Having regard to the Treaty establishing the European Community,

ņemot vērā Padomes 1996. gada 28. oktobra Regulu (EK) Nr. 2200/96 par augļu un dārzeņu tirgus kopīgo organizāciju [1], kurā jaunākie grozījumi izdarīti ar Regulu (EK) Nr. 545/2002 [2], un jo īpaši tās 2. panta 2. punktu un 3. panta 3. punkta c) apakšpunktu,

Having regard to Council Regulation (EC) No 2200/96 of 28 October 1996 on the common organisation of the market in fruit and vegetables(1), as last amended by Regulation (EC) No 545/2002(2), and in particular Article 2(2) and Article 3(3)(c) thereof,

Whereas:

(1) Zemenes ir iekļautas to produktu sarakstā, kuri uzskaitīti Regulas (EK) Nr. 2200/96 I pielikumā un attiecībā uz kuriem jāpieņem standarti. Komisijas 1987. gada 30. marta Regula (EEK) Nr. 899/87, ar kuru nosaka kvalitātes standartus ķiršiem un zemenēm [3] un kurā jaunākie grozījumi izdarīti ar Regulu (EK) Nr. 888/97 [4], ir grozīta un turpmāk vairs nevar nodrošināt juridisku skaidrību.

(1) Strawberries are among the products listed in Annex I to Regulation (EC) No 2200/96 for which standards must be adopted. Commission Regulation (EEC) No 899/87 of 30 March 1987 laying down quality standards for cherries and strawberries(3), as last amended by Regulation (EC) No 888/97(4), has been amended and can no longer ensure legal clarity.

(2) Skaidrības labad noteikumi par zemenēm būtu jāatdala no noteikumiem par citiem produktiem, uz ko attiecas Regula (EEK) Nr. 899/87. Šajā nolūkā un lai saglabātu pārredzamību pasaules tirgū, būtu jāņem vērā tas standarts zemenēm, ko ieteikusi Apvienoto Nāciju Organizācijas Eiropas Ekonomikas komisijas (ANO/EEK) darba grupa jautājumos par produktu, kas ātri bojājas, standartizāciju un kvalitātes uzlabošanu. Noteikumi attiecībā uz zemenēm tādēļ būtu jāpārstrādā, un Regula (EEK) Nr. 899/87 attiecīgi jāgroza.

(2) For clarity, the rules on strawberries should be separated from those on other products under Regulation (EEC) No 899/87. On this occasion, in the interest of preserving transparency on the world market, account should be taken of the standard for strawberries recommended by the Working Party on Standardisation of Perishable Produce and Quality Development of the United Nations Economic Commission for Europe (UN/ECE). The rules concerning strawberries should therefore be recast and Regulation (EEC) No 899/87 amended accordingly.

(3) Sakarā ar jauno standartu piemērojumu neapmierinošas kvalitātes produkti tirgū neparādītos, ražošana tiktu orientēta uz patērētāju prasībām un tiktu sekmētas tirdzniecības attiecības, kuru pamatā ir godīga konkurence, tādējādi palīdzot uzlabot rentabilitāti.

(3) Application of new standards should remove products of unsatisfactory quality from the market, bring production into line with consumer requirements and facilitate trade based on fair competition, thereby helping to improve profitability.

(4) Šie standarti ir piemērojami visos tirdzniecības posmos. Pārvadājumi lielos attālumos, ilgstoša uzglabāšana un dažādie procesi, kam produkti tiek pakļauti, var izraisīt pārmaiņas šo produktu bioloģiskās attīstības dēļ vai tādēļ, ka tiem raksturīga tendence bojāties. Šīs pārmaiņas būtu jāņem vērā, piemērojot standartus tajos tirdzniecības posmos, kas seko pēc nosūtīšanas. Tā kā "ekstra" kategorijas produkti ir jāšķiro un jāiesaiņo īpaši uzmanīgi, attiecībā uz tiem ir pieļaujama tikai svaiguma un piebrieduma samazināšanās.

(4) The standards are applicable at all marketing stages. Long-distance transport, storage over a certain period and the various processes the products undergo may cause some degree of deterioration owing to the biological development of the products or their perishable nature. Account should be taken of such deterioration when applying the standard at the marketing stages following dispatch. As products in the "Extra" Class have to be particularly carefully sorted and packaged, only lack of freshness and turgidity is to be taken into account in their case.

(5) Pietiekamai gatavībai būtu jābūt vienai no obligātajām prasībām attiecībā uz zemenēm, lai tās varētu uzskatīt par tirdzniecības standartam atbilstošām, bet pašreiz pieejamie zinātniskie un tehniskie dati neļauj noteikt ticamus un objektīvus kritērijus, lai novērtētu minēto prasību.

(5) Sufficient maturity should be one of the minimum requirements for strawberries. Existing scientific and technical data do not permit reliable and objective criteria for assessing this requirement to be defined.

(6) Dažu tādu šķirņu zemeņu, kas viegli zaudē kausiņus ražas novākšanas laikā, tirdzniecība bez kausiņiem ir tradicionāla Somijas un Dānijas ražošanas reģionos. Abas minētās dalībvalstis saskaņā ar Regulu (EK) Nr. 2200/96 ir lūgušas, lai standarti neattiektos uz minētajos reģionos ražotajām un patērētajām zemenēm. Šajā regulā tādēļ būtu jāiekļauj attiecīga atkāpe.

(6) The marketing without calyx of strawberries of certain varieties that easily lose their calyx at harvest is traditional in the region of production in Finland and in Denmark. These two Member States have, in accordance with Regulation (EC) No 2200/96, requested that strawberries produced and consumed in those regions should not have to comply with the standards. This Regulation should therefore include a derogation to that effect.

(7) Šajā regulā paredzētie pasākumi saskan ar Svaigu augļu un dārzeņu pārvaldības komitejas atzinumu,

IR PIEŅĒMUSI ŠO REGULU.

HAS ADOPTED THIS REGULATION:

1. pants

Pielikumā ir noteikts tirdzniecības standarts zemenēm, uz ko attiecas KN kods 08101000.

Article 1

Standartu piemēro visos tirdzniecības posmos atbilstīgi nosacījumiem, kas paredzēti Regulā (EK) Nr. 2200/96.

The marketing standard for strawberries falling within CN code 0810 10 00 shall be as set out in the Annex.

Tomēr posmos, kas seko nosūtīšanai, attiecībā uz standarta prasībām ir pieļaujams, ka produktiem var būt:

The standard shall apply at all marketing stages under the conditions laid down in Regulation (EC) No 2200/96.

a) neliels svaiguma un piebrieduma pakāpes samazinājums;

However, at stages following dispatch, products may show in relation to the requirements of the standard:

b) produktiem, kas nav augstākās kategorijas produkti, nelielas pārmaiņas to attīstības dēļ un tādēļ, ka tiem ir raksturīga tendence bojāties.

(a) a slight lack of freshness and turgidity;

1. Atkāpjoties no šīs regulas noteikumiem, tādu šķirņu zemenes, kas viegli zaudē kausiņus ražas novākšanas laikā un izaudzētas Somijā un Dānijā, attiecīgajā audzēšanas reģionā var pārdot bez kausiņiem.

2. Šā panta 1. punkta piemērošanas nolūkā uz katra iesaiņojuma vai partijas papildus citām prasītajām norādēm ir šāda norāde:

1. Notwithstanding the provisions of this Regulation, strawberries of varieties that easily lose their calyx at harvest may be sold without calyx in the region of production in Finland and in Denmark.

Regulu (EEK) Nr. 899/87 groza šādi:

Regulation (EEC) No 899/87 is amended as follows:

a) virsrakstu aizstāj ar šādu: "Komisijas 1987. gada 30. marta Regula (EEK) Nr. 899/87, ar ko nosaka kvalitātes standartu ķiršiem";

(a) The title is replaced by the following: "Commission Regulation (EEC) No 899/87 of 30 March 1987 laying down quality standards for cherries".

b) Regulas 1. panta 1. punktu aizstāj ar šo:

(b) Article 1(1) is replaced by the following: "1. The marketing standards for cherries, falling within CN code 0809 20 95, shall be as set out in the Annex."

"1. Tirdzniecības standarts ķiršiem, uz ko attiecas KN kods 08092095, ir noteikts pielikumā.";

(c) Annex II is deleted.

c) svītro II pielikumu;

(d) In Annex I, the words "Annex I" are replaced by the following word: "Annex".

d) I pielikumā vārdus "I pielikums" aizstāj ar šādu vārdu: "Pielikums".

4. pants

Article 3

Šī regula stājas spēkā 20. dienā pēc tās publicēšanas Eiropas Kopienu Oficiālajā Vēstnesī.

This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Communities.

To piemēro no pirmās dienas trešajā mēnesī, kas seko tam, kad tā stājās spēkā.

It shall apply from the first day of the third month following its entry into force.

Šī regula uzliek saistības kopumā un ir tieši piemērojama visās dalībvalstīs.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

STANDARTS ZEMENĒM

I. PRODUKTA DEFINĪCIJA

Šis standarts attiecas uz no Fragaria L. ģints iegūto šķirņu zemenēm, ko paredzēts piegādāt patērētājiem svaigā veidā, un šis standarts neattiecas uz rūpnieciskai pārstrādei paredzētām zemenēm.

II. NOTEIKUMI PAR KVALITĀTI

ANNEX

Standarta mērķis ir noteikt kvalitātes prasības zemenēm pēc to sagatavošanas un iesaiņošanas.

A. Prasību minimums

STANDARD FOR STRAWBERRIES

Ievērojot īpašos noteikumus attiecībā uz katru kategoriju un pieļaujamās pielaides, visu kategoriju zemenēm jābūt:

I. DEFINITION OF PRODUCE

- veselām,

This standard applies to strawberries of varieties (cultivars) grown from the genus Fragaria L. to be supplied fresh to the consumer, strawberries for industrial processing being excluded.

- nebojātām; produkciju, ko skārusi puve vai tādi bojājumi, ka tā kļuvusi nederīga pārtikai, neizmanto,

II. PROVISIONS CONCERNING QUALITY

- tīrām, praktiski bez jebkādiem redzamiem svešķermeņiem,

The purpose of the standard is to define the quality requirements of strawberries after preparation and packaging.

- svaigām no skata, bet nemazgātām,

A. Minimum requirements

- praktiski bez kaitēkļiem,

In all classes, subject to the special provisions for each class and the tolerances allowed, the strawberries must be:

- praktiski bez kaitēkļu izraisītiem bojājumiem,

- intact,

- ar kausiņiem (izņemot meža zemenes); kausiņiem un kātiem (ja tie ir klāt) jābūt svaigiem un zaļiem,

- sound; produce affected by rotting or deterioration such as to make it unfit for consumption is excluded,

- bez pārmērīga ārējā mitruma,

- clean, practically free of any visible foreign matter,

- bez svešas izcelsmes smaržas un/vai garšas.

- fresh in appearance, but not washed,

Zemenēm jābūt uzmanīgi lasītām.

- practically free from pests,

Tām jābūt pietiekami izaugušām un gatavām. Zemeņu attīstības stadijai un stāvoklim jābūt tādam, lai tās varētu:

- practically free from damage caused by pests,

- pārvadāt un pārkraut, un

- with the calyx (except in the case of wild strawberries); the calyx and the stalk (if present) must be fresh and green,

- apmierinošā stāvoklī piegādāt galapunktā.

- free of abnormal external moisture,

B. Klasifikācija

- free of any foreign smell and/or taste.

Zemenes klasificē trīs kategorijās, kas noteiktas turpmāk:

The strawberries must have been carefully picked.

i) "Ekstra" kategorija

They must be sufficiently developed and display satisfactory ripeness. The development and the condition must be such as to enable them:

Šīs kategorijas zemenēm jābūt augstākā labuma. Tām jābūt ar attiecīgajai šķirnei raksturīgajām īpašībām.

- to withstand transport and handling, and

Pēc izskata tām jābūt spīdīgām, ievērojot šķirnes īpašības.

- to arrive in satisfactory condition at the place of destination.

Tām jābūt tīrām no augsnes.

B. Classification

Tām jābūt bez bojājumiem, izņemot ļoti vieglus virspusējus bojājumus, ar noteikumu, ka tie neietekmē produkta kopējo izskatu, kvalitāti, uzglabāšanas kvalitāti un izskatu iesaiņojumā.

The strawberries are classified in three classes defined below:

ii) I kategorija

(i) "Extra" Class

Šīs kategorijas zemenēm jābūt labas kvalitātes zemenēm. Tām jābūt ar šai šķirnei raksturīgo formu un krāsu.

The strawberries in this class must be of superior quality. They must be characteristic of the variety.

Tomēr ir pieļaujami šādi nelieli bojājumi ar noteikumu, ka tie neietekmē produkta kopējo izskatu, kvalitāti, uzglabāšanas kvalitāti un izskatu iesaiņojumā:

They must be bright in appearance, allowing for the characteristics of the variety.

- nelieli formas defekti,

They must be free from soil.

- bālgani plankumi, kas nepārsniedz vienu desmito daļu no augļa virsmas,

They must be free from defects with the exception of very slight superficial defects provided these do not affect the general appearance of the produce, the quality, the keeping quality and presentation in the package.

- viegli virspusēji iespiedumi.

(ii) Class I

Tām jābūt praktiski tīrām no augsnes.

Strawberries in this class must be of good quality. In colouring and shape, they must be characteristic of the variety.

iii) II kategorija

The following slight defects, however, may be allowed provided these do not affect the general appearance of the produce, the quality, the keeping quality and presentation in the package:

Šajā kategorijā ietilpst zemenes, ko nevar pieskaitīt augstākajām kategorijām, bet kas atbilst iepriekš precizētajam prasību minimumam.

- slight defect of shape,

Ar noteikumu, ka zemenes saglabā tām raksturīgās īpašības attiecībā uz kvalitāti, uzglabāšanas kvalitāti un izskatu, ir pieļaujami šādi defekti:

- a white patch, not exceeding one tenth of the surface area of the fruit,

- formas izmaiņas,

- slight superficial pressure marks.

- bālgani plankumi, kas nepārsniedz vienu piektdaļu no augļa virsmas,

They must be practically free from soil.

- viegli, sausi saspiedumi, kas neizplatīsies tālāk,

(iii) Class II

- nelielas augsnes pēdas.

This class includes strawberries which do not qualify for inclusion in the higher classes, but satisfy the minimum requirements specified above.

III. NOTEIKUMI PAR ŠĶIROŠANU PĒC LIELUMA

The following defects may be allowed provided the strawberries retain their essential characteristics as regards the quality, the keeping quality and presentation:

Lielumu nosaka pēc lielākā vidus daļas diametra.

- defects of shape,

Zemeņu minimālajam izmēram ir jābūt šādam:

- a white patch not exceeding one fifth of the surface area of the fruit,

- "Ekstra" kategorija: 25 mm,

- slight dry bruising not likely to spread,

- I un II kategorija: 18 mm.

- slight traces of soil.

Attiecībā uz meža zemenēm nav noteikts minimālais izmērs.

III. PROVISIONS CONCERNING SIZING

IV. NOTEIKUMI PAR PIELAIDĒM

Size is determined by the maximum diameter of the equatorial section.

Attiecībā uz norādītās kategorijas prasībām neatbilstīgiem produktiem katrā iesaiņojumā ir pieļaujamas kvalitātes un lieluma pielaides.

Strawberries must be of the following minimum sizes:

A. Kvalitātes pielaides

- "Extra" Class: 25 mm,

i) "Ekstra" kategorija

- Classes I and II: 18 mm.

5 % zemeņu pēc skaita vai svara, kas neatbilst kategorijas prasībām, bet atbilst I kategorijas prasībām vai izņēmuma kārtā atzīstamas par minētās kategorijas pielaidēm atbilstīgām. No šiem 5 % kopumā ne vairāk kā 2 % var būt bojātas zemenes.

There is no minimum size for wild strawberries.

ii) I kategorija

IV. PROVISIONS CONCERNING TOLERANCES

10 % zemeņu pēc skaita vai svara, kas neatbilst kategorijas prasībām, bet atbilst II kategorijas prasībām vai izņēmuma kārtā atzīstamas par minētās kategorijas pielaidēm atbilstīgām. No šiem 10 % kopumā ne vairāk kā 2 % var būt bojātas zemenes.

Tolerances in respect of quality and size shall be allowed in each package for produce not satisfying the requirements of the class indicated.

iii) II kategorija

A. Quality tolerances

10 % zemeņu pēc skaita vai svara, kas neatbilst ne kategorijas prasībām, ne prasību minimumam, izņemot produktus, ko skārusi puve, saspiedums vai citāds bojājums, kura dēļ tās nav derīgas lietošanai pārtikā. No šiem 10 % kopumā ne vairāk kā 2 % var būt bojātas zemenes.

(i) "Extra" Class

B. Lieluma pielaides

5 % by number or weight of strawberries not satisfying the requirements of the class but meeting those of Class I or, exceptionally, coming within the tolerances of that class. Of these 5 % not more than 2 % in total may consist of spoilt fruit.

Attiecībā uz visām kategorijām: 10 % zemeņu pēc skaita vai svara, kas neatbilst noteiktajam minimālajam lielumam.

(ii) Class I

10 % by number or weight of strawberries not satisfying the requirements of the class but meeting those of Class II or, exceptionally, coming within the tolerances of that class. Of these 10 %, not more than 2 % in total may consist of spoilt fruit.

Katra iesaiņojuma saturam jābūt viendabīgam, un tajā var būt tikai vienas izcelsmes, šķirnes un kvalitātes zemenes.

10 % by number or weight of strawberries satisfying neither the requirements of the class nor the minimum requirements, with the exception of produce affected by rotting, severe bruising or any other deterioration rendering it unfit for consumption. Of these 10 %, not more than 2 % in total may consist of spoilt fruit.

"Ekstra" kategorijas zemenēm, izņemot meža zemenes, jābūt īpaši viendabīgām un "pareizām" pēc gatavības pakāpes, krāsas un lieluma. I kategorijā zemeņu lielums var būt mazāk viendabīgs.

B. Size tolerances

Iesaiņojuma satura redzamajai daļai jāatspoguļo viss saturs.

For all classes: 10 % by number or weight of strawberries not conforming to the minimum size.

V. PROVISIONS CONCERNING PRESENTATION

Zemenēm jābūt iesaiņotām tā, lai produkcija būtu pienācīgi aizsargāta.

A. Uniformity

Materiāliem, ko izmanto iesaiņojuma iekšpusē, jābūt jauniem, tīriem un tādas kvalitātes, kas produktu pasargātu no jebkādiem ārējiem vai iekšējiem bojājumiem. Materiālus ar tirdzniecības aprakstiem, jo īpaši papīru vai zīmogus, atļauts izmantot ar noteikumu, ka drukāšana vai marķēšana ir izdarīta ar netoksisku krāsu vai līmi.

The contents of each package must be uniform and contain only strawberries of the same origin, variety and quality.

"Ekstra" kategorijas zemeņu noformējumam ir jābūt īpaši rūpīgam.

In the "Extra" Class, strawberries - with the exception of wood strawberries - must be particularly uniform and regular with respect to degree of ripeness, colour and size. In Class I, strawberries may be less uniform in size.

Iesaiņojumiem jābūt bez svešķermeņiem.

The visible part of the contents of the package must be representative of the entire contents.

VI. NOTEIKUMI PAR MARĶĒŠANU

B. Packaging

Uz katra iesaiņojuma vienā iesaiņojuma pusē grupētos burtos, kas ir salasāmi, neizdzēšami, kā arī redzami no ārpuses, jābūt šādām norādēm:

The strawberries must be packed in such a way as to protect the produce properly.

A. Identifikācija

The materials used inside the package must be new, clean and of a quality such as to avoid causing any external or internal damage to the produce. The use of materials, particularly of paper or stamps bearing trade specifications is allowed provided the printing or labelling has been done with non-toxic ink or glue.

Iesaiņotājs un/vai nosūtītājs: nosaukums un adrese vai simbolisks apzīmējums, ko piešķīrusi vai atzinusi oficiāla iestāde. Gadījumā, ja izmanto kodu (simbolisku apzīmējumu), norāde "fasētājs un/vai ekspeditors (vai līdzvērtīgs saīsinājums)" tomēr jānorāda tieši kopā ar kodu (simbolisku apzīmējumu).

Fruit in the "Extra" Class must be particularly well presented.

B. Produkta veids

Packages must be free of all foreign matter.

- "Zemenes", ja iesaiņojuma saturs no ārpuses nav redzams.

VI. PROVISIONS CONCERNING MARKING

- Šķirnes nosaukums (nav obligāts).

Each package must bear the following particulars, in letters grouped on the same side, legibly and indelibly marked, and visible from the outside:

A. Identification

- Izcelsmes valsts un pēc izvēles arī apgabals, kurā produkts izaudzēts, vai valsts, reģiona vai vietas ģeogrāfiskais nosaukums.

Packer and/or dispatcher: name and address or officially issued or accepted code mark. However, in the case where a code mark is used, the reference "Packer and/or dispatcher (or equivalent abbreviations)" must be indicated in close proximity to the code mark.

D. Tirdzniecības specifikācija

B. Nature of produce

- Kategorija.

- "Strawberries", if the contents of the package are not visible from the outside.

B. Oficiālā kontroles atzīme (nav obligāta)

- Name of the variety (optional).
