o podaljšanju ukrepov, uvedenih z Uredbo (ES) št. 920/2005, za začasno odstopanje od Uredbe št. 1 z dne 15. aprila 1958 o določitvi jezikov, ki se uporabljajo v Evropski gospodarski skupnosti, in Uredbe št. 1 z dne 15. aprila 1958 o določitvi jezikov, ki se uporabljajo v Evropski skupnosti za atomsko energijo

THE COUNCIL OF THE EUROPEAN UNION,

SVET EVROPSKE UNIJE JE –

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 342 thereof,

ob upoštevanju Pogodbe o delovanju Evropske unije in zlasti člena 342 Pogodbe,

Whereas:

ob upoštevanju naslednjega:

(1) Council Regulation (EC) No 920/2005 of 13 June 2005 amending Regulation No 1 of 15 April 1958 determining the languages to be used by the European Economic Community and Regulation No 1 of 15 April 1958 determining the languages to be used by the European Atomic Energy Community and introducing temporary derogation measures from those Regulations [1] accorded Irish the status of official language and working language of the institutions of the European Union.

(1) Z Uredbo Sveta (ES) št. 920/2005 z dne 13. junija 2005 o spremembi Uredbe št. 1 z dne 15. aprila 1958 o določitvi jezikov, ki se uporabljajo v Evropski gospodarski skupnosti, in Uredbe št. 1 z dne 15. aprila 1958 o določitvi jezikov, ki se uporabljajo v Evropski skupnosti za atomsko energijo, in o uvedbi ukrepov za začasno odstopanje od teh uredb [1] je bil irskemu jeziku dodeljen status uradnega in delovnega jezika institucij Unije.

(2) Regulation (EC) No 920/2005 provides that, for practical reasons and on a transitional basis, the institutions of the Union are not to be bound by the obligation to draft and translate all acts, including judgments of the Court of Justice, in the Irish language, with the exception of Regulations adopted jointly by the European Parliament and the Council. It is for the Council to determine, not later than 4 years from the date of application of Regulation (EC) No 920/2005 and at 5-yearly intervals thereafter, whether to put an end to this derogation.

(2) V Uredbi (ES) št. 920/2005 je določeno, da iz praktičnih razlogov in na prehodni osnovi institucije Unije niso zavezane sestaviti vseh aktov, vključno s sodbami Sodišča, v irskem jeziku in jih prevesti vanj, razen uredb, ki jih skupaj sprejmeta Evropski parlament in Svet. Svet mora v roku štirih let od dneva začetka veljavnosti Uredbe (ES) št. 920/2005 in zatem vsakih pet let ugotavljati, ali naj se to odstopanje konča.

(3) The institutions of the Union will continue to take steps to improve public access to information in Irish on the activities of the Union. Nevertheless, there are still difficulties in recruiting a sufficient number of Irish-language translators, legal/linguistic experts, interpreters and assistants. It is therefore necessary to extend the derogation provided for in the first paragraph of Article 2 of Regulation (EC) No 920/2005 for a period of 5 years from 1 January 2012,

(3) Institucije Unije bodo še naprej sprejemale pobude, s katerimi naj bi izboljšali dostop državljanov do informacij o dejavnostih Unije v irskem jeziku. Kljub temu pa so še vedno težave pri zaposlovanju zadostnega števila prevajalcev, pravnikov lingvistov, tolmačev in asistentov za irski jezik. Zaradi tega bi bilo treba odstopanje, določeno na podlagi člena 2 Uredbe (ES) št. 920/2005 podaljšati od 1. januarja 2012 za obdobje petih let –

HAS ADOPTED THIS REGULATION:

SPREJEL NASLEDNJO UREDBO:

Article 1

Člen 1

The derogation provided for in the first paragraph of Article 2 of Regulation (EC) No 920/2005 is hereby extended for a period of 5 years from 1 January 2012.

Odstopanje iz prvega odstavka člena 2 Uredbe Sveta (ES) št. 920/2005 se od 1. januarja 2012 podaljša za obdobje petih let.

This Article shall not apply to Regulations adopted jointly by the European Parliament and the Council.

Ta člen se ne uporablja za uredbe, ki jih skupno sprejmeta Evropski parlament in Svet.

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

Ta uredba začne veljati na dan objave v Uradnem listu Evropske unije.

It shall apply from 1 January 2012.

Uporablja se od 1. januarja 2012.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Ta uredba je v celoti zavezujoča in se neposredno uporablja v vseh državah članicah.
