Having regard to the Treaty establishing the European Economic Community,

ustanovujúca vykonávacie pravidlá pre dozor nad dodávateľmi a výrobnými zariadeniami a ich sledovanie podľa smernice Rady 92/34/EHS o uvádzaní množiteľského materiálu ovocných drevín a ovocných drevín určených na pestovanie ovocia do obehu

Having regard to Council Directive 92/34/EEC of 29 April 1992 on the marketing of fruit plant propagating material and fruit plants intended for fruit production(1) , and in particular Article 6 (4) thereof,

Whereas it is appropriate to set out measures concerning the supervision and monitoring of all suppliers and their establishments, with the exception of those whose activity is confined to the placing on the market of propagating material and fruit plants;

so zreteľom na Zmluvu o založení Európskeho hospodárskeho spoločenstva,

Whereas the measures provided for in this Directive are in accordance with the opinion of the Standing Committee Propagating Material and Plants of Fruit Genera and Species,

so zreteľom na smernicu Rady 92/34/EHS z 29. apríla 1992 o uvádzaní množiteľského materiálu ovocných drevín a ovocných drevín určených na pestovanie ovocia do obehu [1] a najmä na jej článok 6 (4),

HAS ADOPTED THIS DIRECTIVE:

keďže je vhodné, aby sa ustanovili opatrenia týkajúce sa dozoru nad všetkými dodávateľmi a výrobnými zariadeniami a ich sledovania s výnimkou takých, ktorých činnosť sa viaže na umiestňovanie množiteľského materiálu ovocných drevín a ovocných drevín na trh;

keďže opatrenia ustanovené v tejto smernici sú v súlade so stanoviskom Stáleho výboru pre rody a druhy ovocných drevín a ich množiteľský materiál,

Article 1

PRIJALA TÚTO SMERNICU:

1. This Directive lays down implementing measures concerning the supervision and monitoring of suppliers and their establishments, other than those whose activity is confined to the placing on the market of propagating material and fruit plants, pursuant to Article 6 (4) of Directive 92/34/EEC, in cases where the checks referred to in Article 5 (2) of the said Directive are carried out by the suppliers themselves or an accredited supplier.

1. Táto smernica ustanovuje vykonávacie opatrenia týkajúce sa dozoru nad dodávateľmi a výrobnými zariadeniami a ich kontrolovania, s výnimkou takých, ktorých činnosť sa viaže na umiestňovanie množiteľského materiálu ovocných drevín a ovocných drevín na trh podľa článku 6 (4) smernice 92/34/EHS, v prípadoch, keď kontroly uvedené v článku 5 (2) vyššie uvedenej smernice vykonávajú samotní dodávatelia alebo úradne uznaný dodávateľ.

The responsible official body shall carry out regularly, at least once a year at an appropriate time, supervision and monitoring of suppliers and their establishments in order to ensure continued compliance with the requirements laid down in Directive 92/34/EEC, and in particular, in respect of with the principles set out in the first to fourth indents of Article 5 (2) thereof, account being taken of the particular nature of the activity or activities of the supplier.

Zodpovedný úradný orgán musí pravidelne, aspoň raz za rok, vo vhodnom termíne vykonať previerku dodávateľov a výrobných zariadení a skontrolovať ich, aby sa zabezpečil neustály súlad s požiadavkami ustanovenými v smernici 92/34/EHS a najmä, pokiaľ ide o zásady ustanovené v prvej až štvrtej zarážke jej článku 5 (2), pričom sa zoberie do úvahy najmä činnosť alebo činnosti dodávateľa.

Pokiaľ ide o zistenie kritických bodov vo výrobnom procese uvedených v prvej zarážke článku 5 (2) smernice 92/34/EHS a vedenie záznamov uvedených vo štvrtej zarážke jej článku 5 (2), zodpovedný úradný orgán musí vykonávať dozor nad dodávateľom a sledovať ho, aby sa zabezpečilo, že dodávateľ:

As far as the identification of critical points in the production process referred to in the first indent of Article 5 (2) of Directive 92/34/EEC and the keeping of records referred to in the fourth indent of Article 5 (2) thereof are concerned, the responsible official body shall supervise and monitor the supplier to ensure that the supplier:

a) naďalej berie do úvahy prípadné nasledujúce kritické body:

(a) continues to take into account the following critical points, where appropriate:

- kvalitu množiteľského materiálu a ovocných drevín použitých na začatie výrobného procesu,

- the quality of propagating material and fruit plants utilized to start the production process,

- sejbu, presádzanie črepníkovanie a výsadbu ovocných drevín a ich množiteľského materiálu,

- the sowing, pricking-out, potting-up, and planting of propagating material and fruit plants,

- súlad s podmienkami ustanovenými v článkoch 3, 4 a 5 smernice Rady 77/93/EHS [2],

- compliance with the conditions laid down in Articles 3, 4 and 5 of Council Directive 77/93/EEC(2) ,

- plán a metódu pestovania,

- the cultivation plan and method,

- všeobecnú starostlivosť o plodinu,

- general crop care,

- množiteľské činnosti,

- the multiplication operations,

- zber úrody,

- the harvesting operations,

- hygienu,

- hygiene,

- ošetrovanie,

- treatments,

- balenie,

- packaging,

- skladovanie,

- storage,

- prepravu,

- transport,

- hospodárenie;

- administration;

b) vedie záznamy s cieľom mať úplné informácie dostupné pre vyššie uvedený úradný orgán, a to:

(b) keeps records, with a view to having complete information available for the said responsible official bodies, on:

i) o rastlinách alebo iných predmetoch:

(i) plants or other objects:

- zakúpených na skladovanie alebo výsadbu v objektoch prevádzky,

- purchased for storage or planting on the premises,

- ktoré sa vyrábajú

- under production,

alebo

or

- ktoré sa odoslali iným

- dispatched to others;

a

and

ii) akékoľvek chemické ošetrenia, ktoré sa aplikovali na rastliny, a o tom, že vedie príslušnú dokumentáciu aspoň počas jedného roka;

(ii) any chemical treatments which have been applied to the plants, and that he keeps related documents for at least one year;

c) je osobne k dispozícii alebo vymenuje inú osobu technicky skúsenú v rastlinnej výrobe a v záležitostiach súvisiacich so zdravotným stavom rastlín, aby bola v styku s vyššie uvedenými zodpovednými úradnými orgánmi;

(c) is available personally or designates another person technically experienced in plant production and related plant-health matters, to liaise with the said responsible official bodies;

d) vykonáva vizuálne kontroly, ako je to potrebné a vo vhodných časových termínoch spôsobom, ktorý schválili vyššie uvedené zodpovedné úradné orgány;

(d) carries out visual inspections as necessary and at appropriate times in a manner accepted by the said responsible official bodies;

e) umožňuje prístup osobám oprávneným konať pre vyššie uvedené zodpovedné úradné orgány, najmä pokiaľ ide o kontroly a/alebo na účely odoberania vzoriek, a umožňuje prístup k záznamom a súvisiacim dokumentom uvedeným v bode b);

(e) allows access by persons entitled to act for the said responsible official bodies, in particular for inspection and/or sampling purposes, and allows access to the records and related documents referred to in point (b);

f) inak spolupracuje s vyššie uvedenými úradnými orgánmi.

(f) otherwise cooperates with the said responsible official bodies.

Článok 4

Pokiaľ ide o zavedenie a uskutočňovanie metód pre sledovanie a kontrolu kritických bodov, ako je uvedené v druhej zarážke článku 5 (2) smernice 92/34/EHS, zodpovedný úradný orgán musí robiť dozor nad dodávateľom a kontrolovať ho, aby sa zabezpečilo, že tam, kde je to vhodné, sa takéto metódy naďalej vykonávajú, aby sa náležitá pozornosť venovala:

a) dostupnosti a skutočnému používaniu metód na kontrolu každého z kritických bodov uvedených v článku 3;

As fas as the establishment and implementation of methods for monitoring and checking the critical points as referred to in the second indent of Article 5 (2) of Directive 92/34/EEC are concerned, the responsible official body shall supervise and monitor the supplier to ensure that, where appropriate, such methods continue to be carried out, giving particular attention to:

b) spoľahlivosti takýchto metód;

(a) the availability and actual use of methods for checking each of the critical points mentioned in Article 3;

c) ich vhodnosti pre posúdenie obsahu opatrení pre výrobu a predaj vrátane administratívnych aspektov a

(b) the reliability of those methods;

d) odbornej spôsobilosti pracovníkov dodávateľa vykonávať kontroly.

(c) their suitability for an assessment of the content of the production and marketing arrangements, including the administrative aspects; and

Článok 5

(d) the competence of the supplier's staff to carry out the checks.

Pokiaľ ide o odoberanie vzoriek pre analýzu vo schválenom laboratóriu, ako je uvedené v tretej zarážke článku 5 (2) smernice 92/34/EHS, zodpovedný úradný orgán musí vykonávať dozor nad dodávateľom a sledovať ho, aby sa zabezpečilo, že:

a) vzorky sa odoberajú počas rôznych štádií výrobného procesu, a tak často, ako sa to oznámilo zodpovednému úradnému orgánu, keď sa preverovali výrobné metódy a čas akreditácie;

b) vzorky sa odoberajú technicky správnym spôsobom a pri použití štatisticky spoľahlivých postupov, pričom sa berie do úvahy druh analýzy, ktorá sa má vykonať;

As far as the taking of samples for analysis in an accredited laboratory as referred to in the third indent of Article 5 (2) of Directive 92/34/EEC is concerned, the responsible official body shall supervise and monitor the supplier to ensure, where appropriate, that:

c) osoby, ktoré vzorky odoberajú, sú na to kvalifikované a

(a) samples are taken during the various stages of the production process and in conformity with the frequency as communicated to the responsible official body when the production methods were verified at the time of accreditation;

d) analýzu vzoriek vykonáva laboratórium, ktoré na tento účel akreditované podľa článku 6 (2) vyššie uvedenej smernice.

(b) samples are taken in a technically correct manner and using a statistically reliable procedure, regard being had to the kind of analysis to be carried out;

(c) the persons who take the samples are qualified to do so; and

1. Členské štáty uvedú do účinnosti zákony, iné právne predpisy a správne opatrenia potrebné na dosiahnutie súladu s touto smernicou do 30. júna 1994. Bezodkladne o tom budú informovať Komisiu.

(d) the analysis of samples is carried out by a laboratory which is accredited for that purpose pursuant to Article 6 (2) of the said Directive.

Ak členské štáty prijmú takéto opatrenia, musia obsahovať odkaz na túto smernicu alebo sa takýto odkaz k nim musí pripojiť pri príležitosti ich úradného uverejnenia. Členské štáty prijmú postup na takýto odkaz.

2. Členské štáty oznámia Komisii text hlavných ustanovení vnútroštátneho práva, ktoré prijmú v oblasti, na ktoré sa vzťahuje táto smernica.

Article 6

1. Member States shall bring into force the laws, regulations or administrative provisions necessary to comply with this Directive not later than 30 June 1994. They shall forthwith inform the Commission thereof.

Táto smernica je adresovaná členským štátom.

When Member States adopt these provisions, these shall contain a reference to this Directive or shall be accompanied by such reference at the time of their official publication. The procedure for such reference shall be adopted by Member States.

2. Member States shall communicate to the Commission the text of the main provisions of domestic law which they adopt in the field covered by this Directive.
