THE COMMISSION OF THE EUROPEAN COMMUNITIES,

ustanovujúce osobitné podmienky, ktorými sa riadi dovoz produktov rybolovu a akvakultúry s pôvodom v Nigérii

Having regard to the Treaty establishing the European Community,
|

Having regard to Council Directive 91/493/EEC of 22 July 1991 laying down the health conditions for the production and the placing on the market of fishery products (1), as last amended by the Act of Accession of Austria, Finland and Sweden, and in particular Article 11 thereof,
|

Whereas a Commission expert has conducted an inspection visit to Nigeria to verify the conditions under which fishery products are produced, stored and dispatched to the Community;
|

Whereas the provisions of legislation of Nigeria on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC;
|
KOMISIA EURÓPSKYCH SPOLOČENSTIEV,

Whereas, in Nigeria the Nigeria Federal Department of Fisheries (FDF) of the Federal Ministry of Agriculture and Natural Resources is capable of effectively verifying the application of the laws in force;
|
so zreteľom na Zmluvu o založení Európskeho spoločenstva,

Whereas the procedure for obtaining the health certificate referred to in Article 11(4)(a) of Directive 91/493/EEC must also cover the definition of a model certificate, the minimum requirements regarding the language(s) in which it must be drafted and the grade of the person empowered to sign it;
|
so zreteľom na smernicu Rady 91/493/EHS z 22. júla 1991, ktorou sa stanovujú veterinárne podmienky výroby výrobkov rybného hospodárstva a ich uvádzania na trh [1], naposledy zmenenú a doplnenú Aktom o pristúpení Rakúska, Fínska a Švédska, a najmä na jeho článok 11,

Whereas, pursuant to Article 11(4)(b) of Directive 91/493/EEC, a mark should be affixed to packages of fishery products giving the name of the third country and the approval/registration number of the establishment, factory vessel, cold store or freezer vessel of origin;
|
keďže odborník Komisie vykonal inšpekčnú návštevu v Nigérii s cieľom preveriť podmienky, za akých sa produkty rybolovu produkujú, uskladňujú a odosielajú do spoločenstva;
|
|
Whereas, pursuant to Article 11(4)(c) of Directive 91/493/EEC, a list of approved establishments, factory vessels or cold stores must be drawn up; whereas a list of freezer vessels registered in the sense of Council Directive 92/48/EEC (2) must be drawn up; whereas this list must be drawn up on the basis of a communication from the FDF to the Commission; whereas it is therefore for the FDF to ensure compliance with the provisions laid down to that end in Article 11(4) of Directive 91/493/EEC;

keďže ustanovenia legislatívy Nigérie, týkajúcej sa zdravotných prehliadok a monitorovania produktov rybolovu sa môžu považovať za rovnocenné s ustanoveniami uvedenými v smernici 91/493/EHS;
|
|
Whereas the FDF has provided official assurances regarding compliance with the rules set out in Chapter V of the Annex to Directive 91/493/EEC and regarding the fulfilment of requirements equivalent to those laid down by that Directive for the approval or registration of establishments, factory vessels, cold stores or freezer vessels;
|
keďže v Nigérii je Federálne oddelenie pre rybolov Nigérie (FDF) Federálneho ministerstva poľnohospodárstva a prírodných zdrojov schopné účinne preverovať uplatňovanie platných právnych predpisov;
|
|
Whereas the measures provided for in this Decision are in accordance with the opinion of he Standing Veterinary Committee,
|
keďže postup na získanie veterinárneho osvedčenia uvedeného v článku 11ods. 4 písm. a) smernice 91/493/EHS sa musí vzťahovať aj na definíciu vzorového osvedčenia, minimálne požiadavky týkajúce sa jazyku(jazykov), v ktorom musí byť koncipovaný a štatút osoby, splnomocnenej podpísať toto osvedčenie;
|

HAS ADOPTED THIS DECISION:
|
keďže na základe článku 11 ods. 4 písm. b) smernice 91/493/EHS sa musia na obaly produktov rybolovu upevniť značky s uvedením názvu tretej krajiny a schvaľovacieho/registračného čísla prevádzkárne, lodnej továrne, chladiarenského skladu alebo mraziarenskej lode pôvodu;
|
|
|
keďže na základe článku 11 ods. 4 písm. c) smernice 91/493/EHS sa musí vypracovať zoznam schválených prevádzkární, lodných tovární alebo chladiarenských skladov; keďže sa musí vypracovať zoznam registrovaných mraziarenských lodí v zmysle smernice Rady 92/48/EHS [2]; keďže tento zoznam sa musí vypracovať na základe komunikácie medzi FDF a Komisiou; keďže z tohto dôvodu je na FDP, aby zabezpečilo zhodu s ustanoveniami uvedenými v tomto zmysle v článku 11 ods. 4 smernice 91/493/EHS;
|

|
keďže FDF predložilo úradné uistenia týkajúce sa súladu s pravidlami uvedenými v kapitole V prílohy k smernici 91/493/EHS a týkajúce sa splnenia požiadaviek rovnocenných požiadavkám stanoveným danou smernicou pre schválenie alebo registráciu prevádzkární, lodných tovární alebo chladiarenských skladov alebo mraziarenských lodí;

keďže opatrenia uvedené v tomto rozhodnutí sú v súlade so stanoviskom Stáleho veterinárneho výboru,
|
|
The Federal Department of Fisheries (FDF) of the Federal Ministry of Agriculture and Natural Resources shall be the competent authority in Nigeria for verifying and certifying compliance of fishery and aquaculture products with the requirements of Directive 91/493/EEC.

Federálne oddelenie rybolovu (FDF) Federálneho Ministerstva poľnohospodárstva a prírodných zdrojov je príslušným orgánom v Nigérii za overovanie a certifikáciu zhody produktov rybolovu a akvakultúry s požiadavkami smernice 91/493/EHS.
|
|
Fishery and aquaculture products originating in Nigeria must meet the following conditions:
|
Článok 2

|
1. each consignment must be accompanied by a numbered original health certificate, duly completed, signed, dated and comprising a single sheet in accordance with the model in Annex A hereto;
|
Produkty rybolovu a akvakultúry pochádzajúce z Nigérie musia spĺňať nasledovné podmienky:
|
|
2. the products must come from approved establishments, factory vessels, cold stores or registered freezer vessels listed in Annex B hereto;
|
1. každá zásielka musí byť sprevádzaná očíslovaným originálom veterinárneho osvedčenia, vyplneným, podpísaným, opatreným dátumom a tento musí tvoriť jediný hárok papiera v súlade so vzorom uvedeným v prílohe A k tomuto rozhodnutiu;
|
|
3. except in the case of frozen fishery products in bulk and intended for the manufacture of preserved foods, all packages must bear the word 'NIGERIA` and the approval/registration number of the establishment, factory vessel, cold store or freezer vessel of origin in indelible letters.
|
2. produkty musia pochádzať zo schválených prevádzkární, spracovateľských lodí, chladiarenských zariadení alebo z registrovaných mraziarenských lodí uvedených v prílohe B k tomuto rozhodnutiu;
|
|
|
3. s výnimkou prípadu mrazených produktov rybolovu voľne uložených a určených na výrobu konzervovaných potravín musí byť na všetkých obaloch uvedené slovo NIGÉRIA a schvaľovacie/registračné číslo prevádzkárne, spracovateľskej lode, chladiarenského zariadenia alebo mraziarenskej lode pôvodu nezmazateľnými písmenami.

1. Certificates as referred to in Article 2(1) must be drawn up in at least one official language of the Member State where the checks are carried out.
|
1. Osvedčenia uvedené v bode 1 článku 2 musia byť vypracované aspoň v jednom úradnom jazyku toho členského štátu, v ktorom sa kontroly vykonávajú.
|
|
2. Certificates must bear the name, capacity and signature of the representative of the FDF and the latter's official stamp in a colour different from that of other endorsements.
|
2. Na osvedčeniach musí byť uvedené meno, funkcia a podpis zástupcu FDF a jeho úradná pečiatka, ktorej farba sa musí líšiť od farby ostatných potvrdení.
