o no público de personas,
|
- cableways, including funicular railways, for the public or private transportation of persons,
|
|
- los ascensores especialmente diseñados y fabricados para fines militares o de mantenimiento del orden,
|
- lifts specially designed and constructed for military or police purposes,
|
|
- los ascensores de los pozos de las minas,
|
- mine winding gear,
|
|
- los elevadores de tramoya teatral,
|
- theatre elevators,
|
|
- los ascensores instalados en medios de transporte,
|
- lifts fitted in means of transport,
|
|
- los ascensores vinculados a una máquina y destinados exclusivamente al acceso al puesto de trabajo,
|
- lifts connected to machinery and intended exclusively for access to the workplace,
|
|
- los trenes de cremallera,
|
- rack and pinion trains,
|
|
- los ascensores de obras de construcción.
|
- construction-site hoists intended for lifting persons or persons and goods.
|
|
4. A los efectos de la presente Directiva,
|
4. For the purposes of this Directive:

- el instalador de un ascensor es la persona física o jurídica que asume la responsabilidad del diseño, fabricación, instalación y puesta en el mercado del ascensor, que coloca el marcado «CE» y que extiende la declaración «CE» de conformidad,
|
- the 'installer of a lift' shall mean the natural or legal person who takes responsibility for the design, manufacture, installation and placing on the market of the lift and who affixes the CE marking and draws up the EC declaration of conformity,
|
|
- la puesta en el mercado del ascensor tiene lugar cuando el instalador pone el ascensor a disposición del usuario por primera vez,
|
- 'placing on the market of the lift' shall occur when the installer first makes the lift available to the user,
|
|
- el componente de seguridad es un componente tal y como se enumera en el Anexo IV,
|
- 'safety component' shall mean a component as listed in Annex IV,
|
|
- el fabricante de los componentes de seguridad es la persona física o jurídica que asume la responsabilidad del diseño y de la fabricación de los componentes de seguridad, que les coloca el marcado «CE» y que extiende la declaración «CE» de conformidad que los acompaña,
|
- the 'manufacturer of the safety components' shall mean the natural or legal person who takes responsibility for the design and manufacture of the safety components and who affixes the CE marking and draws up the EC declaration of conformity,
|
|
- se entenderá por «ascensor modelo» un ascensor representativo cuyo expediente técnico muestre cómo se van a respetar los requisitos esenciales de seguridad en los ascensores derivados del ascensor modelo en función de parámetros objetivos y en el que se utilicen componentes idénticos.
|
- a 'model lift' shall mean a representative lift whose technical dossier shows the way in which the essential safety requirements will be met for lifts which conform to the model lift defined by objective parameters and which uses identical safety components.
|
|
Cualquier variación autorizada del ascensor modelo respecto de los ascensores derivados del ascensor modelo deberá hallarse claramente especificada (con valores máximos y mínimos) en el expediente técnico.
|
All permitted variations between the model lift and the lifts forming part of the lifts derived from the model lift must be clearly specified (with maximum and minimum values) in the technical dossier.
|
|
Se podrá demostrar mediante cálculos y/o a partir de esquemas de diseño la similitud de una serie de dispositivos o disposiciones que respondan a los requisitos esenciales de seguridad.
|
By calculation and/or on the basis of design plans it is permitted to demonstrate the similarity of a range of equipment to satisfy the essential safety requirements.
|
|
5. Cuando, para un ascensor, los riesgos contemplados en la presente Directiva estén regulados en su totalidad o en parte, por directivas específicas, la presente Directiva no se aplicará o dejará de aplicarse para dichos ascensores y para dichos riesgos, desde el momento en que se pongan en aplicación dichas directivas específicas.

5. Where, for lifts, the risks referred to in this Directive are wholly or partly covered by specific Directives, this Directive shall not apply or shall cease to apply in the case of such lifts and such risks as from application of those specific Directives.

- los ascensores a los que se aplica la presente Directiva sólo puedan ser puestos en el mercado y puestos en servicio cuando, estando instalados y mantenidos adecuadamente y siendo utilizados para el fin previsto, no presenten riesgo para la seguridad o la salud de las personas y, en su caso, la seguridad de los bienes;

- lifts covered by this Directive may be placed on the market and put into service only if they are not liable to endanger the health or safety of persons or, where appropriate, the safety of property, when properly installed and maintained and used for their intended purpose.
|
|
- los componentes de seguridad a los que se aplica la presente Directiva sólo puedan ser puestos en el mercado o puestos en servicio si los ascensores en los que está prevista su instalación, estando instalados y mantenidos adecuadamente y siendo utilizados para el fin previsto, no presentan riesgo para la seguridad o la salud de las personas y, en su caso, de la seguridad de los bienes.
|
- safety components covered by this Directive may be placed on the market and put into service only if the lifts in which they are to be installed are not liable to endanger the health or safety of persons or, where appropriate, the safety of property when properly installed and maintained and used for their intended purpose.
|

2. Los Estados miembros tomarán todas las medidas apropiadas para que la persona responsable de la realización del edificio o de la construcción y el instalador del ascensor, por una parte, se informen mutuamente de los datos necesarios y, por otra parte, adopten las medidas necesarias para el correcto funcionamiento y la seguridad de utilización del ascensor.

2. Member States shall take all appropriate measures to ensure that the person responsible for work on the building or construction and the installer of the lift, on the one hand, keep each other informed of the facts necessary for, and, on the other hand, take the appropriate steps to ensure, the proper operation and safe use of the lift.
|
|
3. Los Estados miembros adoptarán todas las medidas necesarias para que no pueda haber en los huecos previstos para los ascensores otro tipo de conducciones o instalaciones que las requeridas para el funcionamiento o la seguridad del ascensor.
|
3. Member States shall take all necessary measures to ensure that shafts intended for lifts do not contain any piping or wiring or fittings other than that necessary for the operation and safety of the lift.
|
|
4. Sin perjuicio de los apartados 1, 2 y 3, las disposiciones de la presente Directiva no afectarán a la facultad de los Estados miembros de establecer, en cumplimiento del Tratado, los requisitos que consideren necesarios para garantizar la protección de las personas con ocasión de la puesta en servicio y de la utilización de los ascensores de que se trata, siempre que ello no suponga modificaciones de los mismos en relación con la presente Directiva.
|
4. Without prejudice to paragraphs 1, 2 and 3, the provisions of this Directive shall not affect Member States' entitlement to lay down in conformity with the Treaty such requirements as they may deem necessary to ensure that persons are protected when the lifts in question are put into service or used, provided that this does not mean that the lifts are modified in a way not specified in the Directive.

5. Los Estados miembros no pondrán obstáculos, en particular con ocasión de ferias, exposiciones y demostraciones, a que se presenten ascensores o componentes de seguridad que no cumplan las disposiciones comunitarias en vigor, siempre que un cartel visible indique con claridad su no conformidad y la imposibilidad de adquirir dichos ascensores o componentes de seguridad antes de que el instalador del ascensor o el fabricante de los componentes de seguridad -o el representante de este último establecido en la Comunidad- los hayan adaptado a las normas. Con ocasión de las demostraciones, deberán adoptarse las medidas de seguridad adecuadas para garantizar la protección de las personas.
|
5. At trade fairs, exhibitions or demonstrations in particular, Member States shall not prevent the showing of lifts or safety components which do not conform to the Community provisions in force, provided that a visible sign clearly indicates that such lifts or safety components are not in conformity and are not for sale until they have been brought into conformity by the installer of the lift, the manufacturer of the safety components or the latter's authorized representative established in the Community. During demonstrations, adequate safety measures shall be taken to ensure the protection of persons.

Los ascensores a los que se aplica la presente Directiva deberán cumplir los requisitos esenciales de seguridad y de salud que figuran en el Anexo I.

Lifts covered by this Directive must satisfy the essential health and safety requirements set out in Annex I.
|
|
Los componentes de seguridad a los que se aplica la presente Directiva deberán cumplir los requisitos esenciales de seguridad y de salud que figuran en el Anexo I o permitir que los ascensores en los que se instalen cumplan esos mismos requisitos esenciales.
|
The safety components covered by this Directive must satisfy the essential health and safety requirements set out in Annex I or enable the lifts in which they are installed to satisfy the said essential requirements.
|

1. Los Estados miembros no podrán prohibir, limitar ni obstaculizar la puesta en el mercado ni la puesta en servicio en su territorio de ascensores y/o de componentes de seguridad que cumplan lo dispuesto en la presente Directiva.
|
1. Member States may not prohibit, restrict or impede the placing on the market or putting into service on their territory of lifts and/or safety components which comply with this Directive.
|
|
2. Los Estados miembros no podrán prohibir, limitar u obstaculizar la puesta en el mercado de los componentes que, mediante la declaración del fabricante o de su representante establecido en la Comunidad, vayan a incorporarse a un ascensor al que se aplique la presente Directiva.
|
2. Member States may not prohibit, restrict or impede the placing on the market of components which, on the basis of a declaration by the manufacturer or his authorized representative established in the Community, are intended to be incorporated into a lift covered by this Directive.

|
1. Los Estados miembros considerarán conformes al conjunto de las disposiciones de la presente Directiva, incluidos los procedimientos de evaluación de la conformidad establecidos en el capítulo II, los ascensores y componentes de seguridad que estén provistos del marcado «CE» y que dispongan de la declaración «CE» de conformidad que se menciona en el Anexo II.

1. Member States shall regard lifts and safety components bearing the CE marking and accompanied by the EC declaration of conformity referred to in Annex II as conforming to all the provisions of this Directive, including the conformity assessment procedures laid down in Chapter II.
|
|
A falta de normas armonizadas, los Estados miembros tomarán las disposiciones que estimen necesarias para que se pongan en conocimiento de las partes interesadas las normas y especificaciones técnicas nacionales vigentes que se consideren importantes o útiles para la correcta aplicación de los requisitos esenciales de seguridad y de salud enunciados en el Anexo I.

In the absence of harmonized standards, Member States shall take any steps they deem necessary to bring to the attention of the parties concerned the existing national technical standards and specifications which are regarded as important or relevant to the proper implementation of the essential health and safety requirements in Annex I.
|

2. Cuando una norma nacional que trasponga una norma armonizada, cuya referencia se haya publicado en el Diario Oficial de las Comunidades Europeas, comprenda uno o más de los requisitos esenciales de seguridad y de salud, se presumirá

2. Where a national standard transposing a harmonized standard, the reference for which has been published in the Official Journal of the European Communities, covers one or more of the essential health and safety requirements:
|

- que el ascensor fabricado con arreglo a dicha norma es conforme con los requisitos esenciales pertinentes, o
|
- lifts constructed in accordance with that standard shall be presumed to comply with the relevant essential requirements.
|
|
- que el componente de seguridad fabricado con arreglo a dicha norma permite que el ascensor en el cual se instale de forma adecuada cumpla los requisitos esenciales pertinentes.
|

|
Los Estados miembros publicarán las referencias de las normas nacionales que traspongan las normas armonizadas.

- safety components constructed in accordance with that standard shall be presumed suitable to enable a lift on which they are correctly installed to comply with the relevant essential requirements.
|

3. Los Estados miembros velarán por que se tomen las medidas apropiadas para permitir a los interlocutores sociales influir, a escala nacional, en el proceso de elaboración y de seguimiento de las normas armonizadas.
|
Member States shall publish the references of national standards transposing harmonized standards.
|
|
|
3. Member States shall ensure that appropriate measures are taken to enable both sides of industry to have an influence at national level on the process of preparing and monitoring the harmonized standards.
|
|

1. Cuando un Estado miembro o la Comisión consideren que las normas armonizadas a las que se refiere el apartado 2 del artículo 5 no cumplen plenamente los correspondientes requisitos esenciales a los que se refiere el artículo 3, la Comisión o el Estado miembro recurrirá al Comité creado por la Directiva 83/189/CEE, exponiendo sus razones. El Comité emitirá un dictamen urgente.
|
|
|
A la vista del dictamen del Comité, la Comisión notificará a los Estados miembros si las normas correspondientes deben ser retiradas o no de las publicaciones a que se refiere el apartado 2 del artículo 5.
|
1. Where a Member State or the Commission considers that the harmonized standards referred to in Article 5 (2) do not entirely satisfy the essential requirements referred to in Article 3, the Commission or the Member State concerned shall bring the matter before the Committee set up under Directive 83/189/EEC, giving the reasons therefor. The Committee shall deliver an opinion without delay.
|
|

Upon receipt of the Committee's opinion, the Commission shall inform the Member States whether or not it is necessary to withdraw those standards from the published information referred to in Article 5 (2).

The Standing Committee shall draw up its own rules of procedure.

The representative of the Commission shall submit to the Standing Committee a draft of the measures to be taken. The Committee shall deliver its opinion on the draft, within a time limit which the chairman may lay down according to the urgency of the matter, if necessary by taking a vote.

The opinion shall be recorded in the minutes, in addition, each Member State shall have the right to ask to have its position recorded in the minutes.

The Commission shall take the utmost account of the opinion delivered by the Standing Committee. It shall inform that Committee of the manner in which its opinion has been taken into account.

4. The Standing Committee may, furthermore, examine any question concerning the application of this Directive and raised by its chairman either at the latter's initiative or at the request of a Member State.
|

Cuando un Estado miembro compruebe que un ascensor o un componente de seguridad provisto del marcado «CE» y utilizado de acuerdo con su finalidad puede poner en peligro la seguridad o la salud de las personas y, en su caso, la seguridad de los bienes, tomará todas las medidas necesarias para retirarlo del mercado, prohibir su puesta en el mercado, prohibir su puesta en servicio o limitar su libre circulación.

Where a Member State ascertains that a lift or a safety component bearing the CE marking and used in accordance with its intended purpose is liable to endanger the safety of persons and, where appropriate, of property, it shall take all appropriate measures to withdraw it from the market, to prohibit it from being placed on the market or put into service or to restrict its free movement.

The Member State shall immediately inform the Commission of any such measure, indicating the reasons for its decision and in particular whether non-conformity is due to:

2. The Commission shall enter into consultation with the parties concerned as soon as possible. Where, after such consultation, the Commission finds that:

3. Where a lift or safety component which does not comply bears the CE marking, the competent Member State shall take appropriate action against whomsoever affixed the marking and shall so inform the Commission and the other Member States.

The procedures for the design and construction stages, on the one hand, and the installation and testing stages, on the other, may be carried out on the same lift;
|
|
- el control final contemplado en el Anexo VI, o
|
(ii) or, if it was designed in accordance with a model lift having undergone an EC type-examination as referred to in Annex V, it shall be constructed, installed and tested by implementing:
|
|
- el sistema de aseguramiento de calidad contemplado en el Anexo XII, o

- the final inspection referred to in Annex VI, or
|
|
- el sistema de aseguramiento de calidad contemplado en el Anexo XIV;
|
- the quality assurance system referred to in Annex XII, or

iii) o bien, si ha sido diseñado de conformidad con un ascensor para el cual se ha aplicado un sistema de aseguramiento de calidad conforme al Anexo XIII, completado con un control del diseño si éste no es totalmente conforme a las normas armonizadas, se construirá, instalará y ensayará aplicando igualmente:

- the quality assurance system referred to in Annex XIV;
|
|
- el control final contemplado en el Anexo VI, o
|
(iii) or, if it was designed in accordance with a lift for which a quality assurance system pursuant to Annex XIII was implemented, supplemented by an examination of the design if the latter is not wholly in accordance with the harmonized standards, it shall be installed and constructed and tested by implementing, in addition:
|
|

|
- the final inspection referred to in Annex VI, or
|
|
- el sistema de aseguramiento de calidad conforme al Anexo XIV;
|
- the quality assurance system in accordance with Annex XII, or

- the quality assurance system in accordance with Annex XIV;

v) bien haber sido sometido a un sistema de aseguramiento de calidad con arreglo a lo dispuesto en el Anexo XIII, completado por un control del diseño si éste no es totalmente conforme a las normas armonizadas.

(iv) or, having undergone the unit verification procedure, referred to in Annex X, by a notified body;

(v) or, having been subject to the quality assurance system in accordance with Annex XIII, supplemented by an examination of the design if the latter is not wholly in accordance with the harmonized standards.

3. En todos los casos mencionados en el apartado 2:

In the cases referred to in (i), (ii) and (iii) above, the person responsible for the design must supply to the person responsible for the construction, installation and testing all necessary documents and information for the latter to be able to operate in absolute security.

3. In all the cases referred to in paragraph 2:

4. a) Cuando los ascensores o componentes de seguridad sean objeto de otras directivas que se refieran a otros aspectos y dispongan la colocación del marcado «CE», éste señalará que se supone que dichos ascensores o componentes de seguridad cumplen también las disposiciones de dichas directivas.

- the Commission, the Member States and the other notified bodies may, on request, obtain from the installer a copy of the declaration of conformity and reports of the tests involved in the final inspection.
|

b) No obstante, en caso de que una o más de esas directivas autoricen al fabricante a elegir, durante un período transitorio, el sistema que aplicará, el marcado «CE» señalará únicamente la conformidad con las disposiciones de las directivas aplicadas por el instalador del ascensor o por el fabricante de los componentes de seguridad. En tal caso, las referencias a esas directivas aplicadas, tal y como se publicaron en el Diario Oficial de las Comunidades Europeas, deberán incluirse en los documentos, folletos o instrucciones exigidos por dichas directivas, adjuntos al ascensor o al componente de seguridad.

4. (a) Where the lifts or safety components are subject to other Directives concerning other aspects and which also provide for the affixing of the CE marking, the latter shall indicate that the lift or safety component is also presumed to conform to the provisions of those other Directives.
|
|
5. (b) However, where one or more of these Directives allows the manufacturer, during a transitional period, to choose which arrangements to apply, the CE marking shall indicate conformity only to the Directives applied by the installer of the lift or the manufacturer of the safety components. In this case, particulars of the Directives applied, as published in the Official Journal of the European Communities, must be given in the documents, notices or instructions required by the Directives and accompanying the lift or safety component.
|

5. Where neither the installer of the lift nor the manufacturer of the safety component nor his authorized representative established in the Community has complied with the obligations of the preceding paragraphs, those obligations shall devolve upon whomsoever places the lift or the safety component on the market in the Community. The same obligations shall apply to whomsoever manufactures the lift or safety component for his own use.

The Commission shall publish for information in the Official Journal of the European Communities a list of the notified bodies and their identification numbers and the tasks for which they have been notified. The Commission shall ensure that this list is kept up to date.

2. Member States shall apply the criteria laid down in Annex VII in assessing the notified bodies. Bodies meeting the assessment criteria laid down in the relevant harmonized standards shall be presumed to fulfil the criteria laid down in Annex VII.

3. A Member State which has notified a body must withdraw its notification if it finds that the body no longer meets the criteria laid down in Annex VII. It shall immediately inform the Commission and the other Member States accordingly.

2. The CE marking shall be affixed to every lift car distinctly and visibly in accordance with Section 5 of Annex I and shall be affixed on each of the safety components listed in Annex IV or, where that is not possible, on a label inseparably attached to the safety component.

(a) where a Member State establishes that the CE marking has been affixed irregularly, the installer of the lift, the manufacturer of the safety component or the authorized representative of the latter established within the Community shall be obliged to make the product conform as regards the provisions concerning the CE marking and to end the infringement under the conditions imposed by the Member State;

REQUISITOS ESENCIALES DE SEGURIDAD Y SALUD RELATIVOS AL DISEÑO Y FABRICACIÓN DE LOS ASCENSORES Y DE LOS COMPONENTES DE SEGURIDAD

ESSENTIAL HEALTH AND SAFETY REQUIREMENTS RELATING TO THE DESIGN AND CONSTRUCTION OF LIFTS AND SAFETY COMPONENTS
|
|
OBSERVACIONES PRELIMINARES
|
|
|
1. Las obligaciones establecidas por los requisitos esenciales de seguridad y de salud sólo se aplicarán cuando para el ascensor o el componente de seguridad de que se trate exista el riesgo correspondiente al ser utilizado en las condiciones previstas por el instalador del ascensor o el fabricante de los componentes de seguridad.

PRELIMINARY REMARKS
|
|
2. Los requisitos esenciales de seguridad y salud contenidos en la Directiva son imperativos. No obstante, dado el actual estado de la técnica, es posible que no se consigan los objetivos que fijan dichos requisitos. En ese caso, y en la medida de lo posible, el ascensor o el componente de seguridad deberá estar diseñado y fabricado para acercarse a dichos objetivos.
|
1. Obligations under essential health and safety requirements apply only where the lift or safety component is subject to the hazard in question when used as intended by the installer of the lift or the manufacturer of the safety components.
|
|
3. El fabricante del componente de seguridad y el instalador del ascensor estarán obligados a analizar dichos riesgos para indagar cuáles de estos riesgos puede presentar su producto; deberán proceder seguidamente a su diseño y fabricación teniendo en cuenta el análisis efectuado.
|
2. The essential health and safety requirements contained in the Directive are imperatives. However, given the present state of the art, the objectives which they lay down may not be attainable. In such cases, and to the greatest extent possible, the lift or safety components must be designed and built in such a way as to approximate to those objectives.
|
|
4. Con arreglo al artículo 14, se aplicarán a los ascensores los requisitos esenciales de la Directiva 89/106/CEE no incluidos en la presente Directiva.

3. The safety-component manufacturer and the installer of the lift are under an obligation to assess the hazards in order to identify all those which apply to their products; they must then design and construct them taking account of the assessment.
|

1. GENERALIDADES

4. In accordance with Article 14, the essential requirements laid down in Directive 89/106/EEC, not included in this Directive, apply to lifts.
|
|

1. GENERAL

Cuando exista el riesgo correspondiente y no se contemple en el presente Anexo, se aplicarán los requisitos esenciales de seguridad y salud del Anexo I de la Directiva 89/392/CEE. En todos los casos será de aplicación el requisito esencial del punto 1.1.2. del Anexo I de la Directiva 89/392/CEE.

1.2. Cabina
|
Where the relevant hazard exists and is not dealt with in this Annex, the essential health and safety requirements of Annex I to Directive 89/392/EEC apply. The essential requirement of Section 1.1.2 of Annex I to Directive 89/392/EEC must apply in any event.
|

La cabina deberá estar diseñada y fabricada de forma que su espacio y resistencia correspondan al número máximo de personas y a la carga nominal del ascensor fijados por el instalador.
|
1.2. Car
|
|
Cuando el ascensor se destine al transporte de personas y sus dimensiones lo permitan, la cabina estará diseñada y fabricada de forma que, por sus características estructurales, no dificulte o impida el acceso a la misma o su utilización por los minusválidos, y permita toda adaptación destinada a facilitar su utilización por estas personas.

The car must be designed and constructed to offer the space and strength corresponding to the maximum number of persons and the rated load of the lift set by the installer.
|
|
1.3. Elementos de suspensión y elementos de sustentación
|
In the case of lifts intended for the transport of persons, and where its dimensions permit, the car must be designed and constructed in such a way that its structural features do not obstruct or impede access and use by disabled persons and so as to allow any appropriate adjustments intended to facilitate its use by them.
|
|
Tanto los elementos de suspensión y/o de sustentación de la cabina, sus sujeciones y todas sus terminaciones, deberán elegirse y diseñarse de forma que garanticen un nivel de seguridad global adecuado y reduzcan al máximo el riesgo de caída de la cabina, tomando en consideración las condiciones en las que se utilice, los materiales empleados y las condiciones de fabricación.

1.3. Means of suspension and means of support
|
|
En los casos en los que la suspensión de la cabina se efectúe por medio de cables o cadenas, el número de cables o cadenas independientes será por lo menos de dos, con sus respectivos sistemas de enganche. Estos cables y cadenas no deberán poseer más empalmes ni ajustes que los necesarios para su fijación o enrollamiento.
|
The means of suspension and/or support of the car, its attachments and any terminal parts thereof must be selected and designed so as to ensure an adequate level of overall safety and to minimize the risk of the car falling, taking into account the conditions of use, the materials used and the conditions of manufacture.
|
|

Where ropes or chains are used to suspend the car, there must be at least two independent cables or chains, each with its own anchorage system. Such ropes and chains must have no joins or splices except where necessary for fixing or forming a loop.
|

1.4. Control of loading (including overspeed)
|
|

1.4.1. Lifts must be so designed, constructed and installed as to prevent normal starting if the rated load is exceeded.
|
|
Estos requisitos no se aplicarán a los ascensores que por el diseño del sistema de arrastre no puedan nunca sobrepasar una velocidad dada.

1.4.2. Lifts must be equipped with an overspeed governor.
|
|

These requirements do not apply to lifts in which the design of the drive system prevents overspeed.

1.4.3. Fast lifts must be equipped with a speed-monitoring and speed-limiting device.
|

1.5. Maquinaria

1.4.4. Lifts driven by friction pulleys must be designed so as to ensure stability of the traction cables on the pulley.

1.5. Machinery
|
|
1.5.2. El instalador del ascensor deberá prever que la maquinaria y los dispositivos asociados del mismo no sean accesibles, excepto para los trabajos de mantenimiento y los casos de emergencia.

1.5.1. All passenger lifts must have their own individual lift machinery. This requirement does not apply to lifts in which the counterweights are replaced by a second car.
|

1.6. Mandos
|
1.5.2. The installer of the lift must ensure that the lift machinery and the associated devices of a lift are not accessible except for maintenance and in emergencies.

- a fault in the electrical installation does not give rise to a dangerous situation.

2.1. El ascensor deberá estar diseñado y fabricado de forma que sea imposible el acceso al hueco recorrido por el ascensor, excepto para los trabajos de mantenimiento y los casos de emergencia. Deberá imposibilitarse la utilización ordinaria del ascensor antes de que una persona se encuentre en dicho hueco.

2. HAZARDS TO PERSONS OUTSIDE THE CAR
|
|
2.2. El ascensor deberá ser diseñado y fabricado para impedir el riesgo de aplastamiento cuando la cabina esté en una de sus posiciones extremas.
|
2.1. The lift must be designed and constructed to ensure that the space in which the car travels is inaccessible except for maintenance or in emergencies. Before a person enters that space, normal use of the lift must be made impossible.
|
|
Se logra este objetivo mediante un espacio libre o refugio más allá de las posiciones extremas.

2.2. The lift must be designed and constructed to prevent the risk of crushing when the car is in one of its extreme positions.
|
|
No obstante, en casos excepcionales, y ofreciendo a los Estados miembros la posibilidad de dar un acuerdo previo, en particular en inmuebles ya existentes, si fuere imposible aplicar esta solución, podrán preverse otros medios apropiados a fin de evitar este riesgo.

The objective will be achieved by means of free space or refuge beyond the extreme positions.
|
|
2.3. Los niveles de entrada y salida de la cabina deberán estar equipados con puertas en los rellanos cuya resistencia mecánica sea la suficiente según las condiciones de utilización previstas.

However, in specific cases, in affording Member States the possibility of giving prior approval, particularly in existing buildings, where this solution is impossible to fulfil, other appropriate means may be provided to avoid this risk.
|

2.3. The landings at the entrance and exit of the car must be equipped with landing doors of adequate mechanical resistance for the conditions of use envisaged.

- the opening of a landing door when the car is still moving and outside a prescribed landing zone.

3. RIESGOS PARA LAS PERSONAS SITUADAS DENTRO DE LA CABINA
|
However, all landing movements with the doors open shall be allowed in specified zones on condition that the levelling speed is controlled.
|
|
3.1. Las cabinas de los ascensores deberán estar completamente cerradas por paredes macizas incluidos el suelo y el techo, con excepción de los orificios de ventilación, y equipadas de puertas macizas. Las puertas de las cabinas deberán diseñarse e instalarse de forma que la cabina no pueda efectuar ningún movimiento, salvo los movimientos de puesta a nivel contemplados en el párrafo tercero del punto 2.3, si no están cerradas las puertas, y de modo que se detenga en caso de apertura de las mismas.

3. HAZARDS TO PERSONS IN THE CAR
|
|
Las puertas de las cabinas deberán permanecer cerradas y bloqueadas en caso de pararse el ascensor entre dos niveles, si existiere un riesgo de caída entre la cabina y el hueco, o en caso de ausencia de hueco.
|
3.1. Lift cars must be completely enclosed by full-length walls, fitted floors and ceilings included, with the exception of ventilation apertures, and with full-length doors. These doors must be so designed and installed that the car cannot move, except for the landing movements referred to in the third subparagraph of Section 2.3, unless the doors are closed, and comes to a halt if the doors are opened.

3.2. El ascensor deberá estar provisto de dispositivos que, en caso de interrumpirse el suministro de energía o de avería de componentes, impidan su caída libre o movimientos ascendentes incontrolados de la cabina.

The doors of the car must remain closed and interlocked if the lift stops between two levels where there is a risk of a fall between the car and the shaft or if there is no shaft.
|

3.2. In the event of a power cut or failure of components the lift must have devices to prevent free fall or uncontrolled upward movements of the car.
|

Este dispositivo deberá ser capaz de detener la cabina en las condiciones de carga nominal y velocidad máxima previstas por el instalador del ascensor. La parada debida a la acción de dicho dispositivo no deberá provocar una desaceleración peligrosa para los ocupantes en todos los casos de carga.

The device preventing the free fall of the car must be independent of the means of suspension of the car.
|
|
3.3. Deberán instalarse dispositivos amortiguadores de la marcha entre el fondo del hueco y el suelo de la cabina.
|
This device must be able to stop the car at its rated load and at the maximum speed anticipated by the installer of the lift. Any stop occasioned by this device must not cause deceleration harmful to the occupants whatever the load conditions.
|
|
En este caso, se medirá el espacio libre citado en el punto 2.2 estando los amortiguadores totalmente comprimidos.
|
3.3. Buffers must be installed between the bottom of the shaft and the floor of the car.
|
|
Este requisito no se aplicará a los ascensores cuya cabina, debido al diseño del sistema de arrastre, no pueda entrar en el espacio libre previsto en el punto 2.2.
|
In this case, the free space referred to in Section 2.2 must be measured with the buffers totally compressed.
|
|
3.4. Los ascensores deberán diseñarse y fabricarse de forma que no puedan ponerse en movimiento si no están en situación de funcionar los dispositivos mencionados en el punto 3.2.
|
This requirement does not apply to lifts in which the car cannot enter the free space referred to in Section 2.2 by reason of the design of the drive system.
|
|
4. OTROS RIESGOS
|
3.4. Lifts must be so designed and constructed as to make it impossible for them to be set in motion if the device provided for in Section 3.2 is not in an operational position.
|
|
4.1. Cuando estén motorizadas, las puertas de los rellanos, las puertas de las cabinas o el conjunto de unas y otras deberán estar equipadas de un dispositivo que evite el peligro de aplastamiento mientras se mueven.
|
4. OTHER HAZARDS
|
|
4.2. Las puertas de los rellanos, cuando deban contribuir a la protección del edificio contra los incendios, incluidas aquellas que contengan partes acristaladas, deberán presentar una adecuada resistencia al fuego, caracterizada por su integridad y sus propiedades de aislamiento (no propagación de la llama) y de transmisión del calor (radiación térmica).
|
4.1. The landing doors and car doors or the two doors together, where motorized, must be fitted with a device to prevent the risk of crushing when they are moving.
|
|
4.3. Los posibles contrapesos deberán ser instalados de manera que se evite todo riesgo de colisión con la cabina o de caída sobre ésta.
|
4.2. Landing doors, where they have to contribute to the protection of the building against fire, including those with glass parts, must be suitably resistant to fire in terms of their integrity and their properties with regard to insulation (containment of flames) and the transmission of heat (thermal radiation).
|
|
4.4. Los ascensores deberán estar equipados con medios que permitan liberar y evacuar a las personas retenidas en la cabina.

4.3. Counterweights must be so installed as to avoid any risk of colliding with or falling on to the car.
|
|
4.5. Las cabinas estarán dotadas de un equipo de comunicación bidireccional que permita una comunicación permanente con un servicio de intervención rápida.

4.4. Lifts must be equipped with means enabling people trapped in the car to be released and evacuated.
|
|
4.6. Los ascensores deberán diseñarse y fabricarse de forma que, en caso de superación de la temperatura máxima prevista por el instalador del ascensor en el local de la máquina, puedan finalizar los movimientos en curso pero no reaccionen a nuevas órdenes de los mandos.

4.5. Cars must be fitted with two-way means of communication allowing permanent contact with a rescue service.
|
|
4.7. Las cabinas deberán diseñarse y fabricarse de manera que garanticen una ventilación suficiente para los ocupantes, incluso en caso de parada prolongada.
|
4.6. Lifts must be so designed and constructed that, in the event of the temperature in the lift machine exceeding the maximum set by the installer of the lift, they can complete movements in progress but refuse new commands.
|

4.8. Las cabinas deberán disponer de una iluminación suficiente que se ponga en marcha cuando se utilicen o cuando tengan abierta una puerta; además, las cabinas contarán con una iluminación de socorro.

4.7. Cars must be designed and constructed to ensure sufficient ventilation for passengers, even in the event of a prolonged stoppage.
|
|
4.9. Los medios de comunicación previstos en el punto 4.5 y la iluminación de socorro prevista en el punto 4.8 deberán diseñarse y fabricarse de manera que funcionen incluso cuando falte por completo el suministro normal de energía. Su tiempo de funcionamiento deberá ser suficiente para permitir la intervención normal de los servicios de socorro.

4.8. The car should be adequately lit whenever in use or whenever a door is opened; there must also be emergency lighting.
|
|
4.10. El circuito de mando de los ascensores utilizables en caso de incendio deberá diseñarse y fabricarse de modo que pueda condenarse el servicio de determinados niveles y permitir un control prioritario del ascensor por parte de los equipos de socorro.
|
4.9. The means of communication referred to in Section 4.5 and the emergency lighting referred to in Section 4.8 must be designed and constructed so as to function even without the normal power supply. Their period of operation should be long enough to allow normal operation of the rescue procedure.
|
|
5. MARCADO
|
4.10. The control circuits of lifts which may be used in the event of fire must be designed and manufactured so that lifts may be prevented from stopping at certain levels and allow for priority control of the lift by rescue teams.
|

5.1. Además de las indicaciones mínimas que se requieren para toda máquina con arreglo al punto 1.7.3 del Anexo I de la Directiva 89/392/CEE, todas las cabinas deberán ir provistas de una placa bien visible que indique claramente la carga nominal en kilogramos y el número máximo de personas cuyo transporte se autoriza.

5. MARKING
|
|
5.2. Cuando el aparato esté diseñado para que las personas retenidas en la cabina puedan liberarse sin ayuda exterior, las instrucciones al efecto deberán ser claras y figurar de forma visible en la cabina.
|
5.1. In addition to the minimum particulars required for any machine pursuant to Section 1.7.3 of Annex I to Directive 89/392/EEC, each car must bear an easily visible plate clearly showing the rated load in kilograms and the maximum number of passengers which may be carried.
|
|
6. INSTRUCCIONES DE USO
|
5.2. If the lift is designed to allow people trapped in the car to escape without outside help, the relevant instructions must be clear and visible in the car.
|

6.1. Los componentes de seguridad citados en el Anexo IV irán acompañados de un manual de instrucciones redactado en una lengua oficial del Estado miembro del instalador del ascensor o en otra lengua comunitaria aceptada por éste, de forma que:

6. INSTRUCTIONS FOR USE

6.1. The safety components referred to in Annex IV must be accompanied by an instruction manual drawn up in an official language of the Member State of the lift installer or another Community language acceptable to him, so that:
|
|

6.2. Cada ascensor irá acompañado de una documentación redactada en la lengua o lenguas oficiales de la Comunidad, las cuales podrán ser determinadas, de conformidad con el Tratado, por el Estado miembro en que se instale el ascensor. Dicha documentación constará como mínimo:

- de un manual de instrucciones que contenga los planos y esquemas necesarios para el uso corriente, así como los necesarios para el mantenimiento, la inspección, la reparación, las revisiones periódicas y las operaciones de socorro citadas en el punto 4.4;

6.2. Each lift must be accompanied by documentation drawn up in the official language(s) of the Community, which may be determined in accordance with the Treaty by the Member State in which the lift is installed. The documentation shall contain at least:
|
|
- de un cuaderno de incidencias, en el que se podrán anotar las reparaciones y, en su caso, las revisiones periódicas.
|
- an instruction manual containing the plans and diagrams necessary for normal use and relating to maintenance, inspection, repair, periodic checks and the rescue operations referred to in Section 4.4,
|
|
|
- a logbook in which repairs and, where appropriate, periodic checks can be noted.
|

1. El examen «CE» de tipo es el procedimiento mediante el cual un organismo notificado comprueba y certifica que un ejemplar representativo de un componente de seguridad permitirá al ascensor en el que se monte correctamente cumplir las disposiciones pertinentes de la Directiva.

A. EC type-examination of safety components

2. El fabricante del componente de seguridad, o su representante establecido en la Comunidad, presentará la solicitud de examen «CE» de tipo ante el organismo notificado que él mismo elija.

1. EC type-examination is the procedure whereby a notified body ascertains and certifies that a representative specimen of a safety component will permit the lift to which it is correctly fitted to satisfy the relevant requirements of the Directive.

If the representative specimen of the safety component complies with the provisions of the Directive applicable to it, the notified body must issue an EC type-examination certificate to the applicant. The certificate must contain the name and address of the manufacturer of the safety component, the conclusions of the check, any conditions of validity of the certificate and the particulars necessary to identify the approved type.

6. The Commission, the Member States and the other notified bodies may obtain a copy of the certificate and, on a reasoned request, a copy of the technical dossier and reports of examinations, calculations and tests carried out. If the notified body refuses to issue an EC type-examination certificate to the manufacturer, it must state the detailed grounds for refusal. Provision must be made for an appeal procedure.

8. EC type-examination certificates and the dossiers and correspondence relating to EC type-examination procedures must be drawn up in an official language of the Member State where the notified body is established or in a language acceptable to it.

9. The manufacturer of the safety component or his authorized representative must keep with the technical documentation copies of EC type-examination certificates and their additions for a period of 10 years after the last safety component has been manufactured.
|
|
B. Examen «CE» de tipo para los ascensores

Where neither the manufacturer of a safety component nor his authorized representative is established in the Community, the obligation to keep the technical documentation available falls to the person who places the safety component on the Community market.
|

B. EC type-examination of lifts

5. If the model lift complies with the provisions of the Directive applicable to it, the notified body must issue an EC type-examination certificate to the applicant. The certificate must contain the name and address of the lift installer, the conclusions of the check, any conditions of validity of the certificate and the particulars necessary to identify the approved type.

MINIMUM CRITERIA TO BE TAKEN INTO ACCOUNT BY MEMBER STATES FOR THE NOTIFICATION OF BODIES

6. The body must take out liability insurance unless its liability is assumed by the State in accordance with national law, or the Member State itself is directly responsible for the tests.

3.4. The manufacturer of the safety components must undertake to discharge the obligations arising from the quality assurance system as approved and to ensure that it is maintained in an appropriate and efficient manner.

4.4. Additionally, the notified body may pay unexpected visits to the manufacturer of the safety component.

All the elements, requirements and provisions adopted by the manufacturer must be documented in a systematic and orderly manner in the form of written measures, procedures and instructions. 4.4. Additionally, the notified body may pay unexpected visits to the manufacturer of the safety components. At the time of such visits, the notified body may carry out tests or have them carried out in order to check the proper functioning of the quality assurance system where necessary; it must provide the manufacturer of the safety components with a visit report and, if a test has been carried out, with a test report.

La documentación relativa al sistema de aseguramiento de calidad deberá permitir una interpretación uniforme de los programas, planos, manuales y expedientes de calidad.

All the elements, requirements and provisions adopted by the installer of a lift shall be documented in a systematic and orderly manner in the form of written policies, procedures and instructions. The quality assurance system documentation must permit a consistent interpretation of the quality programmes, plans, manuals and records.

- the manufacturing, quality control and quality assurance techniques, processes and systematic actions that will be used,
|
|
- los exámenes y ensayos que se realizarán antes, durante y después de la instalación (1).

- the examinations and tests that will be carried out before, during and after installation (1),
|
|
- los expedientes de calidad, tales como los informes de inspección y los datos de ensayos y de calibración, los informes sobre la cualificación del personal afectado, etc.

3.3. El organismo notificado evaluará el sistema de aseguramiento de calidad para determinar si cumple los requisitos a que se refiere el apartado 3.2. Cuando éste se ajuste a la norma armonizada correspondiente, dará por supuesta la conformidad con dichos requisitos (2).

3.3. The notified body must assess the quality assurance system to determine whether it satisfies the requirements referred to in Section 3.2. It presumes conformity with these requirements in respect of quality assurance systems that implement the relevant harmonized standard (2).

3.4. El instalador se comprometerá a cumplir las obligaciones que se deriven del sistema de aseguramiento de calidad, tal como se haya aprobado y a hacer que siga resultando adecuado y eficaz.

3.4. The installer must undertake to discharge the obligations arising from the quality assurance system as approved and to ensure that it is maintained in an appropriate and efficient manner.

The installer shall keep the notified body that has approved the quality assurance system informed of any intended updating of the quality assurance system.

4. Vigilancia bajo la responsabilidad del organismo notificado

4.1. El objetivo de la vigilancia consiste en asegurar que el instalador cumple debidamente las obligaciones que le impone el sistema de aseguramiento de calidad aprobado.

4.1. The purpose of surveillance is to make sure that the installer duly fulfils the obligations arising out of the approved quality assurance system.

4.2. El instalador permitirá el acceso del organismo notificado a los lugares de fabricación, inspección, montaje, instalación, ensayo y almacenamiento para que éste pueda hacer las inspecciones necesarias, y le proporcionará toda la información necesaria, en especial:

4.2. The installer must allow the notified body access for inspection purposes to the manufacture, inspection, assembly, installation, testing and storage locations and must provide it with all necessary information, in particular:
|

- la documentación sobre el sistema de aseguramiento de calidad;
|
- the quality assurance system documentation,
|
|
- los expedientes de calidad, como por ejemplo, los informes de inspección y los datos sobre ensayos y los datos sobre calibración, los informes sobre la cualificación del personal, etc.

- the quality records, such as inspection reports and test data, calibration data, reports on the qualifications of the personnel concerned, etc.
|
|
4.3. El organismo notificado efectuará periódicamente auditorías a fin de cerciorarse de que el instalador mantiene y aplica el sistema de aseguramiento de calidad y facilitará un informe de la auditoría al instalador.

4.3. The notified body must periodically carry out audits to make sure that the installer maintains and applies the quality assurance system and must provide an audit report to the installer.
|
|
4.4. Además, el organismo notificado podrá efectuar visitas de inspección de improviso al instalador. En el transcurso de dichas visitas, el organismo notificado podrá realizar o hacer realizar ensayos con objeto de comprobar, si se considera necesario, el buen funcionamiento del sistema de aseguramiento de calidad. Presentará al instalador un informe de la visita de inspección y, si se hubiera realizado un ensayo, un informe del ensayo.

4.4. Additionally the notified body may pay unexpected visits to the installer. During such visits the notified body may carry out, or cause to be carried out, tests to verify that the quality assurance system is functioning correctly, if necessary. The notified body must provide the installer with a visit report and, if a test has taken place, with a test report.

5. Durante diez años a partir de la última fecha de fabricación del producto, el instalador tendrá a disposición de las autoridades nacionales:

- la documentación a que se refiere el segundo guión del segundo párrafo del apartado 3.1;

- the documentation referred to in the second indent of Section 3.1,

- las adaptaciones a que se refiere el párrafo segundo del apartado 3.4;

- the updating referred to in the second paragraph of Section 3.4,
|
|
- las decisiones e informes del organismo notificado a que se refieren el último párrafo del apartado 3.4 y los apartados 4.3 y 4.4.

- the decisions and reports from the notified body which are referred to in the final paragraph of Section 3.4, Sections 4.3 and 4.4.

6. Cada organismo notificado deberá comunicar a los demás organismos notificados las informaciones pertinentes relativas a las autorizaciones de los sistemas de calidad expedidas y retiradas.

6. Each notified body must give the other notified bodies the relevant information concerning the quality assurance system approvals issued and withdrawn.

7. Los expedientes y la correspondencia relativa a los procedimientos de aseguramiento de la calidad de la producción, se redactarán en una lengua oficial del Estado miembro donde esté establecido el organismo notificado, o en una lengua aceptada por éste.

7. Documentation and correspondence relating to the production quality assurance procedures shall be drawn up in an official language of the Member State in which the notified body is established or in a language acceptable to it.
