THE EUROPEAN COMMISSION,

COMISIA EUROPEANĂ,

Having regard to the Treaty on the Functioning of the European Union,

având în vedere Tratatul privind funcționarea Uniunii Europene,

Having regard to Council Regulation (EC) No 1186/2009 of 16 November 2009 setting up a Community system of reliefs from customs duty [1], and in particular Article 76 thereof,

având în vedere Regulamentul (CE) nr. 1186/2009 al Consiliului din 16 noiembrie 2009 de instituire a unui regim comunitar de scutiri de taxe vamale [1], în special articolul 76,

Having regard to the request made by the Government of the Italian Republic dated 17 April 2009 and 4 January 2010 seeking duty-free importation of goods to be distributed or made available free of charge to victims of the earthquake which occurred in April 2009 in the Italian Republic,

Având în vedere cererile înaintate de Guvernul Republicii Italiene în 17 aprilie 2009 și 4 ianuarie 2010 privind importul în regim de scutire de taxe vamale al mărfurilor care urmează să fie distribuite sau puse gratuit la dispoziția victimelor cutremurului care a avut loc în aprilie 2009 în Republica Italiană,

Whereas:

întrucât:

(1) An earthquake is a disaster within the meaning of Chapter XVII C of Regulation (EC) No 1186/2009; there is therefore reason to authorise the duty-free importation of goods which satisfy the requirements of Articles 74 to 80 of that Regulation.

(1) Cutremurul este o catastrofă, în sensul capitolului XVII litera C din Regulamentul (CE) nr. 1186/2009; sunt întrunite, prin urmare, condițiile pentru autorizarea importului în regim de scutire de taxe vamale al mărfurilor care satisfac cerințele articolelor 74-80 din respectivul regulament.

(2) So that the Commission may be suitably informed of the use made of the goods admitted duty-free, the Government of the Italian Republic must communicate the measures taken to prevent those goods from being employed otherwise than for the use laid down.

(2) În vederea informării corespunzătoare a Comisiei cu privire la utilizarea mărfurilor admise cu scutire de plata taxelor la import, Guvernul Republicii Italiene trebuie să comunice măsurile luate pentru a preveni utilizarea mărfurilor respective în alte scopuri decât cele stabilite.

(3) The Commission should also be informed of the extent and the nature of importation.

(3) Comisia trebuie de asemenea informată referitor la amploarea și natura importurilor.

(4) Other Member States have been consulted in accordance with Article 76 of Regulation (EC) No 1186/2009,

HAS ADOPTED THIS DECISION:

ADOPTĂ PREZENTA DECIZIE:

Article 1

Articolul 1

1. Goods imported for free circulation by State bodies or by organisations approved by the competent Italian authorities to be distributed by them free of charge to the victims of the earthquake which occurred in April 2009 in the Italian Republic, or made available to them free of charge while remaining the property of the organisations in question, shall be admitted free of import duties within the meaning of Article 2(1)(a) of Regulation (EC) No 1186/2009.

(1) Mărfurile importate pentru a fi puse în liberă circulație – de către organisme de stat sau organizații agreate de autoritățile competente italiene și pe care acestea urmează a le distribui sau pune gratuit la dispoziția victimelor cutremurului care a avut loc în aprilie 2009 în Republica Italiană, ele rămânând în proprietatea organizațiilor respective – sunt admise cu scutire de taxe la import, în sensul articolului 2 alineatul (1) litera (a) din Regulamentul (CE) nr. 1186/2009.

2. Goods imported for free circulation by relief agencies to meet their needs during the period of their activity shall also be admitted duty-free.

(2) Mărfurile importate pentru a fi puse în liberă circulație, de către organizații de ajutor umanitar pentru a-și satisface necesitățile pe perioada cât își desfășoară activitatea, sunt de asemenea admise cu scutire de taxe la import.

Article 2

Articolul 2

The Government of the Italian Republic shall communicate to the Commission at the latest on 30 June 2010 the list of approved organisations referred to in Article 1(1).

Până cel târziu la 30 iunie 2010, Guvernul Republicii Italiene comunică Comisiei lista organizațiilor agreate menționate la articolul 1 alineatul (1).

Article 3

Articolul 3

The Government of the Italian Republic shall fully inform the Commission, at the latest on 30 June 2010, of the nature and quantities of the various goods admitted free of duty pursuant to Article 1, by broad category of products.

Până cel târziu la 30 iunie 2010, Guvernul Republicii Italiene furnizează Comisiei informații complete cu privire la natura și cantitățile diferitelor mărfuri admise cu scutire la taxa de import în temeiul articolului 1, pe categorii mari de produse.

Article 4

Articolul 4

The Government of the Italian Republic shall inform the Commission at the latest on 30 June 2010 of the measures which it is taking to ensure that Articles 78, 79 and 80 of Regulation (EC) No 1186/2009 are complied with.

Până cel târziu la 30 iunie 2010, Guvernul Republicii Italiene furnizează Comisiei informații cu privire la măsurile pe care le ia pentru a garanta respectarea prevederilor articolelor 78, 79 și 80 din Regulamentul (CE) nr. 1186/2009.

Article 5

Articolul 5

Article 1 of this Decision shall apply to importations made on or after 6 April 2009 and not later than 31 May 2010.

Articolul 1 din prezenta decizie se aplică importurilor efectuate începând cu 6 aprilie 2009 inclusiv, până cel târziu la 31 mai 2010.

This Decision is addressed to the Italian Republic.

Prezenta decizie se adresează Republicii Italiene.
