DECISION OF THE COUNCIL AND OF THE COMMISSION of 29 May 1998 concerning the conclusion of the Agreement between the European Communities and the Government of the United States of America on the application of positive comity principles in the enforcement of their competition laws (98/386/EC, ECSC)

o sklenitvi Sporazuma med Evropskimi skupnostmi in Vlado Združenih držav Amerike o uporabi načel medsebojne pravne kurtoazije pri izvajanju njihovih pravil o konkurenci

Having regard to the Treaty establishing the European Community, and in particular Article 87 in conjunction with the first subparagraph of Article 228(3) thereof,

Having regard to the Treaty establishing the European Coal and Steel Community, and in particular Articles 65 and 66 thereof,

Having regard to the proposal from the Commission,

KOMISIJA EVROPSKIH SKUPNOSTI STA

Having regard to the opinion of the European Parliament (1),

ob upoštevanju Pogodbe o ustanovitvi Evropske skupnosti in zlasti člena 87 v povezavi s prvim pododstavkom člena 228(3) Pogodbe,

Whereas the Agreement of 23 September 1991 between the European Communities and the Government of the United States of America regarding the application of their competition laws, and the exchange of interpretative letters dated 31 May and 31 July 1995 in relation to that Agreement (together hereinafter referred to as 'the 1991 Agreement`), attached to Decision 95/145/EC, ECSC of the Council and the Commission (2) has contributed to coordination, cooperation and avoidance of conflicts in competition law enforcement;

ob upoštevanju Pogodbe o ustanovitvi Evropske skupnosti za premog in jeklo ter zlasti členov 65 in 66 Pogodbe,

Whereas Article V of the 1991 Agreement, commonly referred to as the 'positive comity` Article, calls for cooperation regarding anti-competitive activities occurring in the territory of one Party that adversely affect the interests of the other Party;

ob upoštevanju predloga Komisije,

Whereas further elaboration of the principles of positive comity and of the implementation of those principles would enhance the 1991 Agreement's effectiveness in relation to such conduct;

ob upoštevanju mnenja Evropskega parlamenta [1],

Whereas, to this end, the Commission has negotiated an Agreement with the Government of the United States of America on the application of positive comity principles in the enforcement of the competition rules of the European Communities and of the United States of America;

ker sta Sporazum z dne 23. septembra 1991 med Evropskimi skupnostmi in Vlado Združenih držav Amerike o uporabi njihovih pravil o konkurenci ter izmenjava razlagalnih pisem z dne 31. maja in dne 31. julija 1995 v zvezi s tem sporazumom (v nadaljnjem besedilu skupaj "Sporazum iz leta 1991"), priloženih k Sklepu 95/145/ES, ESPJ Sveta in Komisije [2], prispevala k uskladitvi, sodelovanju in preprečevanju kolizije pri izvajanju prava konkurence;

Whereas the Agreement should be approved,

ker člen V Sporazuma iz leta 1991, običajno naveden kot člen "o medsebojni pravni kurtoaziji", zahteva sodelovanje v zvezi s protikonkurenčnimi dejavnostmi na ozemlju ene pogodbenice, ki negativno vplivajo na interese druge pogodbenice;

HAVE DECIDED AS FOLLOWS:

ker bi podrobnejša opredelitev načel medsebojne pravne kurtoazije in njihovo izvajanje povečala učinkovitost Sporazuma iz leta 1991 v zvezi s takšnim ravnanjem;

ker je v ta namen Komisija z Vlado Združenih držav Amerike s pogajanji uskladila sporazum o uporabi načel medsebojne pravne kurtoazije pri izvajanju pravil o konkurenci Evropskih skupnosti in Združenih držav Amerike;

ker je treba sporazum odobriti,

Article 1

SKLENILA:

The Agreement between the European Communities and the Government of the United States of America on the application of positive comity principles in the enforcement of their competition laws is hereby approved on behalf of the European Community and the European Coal and Steel Community.

Člen 1

The text of the Agreement, drawn up in the English language, is attached to this Decision.

Sporazum med Evropskimi skupnostmi in Vlado Združenih držav Amerike o uporabi načel medsebojne pravne kurtoazije pri izvajanju njihovih pravil o konkurenci se odobri v imenu Evropske skupnosti in Evropske skupnosti za premog in jeklo.

Besedilo sporazuma, sestavljeno v angleškem jeziku, je priloženo k temu sklepu.

The President of the Council is hereby authorised to designate the person(s) empowered to sign the Agreement on behalf of the European Community.

Predsednik Sveta je pooblaščen za imenovanje osebe (oseb), pooblaščene(-ih) za podpis sporazuma v imenu Evropske skupnosti.

The President of the Commission is hereby authorised to designate the person(s) empowered to sign the Agreement on behalf of the European Coal and Steel Community.

Predsednik Komisije je pooblaščen za imenovanje osebe (oseb), pooblaščene(-ih) za podpis sporazuma v imenu Evropske skupnosti za premog in jeklo.
