Whereas the Council, in its resolution of 21 January 1974 concerning a social action programme (3), included among the priorities action for the purpose of achieving equality between men and women as regards access to employment and vocational training and promotion and as regards working conditions, including pay;
|

Whereas, with regard to pay, the Council adopted on 10 February 1975 Directive 75/117/EEC on the approximation of the laws of the Member States relating to the application of the principle of equal pay for men and women (4);

ob upoštevanju mnenja Evropskega parlamenta [1],

Whereas Community action to achieve the principle of equal treatment for men and women in respect of access to employment and vocational training and promotion and in respect of other working conditions also appears to be necessary ; whereas, equal treatment for male and female workers constitutes one of the objectives of the Community, in so far as the harmonization of living and working conditions while maintaining their improvement are inter alia to be furthered ; whereas the Treaty does not confer the necessary specific powers for this purpose;

ker je Svet v svoji Resoluciji z dne 21. januarja 1974 o programu socialnih ukrepov [3] med prednostne naloge vključil ukrepe, katerih namen je doseči enakost moških in žensk pri dostopu do zaposlitve, poklicnega izobraževanja in napredovanja ter delovnih pogojev, vključno s plačo;

HAS ADOPTED THIS DIRECTIVE:
|
ker je glede plač Svet 10. februarja 1975 sprejel Direktivo 75/117/EGS o približevanju zakonodaj držav članic v zvezi z uporabo načela enakega plačila za moške in ženske [4];
|
|
|
ker se ukrepi na ravni Skupnosti za doseganje načela enakega obravnavanja moških in žensk v zvezi z dostopom do zaposlitve, poklicnega izobraževanja in napredovanja ter v zvezi z drugimi delovnimi pogoji zdijo prav tako potrebni; ker enako obravnavanje delavcev obeh spolov predstavlja enega izmed ciljev Skupnosti, kolikor je usklajevanje življenjskih in delovnih razmer ter ohranitev njihovih izboljšav med drugim mogoče spodbujati; ker Pogodba ne dodeljuje potrebnih pooblastil za te namene;

Article 1
|
ker je treba opredelitev in postopno uresničevanje načela enakega obravnavanja v zadevah socialne varnosti zagotoviti z dodatnimi sredstvi,

1. The purpose of this Directive is to put into effect in the Member States the principle of equal treatment for men and women as regards access to employment, including promotion, and to vocational training and as regards working conditions and, on the conditions referred to in paragraph 2, social security. This principle is herinafter referred to as "the principle of equal treatment."
|
SPREJEL NASLEDNJO DIREKTIVO:

2. With a view to ensuring the progressive implementation of the principle of equal treatment in matters of social security, the Council, acting on a proposal from the Commission, will adopt provisions defining its substance, its scope and the arrangements for its application.

Člen 1

|
|
1. Namen te direktive je uveljaviti načelo enakega obravnavanja moških in žensk v državah članicah v zvezi z njihovim dostopom do zaposlitve, vključno z napredovanjem, njihovim poklicnim izobraževanjem in njihovimi delovnimi pogoji ter glede socialne varnosti pod pogoji, navedenimi v odstavku 2. To načelo je v nadaljevanju opredeljeno kot "načelo enakega obravnavanja".

Article 2
|
2. Za zagotovitev postopnega izvrševanja načela enakega obravnavanja v zadevah socialne varnosti bo Svet na podlagi predloga Komisije sprejel določbe, ki opredeljujejo njegovo vsebino, njegov namen in ureditve za njegovo uporabo.
|
|
1. For the purposes of the following provisions, the principle of equal treatment shall mean that there shall be no discrimination whatsover on grounds of sex either directly or indirectly by reference in particular to marital or family status.
|
Člen 2

|
2. This Directive shall be without prejudice to the right of Member States to exclude from its field of application those occupational activities and, where appropriate, the training leading thereto, for which, by reason of their nature or the context in which they are carried out, the sex of the worker constitutes a determining factor.
|
1. V naslednjih določbah načelo enakega obravnavanja pomeni, da ne sme biti nobene diskriminacije na podlagi spola, bodisi posredne ali neposredne, še zlasti ne glede na zakonski ali družinski status.

3. This Directive shall be without prejudice to provisions concerning the protection of women, particularly as regards pregnancy and maternity.
|
2. Ta direktiva ne vpliva na pravice držav članic, da s področja njene uporabe izključijo tiste poklicne dejavnosti, in če je potrebno, tudi šolanje za te poklicne dejavnosti, pri katerih je spol delavca odločilni dejavnik zaradi same narave dela ali pa zaradi okolja, v katerem se to delo opravlja.

4. This Directive shall be without prejudice to measures to promote equal opportunity for men and women, in particular by removing existing inequalities which affect women's opportunities in the areas referred to in Article 1 (1). 3. Ta direktiva ne vpliva na določbe, ki se nanašajo na varstvo žensk, še zlasti kar se tiče nosečnosti in materinstva.

Article 3
|

|
1. Application of the principle of equal treatment means that there shall be no discrimination whatsover on grounds of sex in the conditions, including selection criteria, for access to all jobs or posts, whatever the sector or branch of activity, and to all levels of the occupational hierarchy.
|
1. Uporaba načela enakega obravnavanja pomeni, da ne sme biti nobene diskriminacije na podlagi spola pri pogojih, vključno z merili izbiranja, za dostop do vseh delovnih mest, ne glede na področje ali vrsto dejavnosti, in do vseh ravni poklicne hierarhije.

2. To this end, Member States shall take the measures necessary to ensure that: (a) any laws, regulations and administrative provisions contrary to the principle of equal treatment shall be abolished;
|
2. V ta namen države članice sprejmejo potrebne ukrepe, da zagotovijo naslednje:
|
|
(b) any provisions contrary to the principle of equal treatment which are included in collective agreements, individual contracts of employment, internal rules of undertakings or in rules governing the independent occupations and professions shall be, or may be declared, null and void or may be amended;
|
(a) vsi zakoni in drugi predpisi, ki so v nasprotju z načelom enakega obravnavanja, se odpravijo;
|
|
(c) those laws, regulations and administrative provisions contrary to the principle of equal treatment when the concern for protection which originally inspired them is no longer well founded shall be revised ; and that where similar provisions are included in collective agreements labour and management shall be requested to undertake the desired revision.
|
(b) vse določbe, ki so v nasprotju z načelom enakega obravnavanja in so vključene v kolektivne pogodbe, individualne pogodbe o zaposlitvi, notranja pravila podjetja ali pa v pravila, ki urejajo samostojne poklice, so ali se razglasijo za nične, ali pa se spremenijo;

(c) tisti zakoni in drugi predpisi, ki so nasprotni načelu enakega obravnavanja se revidirajo takrat, ko dejavniki, ki so prvotno sprožili njihov nastanek, niso več utemeljeni; tam, kjer so podobne določbe vključene v kolektivne pogodbe, se od delavcev in delodajalcev zahteva, da naredijo zaželeno revizijo.

Člen 4
|
|
|
Uporaba načela enakega obravnavanja v zvezi z dostopom do vseh vrst in vseh ravni poklicnega usmerjanja, poklicnega izobraževanja, višjega poklicnega izobraževanja in prekvalificiranja pomeni, da države članice sprejmejo vse potrebne ukrepe za zagotovitev naslednjega:

Article 4
|
(a) vsi zakoni in drugi predpisi, ki so v nasprotju z načelom enakega obravnavanja, se odpravijo;
|
|
Application of the principle of equal treatment with regard to access to all types and to all levels, of vocational guidance, vocational training, advanced vocational training and retraining, means that Member States shall take all necessary measures to ensure that: (a) any laws, regulations and administrative provisions contrary to the principle of equal treatment shall be abolished;
|
(b) vse določbe, ki so v nasprotju z načelom enakega obravnavanja in so vključene v kolektivne pogodbe, individualne pogodbe o zaposlitvi, notranja pravila podjetja ali v pravila, ki uravnavajo samostojne poklice, so ali se razglasijo za nične, ali pa se spremenijo;
|
|
(b) any provisions contrary to the principle of equal treatment which are included in collective agreements, individual contracts of employment, internal rules of undertakings or in rules governing the independent occupations and professions shall be, or may be declared, null and void or may be amended;
|
(c) brez poseganja v svobodo, ki jo nekatere države članice zagotavljajo nekaterim zasebnim izobraževalnim ustanovam, je poklicno usmerjanje, poklicno izobraževanje, višje poklicno izobraževanje in prekvalificiranje dostopno na podlagi enakih meril in na istih ravneh brez kakršne koli diskriminacije na podlagi spola.

(c) without prejudice to the freedom granted in certain Member States to certain private training establishments, vocational guidance, vocational training, advanced vocational training and retraining shall be accessible on the basis of the same criteria and at the same levels without any discrimination on grounds of sex.

Člen 5
|
|
|
1. Uporaba načela enakega obravnavanja v zvezi z delovnimi pogoji, vključno s pogoji, ki uravnavajo odpuščanje, pomeni, da se moškim in ženskam zagotovijo enake možnosti brez diskriminacije na podlagi spola.
|
|
|
2. V ta namen države članice sprejmejo potrebne ukrepe, s katerimi zagotovijo naslednje:
|
|
|
(a) vsi zakoni in drugi predpisi, ki so v nasprotju z načelom enakega obravnavanja, se odpravijo;
|
|

(b) vse določbe, ki so v nasprotju z načelom enakega obravnavanja in so vključene v kolektivne pogodbe, individualne pogodbe o zaposlitvi, notranja pravila podjetja ali v pravila, ki uravnavajo samostojne poklice, so ali se razglasijo za nične, ali pa se spremenijo;

1. Application of the principle of equal treatment with regard to working conditions, including the conditions governing dismissal, means that men and women shall be guaranteed the same conditions without discrimination on grounds of sex.
|
(c) tisti zakoni in drugi predpisi, ki so nasprotni načelu enakega obravnavanja se revidirajo takrat, ko dejavniki, ki so prvotno sprožili njihov nastanek, niso več utemeljeni; tam, kjer so podobne določbe vključene v kolektivne pogodbe, se od delavcev in delodajalcev zahteva, da naredijo zaželeno revizijo.

2. To this end, Member States shall take the measures necessary to ensure that: (a) any laws, regulations and administrative provisions contrary to the principle of equal treatment shall be abolished;
|

(b) any provisions contrary to the principle of equal treatment which are included in collective agreements, individual contracts of employment, internal rules of undertakings or in rules governing the independent occupations and professions shall be, or may be declared, null and void or may be amended;

Države članice v nacionalne pravne sisteme uvedejo potrebne ukrepe, da se vsem osebam, ki se čutijo prizadete zaradi neuporabe načela enakega obravnavanja v smislu členov 3, 4 in 5 omogoči vlaganje zahtevkov v sodnih postopkih po tem, ko so izčrpali pravna sredstva pri drugih pristojnih organih.

(c) those laws, regulations and administrative provisions contrary to the principle of equal treatment when the concern for protection which originally inspired them is no longer well founded shall be revised ; and that where similar provisions are included in collective agreements labour and management shall be requested to undertake the desired revision.

Člen 7
|
|
|
Države članice sprejmejo ustrezne ukrepe, s katerimi varujejo zaposlene pred odpustitvijo s strani delodajalca zaradi pritožbe zaposlenega v okviru podjetja ali pa zaradi pravnega postopka, katerega cilj je uveljaviti načelo enakega obravnavanja.

|
|
Države članice poskrbijo, da na določbe, sprejete v skladu s to direktivo, in na relevantne določbe, ki so že v veljavi, primerno opozorijo delojemalce, na primer na njihovem delovnem mestu.
|
|
Article 6
|

|
|
Member States shall introduce into their national legal systems such measures as are necessary to enable all persons who consider themselves wronged by failure to apply to them the principle of equal treatment within the meaning of Articles 3, 4 and 5 to pursue their claims by judicial process after possible recourse to other competent authorities.
|
1. Države članice sprejmejo zakone in druge predpise, potrebne za uskladitev s to direktivo, najpozneje v 30 mesecih po notifikaciji te direktive. O tem takoj obvestijo Komisijo.
|
|
|
Vendar pa, glede prvega dela člena 3(2)(c) in prvega dela člena 5(2)(c), države članice v štirih letih po notifikaciji te direktive opravijo prvi pregled in, če je potrebno, prvo revizijo zakonov in drugih predpisov, ki so tam omenjeni.
|
|
Article 7
|
2. Države članice redno ocenjujejo poklicne dejavnosti, na katere se nanaša člen 2(2), in tako glede na družbeni razvoj ugotovijo, ali je ohranjanje teh izjem upravičeno. O rezultatih tega ocenjevanja uradno obvestijo Komisijo.
|
|
Member States shall take the necessary measures to protect employees against dismissal by the employer as a reaction to a complaint within the undertaking or to any legal proceedings aimed at enforcing compliance with the principle of equal treatment.
|
3. Države članice predložijo Komisiji besedila temeljnih predpisov nacionalne zakonodaje, sprejetih na področju, ki ga ureja ta direktiva.

Article 8
|
V dveh letih po poteku 30-mesečnega obdobja, ki ga določa prvi pododstavek člena 9(1), države članice posredujejo Komisiji vse potrebne informacije in ji tako omogočijo, da oblikuje poročilo o uporabi te direktive za predložitev Svetu.
|
|
Member States shall take care that the provisions adopted pursuant to this Directive, together with the relevant provisions already in force, are brought to the attention of employees by all appropriate means, for example at their place of employment.
|

|
Ta direktiva je naslovljena na države članice.
|
|
Article 9
|
|
|
1. Member States shall put into force the laws, regulations and administrative provisions necessary in order to comply with this Directive within 30 months of its notification and shall immediately inform the Commission thereof.

However, as regards the first part of Article 3 (2) (c) and the first part of Article 5 (2) (c), Member States shall carry out a first examination and if necessary a first revision of the laws, regulations and administrative provisions referred to therein within four years of notification of this Directive.

2. Member States shall periodically assess the occupational activities referred to in Article 2 (2) in order to decide, in the light of social developments, whether there is justification for maintaining the exclusions concerned. They shall notify the Commission of the results of this assessment.

3. Member States shall also communicate to the Commission the texts of laws, regulations and administrative provisions which they adopt in the field covered by this Directive.
