COMMISSION DIRECTIVE 97/38/EC of 20 June 1997 amending Annex C to Council Directive 92/51/EEC on a second general system for the recognition of professional education and training to supplement Council Directive 89/48/EEC (Text with EEA relevance)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

EUROPEISKA GEMENSKAPERNAS KOMMISSION HAR ANTAGIT DETTA DIREKTIV

Having regard to the Treaty establishing the European Community,

med beaktande av Fördraget om upprättandet av Europeiska gemenskapen,

Having regard to Council Directive 92/51/EEC of 18 June 1992 on a second general system for the recognition of professional education and training to supplement Directive 89/48/EEC (1), as last amended by Commission Directive 95/43/EC (2), and in particular Article 15 thereof,

med beaktande av rådets direktiv 92/51/EEG av den 18 juni 1992 om en andra generell ordning för erkännande av behörighetsgivande högre utbildning, en ordning som kompletterar den som föreskrivs i direktiv 89/48/EEG (1), senast ändrad genom kommissionens direktiv 95/43/EG (2), särskilt artikel 15 i detta, och

Whereas the government of the United Kingdom has made a reasoned request to remove three of its training courses from Annex C to the Directive;

med beaktande av följande:

Whereas the United Kingdom has altered its education and training course for medical laboratory scientific officer, with the result that this course now requires three years of higher education and thus comes under Council Directive 89/48/EEC (3); whereas, accordingly, the course of education and training for the profession of medical laboratory scientific officer should no longer be included in Annex C since holders of qualifications obtained under the former regulation and which are covered by Directive 92/51/EEC could, by virtue of Article 1 (a) of Directive 89/48/EEC, apply to be treated in the same way;

Förenade kungariket Storbritannien och Nordirland har gjort en väl underbyggd begäran om att ta bort tre utbildningar från förteckningen i bilaga C.

Whereas the profession of prosthetist is currently not regulated in the United Kingdom;

Förenade kungariket har ändrat utbildningen för medicinsk laboratorieassistent ("medical laboratory scientific officer") så att denna nu kräver tre års högre studier. Denna yrkeskompetens kommer därmed att omfattas av rådets direktiv 89/48/EEG (3) och bör därför tas bort från bilaga C. Innehavare av kvalifikationer erhållna under de tidigare bestämmelserna och som omfattas av direktiv 92/51/EEG kan nämligen göra anspråk på samma behandling, med hänvisning till artikel 1a i direktiv 89/48/EEG.

Whereas the profession of probation officer is no longer regulated in the United Kingdom;

Yrket protestekniker ("prosthetist") är för närvarande inte reglerat i Förenade kungariket.

Whereas the measures provided for by the present directive are in conformity with the opinion given by the Committee established by Article 15 of Council Directive 92/51/EEC,

Yrket kriminalvårdsassistent ("probation officer") är inte längre reglerat i Förenade kungariket.

HAS ADOPTED THIS DIRECTIVE:

De åtgärder som föreskrivs i detta direktiv är förenliga med yttrandet från kommittén som upprättats enligt artikel 15 i rådets direktiv 92/51/EEG.

HÄRIGENOM FÖRESKRIVS FÖLJANDE.

Article 1

Annex C to Directive 92/51/EEC is hereby amended as shown in the Annex to this Directive.

Artikel 1

Bilaga C till direktiv 92/51/EEG ändras enligt bilagan till det här direktivet.

Article 2

1. Member States shall adopt the laws, regulations and administrative provisions necessary for them to comply with this Directive by 30 September 1997. They shall forthwith inform the Commission thereof.

Artikel 2

When Member States adopt these measures, the latter shall include a reference to this Directive or be accompanied by such reference at the time of their official publication. The methods of making such a reference shall be laid down by the Member States.

1. Medlemsstaterna skall före den 30 september 1997 anta de lagar och andra författningar som är nödvändiga för att följa detta direktiv. De skall genast underrätta kommissionen om detta.

2. Member States shall communicate to the Commission the texts of the main provisions of national law which they adopt in the field governed by this Directive.

När en medlemsstat antar dessa bestämmelser skall de innehålla en hänvisning till detta direktiv eller åtföljas av en sådan hänvisning när de offentliggörs. Närmare föreskrifter om hur hänvisningen skall göras skall varje medlemsstat själv utfärda.

2. Medlemsstaterna skall till kommissionen överlämna texterna till centrala bestämmelser i nationell lagstiftning som de antar inom det område som omfattas av detta direktiv.

Article 3

This Directive is addressed to the Member States.

Artikel 3

Detta direktiv riktar sig till medlemsstaterna.

Article 4

This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Communities.

Artikel 4

Detta direktiv träder i kraft den tjugonde dagen efter att det har offentliggjorts i Europeiska gemenskapernas officiella tidning.

Annex C of Directive 92/51/EEC is amended as follows:

BILAGA

Under '5. United Kingdom courses accredited as National Vocational Qualifications or Scottish Vocational Qualifications` the following indents are deleted:

Bilaga C till direktiv 92/51/EEG ändras på följande sätt:

'- medical laboratory scientific officer,

Under "5. Utbildning i Förenade kungariket Storbritannien och Nordirland som ger Nationell yrkeskompetens eller Skotsk yrkeskompetens" skall följande strecksatser utgå:

- probation officer,

"- Medicinsk laboratorieassistent (`medical laboratory scientific officer`).

- prosthetist,`.

- Kriminalvårdsassistent (`probation officer`).

- Protestekniker (`prosthetist`)."
