Having regard to the Treaty establishing the European Economic Community, and in particular Article 75 thereof,

Having regard to the proposal from the Commission,
|
CONSILIUL COMUNITĂȚILOR EUROPENE,
|
|
Having regard to the opinion of the European Parliament (1),
|
având în vedere Tratatul de instituire a Comunității Economice Europene, în special articolul 75,

Having regard to the opinion of the Economic and Social Committee (2),

având în vedere propunerea Comisiei,
|
|
Whereas, in order to institute under the common transport policy a system of charging for the use of infrastructure, it is necessary to know what expenditure is incurred in respect of infrastructure;
|

Whereas a permanent accounting system offers the most suitable means for knowing what expenditure is incurred in respect of infrastructure;
|

Whereas to this end the Council, by Regulation (EEC) No 1108/70 (3), introduced a permanent accounting system for such expenditure;
|
întrucât în vederea instituirii unui sistem de tarifare pentru utilizarea infrastructurii în cadrul politicii comune de transport este necesar să se cunoască cheltuielile cu infrastructura;
|

Whereas account should be taken of experience gained and of the development of the common transport policy ; whereas the forms of accounts, the list of types of infrastructure and the schedule of returns concerning the use of infrastructure provided for in Regulation (EEC) No 1108/70 should be adjusted accordingly,
|
întrucât un sistem de contabilitate permanentă oferă modalitatea cea mai adecvată de cunoaștere a cheltuielilor cu infrastructura;
|
|
HAS ADOPTED THIS REGULATION:
|
întrucât Consiliul a introdus în acest scop, prin Regulamentul (CEE) nr. 1108/70 [3], un sistem de contabilitate permanentă pentru aceste cheltuieli;
|
|
|
întrucât ar trebui să se țină seama de experiența dobândită și de elaborarea politicii comune de transport; întrucât formularele contabile, lista tipurilor de infrastructură și graficul încasărilor cu privire la utilizarea infrastructurii prevăzute în Regulamentul (CEE) nr. 1108/70 ar trebui să fie modificate în consecință,

Article 1
|
ADOPTĂ PREZENTUL REGULAMENT:
|
|
Regulation (EEC) No 1108/70 is hereby amended as follows: 1. Article 3 shall be replaced by the following:
|

|
Regulamentul (CEE) nr. 1108/70 se modifică după cum urmează:
|
|
Infrastructure expenditure accounts shall be kept for each of the railway networks listed in Annex II (A. 1) and for the total of all the other networks listed in Annex II (A. 2), as well as for all roads and inland waterways open to public traffic, with the following exceptions: (a) roads closed to motor traffic, that is, to vehicles with a cylinder capacity equal to or exceeding 50 cm3;
|

Conturile de cheltuieli cu infrastructura se vor întocmi pentru fiecare din rețelele feroviare specificate la anexa II (A.1) și pentru totalul celorlalte rețele specificate la anexa II (A.2), precum și pentru toate căile rutiere și navigabile interioare deschise traficului public, cu următoarele excepții:

(d) waterways of a maritime character, as listed in Regulation (EEC) No 281/71 (1).
|
a) (drumurile închise traficului auto, adică vehiculelor având o capacitate cilindrică mai mare sau egală cu 50 cm3;
|
|
|
(b) drumurile folosite exclusiv de către vehiculele agricole sau forestiere ori care sunt utilizate exclusiv la asigurarea accesului pentru operațiunile agricole sau forestiere;
|
|
|
(c) căile navigabile interioare unde traficul se limitează la nave având capacitate maximă de transport mai mică de 250 tone;

3. The second indent of the first subparagraph of Article 6 shall be replaced by the following:

Member States shall send to the Commission, at the same time as they send the accounts referred to in Article 5 and in respect of the same period, returns relating to the use of infrastructures in accordance with Tables A, B (1.1) and C of Annex III.
|
Statele membre trimit Comisiei, concomitent cu evidențele menționate la articolul 5 și pentru aceeași perioadă, situația încasărilor privind utilizarea infrastructurilor, în conformitate cu tabelele A, B (1.1) și C din anexa III.
|
|
The returns covered by Tables B (1.2) and B (2) of that Annex shall be sent only once every five years. In the case of Table B (1.2) returns shall be sent for the first time for the year 1980 and, in the case of Table B (2), returns shall be suspended until work on the system of charging for the use of infrastructure make them necessary."
|
Încasările cuprinse în tabelele B (1.2) și B (2) din anexă vor fi trimise doar o dată la cinci ani. În cazul tabelului B (1.2) situația încasărilor va fi trimisă prima dată pentru anul 1980, iar în cazul tabelului B (2) raportarea încasărilor va fi suspendată până când realizarea sistemului de tarifare privind utilizarea infrastructurii o va face necesară."

5. Annexes I, II and III are amended in accordance with the Annex.
|

Articolul 2
|
|
|
În termen util și după consultarea Comisiei, statele membre vor adopta actele cu putere de lege și actele administrative necesare punerii în aplicare a prezentului regulament.
|
|
|
În cazul în care un stat membru solicită acest lucru sau în cazul în care Comisia consideră necesar, Comisia va consulta statele membre respective în legătură cu termenele limită pentru măsurile vizate la alineatul precedent.
|
|
Article 2
|
Prezentul regulament este obligatoriu în toate elementele sale și se aplică direct în toate statele membre.
|
|
Member States shall, in good time and after consulting the Commission, adopt such laws, regulations or administrative provisions as may be necessary for the implementation of this Regulation.
|
|
|
Where a Member State so requests, or where the Commission considers it appropriate, the Commission shall consult with the Member States concerned upon the proposed terms of the measures referred to in the preceding paragraph.
