Having regard to Council Regulation (EC) No 1254/1999 of 17 May 1999 on the common organisation of the market in beef and veal(1), as last amended by Commission Regulation (EC) No 2345/2001(2), and in particular Article 33(12) thereof,
|

Whereas:
|
(1) článok 33 ods. 9 nariadenia (ES) č. 1254/1999 ustanovuje, že vyplácanie vývozných náhrad na živý hovädzí dobytok je predmetom dodržiavania legislatívy spoločenstva týkajúcej sa pohody zvierat a najmä smernice Rady 91/628/EHS z 19. novembra 1991 o ochrane zvierat počas prepravy [3], naposledy zmenenej a doplnenej smernicou 95/29/ES [4];
|
|
(1) Article 33(9) of Regulation (EC) No 1254/1999 provides that the payment of the refund for exports of live bovine animals is subject to compliance with Community legislation concerning animal welfare and, in particular, Council Directive 91/628/EEC of 19 November 1991 on the protection of animals during transport(3), as last amended by Directive 95/29/EC(4).
|
(2) podrobné pravidlá z hľadiska pohody hovädzieho dobytka počas prepravy sú ustanovené v nariadení Komisie (ES) č. 615/98 [5]. Na základe skúseností je potrebné zlepšiť dodržiavanie požiadaviek na pohodu zvierat pre poskytovanie vývozných náhrad na uvedené zvieratá. Preto by sa mali posilniť kontroly a pokuty ustanovené v uvedenom nariadení. Na účel prehľadnosti by sa tiež malo nahradiť nariadenie (ES) č. 615/98;

(2) Detailed rules as regards the welfare of live bovine animals during transport are laid down in Commission Regulation (EC) No 615/98(5). Experience has shown the need to improve the enforcement of animal welfare requirements for the granting of refunds for the export of those animals. Therefore the checks and penalties provided for in that Regulation should be reinforced. In addition, in the interests of clarity, Regulation (EC) No 615/98 should be replaced.
|

(3) In order to guarantee that the animal welfare standards are maintained, a monitoring system should be introduced comprising compulsory checks at the exit point from the Community and after leaving the customs territory of the Community where there is a change of means of transport and also at the place of the first unloading in the third country of final destination.
|
(4) na zabezpečenie správnych kontrol pri výstupe zo spoločenstva je potrebné určiť miesta výstupu;

(4) In order to facilitate proper checks on exit from the Community, it is necessary to designate exit points.
|
(5) hodnotenie fyzickej kondície a zdravotného stavu zvierat si vyžaduje osobitnú expertízu a skúsenosti. Preto by kontroly mal vykonávať veterinárny lekár. Takisto by mal byť objasnený rozsah týchto kontrol a stanovená vzorová správa, aby boli tieto kontroly presné a jednotné;

(5) The assessment of the physical condition and state of health of animals requires specific expertise and experience. Checks should therefore be carried out by a veterinarian. Moreover, the extent of those checks should be clarified and a model report set out in order to make those checks accurate and harmonised.
|
(6) kontroly v tretích krajinách na účely tohto nariadenia by mali byť povinné a mali by ich vykonávať orgány členských štátov alebo medzinárodné agentúry pre kontrolu a dozor (ďalej len AKD) schválené a kontrolované členskými štátmi v súlade s nariadením Komisie (ES) č. 800/1999 z 15. apríla 1999, ktorým sa ustanovujú spoločné podrobné pravidlá uplatňovania systému vývozných náhrad na poľnohospodárske výrobky [6], naposledy zmeneným a doplneným nariadením (ES) č. 444/2003 [7]. Pri vykonávaní kontrol na účely tohto nariadenia by AKD mali zvlášť dodržiavať požiadavky na schválenie a kontrolu ustanovené v prílohe VI k nariadeniu (ES) č. 800/1999 od 1. januára 2004;
|

(6) Checks in third countries for the purposes of this Regulation should be compulsory and should be carried out by agencies of Member States or by international control and supervisory agencies (hereinafter referred to as SAs) approved and controlled by Member States in accordance with Commission Regulation (EC) No 800/1999 of 15 April 1999 laying down common detailed rules for the application of the system of export refunds on agricultural products(6), as last amended by Regulation (EC) No 444/2003(7). In order to carry out checks for purposes of this Regulation, the SAs should in particular meet the requirements for approval and control set out in Annex VI to Regulation (EC) No 800/1999 as from 1 January 2004.
|
(7) ak sa potvrdí, že sa smernica 91/628/EHS nedodržiava u vysokého počtu zvierat, mali by sa okrem nevyplatenia vývozných náhrad uplatňovať aj primerané pokuty. Ak z takéhoto nedodržiavania ustanovení navyše vyplýva úplné zanedbanie požiadaviek na pohodu zvierat, mala by sa ustanovená celková strata náhrady;

(7) In addition to the non-payment of the export refund, when there is evidence that Directive 91/628/EEC is not complied with for a high number of animals, appropriate penalties should be applied. Furthermore, where such non-compliance is due to a complete disregard of animal welfare requirements, the total loss of the refund should be established.
|

(8) Member States should provide the Commission with the necessary information for purposes of monitoring and reporting on the application of this Regulation.
|

Článok 1
|
|
|
Oblasť pôsobnosti

|
Article 1
|
Vývozné náhrady na živý hovädzí dobytok, patriaci pod číselný znak KN 0102, (ďalej len zvieratá) sa v súlade s druhým pododsekom článku 33 ods. 9 nariadenia (ES) č. 1254/1999 vypláca len ak počas prepravy zvierat na prvé miesto vykládky v tretej krajine konečného určenia boli dodržané ustanovenia smernice 91/628/EHS a tohto nariadenia.

Scope
|
Článok 2
|
|
Payment of export refunds for live bovine animals falling within CN code 0102 (hereinafter referred to as the animals), pursuant to Article 33(9), second subparagraph, of Regulation (EC) No 1254/1999, shall be subject to compliance, during the transport of the animals to the first place of unloading in the third country of final destination, with the provisions of Directive 91/628/EEC and of this Regulation.

Kontroly v rámci spoločenstva

|
1. Zvieratá môžu opustiť colné územie spoločenstva len na nasledujúcich výstupných miestach:

|
Article 2
|
a) hraničná inšpekčná stanica odsúhlasená rozhodnutím Komisie o veterinárnych kontrolách živých kopytníkov z tretích krajín;

|
Checks within the Community
|
alebo
|
|
1. The exit of the animals from the customs territory of the Community may take place only through the following exit points:
|
b) miesto výstupu určené členským štátom.
|
|
(a) a border inspection post agreed by a Commission decision for veterinary checks on live ungulates from third countries; or
|
2. Úradný veterinárny lekár v mieste výstupu zo spoločenstva overuje v súlade so smernicou Rady 96/93/ES [8] u tých zvierat, pre ktoré bola prijatá vývozná deklarácia, či:
|
|
(b) an exit point designated by the Member State.
|
a) boli splnené požiadavky ustanovené v smernici 91/628/EHS od miesta odoslania ako je ustanovené v článku 22 ods. 2 danej smernice po miesto výstupu;
|
|
2. The official veterinarian at the exit point from the Community shall verify in accordance with Council Directive 96/93/EC(8) for those animals for which an export declaration is accepted whether:
|
b) boli podmienky pri preprave počas zvyšku cesty v súlade s ustanoveniami smernice 91/628/EHS a či boli prijaté potrebné opatrenia na zabezpečenie ich dodržiavania do prvej vykládky v tretej krajine konečného určenia.

|
(a) the requirements laid down in Directive 91/628/EEC have been complied with from the place of departure, as defined in Article 2(2)(e) of that Directive, until the exit point; and
|
Úradný veterinárny lekár, ktorý vykonal kontroly, vypracováva správu podľa vzoru ustanoveného v prílohe I, v ktorej potvrdí, či výsledky vykonanej kontroly podľa prvého pododseku boli uspokojivé alebo neuspokojivé.

|
(b) the transport conditions for the rest of the journey comply with the provisions of Directive 91/628/EEC and that the necessary arrangements have been taken to ensure their compliance until the first unloading in the third country of final destination.
|
Veterinárny orgán zodpovedný za miesto výstupu uchováva túto správu najmenej počas troch rokov.
|
|
The official veterinarian who has conducted the checks shall complete a report in accordance with the model set out in Annex I certifying whether the results of the checks performed in accordance with the first subparagraph are satisfactory or not satisfactory.
|
3. Ak je úradný veterinárny lekár v mieste výstupu presvedčený, že požiadavky odseku 2 boli splnené, potvrdzuje to zápisom:

|
The veterinarian authority responsible for the exit point shall keep this report for at least three years.
|

3. If the official veterinarian at the exit point is satisfied that the requirements of paragraph 2 are met, he shall certify this by the entry:

Úradný veterinárny lekár v mieste výstupu potvrdzuje v dokumente uvedenom v odseku 3 celkový počet zvierat, na ktoré bola prijatá vývozná deklarácia, pričom odpočíta počet zvierat, ktoré počas prepravy porodili alebo potratili, uhynuli alebo pre ktoré neboli splnené požiadavky smernice 91/628/EHS.

|
and by stamping and signing the document constituting evidence of exit from the customs territory of the Community, either in Section J of the control copy T5 or in the most appropriate place on the national document.
|
5. Členské štáty môžu od vývozcu vyžadovať, aby úradnému veterinárnemu lekárovi na výstupnom bode podal vopred oznámenie o príchode zásielky na miesto výstupu.
|
|
4. The official veterinarian at the exit point shall endorse on the document referred to in paragraph 3 the total number of animals for which an export declaration had been accepted minus the number of animals which gave birth or aborted during transport, died or for which the requirements of Directive 91/628/EEC were not complied with.
|
6. Odlišne od odseku 1, ak sa uplatňuje zjednodušený režim tranzitu v rámci spoločenstva na prepravu po železnici alebo vo veľkých prepravných vozidlách uvedený v článku 10 nariadenia (ES) č. 800/1999, úradný veterinárny lekár vykonáva kontroly v úrade, kde sú zvieratá umiestnené podľa tohto režimu.
|
|
5. Member States may require the exporter to give advance notice of the arrival of the consignment at the exit point to the official veterinarian at the exit point.
|
Certifikácia a potvrdenia uvedené v odsekoch 3 a 4 tohto článku sa vydávajú na dokumentoch používaných na účely vyplatenia náhrady alebo v prípade uvedenom v článku 10 ods. 4 nariadenia (ES) č. 800/1999 na kontrolnej kópii T5.
|
|
6. By way of derogation from paragraph 1, where the simplified Community transit procedure for carriage by rail or large containers referred to in Article 10 of Regulation (EC) No 800/1999 applies, the official veterinarian shall carry out checks at the office where the animals are placed under such procedure.

Článok 3
|
|
The certification and endorsements referred to in paragraphs 3 and 4 of this Article shall be made on the document used for the purpose of payment of the refund or on the T5 control copy in the case described in Article 10(4) of Regulation (EC) No 800/1999.
|
Kontroly v tretích krajinách
|
|
|
1. Po opustení colného územia spoločenstva vývozca zabezpečuje, aby zvieratá boli predmetom kontroly:
|

a) v mieste, kde dochádza k výmene dopravného prostriedku okrem miesta, kde takáto zmena nebola plánovaná a došlo k nej vzhľadom na výnimočné a nepredvídateľné okolnosti;

|
1. After leaving the customs territory of the Community, the exporter shall ensure that the animals shall be subject to a check at:
|
2. Medzinárodná agentúra pre kontrolu a dozor schválená a kontrolovaná na tento účel členským štátom v súlade s článkami 16 písm. a a 16 písm. f nariadenia (ES) č. 800/1999 alebo úradný orgán členského štátu je zodpovedný za vykonávanie kontrol stanovených v odseku 1.
|
|
(a) any place where there is a change of means of transport except where such change was not planned and is due to exceptional and unforeseen circumstances;
|
Kontroly ustanovené v odseku 1 vykonáva veterinárny lekár.
|
|
(b) the place of the first unloading in the third country of final destination.
|
Správu o každej kontrole vykonanej podľa odseku 1 vypracováva, v súlade so vzormi stanovenými v prílohe II a prílohe III, veterinárny lekár, ktorý vykonal kontrolu.
|
|
2. An international control and supervisory agency, approved and controlled for this purpose by a Member State in accordance with Articles 16(a) to 16(f) of Regulation (EC) No 800/1999, or an official agency of a Member State shall be responsible for carrying out the checks provided for in paragraph 1.
|
Článok 4
|
|
The checks provided for in paragraph 1 shall be carried out by a veterinarian.
|
Postup na vyplatenie vývozných náhrad
|
|
A report of each check carried out pursuant to paragraph 1 shall be completed in accordance with the models set out in Annexes II and III by the veterinarian who carried out the check.
|
1. Vývozca informuje príslušný orgán členského štátu, v ktorom bola prijatá vývozná deklarácia, o všetkých potrebných podrobnostiach cesty najneskôr pri podaní vývoznej deklarácie.
|
|
|
Súčasne alebo ihneď ako sa to dozvie, vývozca informuje príslušný orgán o možnej zmene dopravného prostriedku.
|
|
Article 4
|
2. Žiadosti o vyplatenie vývozných náhrad podľa článku 49 nariadenia (ES) č. 800/1999 musia byť doplnené do lehoty stanovenej v danom článku:
|
|
Procedure for payment of export refunds
|
a) riadne vypracovaným dokumentom uvedeným v článku 2 ods. 3 tohto nariadenia; a
|
|
1. The exporter shall inform the competent authority of the Member State where the export declaration is accepted about all necessary details of the journey, at the latest when the export declaration is lodged.
|
b) správami uvedenými v článku 3 ods. 2 tohto nariadenia.
|
|
At the same time, or at the latest when he becomes aware thereof, the exporter shall inform the competent authority about any possible change of the means of transport.
|
3. Ak by sa nemohli vykonať kontroly uvedené článku 3 ods. 1 vzhľadom na okolnosti, ktoré vývozca nemohol ovplyvniť, príslušný orgán na odôvodnené požiadanie vývozcu môže akceptovať iné dokumenty, ktoré vierohodne potvrdia, že smernica 91/628/EHS bola dodržaná.
|
|
2. Applications for the payment of export refunds drawn up in accordance with Article 49 of Regulation (EC) No 800/1999 must be supplemented within the time limit laid down in that Article by:
|

(a) the document referred to in Article 2(3) of this Regulation duly completed; and
|

(b) the reports provided for in Article 3(2) of this Regulation.
|
1. Vývozná náhrada sa nevypláca na:

3. Where the checks referred to in Article 3(1) could not be carried out due to circumstances beyond the control of the exporter, the competent authority, on a reasoned request from the exporter, may accept other documents which prove to its satisfaction that Directive 91/628/EEC has been complied with.
|
a) zvieratá, ktoré uhynuli počas prepravy s výnimkou odseku 2;
|
|
|
b) zvieratá, ktoré porodili alebo potratili počas prepravy pred ich prvou vykládkou v tretej krajine konečného určenia;
|
|
Article 5
|
c) zvieratá, pri ktorých príslušné orgány na základe dokumentov uvedených v článku 4 ods. 2 a/alebo všetkých dostupných údajov týkajúcich sa dodržiavania tohto nariadenia usúdili, že smernica 91/628/EHS nebola dodržaná.
|
|
Non-payment of export refunds
|
Hmotnosť zvieraťa, na ktoré sa náhrada nevypláca, sa stanovuje paušálne tak, že sa celková hmotnosť v kilogramoch uvedená na vývoznej deklarácii vydelí celkovým počtom zvierat uvedeným v tej istej deklarácii.
|
|
1. The export refund shall not be paid for:
|
2. V prípade, že zvieratá uhynuli počas prepravy v dôsledku vyššej moci po opustení colného územia spoločenstva:
|
|
(a) animals which have died during transport, except as provided in paragraph 2;
|
a) v prípade nediferencovanej náhrady sa vypláca celá náhrada;
|
|
(b) animals which have given birth or aborted during transport before their first unloading in the third country of final destination;
|
b) v prípade diferencovanej náhrady sa vypláca časť náhrady stanovená podľa článku 18 ods. 2 nariadenia (ES) č. 800/1999.
|
|
(c) animals for which the competent authority considers that Directive 91/628/EEC has not been complied with, in the light of the documents referred to in Article 4(2) and/or all other elements at its disposal concerning compliance with this Regulation.
|
Článok 6
|
|
The weight of an animal in respect of which the refund is not paid shall be determined on a flat-rate basis by dividing the total weight in kilograms given in the export declaration by the total number of animals given in that same declaration.
|
Pokuty
|
|
2. Where the animals have died during transport as a result of force majeure after leaving the customs territory of the Community:
|
1. Náhrada sa ďalej znížuje o sumu, ktorá sa rovná sume náhrady, ktorá nebola vyplatená podľa článku 5 ods. 1, ak počet zvierat, na ktoré sa vývozná náhrada nevypláca, dosiahne:
|
|
(a) in the case of a non-differentiated refund, the total refund shall be paid;
|
a) viac ako 1 % počtu potvrdeného v prijatej vývoznej deklarácii, avšak najmenej dve zvieratá; alebo
|
|
(b) in the case of a differentiated refund, the part of the refund defined in accordance with Article 18(2) of Regulation (EC) No 800/1999 shall be paid.
|
b) viac ako päť zvierat.
|
|
|
2. Náhrada za všetky zvieratá označené vo vývoznej deklarácii sa zamieta, ak počet zvierat, na ktoré náhrada nebola vyplatená podľa článku 5 ods. 1 dosiahne:

|
a) viac ako 5 % z počtu potvrdeného v prijatej vývoznej deklarácii ale najmenej tri zvieratá; alebo
|

Penalties
|
b) 10 zvierat avšak najmenej 2 % z počtu potvrdeného v prijatej vývoznej deklarácii.

|
1. The refund shall be further reduced by an amount equal to the amount of refund which is not paid pursuant to Article 5(1), if the number of animals for which no export refund is paid amounts to:
|
3. Na účely odsekov 1 a 2 sa neberú do úvahy zvieratá, ktoré uhynuli počas prepravy a zvieratá, ktoré porodili alebo potratili pred ich prvou vykládkou v tretej krajine konečného určenia, pri ktorých vývozca vierohodne potvrdí príslušnému orgánu, že ich úhyn alebo pôrod alebo zmetanie neboli spôsobené nedodržaním smernice 91/628/EHS.

|
(a) more than 1 % of the number endorsed in the accepted export declaration, but at least two animals; or
|
4. Pokuta uvedená v článku 51 nariadenia (ES) č. 800/1999 sa neuplatňuje na nevyplatené množstvo a sumu, o ktorú sa znížila suma náhrady podľa článku 5 a odsekov 1 a 2 tohto článku.

|
(b) more than five animals.
|
Článok 7
|
|
2. The refund for all animals indicated in the export declaration shall be refused if the number of animals for which no refund is paid pursuant to Article 5(1) amounts to:
|

(a) more than 5 % of the number endorsed in the accepted export declaration, but at least three animals; or
|
Ak sa po vyplatení náhrady zistí, že smernica 91/628/EHS nebola dodržaná, príslušná časť náhrady vrátane, ak je to vhodné, pokuty podľa článku 6 tohto nariadenia sa považuje za neoprávnene vyplatenú a vracia sa v súlade s ustanoveniami článku 52 nariadenia (ES) č. 800/1999.

(b) 10 animals, but at least 2 % of the number endorsed in the accepted export declaration.

Článok 8
|
|
3. For the purpose of paragraphs 1 and 2, the animals which died during transport and the animals that gave birth or aborted before their first unloading in the third country of final destination for which the exporter proves to the satisfaction of the competent authority that their death or the birth or abortion was not the result of non-compliance with Directive 91/628/EEC shall not be taken into account.

4. The penalty referred to in Article 51 of Regulation (EC) No 800/1999 shall not apply to the amount not paid and the amount of the reduction pursuant to Article 5 and to paragraphs 1 and 2 of this Article.
|
Členské štáty oznamujú Komisii najneskôr do 31. marca každého roku nasledujúce informácie súvisiace s uplatňovaním tohto nariadenia počas predchádzajúceho kalendárneho roka:
|

|
a) počet vývozných deklarácií pre živé zvieratá, na ktoré bola vyplatená náhrada a počet živých zvierat, na ktoré bola náhrada vyplatená;

b) počet vývozných deklarácií, na ktoré nebola náhrada plne alebo čiastočne vyplatená a počet zvierat, na ktoré náhrada nebola vyplatená;

Recovery of amounts over-paid
|
c) počet vývozných deklarácií, na ktoré bola náhrada plne alebo čiastočne vrátená a počet zvierat, na ktoré bola náhrada vrátená; vrátane tých, pri ktorých vrátenie náhrad súvisí s vývoznými operáciami uskutočnenými pred uvedeným obdobím;

Where it is established after payment of the refund that Directive 91/628/EEC has not been complied with, the relevant part of the refund, including where appropriate the penalty pursuant to Article 6 of this Regulation, shall be considered to have been paid unduly and shall be recovered in accordance with the provisions of Article 52 of Regulation (EC) No 800/1999.

d) dôvody na nevyplatenie a vrátenie náhrady na zvieratá uvedené v bodoch b a c;

|
|
e) sumy náhrad v euro, ktoré neboli vyplatené a sumy, ktoré boli vrátené, vrátane vrátených súm súvisiacich s vývoznými operáciami uskutočnenými pred uvedeným obdobím;

f) počet vývozných deklarácií a sumy, pre ktoré ešte prebieha postup vrátenia;

g) ďalšie iné informácie, ktoré členské štáty považujú za vhodné v súvislosti s uplatňovaním tohto nariadenia.

|
Member States shall notify to the Commission no later than 31 March of each year the following information relating to the application of this Regulation during the previous calendar year:

(a) the number of export declarations for live animals for which the refund was paid and the number of live animals for which the refund was paid;

(b) the number of export declarations for which the refund was totally or partially not paid and the number of animals for which the refund was not paid;

Týmto sa zrušuje nariadenie (ES) č. 615/98. Uvedené nariadenie sa však bude naďalej uplatňovať na vývozné deklarácie prijaté pred uplatňovaním tohto nariadenia.

|
(c) the number of export declarations for which the refund was totally or partially recovered and the number of animals for which the refund was recovered, including those for which the recovery of the refunds relates to export operations carried out before the period concerned;
|
Odkazy na zrušené nariadenie sa považujú za odkazy na toto nariadenie a čítajú sa podľa porovnávacej tabuľky uvedenej v prílohe IV.
|
|
(d) the reasons for the non-payment and the recovery of the refund for the animals referred to in points (b) and (c);

(e) the amounts of the refunds in euro that were not paid and the amounts that were recovered, including the recovered amounts corresponding to export operations carried out before the period concerned;

|
(f) the number of export declarations and the amounts for which the recovery procedure is still in process;
|
Toto nariadenie nadobúda účinnosť tretí deň odo dňa jeho uverejnenia v Úradnom vestníku Európskej únie.
|
|
(g) any other information Member States consider relevant regarding the functioning of this Regulation.
|
Bude sa uplatňovať na vývozné prehlásenia prijaté od 1. októbra 2003.
|
|
|
Avšak požiadavka, že schválenie a kontrola medzinárodnej agentúry pre kontrolu a dozor podľa článku 3 ods. 2 bude v súlade s článkami 16 písm. a až 16 písm. f nariadenia (ES) č. 800/1999 sa uplatňuje na vývozné deklarácie prijaté od 1. januára 2004.

Article 9
|
Toto nariadenie je záväzné vo svojej celistvosti a je priamo uplatniteľné vo všetkých členských štátoch.
|
|
Repeal
|
|
|
Regulation (EC) No 615/98 is repealed. However, that Regulation shall continue to apply to export declarations accepted prior to the application of this Regulation.
