COUNCIL DIRECTIVE 97/2/EC of 20 January 1997 amending Directive 91/629/EEC laying down minimum standards for the protection of calves

RÅDETS DIREKTIV 97/2/EG av den 20 januari 1997 om ändring av direktiv 91/629/EEG om fastställande av lägsta djurskyddskrav för kalvar

THE COUNCIL OF THE EUROPEAN UNION,

EUROPEISKA UNIONENS RÅD HAR ANTAGIT DETTA DIREKTIV

Having regard to the Treaty establishing the European Community, and in particular Article 43 thereof,

med beaktande av Fördraget om upprättandet av Europeiska gemenskapen, särskilt artikel 43 i detta,

Having regard to the proposal from the Commission (1),

med beaktande av kommissionens förslag (1),

Having regard to the opinion of the European Parliament (2),

med beaktande av Europaparlamentets yttrande (2), och

Whereas, pursuant to Article 6 of Directive 91/629/EEC (3), the Scientific Veterinary Committee gave an opinion on 9 November 1995, on the basis of which the Commission drew up a report which was submitted to the European Parliament and the Council;

med beaktande av följande:

Whereas, on the basis of the conclusions of that report, it is appropriate to amend certain provisions of Directive 91/629/EEC in order to ensure that the rules are based on scientific evidence and do not go beyond what is necessary to enable the common organization of markets to function effectively;

I enlighet med artikel 6 i direktiv 91/629/EEG (3) avgav Vetenskapliga veterinärmedicinska kommittén den 9 november 1995 ett yttrande på grundval av vilket kommissionen har utarbetat en rapport som har överlämnats till Europaparlamentet och rådet.

Whereas Declaration No 24 annexed to the Final Act of the Treaty on European Union calls upon the European institutions and the Member States, when drafting and implementing Community legislation, to pay full regard to the welfare requirements of animals;

På grundval av slutsatserna i denna rapport bör vissa bestämmelser i direktiv 91/629/EEG ändras för att säkerställa att reglerna bygger på vetenskapliga bevis och inte går längre än vad som är nödvändigt för att den gemensamma organisationen av marknaderna skall kunna fungera effektivt.

Whereas the harmonization of rules concerning the conditions of calf-rearing in the framework of the common organization of the markets is necessary to ensure the rational development of production under satisfactory conditions of competition; whereas in this regard it is recognized scientifically that calves should benefit from an environment corresponding to their needs as a herd-living species; whereas, for that reason, they should be reared in groups; whereas calves, both group-housed and individually penned, must have sufficient space for exercise, contact with other cattle, and for normal movements when standing up or lying down;

I förklaring nr 24 som utgör en bilaga till slutakten till Fördraget om Europeiska unionen anmodas gemenskapsinstitutionerna och medlemsstaterna att vid utformning och införande av gemenskapslagstiftning fullt ut ta hänsyn till djurens behov av välbefinnande.

Whereas it is necessary to allow time for holdings to make the necessary arrangements to comply with the new rules,

För att säkerställa en rationell utveckling av produktionen på tillfredsställande konkurrensvillkor är det nödvändigt att harmonisera reglerna för uppfödning av kalvar inom ramen för den gemensamma organisationen av marknaderna. I detta avseende är det ett vetenskapligt erkänt faktum att kalvar bör hållas i en miljö som är lämpad för dem som flockdjur och de bör därför födas upp i grupp. Kalvar bör, både då de hålls i grupp eller i enskilda boxar, ha tillräckligt med utrymme för motion, kontakt med andra nötkreatur och normal rörelsefrihet när de står upp eller ligger ned.

HAS ADOPTED THIS DIRECTIVE:

Det är nödvändigt att ge anläggningarna tid att vidta nödvändiga åtgärder för att följa de nya reglerna.

HÄRIGENOM FÖRESKRIVS FÖLJANDE.

Article 1

Directive 91/629/EEC is hereby amended as follows:

Artikel 1

1. Article 3 (3) shall be replaced by the following:

'3. From 1 January 1998, the following provisions shall apply on all newly built or rebuilt holdings and on all those brought into use after that date:

1. Artikel 3.3 ersätts med följande:

(a) no calf shall be confined in an individual pen after the age of eight weeks, unless a veterinarian certifies that its health or behaviour requires it to be isolated in order to receive treatment. The width of any individual pen for a calf shall be at least equal to the height of the calf at the withers, measured in the standing position, and the length shall be at least equal to the body length of the calf, measured from the tip of the nose to the caudal edge of the tuber ischii (pin bone), multiplied by 1,1.

"3. Från och med den 1 januari 1998 skall följande bestämmelser gälla för nybyggda eller ombyggda anläggningar och för alla anläggningar som tas i bruk efter denna tidpunkt:

Individual pens for calves (except those for isolating sick animals) must not have solid walls, but perforated walls which allow the calves to have direct visual and tactile contact;

a) En kalv får inte vara instängd i en enskild box efter åtta veckors ålder, om inte en veterinär har intygat att dess hälsotillstånd eller beteende kräver att den isoleras för behandling. Bredden på kalvens box skall minst motsvara kalvens mankhöjd, mätt i stående ställning, och längden skall vara minst lika med kalvens kroppslängd, mätt från nosspetsen till den bakre spetsen på tuber ischii (sittbenet) multiplicerat med 1,1.

(b) For calves kept in groups, the unobstructed space allowance available to each calf shall be at least equal to 1,5 m² for each calf with a live weight of less than 150 kilograms, at least equal to 1,7 m² for each calf with a live weight of 150 kilograms or more but less than 220 kilograms, and at least equal to 1,8 m² for each calf with a live weight of 220 kilograms or more.

However, the provisions of this paragraph shall not apply to:

b) För kalvar som föds upp i grupp skall det fria utrymmet för varje kalv minst vara lika med 1,5 m² för varje kalv på under 150 kg levande vikt, 1,7 m² för varje kalv på över 150 kg levande vikt men under 220 kg och åtminstone 1,8 m² för varje kalv på över 220 kg levande vikt.

- holdings with fewer than six calves;

Bestämmelserna i den här punkten skall dock inte tillämpas på

- calves kept with their mothers for suckling.

- anläggningar med färre än sex kalvar,

From 31 December 2006, the provisions provided for above shall apply on all holdings.`

2. The second indent of Article 3 (4) shall be deleted.

Från och med den 31 december 2006 skall ovan nämnda bestämmelser tillämpas på alla anläggningar."

3. Article 4 (2) shall be deleted.

4. In Article 6, the date '1 October 1997` shall be replaced by '1 January 2006`.

3. Artikel 4.2 utgår.

4. I artikel 6 ersätts datumet "den 1 oktober 1997" med datumet "den 1 januari 2006".

Article 2

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive not later than 31 December 1997. They shall forthwith inform the Commission thereof.

Artikel 2

When Member States adopt these measures, they shall contain a reference to this Directive or shall be accompanied by such reference on the occasion of their official publication. The methods of making such reference shall be laid down by Member States.

1. Medlemsstaterna skall sätta i kraft de bestämmelser i lagar och andra författningar som är nödvändiga för att följa detta direktiv senast den 31 december 1997. De skall genast underrätta kommissionen om detta.

2. However, as from the date set in paragraph 1, Member States may, in compliance with the general rules of the Treaty, maintain or apply within their territories stricter provisions for the protection of calves than those laid down in this Directive. They shall inform the Commission of any such measures.

När en medlemsstat antar dessa bestämmelser skall de innehålla en hänvisning till detta direktiv eller åtföljas av en sådan hänvisning när de offentliggörs. Närmare föreskrifter om hur hänvisningen skall göras skall varje medlemsstat själv utfärda.

2. Från den dag som anges i punkt 1 får dock medlemsstaterna, i enlighet med de allmänna bestämmelserna i fördraget, inom sina territorier bibehålla eller tillämpa strängare bestämmelser för skydd av kalvar är de som anges i detta direktiv. De skall underrätta kommissionen om dessa åtgärder.

Article 3

This Directive shall enter into force on the 20th day following that of its publication in the Official Journal of the European Communities.

Artikel 3

Detta direktiv träder i kraft den tjugonde dagen efter det att den har offentliggjorts i Europeiska gemenskapernas officiella tidning.

Article 4

This Directive is addressed to the Member States.

Artikel 4

Detta direktiv riktar sig till medlemsstaterna.
