THE EUROPEAN COMMISSION,

COMISIA EUROPEANĂ,

Having regard to the Treaty on the Functioning of the European Union,

având în vedere Tratatul privind funcționarea Uniunii Europene,

Having regard to Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff [1], and in particular Article 9(1)(a) thereof,

având în vedere Regulamentul (CEE) nr. 2658/87 al Consiliului din 23 iulie 1987 privind Nomenclatura tarifară și statistică și Tariful vamal comun [1], în special articolul 9 alineatul (1) litera (a),

Whereas:

întrucât:

(1) In order to ensure uniform application of the Combined Nomenclature annexed to Regulation (EEC) No 2658/87, it is necessary to adopt measures concerning the classification of the goods referred to in the Annex to this Regulation.

(1) Pentru a asigura aplicarea uniformă a Nomenclaturii combinate anexate la Regulamentul (CEE) nr. 2658/87, este necesar să se adopte măsuri privind clasificarea mărfurilor menționate în anexa la prezentul regulament.

(2) Regulation (EEC) No 2658/87 has laid down the general rules for the interpretation of the Combined Nomenclature. Those rules apply also to any other nomenclature which is wholly or partly based on it or which adds any additional subdivision to it and which is established by specific provisions of the Union, with a view to the application of tariff and other measures relating to trade in goods.

(2) Regulamentul (CEE) nr. 2658/87 stabilește regulile generale pentru interpretarea Nomenclaturii combinate. Aceste reguli se aplică, de asemenea, oricăror alte nomenclaturi bazate integral sau parțial pe aceasta sau care îi adaugă subdiviziuni suplimentare și care sunt stabilite prin dispoziții specifice ale Uniunii Europene, în vederea aplicării de măsuri tarifare sau de altă natură privind comerțul cu mărfuri.

(3) Pursuant to those general rules, the goods described in column (1) of the table set out in the Annex should be classified under the CN code indicated in column (2), by virtue of the reasons set out in column (3) of that table.

(3) În temeiul acestor reguli generale, mărfurile descrise în coloana 1 a tabelului din anexă trebuie clasificate la codurile NC indicate în coloana 2, pe baza motivelor care figurează în coloana 3 a tabelului.

(4) It is appropriate to provide that binding tariff information which has been issued by the customs authorities of Member States in respect of the classification of goods in the Combined Nomenclature but which is not in accordance with this Regulation can, for a period of three months, continue to be invoked by the holder, under Article 12(6) of Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code [2].

(4) Este necesar să se prevadă posibilitatea invocării în continuare de către titular, în temeiul articolului 12 alineatul (6) din Regulamentul (CEE) nr. 2913/92 al Consiliului din 12 octombrie 1992 de instituire a Codului vamal comunitar, pentru o perioadă de trei luni, a informațiilor tarifare obligatorii care au fost furnizate de autoritățile vamale ale statelor membre în ceea ce privește clasificarea mărfurilor în Nomenclatura combinată, dar care nu sunt conforme cu dispozițiile prezentului regulament [2].

HAS ADOPTED THIS REGULATION:

Article 1

The goods described in column (1) of the table set out in the Annex shall be classified within the Combined Nomenclature under the CN code indicated in column (2) of that table.

Mărfurile descrise în coloana 1 a tabelului din anexă se clasifică în Nomenclatura combinată la codurile NC indicate în coloana 2 a tabelului.

Binding tariff information issued by the customs authorities of Member States, which is not in accordance with this Regulation, can continue to be invoked for a period of three months under Article 12(6) of Regulation (EEC) No 2913/92.

Informațiile tarifare obligatorii furnizate de autoritățile vamale ale statelor membre care nu sunt conforme cu dispozițiile prezentului regulament pot fi invocate în continuare pentru o perioadă de trei luni, în temeiul articolului 12 alineatul (6) din Regulamentul (CEE) nr. 2913/92.

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

Prezentul regulament intră în vigoare în a douăzecea zi de la data publicării în Jurnalul Oficial al Uniunii Europene.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Prezentul regulament este obligatoriu în toate elementele sale și se aplică direct în toate statele membre.

An article with overall dimensions of 197 × 90 × 2 cm consisting of 16 slats of solid wood held together by two bands of textile fixed to the wood by means of metal staples. The slats are not curved, and they are of non-flexible massive pine. The article is intended to be used together with a bed frame to support a mattress. | 94041000 | Classification is determined by General Rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 3(B) to Chapter 94 and by the wording of CN codes 9404 and 94041000. Although the slats are neither curved nor flexible, the article as a whole meets the terms of heading 9404 as it is designed to support a mattress in a bed. Classification under CN code 94039030 as part of a bed is excluded, as mattress supports, presented separately, are not to be classified as parts of goods by virtue of Note 3(B) to Chapter 94. The article is therefore to be classified under CN code 94041000 as a mattress support. |
