COUNCIL DIRECTIVE of 9 December 1974 amending Directive No 68/193/EEC on the marketing of material for the vegetative propagation of the vine (74/648/EEC)

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 43 thereof;

o spremembi Direktive Sveta 68/193/EGS o trženju materiala za vegetativno razmnoževanje trte

Having regard to the proposal from the Commission;

Having regard to the Opinion of the Economic and Social Committee (2);

ob upoštevanju Pogodbe o ustanovitvi Evropske gospodarske skupnosti in zlasti člena 43 Pogodbe,

Whereas, for the reasons given below, amendments should be made to certain provisions of Council Directive No 68/193/EEC (3) of 9 April 1968 on the marketing of material for the vegetative propagation of the vine, as amended by Directive No 71/140/EEC (4);

Whereas the scope of Directive No 68/193/EEC should be made clear;

ob upoštevanju mnenja Evropskega parlamenta [1],

Whereas Member States must be authorized to distinguish between standard propagation material on the basis of different quality criteria;

ob upoštevanju mnenja Ekonomsko-socialnega odbor [2],

Whereas certain regions benefit from particular conditions which are so favourable for the development of propagation material that the Member State concerned should be enabled to authorize exemptions as to the length of the propagation material for production and marketing in their territories;

ker bi bilo treba zaradi razlogov, naštetih v nadaljevanju, spremeniti nekatere določbe Direktive Sveta št. 68/193/EGS [3] z dne 9. aprila 1968 o trženju materiala za vegetativno razmnoževanje trte, kakor je bila spremenjena z Direktivo št. 71/140/EGS [4];

Whereas the application of the Directive may cause difficulties for importation into certain Member States, since some of them require importers to supply different particulars ; whereas these particulars should therefore be harmonized;

ker bi bilo treba razjasniti področje uporabe Direktive št. 68/193/EGS;

Whereas the amendments to the Annex are intended essentially to permit the application of the Directive and, on these grounds, should be adopted in accordance with the procedure of the Standing Committee on Seeds and Propagating Material for Agriculture, Horticulture and Forestry;

ker je treba državam članicam odobriti, da ločujejo med standardnim razmnoževalnim materialom na podlagi različnih meril kakovosti;

Whereas the growing of vines and the marketing of propagation material may be of minimal economic importance in a Member State ; whereas the Member State concerned should therefore have the possibility of being exempted from most of the provisions of the Directive,

ker imajo nekatere regije korist od posebnih pogojev, ki so tako ugodni za razvoj razmnoževalnega materiala, da bi bilo treba zadevni državi članici omogočiti odobritev izjem glede dolžine razmnoževalnega materiala za proizvodnjo in trženje na njenem ozemlju;

HAS ADOPTED THIS DIRECTIVE:

ker lahko uporaba direktive povzroči težave pri uvozu v nekatere države članice, saj nekatere med njimi od uvoznikov zahtevajo različne podrobne podatke; ker bi bilo zato treba te podrobne podatke uskladiti;

ker je osnovni namen sprememb Priloge omogočiti uporabo Direktive in bi se na tej podlagi spremembe morale sprejeti v skladu s postopki Stalnega odbora za seme in razmnoževalni material za poljedelstvo, vrtnarstvo in gozdarstvo;

Article 1

ker je lahko gojenje trte in trženje razmnoževalnega materiala v državi članici minimalnega gospodarskega pomena; ker bi zato zadevne države članice morale imeti možnost izvzetja iz večine določb Direktive,

Council Directive No 68/193/EEC is hereby amended as follows:

SPREJEL NASLEDNJO DIREKTIVO:

Člen 1

Article 2

Direktiva Sveta 68/193/EGS se spremeni, kakor sledi.

The following shall be substituted for Article 1:

Člen 2

"This Directive shall apply to material for the vegetative propagation of the vine (hereinafter called "propagation material") marketed within the Community."

Člen 1 se nadomesti z naslednjim besedilom:

"Ta direktiva se uporablja za material za vegetativno razmnoževanje trte (v nadaljnjem besedilu "razmnoževalni material"), ki se trži v Skupnosti."

Article 3

Člen 3

The following paragraph la shall be added to Article 3:

Členu 3 se doda odstavek 1a:

"1a The Member States may subdivide the category "standard material" laid down in Article 2 into classes which comply with special conditions. These special conditions, the appellation or a time limit, may be determined in accordance with the procedure laid down in Article 17."

"1a Države članice lahko naprej razčlenijo kategorijo "standardni material" določeno v členu 2, v razrede, ki so skladni s posebnimi pogoji. Ti posebni pogoji, imenovanje ali rok se lahko določijo v skladu s postopkom, predpisanim v členu 17."

Členu 3(4) se doda pododstavek (c):

The following subparagraph (c) shall be added to Article 3 (4): (1)OJ No C 2, 9.1.1974, p. 66. (2)OJ No C 8, 31.1.1974, p. 19. (3)OJ No L 93, 17.4.1968, p. 15. (4)OJ No L 71, 25.3.1971, p. 16.

"(c) pooblasti države članice, da ne glede na Prilogo II(III)(1B) in (2B) zmanjšajo najmanjše predpisane dolžine razmnoževalnega materiala za proizvodnjo in trženje na nekaterih območjih, kjer je takšno pooblastilo utemeljeno s posebnimi pogoji rasti."

"(c) authorize Member States, notwithstanding Annex II (III) (1B) and (2B), to reduce the minimum stipulated lengths of propagation material, for production and marketing in certain areas where such authorization is justified by special conditions of growth."

Člen 5

1. Člen 11 postane člen 11(1).

Article 5

2. Členu 11 se doda odstavek 2:

1. Article 11 shall become Article 11 (1).

"2. Države članice sprejmejo ukrepe, potrebne za zagotovitev, da se pristojnim organom med trženjem vegetativnega razmnoževalnega materiala po poreklu iz druge države članice ali tretje države posredujejo naslednji podrobni podatki:

2. The following paragraph 2 shall be added to Article 11:

(a) vrsta (botanično ime),

"2. The Member States shall take all necessary measures to ensure that the competent authorities are supplied with the following particulars during the marketing of vegetative propagation material, originating in another Member State or in a third country: (a) species (botanical designation),

(b) sorta in, kjer je to ustrezno, klon; pri ukoreninjenih cepljenkah se ti podatki navedejo za podlage in tudi za cepič,

(b) variety and, where appropriate, the clone ; in the case of rooted grafts, these particulars shall be supplied for both the root stocks and the top graft cutting,

(c) kategorija,

(c) category,

(d) narava razmnoževalnega materiala,

(d) nature of the propagation material,

(e) država proizvodnje in uradni nadzorni organ,

(e) country of production and official control authority,

(f) država odpreme,

(f) country of dispatch,

(g) uvoznik,

(g) importer,

(h) količina materiala.

(h) quantity of the material.

Način, kako je treba navesti te podrobne podatke, se lahko določi v skladu s postopkom, predpisanim v členu 17."

Člen 6

Člen 17a se nadomesti z naslednjim besedilom:

The manner in which these particulars must be presented may be determined in accordance with the procedure laid down in Article 17."

"Člen 17a

O kakršnikoli spremembi prilog zaradi razvoja znanstvenih spoznanj ali tehnik se odloča v skladu s postopkom, predpisanim v členu 17."

The following shall be substituted for Article 17a:

Člen 18a se nadomesti z naslednjim besedilom:

"Article 17a

"Člen 18a

Any amendments to be made to the Annexes to the development of scientific knowledge or techniques shall be decided upon in accordance with the procedure laid down in Article 17."

V skladu s postopkom, določenim v členu 17, se lahko država članica, če to zahteva, delno ali v celoti oprosti obveznosti uporabe te direktive, vendar z izjemo členov 12(1) in 12a, če je gojenje trte in trženje razmnoževalnega materiala na njenem ozemlju minimalnega gospodarskega pomena."

Člen 8

Article 7

Točka 2 Priloge IV, oddelek A(a) se nadomesti z naslednjim besedilom:

The following shall be substituted for Article 18a:

"2. Ime in naslov osebe, odgovorne za zapečatenje, ali njena identifikacijska številka."

Člen 9

In accordance with the procedure laid down in Article 17, a Member State may, if it so requests, be wholly or partially released from the obligation to apply this Directive with the exception, however, of Articles 12 (1) and 12a, in so far as the growing of vines and the marketing of propagation material are of minimal economic importance in its territory."

Države članice najpozneje do 1. julija 1976 sprejmejo zakone in druge predpise, potrebne za uskladitev s to direktivo.

Člen 10

Article 8

Ta direktiva je naslovljena na države članice.

The following shall be substituted for point 2 of Annex IV, Section A (a):

"2. Name and address of the person responsible for sealing or his identification number."

Member States shall, not later than 1 July 1976, bring into force the laws, regulations or administrative provisions needed in order to comply with the requirements of this Directive.
