Points 3.10.4, 4.15, 4.16 and 4.17 of the Guidelines on national reginal aid(1) are hereby replaced by the following text: "3.10.4. Regions with a low population density and the outermost regions:

Punkterna 3.10.4, 4.15, 4.16 och 4.17 i riktlinjerna för statligt stöd för regionala ändamål(1) skall ersättas med följande: "3.10.4 Regioner med låg befolkningstäthet och regioner i gemenskapens yttersta randområden:

- subject to the ceiling for each Member State mentioned at point 3.9, regions with a population density of less than 12,5 inhabitants per square kilometre (19) and the outermost regions may also qualify for the derogation in question.

- Inom ramen för det tak som gäller för varje medlemsstat och som anges i punkt 3.9 kan undantaget ifråga tillämpas också på regioner med en befolkningstäthet som är lägre än 12,5 invånare per kvadratkilometer (19) och på regioner i gemenskapens yttersta randområden.

4.15. Regional aid aimed at reducing a firm's current expenses (operating aid) is normally prohibited.

4.15 Regionalstöd som är avsedda att minska ett företags löpande kostnader (driftsstöd) är i princip förbjudna.

Exceptionally, however, such aid may be granted in regions eligible under the derogation in Article 87(3)(a)(2) of the Treaty provided that it is justified in terms of its contribution to regional development and its nature and its level is proportional to the handicaps it seeks to alleviate (36). It is for the Member State to demonstrate the existence of any handicaps and gauge their importance. Operating aid must be limited in time and progressively reduced.

Stöd av denna typ kan dock i undantagsfall beviljas i regioner som faller under undantaget i artikel 87.3 a(2) under förutsättning att det är motiverat på grundval av stödets art och dess bidrag till den regionala utvecklingen och under förutsättning att dess nivå står i förhållande till de handikapp som det är avsett att kompensera för (36). 4.16. Exceptionally, operating aid which is not both progressively reduced and limited in time may be authorised provided that the conditions set out below are met.

4.16 Driftsstöd som inte är både tidsbegränsade och avtagande får undantagsvis godkännas på de villkor som anges nedan.

4.16.1. In the outermost regions qualifying for exemption under Article 87(3)(a) and (c) of the Treaty, and in the regions of low population density qualifying for exemption either under Article 87(3)(a) or under 87(3)(c) on the basis of the population density test referred to at point 3.10.4, aid which is not both progressively reduced and limited in time and is intended to offset in part additional transport costs (37) may be authorised under special conditions (38). It is the task of the Member State to prove that such additional costs exist and to determine their amount.

4.16.1 Stöd som inte är både avtagande och tidsbegränsade och som är avsedda att delvis kompensera för merkostnader för transport (37) får tillåtas i de regioner i de yttersta områdena som omfattas av undantaget i artikel 87.3 a och i 87.3 c och i regioner med låg befolkningstäthet som är berättigade till undantag antingen enligt artikel 87.3 a eller, med stöd av det kriterium för befolkningstäthet som anges i 3.10.4, enligt undantaget i artikel 87.3 c under förutsättning att särskilda villkor uppfylls (38). 4.16.2. Moreover, in the outermost regions qualifying for exemption under Article 87(3)(a) and (c) of the Treaty, aid which is not both progressively reduced and limited in time may be authorised in so far as it is intended to offset the additional costs arising in the pursuit of economic activity from the factors identified in Article 299(2) of the Treaty, the permanence and combination of which severely restrain the development of such regions (remoteness, insularity, small size, difficult topography and climate, and economic dependence on a few products). It is the task of the Member State to determine the amount of the additional costs and to prove that they are linked to the factors identified in Article 299(2).

4.16.2 I de regioner i de yttersta randområdena som omfattas av undantaget i artikel 87.3 a och c får stöd som inte är både avtagande och tidsbegränsat dessutom tillåtas, i den mån som det bidrar till att kompensera för merkostnader för sådant utövande av ekonomisk verksamhet som är förenad med de faktorer som anges i artikel 299.2 i fördragt, vilka faktorer på grund av sin bestående natur och sammanlagda verkan allvarligt hämmar utvecklingen i dessa områden (avlägsen belägenhet, ökaraktär, ringa storlek, besvärliga terräng- och klimatförhållanden, ekonomiskt beroende av ett fåtal produkter). The proposed aid will have to be justified in terms of its contribution to regional development, and its nature; its level will have to be proportional to the additional costs it is intended to offset.

Det planerade stödet skall motiveras med hänsyn till stödets art och dess bidrag till den regionala utvecklingen: dess nivå skall stå i proportion till de merkostnader som det är avsett att kompensera för.

The level of compensation for additional costs will also be examined on the basis of the level of development achieved by the region.

Kompensationen för merkostnaderna kommer också att undersökas på grundval av utvecklingsnivån i den ifrågavarande regionen.

Lastly, the aid will be authorised by the Commission for a period which will come to an end at the latest on expiry of the period of validity of the national regional aid maps in force at the time of the Commission's approval of the scheme in order to ensure that regular re-evaluation of the aid-level guarantees its long-term relevance to the situation of the region concerned.

Slutligen kommer kommissionen att godkänna stödet för en period (som löper ut senast vid utgången av giltighetstiden för de regionalstödskartor som gäller när kommissionen godkänner den aktuella stödordningen) för att genom en regelbunden omprövning av stödets nivå kunna säkerställa att det har en långvarig betydelse med tanke på situationen i den berörda regionen.

4.17. Operating aid intended to promote exports (39) between Member States is not allowed."

The Commission shall apply these amendments, as from the date on which the decision is notified to the Member States, to new State aid notifications and to those notifications on which it has taken no decision by that date.

Kommissionen kommer att tillämpa dessa ändringar från och med den dag då medlemsstaterna delgivits beslutet, på nya anmälningar om statligt stöd och på anmälningar som kommissionen den dagen ännu inte har beslutat om.

All "unlawful aid" within the meaning of point (f) of Article 1 of Council Regulation (EC) No 659/1999(3) shall be appraised in accordance with the rules and guidelines prevailing at the time when the aid is granted.

Varje olagligt stöd i den mening som avses i artikel 1 punkt f i rådets förordning (EG) nr 659/1999(3) kommer att bedömas enligt de regler och riktlinjer som gäller då stödet beviljas.
