THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code [1], and in particular Article 247 thereof,

ob upoštevanju Uredbe Sveta (EGS) št. 2913/92 z dne 12. oktobra 1992 o carinskem zakoniku Skupnosti [1] in zlasti člena 247 Uredbe,

Having regard to Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code [2], and in particular Article 76 thereof,

Whereas:

ob upoštevanju naslednjega:

(1) By Council Regulation (EC) No 980/2005 of 27 June 2005 applying a scheme of generalised tariff preferences [3], the Community granted generalised tariff preferences to Cambodia.

(1) Z Uredbo Sveta (ES) št. 980/2005 z dne 27. junija 2005 o uporabi sheme splošnih tarifnih preferencialov [3] je Skupnost Kambodži podelila splošne tarifne preferenciale.

(2) Regulation (EEC) No 2454/93 establishes the definition of the concept of originating products to be used for the purposes of the scheme of generalised tariff preferences. Regulation (EEC) No 2454/93 also provides for derogations from that definition in favour of least developed beneficiary countries benefiting from the generalised system of preferences (GSP) which submit an appropriate request to that effect to the Community.

(2) Uredba (EGS) št. 2454/93 uvaja opredelitev pojma izdelki s poreklom, ki se uporablja za namene sheme splošnih tarifnih preferencialov. Uredba (EGS) št. 2454/93 prav tako določa odstopanja od te opredelitve v korist najmanj razvitim državam upravičenkam, ki koristijo ugodnosti splošnega sistema preferencialov (SSP) in za ta namen Skupnosti predložijo ustrezen zahtevek.

(3) Cambodia has benefited from such derogation for certain textiles since 1997, in the last instance by virtue of Commission Regulation (EC) No 1614/2000 [4]. The validity of Regulation (EC) No 1614/2000 has been extended until 31 December 2006.

(3) Kambodža koristi ta odstopanja za nekatere tekstilne izdelke od leta 1997, v zadnjem primeru na podlagi Uredbe Komisije (ES) št. 1614/2000 [4]. Veljavnost Uredbe (ES) št. 1614/2000 je bila podaljšana do 31. decembra 2006.

(4) By letter dated 29 June 2006 Cambodia submitted a request for prolongation of the derogation in accordance with Article 76 of Regulation (EEC) No 2454/93.

(4) Z dopisom z dne 29. junija 2006 je Kambodža predložila zahtevek za podaljšanje odstopanja v skladu s členom 76 Uredbe (EGS) št. 2454/93.

(5) When the validity of Regulation (EC) No 1614/2000 was extended until 31 December 2006, it was expected that new, simpler and more development-friendly GSP rules of origin would be in force before expiry of the derogation. However the new GSP rules of origin are not expected to be adopted before 31 December 2006.

(5) Ob podaljšanju veljavnosti Uredbe (ES) št. 1614/2000 do 31. decembra 2006 je bilo pričakovati, da bodo pred datumom izteka odstopanja v veljavi nova pravila SSP, ki bodo enostavnejša in bodo spodbujala razvoj. Vendar sprejetja novih pravil SSP ni pričakovati pred 31. decembrom 2006.

(6) Application of the GSP rules of origin currently in force would have an adverse effect on investment, and employment in Cambodia as well as on ability of existing industry in Cambodia to continue its exports to the Community.

(6) Uporaba pravil SSP o poreklu, ki so trenutno v veljavi, bi imela negativen učinek na naložbe in zaposlovanje v Kambodži, kakor tudi na zmožnost obstoječe industrije v Kambodži, da nadaljuje z izvozom v Skupnost.

(7) The prolongation period should take account of the time necessary to adopt and implement new GSP rules of origin. In addition, the interests of traders concluding contracts both in Cambodia and in the Community, as well as the stability of Cambodian industry, require that the derogation should be prolonged for a period sufficient to permit the continuation or conclusion of longer term contracts.

(7) Obdobje podaljšanja mora upoštevati čas, ki je potreben za sprejetje in izvajanje novih pravil SSP o poreklu. Nadalje zahtevajo interesi trgovcev, ki sklepajo pogodbe tako v Kambodži kot v Skupnosti, kot tudi stabilnost industrije v Kambodži, da se odstopanje podaljša za obdobje, ki je zadostno, da se nadaljujejo ali zaključijo dolgoročne pogodbe.

(8) The derogation should therefore be prolonged until 31 December 2008. However, in order to ensure fair treatment for Cambodia and for other least developed countries, the continuing need for the derogation should be reviewed once new GSP rules of origin are adopted.

(8) Odstopanje je zato treba podaljšati do 31. decembra 2008. Da bi bilo zagotovljeno pošteno obravnavanje tako Kambodže kot drugih najmanj razvitih držav, pa je treba po sprejetju novih pravil SSP o poreklu preveriti, če potreba po odstopanju še obstaja.

(9) Regulation (EC) No 1614/2000 should therefore be amended accordingly.

(9) Uredbo (ES) št. 1614/2000 je zato treba ustrezno spremeniti.

(10) The measures provided for in this Regulation are in accordance with the opinion of the Customs Code Committee,

HAS ADOPTED THIS REGULATION:

Article 2 of Regulation (EC) No 1614/2000 is amended as follows:

Člen 2 Uredbe (ES) št. 1614/2000 se spremeni:

1. In the first paragraph the date " 31 December 2006" is replaced by " 31 December 2008";

1. v prvem odstavku se datum " 31. decembra 2006" spremeni v " 31. decembra 2008";

2. The second paragraph is replaced by the following:

2. drugi odstavek se nadomesti z naslednjim:

"The continuing need for the derogation shall however be reviewed once the new rules of origin of the generalised system of preferences are adopted."

"Vendar je po sprejetju novih pravil splošnega sistema preferencialov o poreklu treba preveriti, če potreba po odstopanju še obstaja.".

This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Union.

Ta uredba začne veljati sedmi dan po objavi v Uradnem listu Evropske unije.

It shall apply from 1 January 2007.

Uporablja se od 1. januarja 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Ta uredba je v celoti zavezujoča in se neposredno uporablja v vseh državah članicah.
