THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

având în vedere Tratatul de instituire a Comunității Europene,

Having regard to Directive 2007/46/EC of the European Parliament and of the Council of 5 September 2007 establishing a framework for the approval of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles [1], and in particular Article 39(2) thereof,

având în vedere Directiva 2007/46/CE a Parlamentului European și a Consiliului din 5 septembrie 2007 de stabilire a unui cadru pentru omologarea autovehiculelor și remorcilor acestora, precum și a sistemelor, componentelor și unităților tehnice separate destinate vehiculelor respective [1], în special articolul 39 alineatul (2),

Whereas:

întrucât:

(1) Council Directive 76/756/EEC of 27 July 1976 on the approximation of the laws of the Member States relating to the installation of lighting and light-signalling devices on motor vehicles and their trailers [2] is one of the separate Directives in the context of the EC type approval procedure established under Council Directive 70/156/EEC of 6 February 1970 on the approximation of the laws of the Member States relating to the type approval of motor vehicles and their trailers [3]. The provisions of Directive 70/156/EEC relating to systems, components and separate technical units for vehicles therefore apply to Directive 76/756/EEC.

(1) Directiva 76/756/CEE a Consiliului din 27 iulie 1976 privind apropierea legislațiilor statelor membre referitoare la instalarea dispozitivelor de iluminat și de semnalizare luminoasă ale autovehiculelor și ale remorcilor acestora [2] este una dintre directivele speciale în contextul procedurii de omologare de tip prevăzută de Directiva 70/156/CEE a Consiliului din 6 februarie 1970 privind apropierea legislațiilor statelor membre referitoare la omologarea de tip a autovehiculelor și a remorcilor acestora [3]. Prin urmare, dispozițiile Directivei 70/156/CEE cu privire la sisteme, componente și unități tehnice separate pentru vehicule se aplică Directivei 76/756/CEE.

(2) In order to increase road safety by improving the conspicuity of motor vehicles the obligation for fitting dedicated daytime running lights on these vehicles should be introduced into Directive 76/756/EEC.

(2) În vederea îmbunătățirii siguranței rutiere prin sporirea vizibilității autovehiculelor, este necesară introducerea în Directiva 76/756/CEE a obligației de echipare a vehiculelor respective cu lumini de întâlnire destinate circulației pe timp de zi.

(3) New technologies like the Adaptive Front Lighting System (AFS) and the Emergency Stop Signal (ESS) are expected to have a positive influence on road safety. Directive 76/756/EEC should therefore be amended in order to allow the fitting of these devices.

(3) Se estimează că noile tehnologii, precum sistemul de iluminare frontală adaptivă (AFS) și semnalul de oprire de urgență (ESS) vor avea un impact pozitiv asupra siguranței rutiere. Prin urmare, Directiva 76/756/CEE ar trebui modificată pentru a permite echiparea cu aceste dispozitive.

(4) In order to take into account further amendments to UN/ECE Regulation No 48 [4] on which the Community has already voted, it is appropriate to adapt Directive 76/756/EEC to technical progress by aligning it to the technical requirements of this UN/ECE Regulation. In the interest of clarity Annex II to Directive 76/756/EEC should be amended.

(4) În vederea luării în considerare a modificărilor ulterioare aduse Regulamentului nr. 48 al Comisiei Economice pentru Europa a Organizației Națiunilor Unite [4] pentru care Comunitatea s-a pronunțat deja, se recomandă adaptarea Directivei 76/756/CEE la progresul tehnic prin alinierea acesteia la cerințele tehnice ale Regulamentului menționat al Comisiei Economice pentru Europa a Organizației Națiunilor Unite. Din motive de claritate, anexa II la Directiva 76/756/CEE ar trebui modificată.

(5) Directive 76/756/EEC should therefore be amended accordingly.

HAS ADOPTED THIS DIRECTIVE:

Article 1

Annex II, paragraph 1 to Directive 76/756/EEC is amended as follows:

Punctul 1 din anexa II la Directiva 76/756/CEE se modifică după cum urmează:

"1. The technical requirements shall be those set out in paragraphs 2, 5 and 6 of UN/ECE Regulation No 48 [*****] and Annexes 3 to 11 thereto.

"1. Cerințele tehnice sunt cele precizate la alineatele (2), (5) și (6) și în anexele 3-11 din Regulamentul nr. 48 al Comisiei Economice pentru Europa a Organizației Națiunilor Unite [*****].

With effect from 7 February 2011 for vehicles of categories M1 and N1 and from 7 August 2012 for vehicles of other categories, if the requirements laid down in Directive 76/756/EEC, as amended by this Directive, are not complied with, Member States, on grounds related to the installation of lighting and light-signalling devices, shall refuse to grant EC type approval or national type approval for new types of vehicles.

Începând cu 7 februarie 2011, în cazul vehiculelor din categoriile M1 și N1, respectiv cu 7 august 2012, în cazul vehiculelor din alte categorii, în situația în care cerințele prevăzute în Directiva 76/756/CEE, astfel cum a fost modificată prin prezenta directivă, nu sunt îndeplinite, statele membre refuză omologarea de tip CE sau omologarea de tip național pentru noile tipuri de vehicule, pe baza motivelor referitoare la instalarea dispozitivelor de iluminat și de semnalizare luminoasă.

1. Member States shall adopt and publish, by 15 October 2009, at the latest, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

(1) Statele membre adoptă și publică actele cu putere de lege și actele administrative necesare pentru respectarea prezentei directive până la 15 octombrie 2009, cel târziu. Statele membre comunică de îndată Comisiei textul dispozițiilor respective și un tabel de corespondență între dispozițiile respective și prezenta directivă.

They shall apply those provisions from 16 October 2009.

Statele membre aplică dispozițiile respective începând cu 16 octombrie 2009.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Atunci când statele membre adoptă aceste dispoziții, ele conțin o trimitere la prezenta directivă sau sunt însoțite de o asemenea trimitere la data publicării lor oficiale. Statele membre stabilesc modalitatea de efectuare a acestei trimiteri.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

(2) Statele membre transmit Comisiei textul principalelor dispoziții de drept intern pe care le adoptă în domeniul reglementat de prezenta directivă.

Article 4

This Directive shall enter into force on the 20th day following that of its publication in the Official Journal of the European Union.

Prezenta directivă intră în vigoare în a douăzecea zi de la data publicării în Jurnalul Oficial al Uniunii Europene.

This Directive is addressed to the Member States.

Prezenta directivă se adresează statelor membre.
