THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Tendo em conta o Tratado que institui a Comunidade Europeia,

Having regard to Council Regulation (EEC) No 792/93 of 30 March 1993 establishing a cohesion financial instrument (1), and in particular Article 8 (6) thereof,

Whereas Article 1 of Regulation (EEC) No 792/93 establishes a cohesion financial instrument to provide Community support for projects in the fields of the environment and trans-European transport infrastructure networks;

Considerando que o artigo 1º do Regulamento (CEE) nº 792/93 institui um instrumento financeiro de coesão através do qual a Comunidade efectuará contribuições financeiras para projectos nos domínios do ambiente e das redes transeuropeias de transportes;

Whereas pursuant to Article 9 of Regulation (EEC) No 792/93 certain provisions of Titles VI and VII of Council Regulation (EEC) No 4253/88 of 19 December 1988 concerning the provisions for implementing Regulation (EEC) No 2052/88 as regards coordination of the activities of the different Structural Funds between themselves and with the operations of the European Investment Bank and the other existing financial instruments (2), as amended by Regulation (EEC) No 2082/93 (3), are to apply, mutatis mutandis;

Considerando que, nos termos do nº 3 do artigo 9º do Regulamento (CEE) nº 792/93, determinadas disposições dos títulos VI e VII do Regulamento (CEE) nº 4253/88 do Conselho, de 19 de Dezembro de 1988, que estabelece as disposições de aplicação do Regulamento (CEE) nº 2052/88 no que respeita à coordenação entre as intervenções dos diferentes fundos estruturais, por um lado, e entre estas e as do Banco Europeu de Investimento e dos outros instrumentos financeiros existentes, por outro (2), alterado pelo Regulamento (CEE) nº 2082/93 (3), são aplicáveis, com as necessárias adaptações;

Whereas Article 2 of Regulation (EEC) No 792/93 defines the types of measure for which the cohesion financial instrument may provide assistance;

Considerando que o Regulamento (CEE) nº 792/93 define, no seu artigo 2º, o tipo de acções cuja realização pode ser apoiada pelo instrumento financeiro de coesão;

Whereas Article 10 of Regulation (EEC) No 792/93 requires the Member States to ensure that adequate publicity is given to the operations of the financial instrument and that the measures which are described in Annex V to this Decision are undertaken;

Considerando que o artigo 10º do Regulamento (CEE) nº 792/93 prevê que os Estados-membros garantam que seja dada a devida publicidade às intervenções do instrumento financeiro; que as medidas adequadas constam do anexo V;

Whereas references to 'project' shall be understood to mean also 'stage of project';

Considerando que por «projecto» deve igualmente entender-se «fase de projecto»;

Whereas on 2 July 1993 Greece submitted an application for assistance from the cohesion financial instrument for the project: Construction of a twin-track railway line over the section Evangelismos-Leptokarya;

Considerando que a Grécia apresentou, em 2 de Julho de 1993, um pedido de contribuição do instrumento financeiro de coesão para o projecto de construção de uma linha de caminho-de-ferro de via dupla - troço Evangelismos-Leptokarya;

Whereas that application concerns a project which is eligible under the terms of Article 2 of Regulation (EEC) No 792/93;

Considerando que o pedido de contribuição diz respeito a um projecto elegível em conformidade com os critérios enunciados no artigo 2º do Regulamento (CEE) nº 792/93;

Whereas the application for assistance contains all the information required by Article 8 (4) of the Regulation and satisfies the criteria set out in Article 8 (3) and (5) of the Regulation;

Considerando que o pedido de contribuição inclui todas as informações previstas no nº 4 do artigo 8º e satisfaz os critérios fixados nos nºs 3 e 5 do artigo 8º do Regulamento (CEE) nº 792/93;

Whereas the project is a transport infrastructure project of common interest;

Considerando que o projecto constitui um projecto de infra-estruturas de transportes de interesse comum;

Whereas the project forms part of the master plan for a trans-European standard railway network;

Considerando que o projecto se integra no programa director da rede transeuropeia de caminhos-de-ferro convencionais;

Whereas the project is a transport infrastructure project of common interest which will also help to achieve the objectives of Article 130r of the Treaty concerning the environment;

Considerando que o projecto contribui para a realização dos objectivos do artigo 130ºR do Tratado, relativo ao ambiente;

Whereas, pursuant to Article 9 (1) of Regulation (EEC) No 792/93, technically and financially discrete stages of the project have been identified for the purpose of granting assistance from the financial instrument;

Considerando que, em conformidade com o disposto no nº 1 do artigo 9º do Regulamento (CEE) nº 792/93, foram definidas, em termos técnicos e financeiros, as diversas fases do projecto para efeitos de concessão de um apoio pelo instrumento financeiro de coesão;

Whereas Article 1 of the Financial Regulation of 21 December 1977 applicable to the general budget of the European Communities (4), as last amended by Council Regulation (Euratom, ECSC, EEC) No 610/90 (5), states that the legal commitments entered into for measures extending over more than one financial year shall contain a time limit for implementation which must be specified to the recipient in due form when the aid is granted;

Considerando que o Regulamento Financeiro, de 21 de Dezembro de 1977, aplicável ao orçamento geral das Comunidades Europeias (4), com a última redacção que lhe foi dada pelo Regulamento (Euratom, CECA, CEE) nº 610/90 do Conselho (5), prevê, no seu artigo 1º, que as obrigações jurídicas contraídas para acções cuja realização se estenda por mais de um exercício incluam uma data limite de execução que deve ser precisada relativamente ao Estado-membro, na forma adequada, aquando da concessão da ajuda;

Whereas pursuant to Article 9 or Regulation EEC No 792/93, the Commission and the Member State will ensure that there is evaluation and systematic monitoring of the project;

Considerando que a Comissão e o Estado-membro assegurarão, em conformidade com o disposto no artigo 9º do Regulamento (CEE) nº 702/93, a avaliação e o acompanhamento sistemático do projecto;

Whereas the financial implementation provisions, monitoring and assessment are specified in Annexes III and IV to this Decision; whereas failure to comply with those provisions may result in suspension or reduction of the assistance granted pursuant to

Considerando que dos anexos III e IV da presente decisão constam as normas de execução financeiras, de acompanhamento e de avaliação, cuja inobservância pode ocasionar a suspensão ou redução da contribuição, nos termos do nº 3 do artigo 9º do Regulamento (CEE) nº 792/93 e de acordo com o disposto no anexo VI;

Article 9

Considerando que todas as demais condições exigidas se encontram satisfeitas,

ADOPTOU A PRESENTE DECISÃO:

Whereas all the other conditions laid down, have been complied with,

HAS ADOPTED THIS DECISION:

Artigo 1º

1. É aprovado, para o período de 1 de Janeiro de 1993 a 31 de Março de 1994, o projecto de construção de uma linha de caminho-de-ferro de via dupla - troço Evangelismos-Leptokarya, na Grécia, descrito no anexo I.

Article 1

2. Para efeitos da aplicação da presente decisão, por «projecto» entende-se igualmente «fase de projecto».

1. The stage of project: Construction of a twin-track railway line over the section Evangelismos-Leptokarya situated in Greece as described in Annex I hereto is hereby approved for the period from 1 January 1993 to March 1994.

2. References to 'project' in the present Decision and Annexes shall be understood to mean also 'stage of project'.

Artigo 2º

1. A despesa máxima elegível a título da presente decisão é de 11 400 000 ecus.

Article 2

2. A taxa do apoio comunitário concedido ao projecto é fixada em 85 %.

1. The maximum eligible expenditure to be taken as the basis for this Decision shall be ECU 11 400 000.

3. O montante máximo da contribuição do instrumento financeiro de coesão é de 9 690 000 ecus.

2. The rate of Community assistance granted to the project shall be fixed at 85 %.

3. The maximum amount of the contribution from the cohesion financial instrument shall be fixed at ECU 9 690 000.

Artigo 3º

1. A contribuição comunitária basear-se-á no plano financeiro estabelecido para o projecto, conforme previsto no anexo II.

Article 3

2. As autorizações e os pagamentos do apoio comunitário concedido ao projecto processar-se-ao em conformidade com o disposto no artigo 9º do Regulamento (CEE) nº 792/93, conforme previsto no anexo III.

1. Community assistance shall be based on the financial plan for the project set out in Annex II.

3. O montante do primeiro adiantamento é de 3 286 666 ecus.

2. Commitments and payments of Community assistance granted to the project shall be made in accordance with Article 9 of Regulation (EEC) No 792/93 and as specified in Annex III.

3. The amount of the first advance payment shall be fixed at ECU 3 286 666.

Artigo 4º

1. O apoio comunitário incidirá nas despesas relativas ao projecto relativamente às quais tenham sido adoptadas normas vinculativas na Grécia e a cujos trabalhos, a realizar o mais tardar até 31 de Março de 1994, tenham sido especificamente afectados os recursos financeiros necessários.

Article 4

2. As despesas realizadas antes de 1 de Janeiro de 1993 não são consideradas elegíveis para a contribuição do instrumento financeiro de coesão.

1. Community assistance shall cover expenditure on the project for which legally binding arrangements have been made in Greece and for which the requisite finance has been specifically allocated to works to be completed not later than 31 March 1994.

3. As despesas relativas ao projecto devem ser realizadas, o mais tardar, doze meses após a data referida no nº 1.

2. Expenditure incurred before 1 January 1993 shall not be eligible for assistance.

3. The closing date for the completion of national payments on the project is fixed not later than 12 months after the date mentioned in subparagraph 1.

Artigo 5º

1. O projecto deve ser executado em conformidade com as políticas comunitárias, nomeadamente com os artigos 7º, 30º, 52º e 59º do Tratado, e com a legislação comunitária, nomeadamente as directivas comunitárias relativas à coordenação dos processos de adjudicação de contratos de obras.

2. A presente decisão não prejudica o direito de a Comissão iniciar processos de infracção ao abrigo do artigo 169º do Tratado.

1. The project shall be carried out in accordance with Community policies, and in particular with Articles 7, 30, 52 and 59 of the Treaty, as well as with Community law, in particular with the Directives coordinating public procurement procedures.

2. This Decision shall not prejudice the right of the Commission to commence infringement proceedings pursuant to Article 169 of the Treaty.

Artigo 6º

Serão assegurados o acompanhamento e a avaliação sistemática do projecto, de acordo com o disposto no anexo IV.

Systematic monitoring and assessment of the project take place in accordance with the provisions set out in Annex IV hereto.

Artigo 7º

O Estado-membro em causa certificar-se-á de que ao projecto será dada a devida publicidade, em conformidade com o disposto no anexo V.

Article 7

The Member State concerned shall ensure adequate publicity for the project as specified in Annex V.

Artigo 8º

Os anexos constituem parte integrante da presente decisão.

Each Annex to this Decision shall form an integral part of it.

Artigo 9º

A não observância do disposto na presente decisão e nos seus anexos pode ocasionar a redução ou a suspensão do apoio, em conformidade com o anexo VI.

Article 9

Failure to comply with the provisions of this Decision or its Annexes may entail a reduction or suspension of assistance in accordance with the provisions set out in Annex VI.

Artigo 10º

A República Helénica é a destinatária da presente decisão.

The stage of project in question involves the implementation of a proportion of the following works:

6. Objectives

O projecto faz parte de um vasto programa de modernização da linha de caminho-de-ferro Atenas-Salónica, do qual alguns troços foram já construídos ou estão em vias de construção. A realização do programa permitirá aumentar a velocidade na linha para 200 km/h e reduzir em duas a três horas (consoante o tipo de comboio) a duração da viagem entre Atenas e Salónica. O projecto prevê também a instalação de uma sinalização automática, a electrificação da linha e a instalação de infra-instruturas de telecomunicações. Com a modernização da linha, o número de utentes, que era de 4 500 por dia no início do programa, deverá passar para 18 000 a longo prazo.

The project forms an integral part of a large programme of modernization of the Athens-Thessaloniki railway line, certain sections of which have already been built or are under construction. The programme will make it possible to achieve speeds of 200 km/h and reduce by 2 to 3 hours (according to the type of train) the journey time between Athens and Thessaloniki. The project also provides for the installation of automatic signalling, electrification of the line and provision of telecommunications infrastructure. With the modernization of the line, the number of users, which stood at 4 500 per day at the beginning of the programme, should increase to 18 000 in the long therm.

A análise da estatísticas sobre o tráfego e a estimativa das incidências do projecto mostram que a relação custos-benefícios é superior a 1 e que o projecto será, por consequência, viável (a incidência socioeconómica do projecto - economias de energia, diminuição das despesas em divisas estrangeiras, etc. - foi também tomada em consideração nos cálculos).

An analysis of traffic statistics and an estimate of the effects of the project show that the cost/benefit ratio will exeed 1 and that the project will therefore be viable (the socio-economic effects of the project - time and energy savings, reduced foreign exchange expenditure - were also taken into account in the calculations).

A TIR (taxa interna de rendibilidade) é estimada em 7,5 % para o período de 1993-2023, e o VAL (valor actual líquido) em - 2,5 mil milhões de dracmas gregas.

The IRR (internal rate of return) is estimated at 7,5 % for the period 1993 to 2033 and the NPV (net present value) at Dr 2,5 billion.

O projecto não afectará de forma sensível o ambiente.

The project has no major adverse effects on the environment.

As condições fixadas em matéria de ambiente no Diploma Ministerial nº 91336, de 19 de Novembro de 1993, estão incluídas nos objectivos do projecto. Os trabalhos limitam-se ao troço Evangelismos-Rapsani.

The project's objectives as set out meet the environmental conditions laid down in Ministerial Decision No 91336 of 19 November 1993. The works will be restricted to the section Evangelismos-Rapsani.

2. Community assistance shall be expressed as a percentage of eligible expenditure. If the actual expenditure incurred differs from the expenditure initially planned, the Community assistance granted shall be varied to take account of this but may not exceed the maximum amount stated in the Decision. A change of the rate of Community assistance or of the maximum amount of the grant will require a modification of decision according to the procedures described in point 12.

2. A contribuição comunitária é fixada em percentagem das despesas elegíveis. Se as despesas elegíveis efectivamente realizadas diferirem das despesas inicialmente previstas, a contribuição comunitária concedida variará em conformidade, sem que possa, todavia, ser superior ao montante máximo indicado na decisão. A modificação da taxa de contribuição comunitária ou dos montantes máximos da contribuição comunitária concedida exige uma modificação da decisão de acordo com o processo previsto no ponto 12.

3. The Member State shall undertake to ensure that, for the project to which this Decision relates, all public or private bodies involved in the management and implementation of these operations maintain either a separate accounting system or an adequate accounting codification of all transactions concerned which will facilitate the verification of expenditure by the Community and national control authorities.

4. Budgetary commitments and payments shall be made in accordance with Article 9 (4), (5) and (6) of Regulation (EEC) No 792/93.

O Estado-membro compromete-se a assegurar que, relativamente ao projecto objecto da presente decisão, todas as instâncias públicas ou privadas envolvidas na gestão e execução desse projecto manterão um sistema contabilístico separado ou uma codificação contabilística adequada de todas as transacções conexas, o que facilitará a verificação das despesas pelas autoridades de controlo nacionais e comunitárias.

5. All payments of aid granted by the Commission under this Decision shall be made to the authority designated by the Member State, which shall also be responsible for refunding any overpaid amounts to the Commission. Payments shall be made to a single bank account designated by the Member State. As a general rule, the Commission shall make payments no later than two months after receipt of a valid application.

4. As autorizações orçamentais e os pagamentos serão efectuados em conformidade com o disposto nos nºs 4, 5 e 6 do artigo 9º do Regulamento (CEE) nº 792/93.

6. The Member State shall ensure that applications for payment and statements of expenditure actually incurred comply with the financing plan, including the schedule of expenditure, annexed to this Decision, as amended where appropriate, following the procedures laid down in points 12 and 13.

5. Todos os pagamentos do apoio concedido pela Comissão ao abrigo da presente decisão serão efectuados à autoridade designada pelo Estado-membro, a qual será igualmente responsável pelo reembolso à Comissão de quaisquer montantes pagos em excesso. Os pagamentos serão depositados numa única conta bancária, a indicar pelo Estado-membro. Os pagamentos são efectuados pela Comissão, em regra geral, o mais tardar dois meses após recepção de um pedido válido.

7. In accordance with Article 22 of Council Regulation (EEC) No 4253/88, all commitments and payments shall be in ecus.

O Estado-membro velará por que os pedidos de pagamento e as declarações de despesas efectivamente realizadas sejam apresentados, tanto quanto possível, de acordo com o plano de financiamento, que inclui o calendário previsional das despesas, anexo à presente decisão, ou eventualmente alterado de acordo com os processos previstos nos pontos 12 e 13.

8. Statements of expenditure in support of applications for payment shall be denominated in ecus or in national currency.

9. Member States which submit statements of expenditure in ecus shall convert the amounts of expenditure incurred in national currency into ecus using the rate for the month during which the expenditure was booked in the accounts of the authorities responsible for the financial management of projects. Each month the Commission shall inform the Member States of the rate to be used for that purpose.

10. As declarações de despesas em moeda nacional serão convertidas em ecus com recurso à taxa em vigor no mês da sua recepção pela Comissão.

11. Any sum wrongly paid shall be repaid to the Commission by the authority designated in point 5. Interest on account of late payments shall be charged on sums not repaid in accordance with Article 24 (3) of Council Regulation (EEC) No 4253/88. If the authority designated under point 5 does not repay the amount due to the Community, the Member State shall refund this amount to the Commission.

12. Any amendments to the Decision shall be made in accordance with the following procedures:

13. Considera-se alteração não substancial do plano de financiamento e do calendário previsional das despesas qualquer alteração que implique uma variação das despesas anuais previstas inferior a 10 % das despesas totais previstas para o projecto.

14. The time limits for complying with the legal obligations contracted under this Decision shall be complied with and payments made in accordance with Article 4 of the Decision. These may be amended before they expire in accordance with the procedure in point 12 (b) provided that the extension does not exceed one year. For that purpose, the Member State shall send the Commission a proposal for amendment together with information justifying the amendment. Where the extension exceeds one year, the procedure in point 12 (a) shall apply.

Para o efeito, o Estado-membro transmitirá à Comissão uma proposta de alteração acompanhada de informações que justifiquem tal alteração. Sempre que a prorrogação exceda um ano, é aplicável o processo previsto na alínea a) do ponto 12.

15. Na ausência de prorrogação do prazo, não serão tidas em consideração, para fins de contribuição do instrumento financeiro, as despesas efectuadas depois das datas indicadas no artigo 4º

FINANCING PLAN

ACOMPANHAMENTO E AVALIAÇÃO 1. A instância nacional responsável pela execução ficará encarregada do acompanhamento e da avaliação dos projectos. A fim de desempenhar esta missão, o Estado-membro pode solicitar à Comissão uma contribuição comunitária a título de medidas de apoio técnico.

A sua missão consiste em, regularmente, verificar o adiantamento da sua execução e propor, se for caso disso, as adaptações necessárias.

In general, the documents required for meetings of the Committee shall be available three weeks in advance.

Após esta análise, a Comissão pode suspender o pagamento do financiamento comunitário. Neste caso, a Comissão notifica a autoridade responsável pela execução do projecto no Estado-membro. Da carta de notificação constarão igualmente as medidas a tomar em relação à parte do financiamento comunitário já paga para o projecto.

Reports

3. No que se refere aos projectos relativamente aos quais já tenham sido tomadas as medidas supramencionadas, os pagamentos em curso, bem como os remanescentes, serão considerados total ou parcialmente suspensos, até que a Comissão tenha garantias de que foram tomadas todas as medidas necessárias para remediar a situação.

6. In accordance with Article 25 (4) of Regulation (EEC) No 4253/88, annual reports for each complete year of implementation and a final report shall be drawn up for the project which is the subject of this Decision.

4. Se o exame relevar que as disposições da decisão e das políticas comunitárias não foram respeitadas e que as medidas necessárias para remediar a situação não foram tomadas, o apoio será reduzido ou cancelado. Quanto à recuperação dos montantes indevidamente pagos, ver ponto 11 do anexo III.

The first annual report on this project shall be submitted to the Commission by the authority responsible no later than 15 months after adoption of the Decision approving the project. The report shall contain the following information:

- progress of the project,

- details of any divergence from the implementation plan originally laid down,

- an outline of the main problems encountered and the measures taken to solve them.

On the basis of the information in the annual reports, the Commission and the Member State may, where necessary, revise the financing plan for the project and make adjustments to it.

The final report, to be submitted six months after physical completion of the project, shall report on the work carried out and its conformity with the Decision approving the project and give an initial appraisal of the chances of achieving the results sought.

Payment of the balance of Community assistance shall be subject to approval of the final report.

Checks

7. Checks may be carried out in accordance with Article 23 (2) of Regulation (EEC) No 4253/88 by both the Member State and the Commission. The Member State and the Commission shall immediately exchange any relevant information concerning the results.

8. For a period of three years following the last payment in respect of the project, the authority responsible for implementation shall keep available for the Commission all the supporting documents regarding expenditure.

9. The Member State shall keep available for the Commission all appropriate national reports concerning the checks carried out.

B. Assessment

10. An assessment of the project may be carried out during its implementation at the request of the Member State or on the initiative of the Commission in order to assess whether the project is progressing in accordance with the objectives originally laid down and to propose adjustments to take account of problems encountered during implementation. The Monitoring Committee shall take into account this evaluation.

11. An ex-post assessment of the impact of the project may be carried out by an assessor appointed by joint agreement between the Member State and the Commission once the project has been completed.

(f) decide by agreement between the Commission and the Member State any additional responsibilities of the Committee.

ANNEX V

INFORMATION AND PUBLICITY The Member State concerned should ensure that the general public are aware of the role played by the Community in financing the project. The following measures, inter alia, should be undertaken with this end in view:

- panels of an appropriate size, to be agreed between the Member State and the Commission, shall mark the project. These panels should indicate that the project in question has been funded by the Cohesion Fund of the European Community at a rate of 80 to 85 %. Appropriate European Community identity symbols should be used on every panel,

- the Member State concerned shall publicize the project using appropriate means, especially audiovisual means. Such publicity shall refer to the objectives and actions and to the benefits to the general public which will derive from the project,

- the Member State concerned shall provide the public with brochures, leaflets and other types of information. They may use Community channels for the distribution of these brochures and leaflets,

- from the outset, the Member State concerned shall ensure transparent and open access to appropriate information requested by the public. With regard to environmental projects the provisions of Council Directive 90/313/EEC (1) have to be respected.

The Member State concerned shall consult the Commission on what initiatives it proposes to take in this respect within two months of adoption of the Decision. It shall also report annually to the Commission on the information and publicity measures undertaken.

ANNEX VI

OBSERVANCE OF THE TERMS AND CONDITIONS OF THE DECISION AND OF OTHER COMMUNITY POLICIES 1. The Member State and the beneficiaries shall ensure that Community finance is used for the purposes intended.

2. Where the Commission considers that for a given project, this requirement or other provisions of the Decision or of Community policies have not been or are not being complied with, it shall conduct suitable examination of the case in particular requesting that the Member State or other authorities designated by it to implement the project submit their comments within specified period of time.

Following this examination, the Commission may suspend payments of Community funds. In this case, it will notify the authority in the Member State responsible for implementation of the project. This letter of notification shall also state the action to be taken in respect of Community funds already paid out for the project.

3. For projects in respect of which the above steps have been taken, the current and the remaining payments shall be considered suspended totally or in part until the Commission is satisfied that the necessary remedial measures have been taken.

4. If this examination reveals finally that the proper terms and conditions of the Decision and of Community policy have not been complied with, and that corrective measures have not been taken by the Member State, the assistance shall be reduced or cancelled. Provisions concerning the recovery of funds unduly paid are set out in point 11 of Annex III.
