Having regard to the Treaty establishing the European Economic Community, and in particular Article 75 thereof,

Having regard to the proposal from the Commission,
|
RADA EURÓPSKYCH SPOLOČENSTIEV

Having regard to the opinion of the European Parliament (1),
|
so zreteľom na Zmluvu o založení Európskeho hospodárskeho spoločenstva a najmä na článok 75 tejto zmluvy,
|
|
Having regard to the opinion of the Economic and Social Committee (2),
|
so zreteľom na návrh Komisie,
|
|
Whereas, in order to institute under the common transport policy a system of charging for the use of infrastructure, it is necessary to know what expenditure is incurred in respect of infrastructure;
|
so zreteľom na stanovisko Zhromaždenia [1],
|
|
Whereas a permanent accounting system offers the most suitable means for knowing what expenditure is incurred in respect of infrastructure;
|
so zreteľom na stanovisko Hospodárskeho a sociálneho výboru [2],
|
|
Whereas to this end the Council, by Regulation (EEC) No 1108/70 (3), introduced a permanent accounting system for such expenditure;
|
keďže je nevyhnutné poznať, aké výdavky existujú na infraštruktúru s cieľom stanoviť systém poplatkov za používanie infraštruktúry v rámci spoločnej dopravnej politiky;

Whereas account should be taken of experience gained and of the development of the common transport policy ; whereas the forms of accounts, the list of types of infrastructure and the schedule of returns concerning the use of infrastructure provided for in Regulation (EEC) No 1108/70 should be adjusted accordingly,
|
keďže priebežný účtovný systém predstavuje najvýhodnejší prostriedok k poznaniu výdavkov na infraštruktúru;
|
|
HAS ADOPTED THIS REGULATION:
|
keďže Rada svojim nariadením (EHS) č. 1108/70Ú. v. ES L 130, 15.6.1979 s. 4 zaviedla priebežný účtovný systém na takéto výdavky;
|
|
|
keďže by sa mali vziať do úvahy získané skúsenosti a rozvoj spoločnej dopravnej politiky; keďže účtovné osnovy, zoznam typov infraštruktúry a zoznamy údajov o využívaní infraštruktúry, uvedené v nariadení (EHS) č. 1108/70, by mali byť podľa toho prispôsobené,

Article 1
|
PRIJALA TOTO NARIADENIE:
|
|
Regulation (EEC) No 1108/70 is hereby amended as follows: 1. Article 3 shall be replaced by the following:
|

Nariadenie (EHS) č. 1108/70 sa týmto mení a dopĺňa takto:
|
|
Infrastructure expenditure accounts shall be kept for each of the railway networks listed in Annex II (A. 1) and for the total of all the other networks listed in Annex II (A. 2), as well as for all roads and inland waterways open to public traffic, with the following exceptions: (a) roads closed to motor traffic, that is, to vehicles with a cylinder capacity equal to or exceeding 50 cm3;

(b) roads used exclusively by agricultural or forestry vehicles or which serve only to provide access for agricultural or forestry operations;

Výdavky na infraštruktúru sa účtujú za všetky železničné siete uvedené v prílohe II. (A.1) a celkom za všetky ostatné siete uvedené v prílohe II. (A.2), rovnako ako za všetky cestné a vnútrozemské vodné cesty prístupné verejnej doprave, s výnimkou:

(d) waterways of a maritime character, as listed in Regulation (EEC) No 281/71 (1).
|
a) ciest uzavretých motorovej doprave, t. j. pre vozidlá s obsahom valcov 50 cm3 a viac;
|
|
|
b) ciest, ktoré sú používané výlučne poľnohospodárskymi alebo lesnými vozidlami alebo ktoré slúžia na zabezpečenie prístupu k poľnohospodárskym a lesným prácam;
|
|
|
c) vnútrozemských vodných ciest, na ktorých je doprava obmedzená na plavidlá s nosnosťou do 250 ton;
|
|

3. The second indent of the first subparagraph of Article 6 shall be replaced by the following:

Member States shall send to the Commission, at the same time as they send the accounts referred to in Article 5 and in respect of the same period, returns relating to the use of infrastructures in accordance with Tables A, B (1.1) and C of Annex III.
|
Členské štáty zašlú Komisii súčasne so zaslaním účtovných výsledkov podľa článku 5 a za rovnaké obdobie údaje o využívaní infraštruktúry v súlade s tabuľkami A, B (1.1) a C prílohy III.
|
|
The returns covered by Tables B (1.2) and B (2) of that Annex shall be sent only once every five years. In the case of Table B (1.2) returns shall be sent for the first time for the year 1980 and, in the case of Table B (2), returns shall be suspended until work on the system of charging for the use of infrastructure make them necessary."
|
Údaje uvedené v tabuľkách B (1.2) a B (2) tejto prílohy sa zašlú raz za päť rokov. V prípade tabuľky B (1.2) sa údaje predložia prvýkrát za rok 1980 a v prípade tabuľky B (2) sa údaje nemusia predkladať, pokiaľ si to nevyžiadajú práce na systéme poplatkov za využívanie infraštruktúry."

5. Annexes I, II and III are amended in accordance with the Annex.
|
5. Prílohy I., II. a III. sú zmenené a doplnené v súlade s touto prílohou.
|
|
|
Článok 2
|
|
|
Členské štáty prijmú v príslušnom čase a po porade s Komisiou také zákony, iné právne predpisy a správne opatrenia, ktoré sú nevyhnutné na vykonanie tohto nariadenia.
|
|
|
Pokiaľ to členské štáty vyžadujú alebo kde to Komisia považuje za vhodné, Komisia sa poradí s členskými štátmi o navrhovaných termínoch opatrení týkajúcich sa predchádzajúceho odseku.
|
|
Article 2
|
Toto nariadenie je záväzné vo svojej celistvosti a je priamo uplatniteľné v členských štátoch.
|
|
Member States shall, in good time and after consulting the Commission, adopt such laws, regulations or administrative provisions as may be necessary for the implementation of this Regulation.
|
|
|
Where a Member State so requests, or where the Commission considers it appropriate, the Commission shall consult with the Member States concerned upon the proposed terms of the measures referred to in the preceding paragraph.
