KOMMITTÉN FÖR UTRIKES- OCH SÄKERHETSPOLITIK HAR BESLUTAT FÖLJANDE

Having regard to the Treaty on European Union, and in particular third subparagraph of Article 25 thereof,

med beaktande av fördraget om Europeiska unionen, särskilt artikel 25 tredje stycket,

Having regard to Council Joint Action 2006/319/CFSP of 27 April 2006 on the European Union military operation in support of the United Nations Organisation Mission in the Democratic Republic of the Congo (MONUC) during the election process [1] (Operation EUFOR RD Congo), and in particular Article 10(5) thereof,

med beaktande av rådets gemensamma åtgärd 2006/319/GUSP av den 27 april 2006 om Europeiska unionens militära operation till stöd för Förenta nationernas uppdrag i Demokratiska republiken Kongo (Monuc) under valprocessen [1] (Operation EUFOR RD Congo), särskilt artikel 10.5, och

Whereas:

av följande skäl:

(1) Under Article 10(5) of Joint Action 2006/319/CFSP, the Council authorised the Political and Security Committee (PSC) to take relevant decisions on the setting up of a Committee of Contributors for the European Union military operation in the Democratic Republic of the Congo (DRC) in support of MONUC during the election process.

(1) I artikel 10.5 i gemensam åtgärd 2006/319/GUSP bemyndigar rådet kommittén för utrikes- och säkerhetspolitik (Kusp) att fatta nödvändiga beslut för att inrätta en bidragande länders kommitté för Europeiska unionens militära operation i Demokratiska republiken Kongo till stöd för Monuc under valprocessen.

(2) The European Council Conclusions of Nice of 7, 8 and 9 December 2000 and Brussels of 24 and 25 October 2002 laid down the arrangements for the participation of third States in crisis management operations and the setting up of a Committee of Contributors.

(2) I slutsatserna från Europeiska råden i Nice den 7, 8 och 9 december 2000 och Bryssel den 24 och 25 oktober 2002 fastställs arrangemangen för tredjeländers deltagande i krishanteringsoperationer och inrättandet av en kommitté bestående av de bidragande länderna.

(3) The Committee of Contributors will play a key role in the day-to-day management of the operation. It will be the main forum where contributing States collectively address questions relating to the employment of their forces in the operation. The PSC, which exercises the political control and strategic direction of the operation, will take account of the views expressed by the Committee of Contributors.

(3) Bidragande länders kommitté kommer att spela en nyckelroll i den dagliga ledningen av operationen. Den kommer att vara det viktigaste forumet, där bidragande länder gemensamt tar upp frågor som gäller användningen av deras styrkor i operationen. Kusp, som utövar den politiska kontrollen och den strategiska ledningen av operationen, kommer att beakta synpunkterna från bidragande länders kommitté.

(4) In accordance with Article 6 of the Protocol on the position of Denmark annexed to the Treaty on European Union and to the Treaty establishing the European Community, Denmark does not participate in the elaboration and implementation of decisions and actions of the European Union which have defence implications,

(4) I enlighet med artikel 6 i det till fördraget om Europeiska unionen och fördraget om upprättandet av Europeiska gemenskapen fogade protokollet om Danmarks ställning deltar Danmark inte i arbetet med att utarbeta och genomföra sådana unionsbeslut och unionsåtgärder som har anknytning till försvarsfrågor.

HAS DECIDED AS FOLLOWS:

Article 1

Establishment and terms of reference

A Committee of Contributors for the European Union military operation in the DRC in support of MONUC during the election process (hereafter called "the CoC") is hereby established. Its terms of reference are laid down in the European Council Conclusions of Nice and Brussels.

Härmed inrättas bidragande länders kommitté (nedan kallad "kommittén") för Europeiska unionens militära operation i Demokratiska republiken Kongo till stöd för Monuc under valprocessen. Kommitténs uppgifter fastställs i slutsatserna från Europeiska råden i Nice och Bryssel.

Composition

1. The CoC members shall be as follows:

1. Kommittén skall bestå av

- representatives of all Member States,

- företrädare för alla medlemsstater,

- representatives of third States participating in the operation and providing significant military contributions, as referred to in the Annex.

- företrädare för de tredjeländer som deltar i operationen och ger betydande militära bidrag till operationen och som anges i bilagan.

2. The Director General of the European Union Military Staff and the EU Operation Commander shall also be entitled to attend, or to be represented at, the CoC meetings.

2. Generaldirektören för Europeiska unionens militära stab och EU:s operationschef skall också ha rätt att delta i eller vara företrädda vid kommitténs möten.

In accordance with the European Council conclusions of Nice and without prejudice to the prerogatives of the Presidency, the CoC for this operation shall be chaired by the Secretary-General/High Representative or his representative in close consultation with the Presidency, assisted by the Chairman of the European Union Military Committee (CEUMC) or his representative.

I enlighet med slutsatserna från Europeiska rådet i Nice och utan att ordförandeskapets rättigheter påverkas skall generalsekreteraren/den höge representanten eller dennes företrädare, i nära samråd med ordförandeskapet, vara ordförande i kommittén för denna operation, och biträdas av ordföranden för Europeiska unionens militära kommitté eller dennes företrädare.

Meetings

Möten

1. The CoC shall be convened by the Chair on a regular basis. Where circumstances require, emergency meetings may be convened on the Chair's initiative, or at the request of a member.

1. Kommittén skall regelbundet sammankallas av ordföranden. Om omständigheterna så kräver kan krismöten sammankallas på ordförandens initiativ eller på en ledamots begäran.

2. The Chair shall circulate in advance a provisional agenda and documents relating to the meeting. Summary of the meetings shall be circulated after each meeting.

2. Ordföranden skall i förväg skicka ut en preliminär dagordning och dokument som rör mötet. Sammanfattande noter skickas ut efter varje möte.

3. Representatives of the Commission and other persons may be invited for relevant parts of the discussion, as appropriate.

3. Företrädare för kommissionen och andra personer får vid behov inbjudas att delta i valda delar av diskussionen.

1. Except as provided in paragraph 3 and without prejudice to the competencies of the PSC and the responsibilities of the EU Operation Commander,

- unanimity of the representatives of States contributing to the operation shall apply when the CoC takes decisions on the day-to-day management of the operation,

- skall företrädarna för de stater som bidrar till operationen vara enhälliga, när kommittén fattar beslut om den dagliga ledningen av operationen,

- unanimity of the CoC members shall apply when the CoC makes recommendations on possible adjustments to operational planning, including possible adjustment to objectives.

- skall kommitténs ledamöter vara enhälliga, när kommittén lämnar rekommendationer om eventuella anpassningar av den operativa planeringen, inklusive en eventuell anpassning av målen.

The abstention of a member shall not preclude unanimity.

Enhällighet skall gälla även om en ledamot lägger ned sin röst.

2. The Chair shall establish that the majority of the representatives of States entitled to take part in the deliberations is present.

2. Ordföranden skall fastställa att majoriteten av företrädarna för de stater som har rätt att delta i överläggningarna är närvarande.

3. All procedural questions shall be settled by the simple majority of the members present at the meeting.

3. Alla procedurfrågor skall avgöras med enkel majoritet bland de ledamöter som är närvarande vid mötet.

4. Denmark shall not take part in any decision of the Committee.

4. Danmark skall inte delta i något beslut av kommittén.

1. The Council Security Regulations shall apply to the meetings and proceedings of the CoC. In particular, representatives in the CoC shall possess adequate security clearance.

1. Rådets säkerhetsbestämmelser skall gälla kommitténs möten och arbete. I synnerhet skall företrädarna i kommittén ha genomgått lämplig säkerhetsprövning.

2. The deliberations of the CoC shall be covered by the obligation of professional secrecy, except insofar the CoC unanimously decides otherwise.

2. Kommitténs överläggningar skall omfattas av tystnadsplikt, om inte kommittén enhälligt beslutar något annat.

This Decision shall enter into force on the day of its adoption.

Detta beslut träder i kraft samma dag som det antas.
