REGULAMENTO (CE) Nº 2772/95 DA COMISSÃO de 30 de Novembro de 1995 que substitui os valores em ecus no Regulamento (CEE) nº 2078/92 do Conselho, relativo a métodos de produção agrícola compatíveis com as exigências da protecção do ambiente e à preservação do espaço natural

Having regard to the Treaty establishing the European Community,

Tendo em conta o Tratado que institui a Comunidade Europeia,

Having regard to Council Regulation (EEC) No 3813/92 of 28 December 1992 on the unit of account and the conversion rates to be applied for the purposes of the common agricultural policy (1), as last amended by Regulation (EC) No 150/95 (2),

Tendo em conta o Regulamento (CEE) nº 3813/92 do Conselho, de 28 de Dezembro de 1992, relativo à unidade de conta e às taxas de conversão a aplicar no âmbito da política agrícola comum (1), com a última redacção que lhe foi dada pelo Regulamento (CE) nº 150/95 (2),

Having regard to Commission Regulation (EEC) No 1068/93 of 30 April 1993 on detailed rules for determining and applying the agricultural conversion rates (3), as last amended by Regulation (EC) No 1053/95 (4), and in particular Article 18 (2) thereof,

Tendo em conta o Regulamento (CEE) nº 1068/93 da Comissão, de 30 de Abril de 1993, que estabelece regras para a determinação e aplicação das taxas de conversão no sector agrícola (3), com a última redacção que lhe foi dada pelo Regulamento (CE) nº 1053/95 (4), e, nomeadamente, o nº 2 do seu artigo 18º,

Whereas with effect from 1 February 1995, Article 13 (2) of Council Regulation (EEC) No 3813/92 alters the value in ecus of certain prices and amounts in order to neutralize the effects of the abolition of the corrective factor of 1,207509 which until 31 January 1995 affected the conversion rates used for agriculture;

Considerando que o nº 2 do artigo 13º do Regulamento (CEE) nº 3813/92 alterou, com efeitos a partir de 1 de Fevereiro de 1995, o valor em ecus de certos preços e montantes, a fim de neutralizar as consequências da supressão do factor de correcção de 1,207509, que, até 31 de Janeiro de 1995, afectava as taxas de conversão utilizadas para a agricultura;

Whereas the new values in ecus of the prices and amounts concerned have been established as of 1 February 1995 according to the rules laid down in Article 13 (2) of Regulation (EEC) No 3813/92 and Article 18 (1) of Regulation (EEC) No 1068/93;

Considerando que os novos valores em ecus dos montantes em causa foram estabelecidos, a partir de 1 de Fevereiro de 1995, de acordo com as normas referidas no nº 2 do artigo 13º do Regulamento (CEE) nº 3813/92 e no nº 1 do artigo 18º do Regulamento (CEE) nº 1068/93;

Whereas, in accordance with Article 18 (2) of Regulation (EEC) No 1068/93, in order to avoid confusion and to facilitate the application of the common agricultural policy, the values in ecus of the amounts given in Council Regulation (EEC) No 2078/92 (5), as last amended by the Act of Accession of Austria, Finland and Sweden, which apply at least from:

Considerando que, em conformidade com o nº 2 do artigo 18º do Regulamento (CEE) nº 1068/93 e para evitar confusões e facilitar a aplicação da política agrícola comum, é conveniente substituir os valores em ecus dos montantes do Regulamento (CEE) nº 2078/92 do Conselho (5), com a última redacção que lhe foi dada pelo Acto de Adesão da Áustria, da Finlândia e da Suécia, aplicáveis, no mínimo, a partir:

- 1 January 1996 for amounts which are not affected by a marketing year,

- de 1 de Janeiro de 1996, no caso dos montantes não relacionados com uma campanha de comercialização,

- the beginning of the 1996 marketing year in the case of amounts for which the marketing year begins in January 1996, and - the beginning of the 1995/96 marketing year in the other cases,

- do início da campanha de comercialização de 1996, no caso dos montantes em relação aos quais a campanha começa em Janeiro de 1996,

and which are among the legal instruments coming into force before 1 February 1995, should be replaced,

- do início da campanha de comercialização de 1995/1996 nos restantes casos,

HAS ADOPTED THIS REGULATION:

e que constam dos actos entrados em vigor antes de 1 de Fevereiro de 1995,

ADOPTOU O PRESENTE REGULAMENTO:

Article 1

As a consequence of the adjustment with effect from 1 February 1995, pursuant to Article 13 (2) of Regulation (EEC) No 3813/92 and to Article 18 (1) of Regulation (EEC) No 1068/93, on the amounts in ecus in Regulation (EEC) No 2078/92, the latter shall be amended as laid down in Article 2 hereof.

Artigo 1º

Em consequência do ajustamento dos montantes em ecus do Regulamento (CEE) nº 2078/92 efectuado a partir de 1 de Fevereiro de 1995 nos termos do nº 2 do artigo 13º do Regulamento (CEE) nº 3813/92 e do nº 1 do artigo 18º do Regulamento (CEE) nº 1068/93, aquele regulamento é alterado de acordo com as indicações que constam do artigo 2º

Article 2

Artigo 2º

Regulation (EEC) No 2078/92 is amended as follows:

O Regulamento (CEE) nº 2078/92 é alterado do seguinte modo:

1. in Article 4 (2) the amount 'ECU 150` is replaced by 'ECU 181,1`; the amounts 'ECU 250` are replaced by 'ECU 301,9`; the amount 'ECU 100` is replaced by 'ECU 120,8`; the amount 'ECU 400` is replaced by 'ECU 483,0`; the amount 'ECU 1 000` is replaced by 'ECU 1 208`; the amount 'ECU 700` is replaced by 'ECU 845,3` and the amount 'ECU 600` is replaced by 'ECU 724,5`;

1. No nº 2 do artigo 4º, o montante de « 150 ecus » é substituído pelo montante de « 181,1 ecus »; o montante de « 250 ecus » é substituído pelo montante de « 301,9 ecus »; o montante de « 100 ecus » é substituído pelo montante de « 120,8 ecus »; o montante de « 400 ecus » é substituído pelo montante de « 483,0 ecus »; o montante de « 1 000 ecus » é substituído pelo montante de « 1 208 ecus »; o montante de « 700 ecus » é substituído pelo montante de « 845,3 ecus » e o montante de « 600 ecus » é substituído pelo montante de « 724,5 ecus ».

2. in Article 4 (3) the amount 'ECU 350` is replaced by 'ECU 422,6`;

2. No nº 3 do artigo 4º, o montante de « 350 ecus » é substituído pelo montante de « 422,6 ecus ».

3. in Article 6 (1) the amount 'ECU 2 500` is replaced by 'ECU 3 019`.

3. No nº 1 do artigo 6º, o montante de « 2 500 ecus » é substituído pelo montante de « 3 019 ecus ».

Article 3

Artigo 3º

This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities.

O presente regulamento entra em vigor no sétimo dia seguinte ao da sua publicação no Jornal Oficial das Comunidades Europeias.

It shall apply, for each amount in question, from the date on which an agricultural conversion rate fixed on or after 1 February 1995 is first applied.

É aplicável, em relação a cada montante em causa, a contar da data da primeira aplicação de uma taxa de conversão agrícola fixada a partir de 1 de Fevereiro de 1995.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

O presente regulamento é obrigatório em todos os seus elementos e directamente aplicável em todos os Estados-membros.
